Rural dumping may get worse before better, council hears With many fellow rural Grimsby residents in the gallery, Kemp Road resident Joe Majetic gave council an earfull Monday night regarding the ongoing dumping issue at 42 Kemp Road West. Majetic said inaction by the Town, not just recently but going back several years when rural dumping issue first arose, have put the community in a spot where there is no controls in place. “This is not clean fill,” said Majectic, handing out photos for council to peruse which appear to show metal, brick and cement among the rubble. “This is zoned agriculture. Private land or not, that stuff should not be allowed on farm land,” he added, citing noise, dust and traffic all as serious concerns. Majetic said he understands Mayor Bob Bentley’s point that no

bylaw is being infringed on, but he said that is a major part of the issue today - not having a proper bylaw in place to protect the taxpayers. “We need you to take this seriously and take immediate action. I have heard there may be as many as three more dumps starting up on Kemp. These people know we don’t have a bylaw,” said Majetic, adding if the dump site was closer to a town interest, like the cemetery or Southward Park more immediate action would have resulted. Council was very much hung up on the question of having the extension removed from plans before an Environmental Assessment study is completed for the area. With the GO station in the works, EAs for both Casablanca and the extension have been planned. The Livingston EA was supposed to be done back in 2014, said extension opponent Bruce MacKenzie. But it was held in abeyance. MacKenzie noted there was never any public information as to why it was started in 2014 or why it got mothballed with no notice. While the vast majority of the gallery at both meetings opposed the

Livingston extension, some property owners were on hand at both meetings to tell council the road should go through as planned. Representatives for three-quarters of the eight family members which owns the Hunter Road woodlot parcel of land attended both meetings. They said they would like to see the road built as it was set out when the land was expropriated from them in 1972. As well, George Trifunovic noted his family owns a 21-acre parcel of land which extends from Main Street West north to the CN tracks. He said a hike/bike trail would sever his properties split by the expropriated right-ofway, which is 100 ft wide. A road would allow for accesses for each property, allowing them to move farm equip-

ment across the road, which he said a walk path would not do. Trifunovic also said a path would lead to bonfires and vandalism initiated by “out-of-town revellers”. Ald. Steve Berry, among others, noted a significant disconnect with this thinking. “I miss the connection. I respectfully disagree that the wild west would form,” said Berry. MacKenzie, who was initially told he would not be permitted to address council, was allowed, when council passed a special motion to allow anyone who spoke at Public Works an opportunity to present. He outlined several points in the process to date which he believed were flawed and an attempt to keep information from the public about what was happening with the exten-

CAO Derik Brandt, “clarified” for council that it does not matter if the extension is included in the Region’s transportation Master Plan or not. It may or may not be built regardless of its inclusion. Ald. Dave Wilson questioned why the EA would be done at all given that the Greenbelt legislation has ceased any rezoning and development. Ald. Michelle Seaborn agreed saying a new road would be “a road to nowhere.” She said, to loud applause, the EA should be shelved at least 10 years and the extension put on hold. “We should put it on the shelf for the time being”, she said.

Council track record poor across board: reader Dear Editor, “The few locals” referred to in your letter happen to be a group of people concerned about how the present council and administrative staff of Grimsby Town are failing in their duty of acting for the best interests of Grimsby’s citizens. The issue of ‘urban sprawl is not ‘A Fact of Life’ It is a concern which needs desperately to be addressed in a rational manner. The current and previous councils elected to use residential growth as a major tax base and not pursue other commercial/industrial growth to offset this revenue focus.

Letter This poor governance has resulted in pressure to develop yet more land for residential construction. There is a need to address long term effects of covering yet more of arable and arborial lands with concrete and asphalt. Development of the Livingston Avenue extension will result in yet more high density residential construction, placing even greater loads on services such as sewage and water supply. At a forecast cost of $8.1 million, what are the benefits to the Town and to the envi-

ronment? You state that ‘the silent majority’ are content with the way the town is managed! Are they content with the erosion of our Town reserves? Are they content with the rampant over-budget costs for the Town Hall and library? Are they happy with the bio-digester fiasco? The micro turbine farce? The present mayor and council have demonstrated their inability to manage Grimsby’s operations and future planning simply by their performance record! If change is not made at the next election, Grimsby’s future will

