Losani project takes first step in appeal process By Mike Williscraft NewsNow Grimsby has seen many “firsts” of late when it comes to planning matters and another materialized Friday with an Ontario Land Tribunal Case Management Conference dealing with 141-149 Main St E., the Cole’s Florist property. Losani Homes has proposed a seven-storey condo be developed on the site. While more than 100 residents opposed the development - as well as Town of Grimsby’s planning staff - it was Losani which launched an appeal after the Town did not issue a decision within the 120-day required response time.
“This is unique, obviously, for the first time we’re actually having two case management conferences in a day. One in relation to Planning Act matters and the other is relating to stuff and used to be under the Conservation Review Board,” said meeting chair, Gregory Bishop, a former vice-chair for the Ontario Municipal Board, and a vice-chair of the Local Planning Appeal Tribunal (LPAT). “The issue I had is whether there are two more appeals or four more appeals,” Bishop added later when outlining the procedures for the hearing. Two appeals related to the Town’s intention to designate two of the properties as heritage sites.
However, Bishop noted his notice cited two other appeals related to demolition. The hearing was not to hear evidence, but to formalize the process under which the appeals would be handled, scheduling dates and deciding participants. “My client filed an application for an Official Plan amendment and a zoning bylaw amendment to develop the property,” said Denise Baker, legal counsel representing Losani Homes. “As part of processing that, the Town of Grimsby issued a Notice of Intention to Designate the property under the Ontario Heritage Act. So then, in addition to the OPA and
zoning bylaw, because of the way the Ontario Heritage Act works is once a Notice of Intention to Designate is issued, you have to treat the property as if it is designated until that’s resolved.” “Then my client filed, and was turned down, a demolition permit.” The result, said Baker, was the series of appeals and one objection filed by Losani. Baker noted there was no consensus on whether or not all the matters would “stay together” during the process, but that was her preference as “they are all entirely related.” On the matter of just how many files are related to the hearing, Baker See COLE’s, Page 2

It’s going be my submission that outright consolidation is probably not correct given the different statutory framework.” Halinski noted that, while he is participating representing the Town, the Town had not yet taken a formal position on the application. “I expect that to happen shortly,” said Halinski. “But as you saw, sir, from the draft procedural work we were able to put together a ‘preliminary issues’ list. The other thing you will hear from us...is that that issues list was put together with the stipulation that some additional time be provided to the parties to finalize it.” Several residents spoke to their request to be included on the process’s participant list. residents have cited concerns of heritage, traffic, parking and density issues. Ruxandra Bucataru of the citizens’ group Save Main Street was also among those requesting participant status. Bucataru noted SMS represents more than 420 residents. Bishop noted that while she represents a large group, her presentation at the meeting could only be considered as her personal representation as the SMS group must be incorporated to allow for one representative to speak on their behalf. Halinski suggested, and Bishop agreed, Bucataru would be included on the participant list and if the group is incorporated before the hearing it could be upgraded in terms of participation. The 10-day hearing was set down to start on Monday, July 4, 2022 with some aspects being consolidated, while others would remain separate.
Beamsville Lions food drive set for Sept. 18 The 32nd annual Beamsville & District Lions Food Drive is set for Saturday Sept. 18. Based at Great Lakes Christian High School, it will support Community Care of West Niagara (CCWN)’s food bank. As with last year, the Lions and other volunteers will pick up donations from donors’ front doors. Items most needed include: Soda and other crackers, instant potatoes, canned potatoes, canned mushrooms, instant rice meals, canned chunky and cream soups, canned stews and chilis, canned fruit, apple sauce, fruit snack, lunch meats like ham or turkey, canned corn beef, condiments and dressings, cooking oils, cookies, cereals and oatmeals, jams and peanut butter, pancake mix, syrup, ground and instant coffee, teas, hot chocolate, juices,
snack packs, granola and protein bars, small bags of flour, brown sugar, toilet paper, paper towel, kleenex, cleaning supplies, dish soap and personal care items. CCWN manager of community engagement Lynda O’Donnell said she is excited about this event, especially as it comes after another difficult pandemic year. “With the increase in clients using the food bank and the almost 30 programs here at CCWN, we truly need this influx of non-perishable food items to get us back on track and through the winter,” she said. “This is our one and only food drive that we ask for help from the Lincoln community and they always come through with flying colours!” Lion Food Drive chair John Tutecky said the Lions will work hard to help stock the shelves.
“We understand it has been another difficult year living with Covid-19. We appreciate anything and everything the generous residents of Lincoln can do to help,” he said. Donors are asked to leave their donations visibly by their front door for the road teams to gather. The Lions and CCWN are also looking for volunteers to either help out on the road team gathering donations, or at Great Lakes Christian High School to help out with sorting and packing the donations. Volunteers can register as individuals or in groups. 4 things you need to know about your Home Equity Line of Credit (HELOC)
I anticipate that, as the pandemic continues to disrupt so many homeowners’ employment, the banks will scrutinize its portfolio of HELOCs, paying close attention to those homeowners who are maxed out on their HELOC. I also believe that the banks will review any HELOCs that are held by homeowners whose sole source of earnings is pension income. Little-known HELOC facts: The interest rate can be increased. I’m not referring to the bank’s Prime lending rate here, but the discretionary surcharge that your institution charges on the Prime rate. For instance, in 2008, many Canadian banks triggered HELOC rate increases - aftershock of the global subprime mortgage crisis. The HELOC credit limit can be lowered - without the homeowner’s consent. A HELOC can be recalled. A HELOC is in simple terms, a demand loan. The bank can demand full repayment immediately, for example, if the borrower experiences an event that restricts their ability to make payments. The HELOC repayment terms can be changed. The bank can mandate a higher repayment amount than just the interest payment so that a portion of the principal balance also gets paid monthly. Financial institutions pay close attention to their customers’ debt loads. A low credit score, balances close to limits, and missed payments are all triggers for a HELOC review. Beatrice “Betty” O’Donnell
Betty came to live in Grimsby 20 years ago and became an active community member. She joined St. Joseph’s Catholic Church and the Senior’s choir. She also played piano with Larry Grace’s band, the Grimsby Rovers. Betty had celebrated her 100th birthday on August 14, 2021 with family and friends - she will be sadly missed in the community.

