Town drops Jordan appeal $115,000 OMB award will stand after council decision By Mike Williscraft NewsNow The appeal of an Ontario Municipal Board decision in favour of Jordan’s Greenhouses by the Town of Grimsby has been dropped. At a special meeting of council held last Thursday afternoon, council went into closed session to discuss an independent third party legal opinion sought in the case, which has been onging for nearly five years. In mid-February, NewsNow broke the story that the OMB had awarded Jordan Greenhouses Ltd $115,000 relating to a host of serious problems stemming from a sewer contruction project in front of Jordan’s former Main Street West retail shop in spring 2010. At a council meeting in February, council had opted to seek independent legal advice about a possible appeal of the decsion. “We decided that after receiving a second legal opinion, there were definite errors and problematic areas in the judgment but it would not be in the best interests of our taxpayers to continue spending more money to launch an appeal,” said Mayor Bob Bentley in an email communication. Several councillors were asked for a comment on the outcome, but all deferred to the mayor. All Town officials noted additional steps would be taken – a press release issued and the legal opinion posted to the Town’s website – in the near future. “We are looking to post the legal second opinion on our Town website for all to read and come to their own conclusions,” said Bentley. West Lincoln sees 6.9 % tax increase By Katherine Grant NewsNow Over the next decade, West Lincoln will need to spend $42 million on road repairs according to a roads needs assessment. To that end, the township passed a budget Monday night that will increase its tax levy by 6.9 per cent to support a net

budget of $7.4 million. On average, a homeowner with a 2015 property assessment of $303,103 will see the West Lincoln portion of their 2015 tax bill increase by about $67 ($5.58 per month). Budget highlights include a $1.1 million investment in roads and bridges that will

see improvements made to Young Street, Port Davidson Road and Caistor Centre Road. “Roads in all three wards will be improved,” said Mayor Doug Joyner. The township held a budget open house for the first time, said Joyner. “It was well attended, people

had a chance to ask questions and talk about the needs of the community.” In addition, this year’s process included the development of 10-year capital plans for the first time. These plans outline both present and future infrastructure, capital replacements See TAXES, Page 3

Despite the decision by council, Bentley said he believes there were grounds for appeal. “There definitely were grounds for appeal, however, the way the decision was worded, would make it very expensive and difficult to appeal with success,” said Bentley, noting additional measures will be taken to communicate the Town’s position. “We will be issuing a press release in the near future as our side has not been told and needs to be for the record as this is a dangerous precedent setting decision for all municipalities.” Jordan said he will be interested to see

The OMB decision is well-reasoned and is fully supported by the evidence. It is what counts. West Lincoln to discuss new $14 million recreation facility A new multi-purpose recreational facility to replace West Lincoln’s Smithville Arena will be the subject of discussion at an upcoming meeting. “It all hinges on the April 20 meeting,” said Mayor Doug Joyner. The projected cost, based on a preliminary study, is $14.3 million, said Joyner. The township has earmarked $100,000 in its contingency fund for the design, he added. The community has discussed its wish list for the complex, now the talk will turn to potential federal and provincial grant

money, fundraising efforts that might be needed, borrowing costs and a design for the new centre. Among desired amenities are an NHL-sized ice pad, a skate board park and splash pad among other items. Not everyone agrees that a new facility is needed. Resident Dave Willis was among those making presentations to West Lincoln Council Monday night speaking against the new complex. “A lot has changed in recent years. The usage of the arena has drastically changed in the

How a $190,000 transfer payment is dealt with could determine if the Town of Grimsby treads into unfamiliar, but very positive, ground. Ald. Carolyn Mullins, chair of the Town’s Finance Committee, said after Monday’s budget discussions that council is looking at an initial tax increase of .07 per cent, but noted, depending on a couple of things, a two per cent decrease in the Town’s tax portion could be approved. “We are still looking at how to deal with that (the transfer payment). We have also asked the Library Board to revisit their budget, as well as a couple of other things,” said Mullins. Mullins noted that another factor still to be decided would be the size and scope of the proposed new Station 2 fire hall and training centre on Mountain Road, at the current Calder School site. “We have to look at the fire department’s needs and wants. We have to get that hammered out. What it is going to look like has not been decided,” said Mullins. A major component of this year’s budget is the projected hiring of 8-9 new full-time staff, added Mullins. “I can’t tell you the last time there was an increase in staff. It has been a very long time. Now is the time,” she said, citing growth in town and succession planning as two reasons. “It is a good, responsible budget that positions us well for the future. Property taxes are a bear to us all so anything we can do to help I’m sure would be apprecaited,.” A follow up budget discussion is expected before a completed document is set.

