Landlord tries to evict tenants

Grant - Photo By Katherine Grant NewsNow Olga Rochon is 64 years old, has advanced glaucoma, has had cataract surgery and has been warned by her doctor that the arteries in her neck are in poor condition which could lead to stroke. Her poor health didn’t stop her from holding a fire watch at the complex where she lives throughout the frigid month of February. Every 30 minutes she said, she walked from door to door, placing her

hand on each to check for heat. Because her vision is severely limited, she needed help to read the fire extinguishers. Had she suspected there was a fire she didn’t really have a plan as she has no telephone and there is no pay phone on site. “I was going to scream until someone with a cell phone heard me and called 9-1-1,” she said sitting on the edge of the pull-out bed in her tworoom unit. The alternative, from what she understood,

was the loss of the place she has called home for the past four years – the Escarpment Inn and Residences at 575 Main St., West in Grimsby. At issue seems to be the difference between being a tenant under the Landlord Tenant Act or a lodger under the Innkeepers Act and it is a significant difference for the families faced with being homeless this week. Last week, the owner of the property, Olu Akinbolue, issued notices to the 25 tenants they had to move out by April 1;

a second eviction notice quickly followed noting all had to vacate by noon Monday, March 9. “Everyone has lived here for several months to several years,” said Olga. Only a small portion of the building is used for motel guests, according to the long-term tenants. There is no staff present at any time. There are no services such as for towels; no telephone service, and; the driveway wasn’t plowed all winter. According to tenants, they dug it out by hand.

Of major concern to Grimsby Fire Department was the lack of fire alarms, necessitating the fire watch. “Olu told me if I didn’t do the fire watch, the building would be closed and everyone would have to move out,” said Olga. Under order by the Grimsby Fire Department to install working smoke alarms, the land owner instead opted to empty the building. Olga is paying $800 rent for two rooms. See EVICT, Page 3

After the fire department informed tenants the landowner was responsible for the fire watch, a security company took over this week. A tour of the building revealed a number of issues including leaking ceilings necessitating buckets to catch the water; cracked windows, crumbling ceilings and general disrepair. Residents did without a furnace last winter, instead heating their rooms with space heaters. The furnace has since been replaced. Outside in the parking area is a garbage dumpster filled to overflowing. The twice-a-month pick up is inadequate said tenants but they were told if they called to have it picked up more frequently they would have to pay for it themselves. Some tenants are paying up to $1,300 per month for their units. Each also paid a $100 cleaning deposit as well as a $100 deposit for a TV box to allow access to cable. The eviction notices came as a shock to residents. “We got these letters saying we had to be out by the end of the month,” said Chantel Farnsworth who moved into the house adjacent to the office last summer with her 11-year-old son. “Then we got a second letter saying we had to be out by Mon-

I’m not going to just let her do this,” said Chantel. “She can padlock my door with me inside,” said Olga. “I have nowhere to go.” On the weekend, new padlocks appeared on the doors of empty units, and on the utility and furnace room doors. The washing machines and dryers were removed as well. A notice on the office door read that the “motel” would close at noon, March 9 and, shortly after 10 a.m., Akinbolue arrived with two SUVs towing utility trailers. There were at least two men with her. Residents called police. Akinbolue and the men went into the office and the police headed inside to speak to them. After about an hour the police came outside and addressed the residents. Akinbolue remained inside the office. “We have told her she can’t padlock the doors,” said Const. Chris Carter, told the tenants. He also said they were going to have to move eventually but there was a process in place that had to be followed. Lisa Ridsdill from Niagara North Community Legal Assistance arrived as well to speak to the residents and ensure their rights were being considered. Ridsdill noted there have been problems in the past with tenants not receiving their mail and

Ridsdill said it can take about two weeks to get a hearing date set with the Landlord and Tenant Board, which meets in St. Catharines. “It is important that the board realizes that these people are tenants and it is not an inn just because that is in the title of the place,” said Ridsdill. “The first goal here was ensure nobody was forced out. That was done. The next step is to get the hearing set.”

Ted Wieclawek, fire marshal and chief of emergency management, and also featured several guests, including Grimsby Fire Chief Mike Cain. Wieclawek praised the long service of the 30 recipients from our region. He made mention of “their dedication,

not only themselves but their families. Thank you for your service.” The award, which was first presented in 1971, includes a medal featuring the Matese cross and the Ontario coat of arms, as well as a written citation from the Fire Marshal of Ontario.

