WL council to take hard look at clean fill By Joanne McDonald For NewsNow An application for a site alteration permit to allow the dumping of clean fill on a West Lincoln property has been deferred to staff while councillors dig deeper as to what constitutes clean fill
in preparation for an Aug. 13 public meeting to consider the application. Coun. Terry Bell called for the staff information report to be pulled from Monday night’s list of items set for approval by council. Looking closely at
the application, Bell had concerns about the content of the soil samples and questioned that Township has been requested to call before visiting the site. Director of planning and building Brian Treble said there are
two properties that have been subject to some bylaw enforcement activity over the past six weeks. Both of those are subject to the public meeting. Treble said both are proposing to bring in volumes of fill and advised it is appropriate
to get clarity before council supports the site alterations at the proposed scale. Representatives of both properties have indicated it is not top soil but good, clean fill. The township has an obligation in protecting the land to
determine it is an improvement over the soil quality there now, and to be convinced people are proposing to bring in the fill for the right reasons - to improve the soil quality. There will be more information available See SOIL, Page 3

SOIL From Page 1 leading up to the August meeting. Coun. Mike Rehner warned that the term ‘clean fill’ may be free of brick and asphalt, but in his experience if the fill is clay without nutrients, it will not support growing a crop. “It won’t even support a weed,” Rehner said. In an overview report to Council, Treble said a complaint was received that trucks of soil were travelling through West Lincoln during May and June. The soil was being placed at 8244 Silver Street which had received between 50 and 60 loads of soil to date. The proposal is to haul in another 1000 loads to level the farm for improved farming purposes. A key discussion has
been whether the soil is topsoil or fill. It does not appear to be clay and the owner has argued with some merit, that the soil improves the land for agriculture. A soils report was provided which confirms that the soil is generally clean and good quality fill. The soil analyst however, confirms that the soil is not topsoil. The Niagara Peninsula Conservation Authority has been involved and has issued a permit to regulate fill placement adjacent to their regulated feature. As background, the report indicated the Site Alteration Bylaw was approved on June 27 and amended July 24. This bylaw regulated fill but exempts topsoil from the bylaw. Most of the material dumped at 8244 Silver St. was fill which requires a permit from
the Township once 50 loads are exceeded. Given the volumes of fill proposed, permit approval is required from Council. The same distributor of fill is hauling to this site as was previously hauling to the site at 8951 Concession 2 Road. Staff has been advised that the distributor and farmer believe
that they are doing good for the farmland and are attempting to improve soil quality and raise low areas of the farm. The soil is not topsoil however and is therefore regulated by the Site Alteration Bylaw, as amended. Both property owners have said that the soil being imported is a significant improvement over the
clay that is currently on the farmland. Further, the distributor advises that he prides himself in hauling in clean soil and staff have found everyone involved to be easy to work with to date. The proposal is to haul in significant amounts of fill to elevate the farmland in low areas and to leave
a layer of this new soil everywhere on the farmland. Consultation with the NPCA has occurred. They have provided clearance so long as the fill remains at an acceptable distance from the wetland, along the west side of this farm. This proposed volume of fill requires Council approval.
Wellandport library re-opened Monday The strong beat of Wellandport’s heart could be heard at West Lincoln Council Monday as councillors celebrated the reopening of the community’s branch library earlier that day. “Libraries are vital institutions and we were very happy to recognize the importance that our newly renovated Wellandport library brings to the fabric of our Township,” Mayor Doug Joyner said. Last year the Township and the West Lincoln Pubic Library Board announced they would
be making improvements to the Wellandport Library and Community Centre with the support of $440,000 funding though a Canada 150 Community Program federal grant. Monday’s celebration opened and closed with a traditional Indigenous ceremony in the newly created Indigenous healing garden. Staff at the meeting said there were a number of donors, including some who wanted to remain anonymous and made substantial contributions to
the project. Joyner said the library is “extremely well used,” adding, “the previous space was small and it’s the important heart of the community.” A crowd of 100 people turned out to celebrate Monday’s grand opening. The expansion includes an indoor-outdoor community living room. Environmental improvements include installing a new roof, new furnace and windows, electrical upgrading and LED lighting.

