Grimsby to pay Jordan Greenhouses $115,000 By Mike Williscraft NewsNow “Complete vindication” is how Rebecca Jordan reacted to the Ontario Municipal Board’s award of $115,000 in damages to be paid by the Town of Grimsby. The decision, delivered by OMB member Blair Taylor, outlines several major issues with how a major construction project was managed on Main Street West in the stretch right in front of Jordan
Greenhouses, operated by Rebecca and her husband, Jeff. A “reactionary approach”, “careless implementation and supervision of the Project,” and a series of moves designed “with the convenience, welfare, and best interests of the contractor only at heart,” were several key reasons the OMB findings went in favour of the Jordans. “The list of problems is far too long to get into and I re-
ally don’t want to do that anyways. It is all there in the decision. I hope people read it to see how town hall really operates,” Rebecca said. The OMB hosted a lengthy hearing in mid-October 2014 at which a great deal of e-mail, video and verbal testimony played out. Town manager Keith Vogl said a review of any possible next steps would come at council’s next meeting.
“Obviously we are disappointed with the decision. We have requested the Town’s solicitors to attend the next council meeting on March 2, 2015 to give us his perspective on the decision, the implications and any options we may wish to consider,” noted Vogl in an email. At issue was the Jordans’ claim for compensation for “injurious affection” caused by construction along Main
Street West where the couple operated Jordan’s Greenhouses. While the OMB found “that Jordan’s was injuriously affected by the construction activity carried out in the Spring of 2010, under the auspices of the Town” the evidence road to get to that decision was long. The whole process took five years. The planned construction start was to be mid-November
2009. The Board recognized the Town pushed for that start, but Kenwood Trenching and Sand Excavating Ltd., which was awarded the contract, did not meet that target. The timeline would overlap the prime season for the Jordans’ greenhouse operation and would bankrupt the business, Jeff Jordan told Grimsby public works director Bob LeRoux after getting a copy of the Town’s letter outlining project details from a neighbour. The Board found the Town’s mangement of the project was designed to meet minimum standards, citing comment by LeRoux as
an example. “They have a contact number if they have a problem and, ah, that’s the way we approach the project. If you--- if you stick your hand in a jar of snakes you’re gonna get bit and to tell them they’re gonna have problems and concerns is only---it’s not a positive approach to it,” LeRoux is quoted in the decision. “In this case, the pursuit of minimum standards has led to a situation where the Town could not remedy a fundamental timing issue that was arbitrarily made at the outset without due care and attention to the area and the properties in that area. More-
over, the Board finds that this approach led to the careless implementation and supervision of the Project where the contractor provided not even a preliminary construction schedule until after the Project had commenced, provided no fixed construction start date, manipulated the signing of the contract to facilitate a start date to suit the contractor, provided no traffic plan, failed to comply with the Ontario Traffic Manual, and in essence managed the Project with the convenience, welfare, and best interests of the contractor only at heart,” states the decision.

Drivers charged at RIDE check point Members of the Special Enforcement Unit of the Niagara Regional Police, conducted a RIDE program in the town of Lincoln and City of St. Catharines last Friday. Over the course of the evening about 350 vehicles were checked and of those drivers 11 roadside breath samples were taken. As a result of the program one driver was arrested for Over 80mg (blood alcohol) and two others received a three-day driving licence suspension. In addition, nine provincial offences charges were laid for various infractions under the Highway Traffic Act. Earlier in the evening police arrested two people who came through the RIDE checkpoint and
were found to be in possession of 28 grams of marijuana while operating a motor vehicle. R.I.D.E. campaigns will be conducted throughout the Region of Niagara all year long. The Niagara Regional Police Service is committed to reducing Impaired Driving Offences through education and the apprehension of offenders with enforcement programs like R.I.D.E. The police media release noted that impaired driving is still the leading cause of Criminal Death in Canada. Impaired motorists place everyone’s safety at risk by drinking and driving on Ontario roads and highways with thousands of lives lost every year.

Six confirmed measles cases in Niagara Measles is now circulating in Niagara - residents could be exposed to measles anywhere. It is a highly contagious disease and Niagara Region Public Health is strongly recommending that all residents update their vaccinations now to be best protected. As of Monday, there were five confirmed cases in the Niagara Falls area but the health department is warning
that it could show up anywhere and more cases are expected. Niagara’s first confirmed case of measles was announced earlier this month as a woman in her early 20s who was not vaccinated against the virus. Niagara public health officials have posted warnings about two Niagara Falls schools — Our Lady of Mount Carmel and Saint Michael High School — where measles could have been transmitted to students, teachers and parents. Public health officials are asking anyone who attended
or visited Our Lady of Mount Carmel between Feb. 9 and 10 and Saint Michael High School between Feb. 6 and 10 to watch for symptoms of measles until March 3. If you are not vaccinated against the measles, you can: book an appointment with your doctor or health care provider; call Public Health at 905-6888248 ext. 7425 (toll free: 1-888-5056074) or attend a vaccination clinic Symptoms of Measles: fever of 38.3° C (101° F) or greater, cough, runny nose and red/watery eyes,
a red blotchy rash. Persons who have measles need to isolate themselves while they are ill and for four full days after the rash first appears. Complications of measles can include middle ear infections, pneumonia, croup and inflammation of the brain. Those at risk include anyone who has not had their age-appropriate vaccines; infants under one year of age; pregnant women; and persons with weakened immune systems are more likely to get very ill with measles.

