Grimsby files notice of appeal in Jordan’s case By Mike Williscraft NewsNow The Town of Grimsby’s has opted to seek a third-party legal opinion regarding the Feb. 11 Ontario Municipal Board decision which awarded Jordan Greenhouses $115,000. The decision was the result of an action brought by Jordan Greenhouses seeking damages from a major 2010 construction project which spanned the front of Jordan’s greenhouse and retail operation on Main Street West in Grimsby for about three months. Town solicitor Tom Richardson appeared before council at its regular meeting Monday night and gave an
overview of how the case progressed. Jeff and Rebecca Jordan, who were in attendance at council, said after Richardson’s presentation that they did not believe all the circumstance around Richardson’s comments was given to council. In Richardson’s statement, he said the Jordans refused an opportunity to have a chartered accountant review the file and offer a possible settlement figure. The Jordans noted after the meeting it was stipulated in the Town’s offer that it was to be the Town’s CA and the finding would be final and binding. They said they would have agreed if
it could have gone to a third-party CA. Also, Richardson noted the Jordans “would not or could not specify its costs”, which, along with damages would comprise any possible settlement figure. Richardson said that was ultimately what pushed the matter to the two-week OMB hearing last October. Richardson noted that he saw two keys in the OMB officer’s finding for the Jordans: 1) the decision was critical of town staff and noted insufficient notice was provided despite, Richardson noted, notice did fall within guidelines and; 2) there was a failure See OMB, Page 2

on the town’s part to have its contractor follow a suitable timeline for the project. These factors, in the mind of the OMB officers, constituted a “nuisance” being created – Richardson noted that is the term noted in the legislation – and the finding went in favour of the Jordans. There were a couple of questions asked by councillors, one being from Ald. Dave Kadwell who queried Richardson about any possible pursuit of the contractor as the OMB decision also noted several issues with the contractor’s performance. “That was not pursued,” said Richardson. The Jordans vehemently disagreed with Richardson’s claim that they were not forthcoming with whatever was asked to help reach a possible settle-

ment. Rebecca Jordan said there were different points of contention with each settlement offer, no matter which side made the offer. Richardson had noted the Town made two offers, while the Jordans made one. After the meeting, town manager Keith Vogl said, in the end, that council “does want to do the right thing”. Council opted for a third party consult because town staff are almost too close to the situation, he said. “We went through the process thinking we were doing the right thing for the Town,” said Vogl. “From the Board decision, clearly that is not the case.” Council discussed the notion of whether to appeal or not in closed session and, after rising from the incamera talks, passed a motion which read, “Resolved that the Council of the Town of Grimsby direct legal counsel to contact an inde-
pendent law firm for a second opinion regarding the Jordan Greenhouse Limited Ontario Municipal Board hearing.” Vogl said the reasoning behind the third party review of the file is to allow Town officials to step back and get an external view of the case. “Nobody wants this to go on and on and on,” said Vogl noting the matter is not one being dealt with on a personal level but one which takes into account the taxpayer. Vogl said there is a six-week window for an appeal. Rebecca Jordan said they were notified through their lawyer that a “leave to appeal” had been served on them last week. Vogl said, with about three weeks left in the window, a special meeting of council may be called to review the thirdparty opinion and then determine how it wants to proceed. “Council wants to feel they are doing things right and have the best advice,” said Vogl.

Change your clocks, change your batteries Daylight Savings time begins this Sunday, March 8. When advancing the time on your clocks ahead by one hour, the Grimsby Fire Department would like you to take the time to also change the batteries in your smoke alarms and carbon monoxide alarms. “Working smoke alarms will provide early warning of a fire and allow you and your family the valuable time required to evacuate,” said Doug Henderson, Grimsby Fire Department fire prevention inspec-
tor. “The law requires you to have a working smoke alarm on every level of your home and, if you have a fuel-fired appliance in your home or have an attached garage you are required to have a carbon monoxide alarm outside each sleeping area.” Henderson also wanted to remind building owners and landlords of multi-unit residential properties that they are responsible for maintaining and changing batteries for alarms in suites in their buildings.