Raptor rehabilitator contains sick raccoon at Lions pool By Joanne McDonald Rocky raccoon may be cute in the movies, but close encounters in an urban setting can pose a great risk to residents says authorized wildlife custodian Carol Ricciuto, owner of Open Sky Raptor Foundation and she is calling on the Town to confirm the protocol in place to direct residents who call in emergency situations. Swimming lessons were in full swing Wednesday morning at the Grimsby Lions Community Pool when a raccoon wandered through the park, lethargic and disoriented, drawing curious children and parents to gather around the distressed animal. A fast acting life guard asked parents at the pool to call for assistance and said the message he received back was they were unable to find immediate help. He said that luckily, one of the mothers of the children he teaches, Foundation volunteer Kara Kristianson, was able to contact Ricciuto and he was grateful that she was able to immediately respond. “There are times and reasons when you can’t get in touch with
someone who can assist,” Ricciuto said. “But there should be a protocol in place, especially at the Town offices when residents who come into contact with wildlife call for emergency assistance.” Daryl Barnhart, communications manager for the Town of Grimsby said the Town has procedures in place. “If a resident calls during normal business hours about a wild animal on municipal public property, we will give the number for the Lincoln County Humane Society. One dead in Mountain Rd collision on Monday Mountain Road in Grimsby was closed for most of the day Monday after a fatal accident near Kemp Road just after 1 p.m. Niagara Regional Police were called to the scene at 1:10 p.m. Initial investigation revealed that a Chevrolet Cobalt collided head on with a Pontiac Montana minivan; with a third vehicle, a Volkswagen, also becoming involved. The driver of the Cobalt, a 32-yearold female was pronounced dead at the scene. Her 13-year-old male passenger was airlifted to an out-oftown hospital for treatment of serious injuries. The occupants of the minivan were taken to hospital for treatment of their injuries while one occupant of the Volkswagen sustained minor injuries. Investigators from the Collision Reconstruction Unit were on the scene all day and Mountain Road remained closed until nearly 9 p.m. Monday night. Bandmates, musicians, family and friends all turned out Friday night at Coronation park to pay tribute to the late Todd Pyper. Pyper was integral on the local music scene and a stalwart community volunteer. He lost his battle with cancer last fall. “All the musicians, Happening at The Forty committee and Josh Coulter, all I can say is thanks,” said long-time Pyper friend and former bandmate John Restas, who added the event will become annual. “It was a great night.”

Adults, kids alike need to show caution around animals Dear Editor, I am an authorized Wildlife Custodian; I run the Open Sky Raptor Foundation right here in Grimsby and for the past 22 years I’ve specialized in birds of prey but also do other birds under my Canadian Wildlife Services authorization. On Wednesday, July 18, I received a call from a friend of mine who is also a volunteer at the
Letter Open Sky Raptor Foundation, Kara Kristjanson, about a raccoon that was at the Lions Pool in Grimsby. The time was around 10:30 am. The coon was walking about – ignoring the fact that there were many people about and that kids were screaming with glee while play-
ing in the pool. It was easily led to other areas and then it would just lie down and seemingly sleep in the open. She told me several people had tried to get in touch with animal control and the Town but to no avail. Now, a raccoon, out and about in daytime, can make one question the health of the animal. BUT it can be absolutely normal and
healthy if it is a mama looking for food for her young, or an orphaned babe looking for food or a place to hide. It might be one of the coons that have been ‘kicked out’ by mom cause it’s old enough to be on its own so it’s looking for new ‘digs’ with plenty of food in the area. Even, possibly, one that’s been up-rooted by human or critter…