Gale took down George M. Case in 1886 By Skip Gillham For NewsNow Somewhere off Port Colborne lies the remains of the wooden schooner George M. Case. The 12-year-old sailing vessel got caught in a fall gale on Oct. 14, 1886, while carrying 23,000 bushels of corn from Chicago to Buffalo. The ship was spotted in distress by the tugs Root and W.A. Moore. The pair tried to get to the scene but arrived too late. The George M. Case sank an estimated six to eight miles off
Shipwreck Port Colborne. The Captain, the cook and one member of the crew went down with the ship but another four who had been on board were rescued by one of the tugs. The 344 gross-ton sailing ship dated from 1874. Reports vary on the value of the ship and cargo with one source listing it as $60,000 while another source notes the ship was worth $9,000 and the cargo $10,000.

NANCY MORGAN Using store bought pizza dough, change up pizza night. SPINACH-CHEESE CALZONE • 15 oz container ricotta cheese • 1 cup mozzarella cheese, grated • 1-10 oz pkg frozen spinach, thawed and squeezed dry • Salt and pepper to taste • Pinch of nutmeg • 3 tbsp Parmesan cheese • 1 tsp dried basil, crushed • 1 pkg fresh or frozen pizza dough, thawed if frozen • 1 jar prepared marinara Preheat oven to 400. Combine ricotta, mozzarella, spinach, & spices. Mix well. On a lightly floured work surface, roll the dough out into a 15 inch circle. Spread cheese mixture over one half of the circle. Fold dough over, forming a half moon. Pinch the edges together to seal. Transfer to a baking sheet lined with parchment paper and sprinkle with parmesan. Bake until puffed up and golden brown, about 15 minutes. Let stand for 5 minutes. Serve with warm marinara.

Warning signs you’re about to get a flat Few drivers will be fortunate enough to go their entire driving lives without dealing with at least one flat tire. Tires often produce warning signs that a flat or blowout is about to happen, so drivers should inspect their tires for the following signs. •Varying wear: Uneven tread on tires indicates that the tire with more wear could be about to go out. •Worn tread: Even drivers who know little about cars can typically recognize when tire tread has worn down to the point where the tire is a safety risk. •Low pressure: An underinflated tire is under stress that can cause the tire to blowout. In addition, poorly inflated tires force engines to work harder, which negatively affects a car’s fuel efficiency. •Vibration: A car that vibrates excessively may do so because tires are damaged. Poor suspension is another cause of excessive vibration. Drivers should immediately take the car to their mechanic for an inspection. •Physical damage to the tire: Sometimes tires exhibit physical damage like bulges or cuts, and such signs could mean a flat tire or blowout is just around the corner. Tires that exhibit such physical damage need to be replaced.