Three Lieutenant Governor Awards for Grimsby Grimsby’s pride in its heritage is showing – in a big way. The annual Lieutenant Governor’s Ontario Heritage Awards were handed out last Friday, Feb. 27 and out of 17 awards, provincewide, Grimsby took home three of them. The awards recognize individuals and groups who have made outstanding contributions to conserving Ontario’s heritage. John and Josefa Dunstall received the Excellence in Conservation Award for restoration of Grimsby’s Old Firehall. The Old Firehall building, built in 1883, is the oldest civic building in Grimsby. “Josie and I bought the building in early 2011 for investment purposes. We fell in love with the unique history of the building and decided in 2012 to restore the façade to its original look,” said John Dunstall. Allan Smith was awarded a Lifetime Achievement Award. Smith has actively contributed to the community and has been a part of sharing Grimsby’s history since the 1960s. He has volunteered at Grimsby Archives, for Doors Open Grimsby, and been a member of the Grimsby Historical Society. Smith has also led visitors on walking tours and assisted Grimsby with obtaining historical information and photographs for heritage designation reports. The Town of Grimsby earned the Lieutenant Governor’s Ontario Heritage Award for Community Leadership.

BBBS Bowl for Kids’ Sake brings out the best

Laughter and friendly rivalry was in the air last Saturday at Pla-Mor Lanes in St. Catharines. The community came together to help support Big Brothers Big Sisters of Grimsby, Lincoln and West Lincoln. “The community was great, the support was wonderful. We were hoping for 50 teams and we had close to 40,” said Lisa Pare, BBBS executive director. Funds raised – which are still being tallied – will support the programs of BBBS which provides big brothers and sisters as well as mentoring for local children. Grimsby, Lincoln and West Lincoln were all well represented as the mayor of each municipal-
ity put in a team. They were joined by council and family members. “I wouldn’t miss it for the world,” said West Lincoln mayor Doug Joyner. “There are lots of ‘littles’ out there who still need support.” Lincoln Mayor Sandra Easton noted the service provided by BBBS was one vital for local children. “They have the right to a good future,” she said. Pare said she was grateful for the support the agency received. “The board, the bowling committee and volunteers that help us out are wonderful. They make it a real success and I want to thank them for all their hard work,” said Pare.

There needs to be some recognition that the farmer is the steward of our wetlands and woodlots.”

A. Bleach doesn’t clean, so much as it disinfects. Bleach does a great job of killing bacteria and removing tough stains, but bleach doesn’t really clean dirt and residue from surfaces. To do that, you need to scrub and rinse the surface with an actual cleaning product. For many household cleaning jobs, bleach just isn’t the right choice. It has heavy fumes that can make you sick, as well as damage and remove colour from some surfaces.

Grimsby Grizzlies take tournament silver The Grimsby Grizzlies Bantam boys won a silver medal at the Ancaster Magic basketball tournament Feb. 20-22. The tournament started with a seesaw battle between the Grizzlies and Blessed Sacrament team #3. The Grizzlies ended up on the short end of the stick with a three-point loss. Next game was against the Stratford Revolution. The
Grizzlies never looked back for their first win of the tournament. The semi finals pitted the Grizzlies against Stoney Creek with the trip to the finals on the line. After finding themselves down 16-3 after the first quarter, the Grizzlies exploded for 26 points in the second quarter to take a halftime lead. Despite the heavy pressure, the Grizzlies man-
aged a 10-point win and a spot in the finals. The finals would be a rematch of the tournament’s first game with the Blessed Sacrament team #3. Both teams played with great intensity and few mistakes. Blessed Sacrament gained control of the game in the 4th quarter and held off a last minute charge by the Grizzlies for an eight-point win.

They cared about us all,” said Lisa. “Since then so many people we know have gone through the doors of McNally House - each time I think first of the sadness then I think of how wonderfully they will be treated and it’s somehow a little easier to think about.” “We’ve been to all four dinners held at August - each year is something new and tastier than the year before. We do this to support McNally House, as a remembrance to my Dad and, of course, because it’s such a wonderful way to spend an evening - great food, friends and wine!

By Mike Williscraft NewsNow Two sold out dinner seatings helped the team at August Restaurant achieve its goal Sunday – to raise $10,000 for McNally House Hospice. In its fourth year, the event has proven very popular with its two menu streams. This year pitted a fine dining menu with an upscale diner-style menu...as co-owner Clayton Gillie noted, “How do you go wrong with lobster pigs in a blanket?” It would seem one could not. Among the crowd were members of the Mitchell family, who have been supporting the event in each of its four years. Charlie Mitchell had had a long, difficult battle with cancer and it was a difficult choice for his family to put him in McNally House as they had cared for him at home as long as possible. “Our dad spent the better part of a year fighting a tremendous battle with cancer. We didn’t really know what cancer it was for a long time as it seemed that there were too many questions and not enough answers,” recalled his daughter Lisa. “As it turned out, it started with prostate cancer and it spread. As a family, including my mom, Joann, who is a nurse, we decided to care for my dad at home as long as we possibly could. He was always positive and upbeat - happy to see anyone who came to see him and he loved having visitors. “ After 10 months and numerous treatments it proved too much, and the decision was made to move Charlie to McNally House where he could receive around the clock care. “He was there 24 hours. He died on June 18, 2009,” noted Lisa. The decision to make the move was not hasty. “We had visited McNally House prior to my dad going as part of our research. The palliative team, lead by Dr. Denise Marshall, encouraged us to do so. I recall having two thoughts at the time: 1) What