It’s also a case of us having destroyed their habitat so they are adapting to ours much to our own chagrin. We take their homes away so they don’t have the option but to move into ours or at least our home fronts. YET, if that coon is unhealthy, it can be a real hazard to people, pets and even to itself. Two diseases of a fearful nature come to mind: Rabies – that is always a scary word to bandy about – and Distemper…neither a good scenario. Dear editor, I would like to tell, no, YELL at the Town Of Grimsby personnel that ignoring instances where several people call into the Town Hall and report a raccoon acting strangely in an area that is loaded with adults and kids, is just plain wrong! Several people called the Town offices and were told that they (the Town) didn’t deal with that sort of thing. Ok…fine: if you don’t deal with it then you should take down the information about caller, location, any human contact, etc. and then contact the authorities. Numbers which you should have at hand since Grimsby has been designated by the MNRF as an area of rabies content concern. The Lincoln Animal Control did eventually show up. Upon stating that, it is possible that they (the callers from the pool area) got their answering service who didn’t know what to tell the callers and just made up their own story or they weren’t given specific instructions on what to tell the public. For both the Town of Grimsby and the Lincoln Animal Control it
is time to clean up your respective acts. When Todd (the officer from the Lincoln Animal Control) finally arrived, he was telling us there have been instances of rabid raccoons in the downtown in the past. I deal with birds! But I came to help. Kara and I got the coon into a carrier on our own! We even had to get right up into the faces of some kids and adults who wouldn’t stay away from it even though they were warned that it was sick. I knew the raccoon was sick just by walking up to it and observing it for less than two minutes. Not because I am an expert on raccoons, no, but because I recently had an experience with a sick raccoon on my own property. I was 99 per cent sure that the coon had distemper – early stages – because of the way the eyes were crusted over and how the animal was gingerly walking about. That 1 per cent of doubt was enough to make me put on thick gloves and use nets for our own protection (not that I wouldn’t have anyway). We did their work for them…neither of us got paid to do it…but we would both do it again because we are people who volunteer our time to help out wildlife and educate the public when we can. If you need us, we will try and help. We may not appreciate wildlife coming close to where we live but since habitat destruction is one of the main reasons why, it is time we got educated. Mighty swing beam carries legacy of agricultural past By Joanne McDonald love of old barns brought the farm community together Saturday, sitting under the mighty swing beam in the Bucknall barn and sharing in the oral tradition, the stories that have shaped the Town of Lincoln’s rich agricultural past. Twelve years ago, in 2006, Jim and Irene Bucknall presided as the king and queen of one of the early castles of Ontario during the official heritage designation ceremony of their Campden barn. They were honoured as the keepers of Lincoln’s strong agricultural traditions through the careful preservation of their “salt box” style barn that was built circa 1841. Saturday they once again opened the doors to the farming community, this time the barn turned classroom, for two presentations on the

There was a sense of being grounded under that massive swing beam in the Bucknall barn Saturday afternoon - a big steel floor fan pushing humid summer air through the doors, the scent of seasoned wood and stored grain, and a close-knit crowd sharing the cumulative knowledge of generations past. Huber has given hundreds of presentations, but Saturday marked his first talk in Canada. And for Fraser, now writing a 50-chapter book that will include photos of swing beam barns across Niagara, date their construction and spin stories to bring the history of the times to life - old barns run in his blood. The two connected recently and they visited a number of local swing beam barns in Niagara. See BEAM, Page 43
News Now • Thursday, July 26, 2018 • Page 43 BEAM From Page 42 “It’s been an amazing adventure up here,” Huber said. Huber has examined thousands of barns in the eastern sections of North America. He said the earliest swing beam barns from Ontario to Vermont date around 1800 to 1810; in New Jersey, around 1780, and 1785 in Bucks County, Pennsylvania. In 2011 he wrote the first ever article on swing beam barns in North America. Saturday, he signed copies of his new book, The Historic Barns of Southeastern Pennsylvania Architecture and Preservation - 1750 to 1900. “When the first pioneers arrived they had to feed their families so wheat was the crop and the barns were built with wheat in mind,” said Fraser. The settlers couldn’t get the trees down fast enough to plant wheat and the swing beams were made from massive timbers. “They were ingenious. Farmers of the day knew how to hew to the right shape and winch them out using devices that took a lot of people power. They all worked together with building bees. In 1825 there weren’t a lot of people here. They had to work together,” noted Fraser. Many of the barns have been renovated and its takes some forensic digging to figure out who built them and when. Mitges said the oral history is important to record as it will be gone in 30 years. “Hugh is doing a good job of recording it.”

swing beam from a barn, located across from Walker’s Quarry,
that was slated for demolition. The beam was on display at the Bucknall farm. “It would’ve been cut from white pine about 1825. It’s a beautiful piece of wood, incredibly huge. It’s nice to see it preserved.” Barns, Huber has said in his writings, “are one of the greatest
architectural vernacular expressions….. deeply appreciated for their great beauty and purity of form. They may be regarded as special windows of opportunity in unraveling secrets of the agrarian past. They also reflect how rural folk lived their independent and determined lives.”