Rex Ge, the operator of West Lincoln’s G&L Nursery who had the contents of his business destroyed when power was turned off in February, has seen his already difficult path get that much more hard to navigate. At the end of a 16-hour day last weekend, Ge fell in his greenhouse and broke his leg. Since NewsNow broke that story weeks ago, Ge has received considerable support from his friends, neighbours and the community at large. A bank account for contributions was set up at Bank of Montreal. Donations can be made at any BMO branch, Transit #03262, Acct. No. 3983-612. A gofundme.com account has also been put in place. People have stopped by to help and do work in the greenhouse, offers of plant donations have been made, and students at Covenant Christian School have taken on helping Ge as part of the project. All the while, Ge said he still hopes Niagara Peninsula Energy steps up and recognizes everything from his disconnection notice to power being cut off when the account was less than 60 days overdue for $360, was not handled in a reasonable manner. The resulting loss in power caused in excess of $150,000 in damage.

Easter bunny stops in West Niagara The Easter bunny will be busy this weekend at several great family events throughout West Niagara. All the events offer free admission but are requesting donations of cash or food items in support of local food banks. FRIDAY Smithville – Friday, April 3 beginning at 10 a.m. at the West Lincoln Arena and Fairgrounds. Admission is free but organizers are requesting non-perishable food items for the West Lincoln Community Care. Grimsby – Friday, April 3 beginning at 1 p.m. hosted by the Kinsmen Club of Grimsby at Centennial Park adjacent to Nelles School. Children will be divided into groups by age. The Grimsby Kinettes will be holding a barbecue as well. SATURDAY Beamsville – Saturday, April 4 from 2-4 p.m. at Great Lakes Christian High School, 4875 King St. Village of Hope will also be hosting its annual Easter Egg Hunt. Barbecue, hot chocolate, great prizes and gifts to all chil-

playdowns,” said coach John DeTullio, noting the team went with a perfect 15-0 record in the playoff rounds. The team is now preparing to compete for Grimsby’s first, potentially, Ontario Hockey Federation title. They will travel to Stratford April 9-12 to take on Ontario’s best. MINOR BANTAM Not to be outdone, Minor Bantam Physiotherapy Edge team rebounded from a Game 1 loss at home in the first round to Amherstburg to go on a tear. They got by Round 1 with three straight wins. Round 2 went the full five

games against the #1 ranked team in Ontario, the Burlington Eagles. The turning point for their whole season came in Round 3 vs Whitby, Ontario’s #2 teams. Down 3-0 after one period, the boys rocketed back with four unanswered goals in a six-minute span in period two and held on through a scoreless third to take the series. “This season was a huge success because these boys put the TEAM first every night,” said coach Greg Stevens. “They are an amazing group of young men. Beamer Memorial Conservation Area has the ideal elements for birds of prey to soar over the escarpment during their spring migration. Tough budget year for WL Most municipal budgets tend to float along with 2-3 per cent increases – cost of living bombs, essentially. So when West Lincoln passes a budget increase double or triple the norm, one sits up and takes notice. When a projected budget in excess of six per cent rolls down a town’s pipe, elected officials will quickly send it back to department heads in need of a sharper pencil. Skeptics in West Lincoln say the last council handed the new council elected in October this political football by putting off projects last year to keep any budget increase to a minimum in an election year. There may have been some of that. But one must remember, West Lincoln is the largest mass of land in Niagara, and a major expense is roads. Roads are expensive to maintain. Should the township get extra consideration from the Region on other matters because of this? Maybe. A debate for another day. M.W.

The good, the bad and the ugly Lots on the go, so let’s jump in... Last week I gave all an update on what is likely to happen at some key commercial locations in our coverage area. Remember, those were planned uses. The picture can change, but those were intended plans at this point. A good example of that is the Beamsville Towne Centre. I was lucky enough to be parked next to Rose and John Luppino at last week’s Lincoln Chamber of Commerce awards gala. There was, at one time, to be another coffee shop going in the vacated Tim’s location there, but in the end, the good folks at Paulmac’s Pet Food have opted to expand and move in there. Good luck to them! And, while I am on it, what a dinner that was. Many said it was the best ever. I’ve attended every one of the OBAA galas and been a regular at the dinner meetings for 20 years. I would agree with that assessment. ****** Let’s do a “the good, the bad and the ugly”. Town of Grimsby can take the first two...and I’ll get to the ugly. The good: Grimsby is looking at a possible if not likely tax decrease. Sweet! There are likely a lot of years a tweak here or there could result in a zero or decrease, but it is most common for municipalities to come in around two per cent, basically the rate of inflation so they don’t lose ground. Grimsby needs the PR bump though, no doubt,