reach a ‘tipping point’ which will lead to it becoming more of a dormitory town than it is today and a residential ghetto in its West End. A case in point: With an estimated growth of the west end of town (Grimsby on the Lake) to 10,000 population, has anyone recognized that at least 5,000 commuters from that area will be trying to access the QEW at Casablanca and/or reach the GO station planned for south of the South Service Road between the hours of, say, 6-8 a.m.? Woodlot should generate bigger picture thinking, writer Dear Editor, It is unfortunate that some of your readers are not concerned about the issue of the Woodlot of the “Save the Woodlot” fame. Anyone who lives in Niagara and particularly Grimsby should be. Trees make oxygen, which all your readers need. Have you noticed how “stale” our air is getting below the escarpment? We are losing trees and their benefits at an alarming clip while, for some years, more and more children are born with breathing difficulties such as asthma. As voters, we get to attend Town meetings, for purposes of obser-

vation to see how our elected officials are using the mandates we have given them. We also have a right to let our aldermen know how we are positioned in support of this controversy. Please do so. We all are aware that it is not possible or even desirable to stop all development in Grimsby. No one can stop people from having families and wanting to live in such an extraordinary place. But the key is thoughtful, environmentally conscious, and affordable development, is it not? We are getting some ‘fly by night’ builders here, I fear. There is only

so much land between the escarpment and the lake, making what we do build extremely critical. The Inconvenient Truth about the Grimsby woodlot is that if it is divided, it will be damaged and degraded. The Environmental Assessment will discover this, of course. The woodlot is protected, however, by the Greenbelt legislation, which combats urban sprawl. Many landowners have been affected in similar ways by the Greenbelt restrictions, and will have to wait for the legislation to be changed at the Provincial level before their properties can be sec-

tioned and sold off. Neither the Town of Grimsby nor the Niagara Region should weigh in with a two-lane black top $8.1 million expenditure to assist or detract from the road/no road position. We can only hope that council will willingly support Provincial legislation and the Town by-laws and that those who are in positions of power, like the Committee of Adjustment, will faithfully enact their duty to enforce the laws and by-laws, which I assume were carefully thought out for the good of the Town and all its residents. Side issue on Kemp also a concern To clear a few things up on this Kemp Road West dump situation: the mayor is 100 per cent correct when he stated last week and again Monday at council that the Town could do nothing to halt the situation based on its currently bylaws. When residents cited at council, in emails, in visits and phone calls to NewsNow’s office their disgust with the lack of Town action it was for more than just the dump truck traffic (which can quickly be shrugged off as a Niagara Region matter since Mountain is a regional road) and concerns with the amount and make-up of the fill being dumped. Residents noted time and again concerns about noise, dust, drainage and lack of action on things like culverts being filled in/clogged. Town officials ran the playbook - NPCA, MOE etc, but Joe Majetic was right. Council was “asleep at the switch” with no reaction to Woolverton Road dump activity, which left them exposed on Kemp now. Shiny lure hooks Grimsby council As far as Grimsby town council meetings go, I must say, Monday was one of the best ones this council has run in the last two configurations of council - that goes back about seven years. It had all the earmarks of another train wreck starting with Bruce MacKenzie coming over to tell me he had been barred from speaking by clearly an overzealous clerk who selfdetermined Bruce had his say last week at the Public Works Committee meeting. For years, whether it was the clerk’s office or planning, yikes, some shocking decisions and reports have surfaced. On this occasion, not a surprise. Council voted to let him speak. From the discussion on the woodlot at Public Works it was clear council would be cajolled into following the shiny lure of the proposed Environmental Assessment to be done for the Livingston Extension. One is also to be done for the Casablanca corridor as part of the onslaught of development and traffic growth projected to come in concert with a new GO station. The Livingston Extension, of course, is joined at the hip with the Hunter Road woodlot. The community has spoken repeatedly and in unison on the issue of putting in the extension and impacting the woodlot. They don’t want it and, up until Monday, opponents of the project believed they had the support of a majority of council to get it removed - as per the ‘yes include’ or ‘no extract’’ the proposal from Niagara Region’s Transportation Master Plan. The Plan and EA is the grey area which was thoroughly danced in Monday night to create enough confusion that a couple of councillors took the bait, flipped their votes, according to MacKenzie, and allowed a motion which was wholly irrelevant to be passed. Basically, the motion de-