Meatloaf: the best of all comfort foods

NANCY MORGAN Good meatloaf is about as comforting as comfort food gets. Here is a classic. CLASSIC MEATLOAF •3 slices white sandwich bread •1/2 cup milk •1-1/2 pounds ground beef chuck •1/2 pound ground pork •1/2 medium onion, grated •2 garlic cloves, minced •1 large egg •1/2 cup ketchup •salt and pepper Preheat oven to 375. Line a baking sheet with aluminum foil or parchment paper. Place bread in food processor; pulse until fine crumbs form. Transfer to a small bowl and pour in milk. Set aside, about 10 minutes, stirring occasionally. In large bowl, combine beef, pork, onion, garlic, egg, 1/4 cup of the ketchup, salt and pepper. Add bread-milk mixture and mix very gently with a fork (do not overmix, light mixing keeps meat tender). Place meat mixture on prepared baking sheet and form into a loaf about 9 inches long and 4-5 inches wide. Bake, brushing twice with remaining ketchup until an instant-read thermometer registers 160, about 55-60 minutes. Serves 6. VARIATION TOPPING: (Omit brushing with ketchup) Bacon: before baking, lay 8 slices bacon crosswise over meatloaf, slightly overlapping. Using a thin metal spatula or dinner knife, tuck ends of bacon under meat.

Bucs finish at the top Beamsville District Secondary School wrestlers take top honours The Beamsville Bucs won the boys, the girls and combined titles at Niagara Region High School Athletic Association (NRHSAA) for Zone 3/4. At Jr SOSSA, they won the boys and combined titles and at SOSSA they won the girls and combined titles. To the competition at OFSAA, (Ontario Federation of School Athletic Assciations) Beamsville District Secondary School sent a very young team made up mostly of Juniors: Reet Chahil, Alex Freer, Phillip Truong, Amen Quereshi and Jessica Tilmanns. They all gained valuable experience for future OFSAA championships while the two seniors Nikki Cubitt (77kg) and Rachael Swinson (44kg ) dominated their weight classes.

Both girls were up against the top 32 wrestlers from the province in their respective categories. They won five matches each by either pin or technical superiority en route to their respective gold medal performances. This marks the end of Nikki’s wrestling career which also included being an OFSAA bronze medalist, a provincial age group champion and a member of team Ontario which won the Canada Summer Games. Rachael will be back for one more year at BDSS and have the opportunity to defend her title next year at OFSAA. Up next for Rachael is the Canadian championships in New Brunswick in April where she will try and improve upon her bronze medal performance from last year.

Fainting goats – not even kidding

Build up, not out, please please please Without a doubt, the Town of Grimsby – in a way – has to be happy with the silly goings on at an “inn” in the town’s west end. Not because of the unrest caused to local residents, but because it creates a hot coffee shop topic other than the Jordan Greenhouse matter. But another matter discussed at the March 2 council meeting, besides a presentation about Jordan’s OMB results, centred around proposed apartment/condo units planned for the area near the Casablanca/QEW quadrant. Whether they are five-storey or three-storey, the point has been made on this page before, skyline be darned (pardon my French). Build up. Go higher. Go 20 storeys....if it means salvaging more greenspace, whether it be lakefront or otherwise. We are running out. Save land. And use height to do it. Please. M.W.

Tough week for common sense Interesting news week here in good ol’ Niagara West. Funny how some of the most interesting news stories have a common denominator – a lack of common sense. The Town of Grimsby has had a lack of common sense fused with a five-year brain cramp in stringing along the Jordan Greenhouses case. It bears saying again, Town of Grimsby has a small window of time to do the right thing: end the financial carnage and withdraw the appeal filed in the Jordan Greenhouses Ltd. case. Then out in the west end we have a serious case of multiple brain cramps – all in rapid succession I might add – with a landlord taking beyond-exteme measures in an attempt to herd about 30 tenants out of their homes on what amounted to three days notice. This one is a head scratcher. We have a husband and wife team – property owner Olu Akinbolue, a nurse, and her doctor husband – who apparently have no interest in following through on any of the “suggestions” made by Grimsby Fire Department over a period of many months, an example of which would be the need to install fire alarms in the rooms at Escarpment Inn and Residences. Here is where common sense leaves the equation. The Akinbolues have applied to the Niagara Escarpment Commission and obtained approval for a 34-unit, two-storey retirement residence. Approval was received in February. A site plan must still be submitted

MIKE WILLISCRAFT for approval before any building permits can be issued. As of last Friday, the Town had not received the submission of a site plan application. So, we know the Akinbolues own the property and they want to have tenants cleared out to make way for a new development. Nothing wrong with that. It is their property: their prerogative. But is there a reason to drive people with limited means out into the streets on days notice? None. Would it make sense to remove the on-site laundry facility as an alleged punitive measure because tenants attended an emergency meeting at the Peach King Centre on Saturday afternoon – complete with several Niagara agencies which could get them a meal or shelter if needed? None. Would it make sense to threaten to tow their vehicles away? None. There is a very long list of things that do not make sense with this incident. It could have been so simple....written notice to tenants, “Hi people who are paying to live here, I would like to build a retirement