Loving father to Christine (Rob), Ron Miller, Nicole (Ger), Katie (David), Amanda (DJ) and honary son Nathan. Will be greatly missed by his sisters Jolanna (George) and Elizabeth (Innes). Proud grandfather of Zana, Eoghan, Clan, Eloise, Frances and will be forever missed by his companion Archie and his Lakecourt buddies. Ken was an employee of Dofasco for 28 years. Plug pulled on Gateway marketing There was a stunned silence at Grimsby’s Council meeting on Monday when Niagara Region’s Bob Sequin, almost as an afterthought, mentioned the plug has been pulled on the region’s tumultuous marketing plan at the Niagara Gateway. He said it was not a “stat decision” rather the determination was made that the expenditure at the site was “not appropriate for the limited results achieved.” The opinion that results were limited came from stakeholders elsewhere in the region. Thinking back to before Gateway was there – it is important to note tourism-based industry in Niagara never wanted it there in the first place. They favoured such a feature in Fort Erie, so piling on the tragically mismanaged Grimsby Gateway feature is unfortunate at best. This is a short-sighted decision from a regional government that has no idea where it is going with marketing. M.W.
Time to cut bait, Grimsby council There is no doubt the talk of the town in the last two weeks has been the Jordan Greenhouse’s $115,000 award from the Town of Grimsby resulting from an Ontario Municipal Board decision –a story broken by NewsNow. I’ve been spending my time at Lincoln council for the most part of late, but I ventured to Monday’s Grimsby council meeting intrigued to see Town solicitor Tom Richardson listed on the public delegation roster. It is very unusual for Town officials to speak on matters with legal implications and it is usually the lawyers telling them to shut up, so I was compelled to attend out of sheer curiosity if not journalistic need. Part of my newspaper illness, and believe me it is an untreatable illness, is council meetings. I have always loved covering them right from my first Huron County meeting back in the late 80s. The process, the elected officials who bluff their way through trying to appear like they have a grasp on an issue, good debate and core desire to protect public interests through good coverage: those are a few of the reasons I have always loved covering municipal politics. Nothing against Mr. Richardson, but his job is not to protect taxpayers. His job to win for his clients. So it was interesting to hear his interpretation of the findings in the Feb. 11 OMB decision. It is for reasons such as his presentation to council that I stressed to

There are so many reason why, I won’t go into listing them here, but I will touch on one key point, which I also raised, that was brought up by Ald. Dave Kadwell in question period after Mr. Richardson addressed council. Ald. Kadwell asked the elephant in the room the question which anyone who read the full report would realize: did the Town consider going after the contractor to recover any damages? Mr. Richardson’s answer: “That was not pursued.” In my humble opinion, a major error. The thinking, it would seem, is that right up until the report dropped, Town officials really believed they were doing the right thing by taxpayers. I do believe it was not a personal vendetta or anything of the sort. I think they were all pretty surprised by the OMB decision. Council took the slightly odd approach to it all of sending the matter off to
another lawyer removed from the case for a thirdparty, external opinion as to whether they should consider an appeal. I say “slightly odd” since the Jordans were served with a “Leave to Appeal” last week before Monday’s council meeting....not sure if council members realized that was already in play. At any rate, it is time for council to cut bait on this one. Any further pursuit of this case will just mean more losses for taxpayers through added expense. It will be interesting to see what the legal tab for this five-year process has amounted to, and council should absolutely make that public. Lakes in each of 1968, 1971 and 1972. By then, its trading days were nearing the end and, in 1974, the ship was tied up at Baie St. Paul. There the vessel served as a floating home and was later purchased for use as an art gallery. L’Accalmie was painted on the hull in 1975 but it never sailed or was officially registered as such. The ship was sold to a musician in 2007 who intended to use the vessel as a floating resto-bar to promote French-Canadian songs but the renovation work was not completed. L’Accalmie was later towed to a secluded beach and the hull collapsed there in 2010. The remains continued to deteriorate until the fire.