On the surface it makes a bit of sense, until you scratch that surface every so slightly to realize there is no substance there whatsoever. About the most direct and truthful statement of the evening came from CAO Derik Brandt on several occasions when he stated it makes no difference if the extension is in the Region’s Master Plan or not. It could be removed, all think it is settled, the EA rolls out, they think it should go, and it gets done. Case closed. This is a possible scenario. The key here, the EA and the extension are not connected. The EA would proceed and be studied in the area under the Casablanca analysis anyways, even if something was not done specifically for the proposed link between Casablanca and Oakes Road. But, and in these cases there always is a BUT, it would have behooved council to actually do what they were asked by Region and give them a yes or no answer - which should have directed regional officials to remove it from the plan. Then the EA would still proceed to cover the area and if there was a need, then putting it back in play could be considered, just as the other side of the coin will be studied now that coun-

cil went all Switzerland on this issue and stayed painfully neutral, ignoring the specific request from Region. There were some good points on both sides of this debate. For the property owners along that corridor who either had land expropriated in 1972 or bought land with that 100-foot swath already in place (I have much more sympathy for those who were there from the start as opposed to someone who bought land and knew the situation), I get their concern for safety, potential trespassing and such. But I get off that ride just as Ald. Steve Berry did when talk starts of “outof-town revellers” and such. Hikers, joggers and cyclists are not the Hell’s Angels. Going into it, MacKenzie thought he had the votes of Ald. Joanne Johnston and Ald. Dave Wilson. Wilson had voted at the regional transportation meeting to remove it, so it was surprising to see his flip-flop Monday. Again, it was that shiny lure of the EA...who would want to look like they were not supportive of environmental analysis before undertaking a project? Nobody who wanted to get re-elected. But the point was completely lost that Brandt kept saying it didn’t matter. It didn’t, but the problem moving forward will be the Master Plan will be completed before the EA is done and the plan will show the road being completed. Once done, it is much harder to remove than to add. It has been proven time and time and time again, once government started leaning in one direction it is near impossible to change its course. That was the plan all along on Monday: delay and it will be included. Sadly, it was a lot like the provincial government grant charade with the biodigester back in Fall 2015. It is a familiar playbook with unfortunate results for the community.

“Am I missing something?” reader asks Dear Editor, I read, with both interest and growing sadness and dread, the back and forth between yourself and Hizz-onner, Mayor Bob Bentley on the editorial page of the Aug. 17th edition of NewsNow. The tone of the entire back and forth degenerates quickly once the issue of bylaw regulation on landfill, and how the situation which has developed on Kemp Road, is being handled by the Town. Mayor Bob seems more than petulant when he says that you, “Probably have already written your story from the group of Forty…” on the topic. It would seem that the group writing the flyers about the goings on in the Town are an an-

noyance to the current Town administration. In fact, and what concerns many out here in the Town a great deal, is our mayor using the term “fake news”, arguing that you have stated that our job “is to be controversial and not necessarily factual”. As a news man, the idea of fabrication and publishing your paper should be mutually exclusive. Am I missing something, here? Perhaps we are mere peons and uneducated seniors, but we have lived in this Town for over 30 years and have not had one occasion since you began NewsNow where we have had difficulty with the veracity of your paper...unless it is quotations from our civic servants at the Town

(Mayor Bob included). I cannot vouch for the content of the “Flyers” about which he speaks, but I am aware of the what and why of their creation and publication. There seems to be more than a tight shoe on the foot of Hizz-onner. It is difficult to fathom what the mayor is complaining about when such a great deal of council business is carried on “in-camera”, behind closed doors and away from the “prying eyes” of the public and press. What is being hidden and what information is Hizz-onner trying to hide by shouting ‘fake news”. I can honestly hear the voice of one Donald J. Trump as I read his words. Keep on poking around the back doors of town hall and poking

the ribs of those who have assumed the license to run roughshod over our Town, and our tax monies. Don’t get me going on the Wood Lot…. Also, the idea of pointing you toward “illegal grow ops” as a real problem (more serious than the limits of bylaws) where the NRP seems to feel it is not an issue is odd. I may be a cynic. At my age, and given all that has transpired, it would seem to be the mayor looking to pull a Trump and try to set a smokescreen up to divert our eyes from the issue you asked him about in first instance… Why, I wonder? I don’t think I’m alone out here in “plebeian ratepayer-land”. Bud Hightower