residence on this site. This will serve as notice you have 90 days to move to a new home.” Done deal. If there is one thing I hate it’s bullies. I have no tolerance for it. The stress caused to these people has been unspeakable...and we’re not even getting into the condition of the building here. Last but not least, we have Niagara Peninsula Energy. NPE had a right to cut off power to Rex Ge’s greenhouse in West Lincoln, but is there any common sense in destroying a man’s livelihood and causing $100,000-plus in damages to his greenhouse over a $360 hydro bill? None. it is truly unfortunate, but all too common. A big corporation is not going to pick up the phone and say, “Hi Rex, you’ve been a perfect customer for 13 years on both your residential and greenhouse accounts, but it seems you’ve gone a little over time. What’s up? Oh, you had to go to China to tend to you ill father and mother with early on-set Alzheimers and you can pay your bill right away? That’s great, Rex, we would appreciate that.” Nope. Have your guy walk right by his house where the power is still on and shut off power to his greenhouse and ruin his life. It seemed too callous to take his story and run it on an inside page like it was not front-page material, so why not do two front pages? It might be the only thing this week with common sense.

I totally get that council has a responsibility to grow the town and collect taxes accordingly. When the town is trying to fill a hole with an apartment/condo building which is obviously totally out of sync with the present populace in that area of Grimsby, then my wife and I are both objecting to such a callous tax-money grabbing project. The rather slick townâ€™s computer presentation showed Bartlett totally bare. It didnâ€™t show that both sides of Bartlett are built up with a seniors condo building on one side and a seniors home on the other, all the way up to Main Street. We, as seniors, understand the world has changed to a bottom-line-is-king environment but has it gone so far that Grimsby council has forsaken its status as basically being a well-known and desirable retirement community? Seldom does one see a parent walking with a child on Bartlett because there

As with our neighbours it is probably the last investment made with the reasonable expectation its real estate value would increase with the market value of the times. Battista, said, while she cannot comment on a specific customer’s case, that NPE has a protocol to follow and reiterated several times that if Ge contacted the company, measures would have been taken to stop a disconnection. 2) He confirmed a notice was delivered to the property, but it went into his roadside mailbox and he did not see it in time. When asked if disconnection notices were not normally affixed to doors, Battista said there would be a note on an account if

a notice was not given as per normal protocol. 3) The power at his home was on throughout, so an NPE representative would have had to walk right by his house to access the meter on the greenhouse. Again, Ge noted, “All he had to do was knock on my door.” He noted both bills have the same address. 4) As a 13-year customer, would NPE not have considered some leeway in shutting off power for such a small amount? Battista said account balances and details are reviewed and considered before a disconnection is executed. “There is a threshold we look at,” Battista said. She did not say why a review of Ge’s account would have resulted in the disconnection proceeding.

Ge estimates the total damage at about $150,000 all in. “Unless they can do something for me, this will kill me. I have no money for lawyers. I need help or I am done,” said Ge. That help will not be coming from NPE, said Battista. She noted NPE’s Conditions of Service stipulates the company is “not accountable for any damage due to nonpayment”. Section 2.2.2 of the same document says, “Niagara Peninsula Energy will make reasonable efforts to establish direct contact with the Consumer.” Ge maintains, in the circumstance, NPE’s actions were not reasonable. “One phone call, one knock on the door, that is all I needed,” said Ge.

One: his hydro bill to Niagara Peninsula Energy was overdue, and he paid it immediately once it was realized. Two: NPE’s cutting off his hydro service resulted in the entire nursery stock at his greenhouse being frozen, his boiler ruined and pipes for his watering and heating system burst at many points throughout the structure. The saga includes a series of circumstances going back to December when Ge made the trek back to China to visit his ailing parents, both in their late 80s. The bottom line for NPE, said vice-president customer service Margaret Battista, is the customer did not “reach out:” and let they company know he was going to be away. “If the customer had reached out...it would have stopped any further action,” said Battista. Paid to current and being an NPE customer for

13 years with no issue, he headed off on his trip home. Upon his return in mid-February, he was home to West Lincoln briefly, but went to stay with family in Toronto for a few days as he was feeling ill. When he finally returned to his home, located right at the intersection of Hwy. 20 at the end of Mountain Road, all was in working order. Having been away for many weeks, the yard was full of deep snow, as was the laneway. From that point, Ge said is where things went off the rails. “I went out to the greenhouse and everything was frozen. I thought a fuse blew and everything shut off, so I went to the store and got two fuses,” Ge recalled. “When I changed them, it still did not work, so I thought the boiler blew. I went and got parts to repair it. When I was talking to the parts salesman, he said something was wrong and there was no way all three parts of the boiler blew out at the same time. He asked me if there was power.”

That was when the light bulb went on, so to speak. He immediately got a certified cheque for nearly $1,000 – NPE now wanted an additional $400 security since the account had been disconnected – and stressed the importance of getting the power back on immediately. “Everything is dead, only maybe a couple of saplings may survive but I cannot tell yet. All my garden plants are gone,” said Ge. Same for the boiler, with one component being damaged beyond repair, two others are salvagable. All around the perimeter of the greenhouse are ballooned pipes both in the heating system and watering system. Throughout the watering system are special units which inject fertilizer into the system. All those units have been destroyed as well. There are several issues which complicate See POWER, Page 22
