OMB says no to Shire’s sludge By Mike Williscraft NewsNow An appeal which would have allowed the storage and distribution of sludge at a Frost Road location in Lincoln has been rejected by the Ontario Municipal Board.

NewsNow broke the story last Thursday on its newsnowniagara.com site. “From all the mail we have been receiving, it is clear the citizens of Lincoln feel tremendous relief with the result. No one can ever

pre-judge the outcome of an OMB Hearing and so the thought of losing and, “what next?” is always top of mind,” said Lincoln Mayor Sandra Easton. “There were two major parts to the decision; local

Our Agricultural imperative and the Centre of Excellence for Agriculture is core to our Official Plan and it has been strategically defended in this decision.” In its findings, which can be found

in its entirety on newsnowniagara.com, the OMB sided with the municipality on virtually every major point. In addition to the policy based findings, Lincoln CAO Mike Kirkopoulos noted the efforts of the community also played a major role. “I think it’s important to acknowledge the broad-based community support and advocacy that

had an impact on this case. The majority of the community rallied against this proposal,” noted Kirkopoulos. Easton agreed. “There was a major public defence of the impact on the local economy and quality of life and we would like to hope that those presentations influenced to some extent the final decision but since they are more subjective, it makes sense that strong consistent policy is what carries the day,” said Easton. “Everyone of those impassioned pleas spoke to how every member of our community was feeling. This was a four year struggle and throughout, the community never gave up.” Among the reasons listed in the OMB decision for dismissing Shire’s appeal, the OMB wrote: • The applications do not conform to the

Official Plan of the Town; • The development does not constitute good land use planning as it fails to have appropriate regard for the protection of agricultural resources of the Province; • The use is inconsistent with the Provincial Policy Statement as it is not an agriculture-related use; • The use does not conform to the Regional Official Plan; • There is no demonstrated need or desirability of the development proposal for the subject lands; • No alternative sites were considered; and • The lands ought to be preserved for longterm agricultural use. “Council is very proud of the work of Staff and our legal team. We thank all of the community who helped in any way at all; small or large. There is a great deal to celebrate; a great win and a wonderful community,” said Easton.

Evan ready to ride this Sunday Evan’s Ride, which has generated more than $85,000 for programs and services for Niagara’s Autism Community is ready for its eighth year this Sunday. The event will start at Sheldrake Transport, 2942 Thompson Rd, Smithville, with registration at 9 a.m. The ride will cover a 11 km distance, and riders have the option to run the course twice. Biggs and Barr of 97.7 HITZ FM will be on hand to entertain participants. The three participants who raise the most funds will take home a new bike. “It’s going to be a great day,” said Len Sheldrake, who started the event to honour his son, Evan, who rides in the event.

members will be added to the dollars raised by Niagara’s Rankin Cancer Run/Walk held Saturday, May 28. Community Members wishing to participate in the Walk can bring a $20 registration fee. Students are $10.

The event starts with a BBQ at 4:30 p.m. Opening ceremonies are set for 6:30 p.m., witih a survivor lap and the run/walk immediately afterwards. The event is open to all. Proceeds from the BBQ et al will go the Rankin Run.

Farmers’ Market open for season The Grimsby Farmers’ Market opens today, Thursday, May 26 and for the first time since it came to Main Street, virtually all the businesses in the core are looking forward to it. It has taken a couple of years, but market officials have finally made some major concessions in the layout of the street to centre booths and remove the large trucks to give market goers and consumers wanting to access Main Street businesses unfettered passage to both sides of the street. Phew! That’s done. Time to turn the page and move ahead, which can only be a great thing for downtown Grimsby. Last fall, a spot on this page noted optimism as the core was transitioning with several new restaurants and retailers about to launch. Look now. Hard to spot a vacancy. Neat new places abound. Welcome to all. Now let’s have a great summer!!

Sometimes common sense should prevail If I was any kind of an artist, I would have penned an editorial cartoon with a caricature of Lincoln Mayor Sandra Easton popping a bottle of chilled champagne this week. The cork, flying through mid-air, would be strategically aimed at a logo of Shire Corp., which was pinned covering the bull’s eye on a dart board. A relief for all involved from the Town’s point of view? You bet! In speaking with Town officials and those who spent a great deal of time in attendance at the arduous OMB hearing, all were cautiously optimistic throughout the process. However, Mayor Easton was quite correct in pointing out that OMB decisions often don’t go the way one might expect or even understand. Much of the OMB’s findings are so urban-centric they defy logic when it comes to implementation and impacts in agricultural and small town settings. I have seen hearings where all logic would dictate a finding on one side of the ledger, only to be blindsided by what would appear to be a completely arbitrary finding. The devil is in the details to be sure. With this go round, what was quite amazing was the breadth and depth of the win. The only other time I saw such a pronounced and one-sided OMB finding was when Jeff and Rebecca Jordan won their case against the Town of Grimsby, which came with a large com-

MIKE WILLISCRAFT pensatory award as well as full legal costs to be paid. By the way, has the Town of Grimsby finally follow through and paid that out yet? No? Maybe it will come when that 2011 (I believe that is the correct year which still remains outstanding) hydro dividend finally gets paid. Not! But enough about Grimsby’s bag of toys. This day is Lincoln’s! I must admit, I was skeptical they could pull it off. Not because of a lack of effort either on the part of the Town or the scores of townsfolk who put in a ton of time and effort to make it widely known the citizenry did not support the project. What proved effective, and was noticed by the OMB, were facts ushered in by the public. It was noticed it was not simply a case of NIMBY. When I saw the 70-page OMB document last week, I perused the entire piece until I put fingers to my keyboard. It was surprising to see that the Town received sweeping results on all fronts: policy, environment, commercial and agricultural impacts, you

name it. When one considers the truck traffic alone, it is not hard to understand why businesses and residents along the commercial core on Ontario Street, King and Mountain are breathing much easier today. For simplicity, Shire estimated there would be 80100 trucks per day making their way to the proposed Frost Road site. If they rumbled up Ontario Street from 8 a.m. to 6 p.m. Monday-Friday that is 10 trucks an hour for those 10 hours...it would seem likely Shire would estimate on the conservative side when suggesting traffic levels, so we’ll go with their maximum. Now those trucks also need to return, so I could have worked to a truck rolling through downtown every three minutes for 10 hours per day - in addition to the exhaustive traffic which already exists. Even if you’re not paying an ounce of attention to this issue, you can still see why town officials are breathing that collective sigh of relief. ****** I draw you attention to Page 23 of this week’s edition, our Best In The West reader survey ballot.