Died peacefully on February 15, 2015 in his 85th year. Survived by dear wife Stella (Dalzilio Daley), sons Dr. David (Karen Fullerton) and Dr. James (Wendy McGregor); his Daley stepchildren Patricia (Michael Kennedy), Kathryn (Robert Quick), Gregory, Michael (Pat Hollister), Dr. Andrea and Anne; grandchildren Sam, Isobel, Emma and Eric Hendry, Stephen and Peter Eelhart, Matthew, Jason and Joseph Daley, Madeline and Evan Daley Samsa, and great-children Ava, Owen, Meike, Lauren and Mackenzie. Predeceased by parents Gordon and Vera (Lindsay) and first wife, Isobel (Newhouse, 1971). Fondly remembered by Cheryl Murton, Silvia Samsa, the Newhouse and Dalzilio families, and special cousin Betty Kirchner. In 1948, at age 18, Sam began a career with the Bank of Montreal that took him to Werl, West Germany; Montreal, Georgetown, Waterloo, and many other towns and cities. He retired as the manager of the main branch at Jackson Square, Hamilton. Sam and Stella finally put down roots in Grimsby, Ontario where he was an active member of the Grimsby Curling Club and Probus. Sam enjoyed travelling, skiing, curling and spending time at his property in the Rideau Lakes. Above all else, he loved his family. Thanks to the doctors, nurses and other staff at West Lincoln Memorial Hospital for their care and dedication. Cremation. A memorial gathering took place at Grimsby Curling Club, 277 Kerman Avenue, Grimsby on Wednesday, February 18, 2015, from 2-4 p.m. If desired memorial contributions to McNally House would be sincerely appreciated by the family. Things are going well when... ...your fundraising event sells out before even one ad is published to let people know it is happening. The Kinsmen Club of Grimsby knows this scenario. NewsNow published a brief a couple of weeks ago, which resulted in 16 teams signing up for the club’s Greater Grimsby Mini-Putt, which raises funds for West Lincoln Memorial Hospital Foundation’s Project X-Ray. Last week we ran a story with a photo of a smiling organizer, Bruce Bond, and the remaining 14 spots were filled by the end of the day the paper came out. So first, thanks for the great response to all the registrants. Second, what a great way to get the ball rolling for the 20th anniversary of the event. M.W.
Town, contractor should be on hook You know when you can just feel, in a palpable way, that something is wrong and you really just do not want to know how wrong? That was the feeling when things were blowing up in the faces of Jeff and Rebecca Jordan in Spring 2010. That was when a major and ill-timed sewer project effectively suffocated their struggling business, Jordan’s Country Garden, which had operated as a greenhouse and retail shop on Main Street West in Grimsby for 80 years. It has taken five years, but the Jordans now feel completely vindicated and are very appreciative of the Ontario Municipal Board’s decision to itemize all the serious problems with how the project was handled from the outset right through to failure on the part of the contractor to adhere to basic construction safety measures, to a flat out lack of interest on the part of town employees and council to take any level of action to rectify what was clearly a bad situation. I really don’t know where to start....and that is rare. I could go with the OMG hearing, er, I mean OMB hearing. Or maybe I should review the erroneous published reports regarding a civil suit that never was. NO the Jordans never filed a civil suit regarding any of this.
MIKE WILLISCRAFT Maybe it is best to go back to the start and see how this whole ball of goo got rolling. It is interesting to note that early in 2011, I wrote a column for my previous employer which noted the project was originally supposed to get rolling in Fall 2009. That is accurate. The Jordans had been told the change in timeline was made at the request of the contractor. Turns out that is false. According to evidence, email and otherwise, offered at the OMB hearing, Town officials were attempting to push the contractor for the planned mid-November start date, but the contractor appeared not to be very interested in what its customer wanted. When a customer emails (Nov. 9, 2009) and says, in effect, “hey guys, remember that super expensive project you were awarded? Well, the start date was to be Nov. 16-17. What’s up?”....and the contractor does not bother to even reply, one could
surmize there would be a big sign on the highway screaming “Hey, Troubles Ahead!” You folks really do need to read the report first-hand. Don’t take my word for it. Don’t take the Jordans word for it. You can read the whole document by going to: newsnowniagara.com I will put a hyperlink for the OMB findings right on the home page. I could note the lengthy list of problems with the constuction site itself, the lack of attention regarding safely issues with signage and a host of other issues, but I will leave it at that. The paragraph that starts at the bottom of Page 34 and outlines the litany of issues begins to cover the essence of all that went on. So, yes, the Town is on the hook for a huge settlement. But I cannot help but wonder how or why the contractor is not also on the hook. The OMB decision notes, at many points, a host of contractor-related issues. I would hope the Town has the opportunity to go back at the contractor for no other reason than if the initial start date was adhered to and communication was not seemingly ignored, the work would have spanned three months and been done in February 2010. No harm, no foul. It did not and the rest, as they say, is history.

Reader: proposed use of former police station example of poor planning Dear Editor, I read with no small amount of disbelief your article about a three-story condo unit being proposed for the site of the old Grimsby police station on Bartlett Avenue, at Central. This is an example of very poor landuse planning, and certainly does not fit into the neighbourhood. There are single-story dwellings all around this site,
Letter which would all be overlooked by this proposed monstrosity. The existing residents have a right to their privacy. This proposed apartment building was not on the drawing board when the existing residents purchased their homes, and they don’t deserve it. I am not affected
by this directly, but everyone in Grimsby is affected when it seems their rights and expectations can be so blithely ignored by the Region, Town and the devel oper. If this property is under Regional planning jurisdiction and approval, then the Town must step up to file an objection on its own behalf and that of the affected residents. Otherwise,
where does this nonsense stop? Anyone with vacant land nearby could be easily affected. This is just a ridiculous proposal which must be halted in its tracks. It is much too dense for this small piece of land, violates the privacy of the neighbours, and presents a poor face to visitors along a major access road (Bartlett Ave). It is not in keeping
with the area despite the presence of other senior’s residences, as it does not abut these other properties, nor is it a transition development between single-story and other
high-rises. It is therefore nothing but a serious intrusion into other people’s privacy. Don’t they have rights? Tim Fletcher Grimsby