MIKE WILLISCRAFT so good on council for doing what needs to be done this year (they still have to close the deal, but it looks good). The bad, not going to belabour this, but the whole Jordan’s Greenhouse thing. It is also good council finally opted to put the matter to bed and not continue with the OMB appeal. Town officials says they could have appealed. The Jordans say the Town should have settled years ago and have a great deal to learn about how it conducts business. Just a hunch, I don’t see the Town changing anything. Town officials really believe they were in the right, so I don’t think it was personal. The only problem with that line of thinking is virtually nobody in town who has voiced an opinion to me agrees with the Town’s position and, more importantly, the OMB official could not have been more vehement in his analysis of the Town’s faults in the process. Time to move along, for sure. The ugly...this is a head scratcher for me because I deal with these folks all

the time, but maybe it is just a sign of the times here in Niagara. The tourism sector, which everyone assumes is just buzzing along because we do get a ton of traffic through the area every year, is in just as rough a shape as some of its retail counterparts. We have rejigged our May edition of ClubWEST Magazine to be a full West Niagara run, but at our regular rates. In promoting a huge, extended run with a footprint spanning Mississauga to NOTL, I found the consensus to be things just aren’t great...bottom line. So, scrap that, reset. What would help our local businesses? How about a full run, every home, regular rates... sounds good to me. So that is the plan. All those people who come in to pick up ClubWEST copies, you will get one at home, or at least you better, or call me! Tourism is a funny thing. When I covered NOTL, residents there would tell me they can’t get out of town fast enough on long weekends, but it is a necessary evil to make the local economy go round. Same sort of thing here: The wineries, for example, are so commonplace to us, many don’t think to frequent them for events. Now, many wineries don’t communicate very well to the local residents about what is going on, but it makes for an odd formula to be sure. That is why the mag’s Go West calendar has been so popular with the wineries. Slow but sure, we’ll get it right.

Reader: Beamsville residents will fight “Fort Timmy” at OMB – again Dear Editor, Katherine Grant’s article in last week’s NewsNow was headed “Beamsville Tim’s takes another step”. While this might be true, their next step is a high hurdle, almost as high as the wall they plan to encircle the restaurant with. Local residents are appealing the Town Council’s decision to allow “Fort Timmy” (as it has been dubbed by one resident) to the Ontario Municipal Board. It has already been to the OMB once, with council support, and was rejected. We have difficulty understanding why the Town of Lincoln would still support this venture. Town Council appears to be overlooking a number of issues that do not meet the requirements of its own Official Town Plan and the Zoning By-Law. As quoted in your article last week, John Ariens, planning consultant for DeSantis, acknowledged the OMB rejected the previous proposal because “it was too large, too close and too noisy and there wasn’t enough parking”. While Tim Hortons has made a substantial reduction in the internal public floor space of the restaurant, the building is virtually the same size as before. This leaves Tim Hortons with the option of expanding the floor area at some later date. The solution to “the too noisy” rejection, is to encircle the building with a

Letter concrete wall almost 13ft high for most of its length. The proposed wall contours around the outside curb of the drive thru area and runs for 350ft. No matter what colour they paint it, this wall will look hideous. It will be an eyesore but Lincoln Town Council has agreed this is a satisfactory solution to “too noisy”. The last item quoted in the OMB rejection was “there wasn’t enough parking”. This Tim Hortons will have 15 parking spaces plus 13 drive-thru spaces. At least half the parking spaces will be needed for the employees. This doesn’t leave much parking for customers. The joke here is that the drive-thru spaces count as parking spaces when meeting by-law requirements. Now, if you or I were to park our cars in the drivethru and went inside for a coffee our cars would be ticketed and/or towed away. Lincoln’s Official Town Plan is sprinkled throughout with the notion of “Quality of Life” for its residents. The families in 20 or so homes close to the Tim Hortons would have serious degradation in their “Quality of Life” as would others living

close by. All parents of children going to Senator Gibson School and Beamsville District Secondary School should be concerned. The traffic lights at the Ontario/John intersection have required a crossing guard for many years due to the volume of traffic. During those years the traffic at the junction has steadily increased. Tim Hortons expects this drive-thru to increase the volume by a further 200 cars just in the critical hour between 8-9 a.m. when the children are on their way to school. In approving this Tim Hortons development, it appears Town Council is looking strictly at the technicality of whether it meets the “approved use” of the lot, which it supposedly does. Council is ignoring the impact on the residents of Beamsville. I am told by the Town that there has been ample opportunity for the public to provide their input at a number of public hearings. That the fact 100 of the most affected families did not even live in Beamsville when the public hearings took place, would seem reason enough to take a sober second look. Rod J Sinnott, Beamsville