West Lincoln gets ahead of fill issue Great to see Township of West Lincoln council showing forethought and doing what they can to get in front of yet another fill situation coming down the pipe at them. Fill has been a major, ongoing issue in the township for several years and council has been tactical in doing what they can to slow or even control - where possible - what is coming into their municipality. Of course they are looking to accept only “clean” fill and that is always part of the challenge with those endeavours. The Kemp Road fiasco in Grimsby was supposed to be clean fill but NewsNow has published photos showing that was not the situation at all. Too bad, too, because landowners in West Lincoln could have had the material shipped in from Grimsby to “fill” their needs (get it?) as opposed to from whoknows-where but Grimsby had no restrictions at the time and who does know what’s in there? M.W.
Election field set tomorrow (Fri.) Tomorrow (Friday) is kind of like municipal politics’ version of the Academy Award nominees, minus the star power. No, not really with excitement. Really, it is more of a sense of relief for people who follow local politics to find out who’s in, where they are running, and (more importantly in some cases) who’s out. There have been the usual lost leaders and smoke screens filtered about as potential candidates test the waters on various possibilities. If you’re thinking this is some kind of an announcement on my part, no, it is not. As I have said in the past, it would be exceedingly difficult to see an acclamation for Grimsby’s mayoral position, but that won’t happen as Jeff Jordan has stepped up to the plate, so I know there is an excellent candidate there already. As I write this, Jeff is the only candidate for Grimsby’s top position. It is hoped, and I am sure there will be, others. Will the esteemed Mayor Bob Bentley take another kick at the can? Will he step aside and give his lieutenant Steve Berry a shot at the title? Who knows. But people definitely should care. Lincoln is in good shape all around. With Coun. Rob Foster opting to take a shot at regional councillor a significant opening materializes around the Lincoln council table. West Lincoln, like Grimsby, needs some new common sense candidates. The municipality will be well-served if Albert Witteveen wins his run at West Lincoln’s shiny new regional councillor seat. Albert always has been a voice of reason and experience. He did great work getting the West Niagara Agricultural Centre up to its
MIKE WILLISCRAFT feet and he would do the same kind of thing at the region’s council chamber. At West Lincoln’s council table you could have a husband and wife team in the Gananns. Now, as much as I like those folks, it would be awfully strange for a community as small as West Lincoln to not have varied enough choices that a married couple gets elected, but who knows? For the mayoral race there, excellent candidates to oppose Mayor Doug Joyner. Problem will be there, with solid opposition, we could see 2014 relived when two good opponents split the majority of votes and Joyner skated down the middle to a win. Two of the four candidates, Dave Bylsma and Joann Chechalk, both have council experience, too. The fourth declared candidate, so far, is Paul Wiebe, who was a vocal opponent of the massive MURS spend and the council finagling that went on to get it approved. Now, I note, “so far” in terms of registered candidates because tomorrow is the big day...finally. The cut off at all town halls to register is 2 p.m. I leave Grimsby for last in terms of this candidate overview because, by far, it needs the most work. In my 33 years in print
media I have probably dealt with upwards of 500 politicians. I’ve never seen anything like the collection Grimsby has accumulated over the years. I recall the first council meeting I went back to as I started to cover Grimsby council regularly again and another fellow who has covered council longer than said, “Boy, I am glad you’re here. If people know half of what some of these guys say, there is no way they would get elected again.” After taking in this term of council, all I can say is, his impression was 100 per cent correct. Yikes! There are simply people around that table who should not be. Without getting into particulars, because there simply is not room, it seems the mindset of council has been they know all and really don’t have to listen to taxpayers. That has to change. If someone asks a question, it is not a bad thing. It’s good to have people engaged, not a nuisance. Council should be trying to elicit public opinion not stifle and control it. The bullying tactics employed by some members of council are legendary. Oh ya, more written proof arrived on the weekend. Grimsby simply needs to throw open the window and let a fresh breeze of change waft through town hall - full on rookies, no experience, no baggage. The current council always says it depends fully on its staff for expert opinion anyways, so why would that be a limitation for someone brand new who can listen, reason and give a thoughtful response. As I have said countless times, get informed, get out and vote. Make an informed decision.

Nobody builds houses like this anymore”. I told them about the changes that the Town’s Planning Department is considering for Main Street East from Nelles Road to Lynwood Av-

nize the place. With all that’s going on at our Town Hall, it’s a preview of what Grimsby will look like in 5-10 years. If we don’t want this to happen here, we need to wake up now. Yes, it’s summer and we want to relax instead of thinking about unpleasant things like these. But burying our heads in the sand just sends the Town the message that we do not care.