nee Dineen With profound sadness the family announces the death of Beatrice “Betty” Ann O’Donnell, nee Dineen who died peacefully in Beamsville on September 1, 2021 at the age of 100. She is now reunited with her beloved Jimmy. Lovingly remembered by daughters Sharon King, Linda Cook, Ellen Ottenbreit (Rick), son Tom (Arlene) and daughters-in-law Nancy Billone and Ann Gallant. Predeceased by cherished husband Jimmy (1972), sons Terry (1973) and Austin (2007), infant daughter (1943), siblings Gertrude, Dan, Joe, Fred, Eddy, Austin, Anthony and Bert and parents Patrick and Ellen, nee Bodendistel. Betty was a proud grandmother of 13, great grandma of 17 and great- great grandma of 3 and a loving aunt to many nieces and nephews. She will be remembered for her generous spirit, big heart, love of music, dance and strong faith. Betty lived her life with courage, compassion and dignity, she will always remain with us in our hearts through many cherished memories. She leaves a legacy of love and a lasting footprint on this world. As per Betty’s wishes, cremation has taken place. Reporting to the Manager, Information Technology, the IT Help Desk Analyst will be the first point of contact for staff seeking technical assistance for a variety of hardware/ software and other technical issues. This position is part time working 30 hours per week. Responsibilities include providing first level support to staff dealing with workstations, server, and corporate application issues, diagnose and troubleshoot hardware, software issues and telephone issues including VOIP and Cellular, repair hardware/ software issues, provide and maintain anti-virus protection to servers and desktops, provide and maintain backups to all servers and desktop computers, maintain and update computer/network/telephone inventory, maintain and install computer software and updates for all computers, provide staff training on systems, manage software deployments and planning, roll-out of new hardware including imaging, deployment and individual customization, provide IT Support during Council/Committee meetings including set up and assistance of audio/video presentations, provide maintenance of Township website and provide vacation relief for Manager, Information Technology. MINIMUM QUALIFICATIONS: College Diploma in Network Administration or similar field. Minimum one-year desktop support or help desk experience. Municipal experience is an asset. Strong communication skills and analytical/problem-solving skills. Ability to work under minimal supervision and outside of normal business hours. Strong knowledge of MS Office, VOIP Phone Administration, and website support. Fundamental understanding of Active Directory and Group Policies. Knowledge of Barracuda appliances is an asset. A valid Ontario Class “G” driver’s license and access to a vehicle is required. Important process started Friday It was a relatively simple part of the planning appeal process, but it marked the start of something which will, essentially, determine whether or not Grimsby’s east end gets significantly overdeveloped or if, somehow, common sense prevails. The appeal process has been significantly stacked for the developers’ point of view, so it will be a difficult row to hoe for residents and Town planning staff who opposed the seven-storey proposal submitted for the Cole’s Florst site by Losani Homes. Of late, some members of the former town council have chimed in noting a proposed hospital corridor study which was killed by the current council in early 2018 would, somehow, have been a saviour from the prosects now faced. This is completely false. The study, supported by Niagara Region, would have led to a change in zoning to “mixed use” similar to Winston Road. This would have allowed up to six storeys AND the dreaded “bonusing” - allowing developers to buy more height, essentially. Here we go! M.W.
Common sense vs blind control As this edition is printing, the rubber will be hitting the road when it comes to Grimsby and Lincoln amalgamating fire departments. Lincoln will have its act together. They always do. Grimsby? Well all bets are off not only on any thought of having its collective act together going into it, but you can bet those council put on the committee will also cloud matters far more than they help. Chances are slim to none appropriate members of council pass muster when it comes to garnering enough votes to get proper candidates on the joint department management committee. To look around the Grimsby table, it is evident who would make the best representatives on the joint committee. A good numbers person is needed and someone who can take data and apply it in a creative, if not abstract manner is even better as this is a new trail about to be blazed for these two municipalities. Clearly that points directly with someone with a solid financial background, and that would be Coun. Reg Freake. Second, you need someone who is an excellent planner and stickler for details. Someone who can digest policy and documents, seemingly mundane but very important. That points to Coun. Dorothy Bothwell. Now, I have not spoken to either individual about their interest, time or desire to take on such an added role but their background shows they are best suited to the positions. As I stated in this space months ago, who I think you will get will be Coun. Kevin Ritchie and Coun. Dave Kadwell. Their cohorts in the G5 typically find it very difficult to show any level of

Ritchie and Kadwell should not be on the joint committee for very different reasons. Both have a background in their work life as firefighters. Yes, that could help. Ritchie has gone down the road of being a union leader. Now anyone who knows anything about unions is their mandate is to grow their numbers in any way possible. This whole joint venture is being done to avoid exactly that - a full-time (unionized) fire department which would escalate fire service costs astronomically across the board. Just in terms of playing well in a brand new sandbox with others? Please... move on. As for Kadwell, experience simply would not overcome an inability to digest a great deal of new data, reports and information. Yes, the Town’s CAO will be on the committee to hand-hold and coach council representatives through, but it is not like he has been any kind of positive influence for the community as a whole since his arrival. Independent thinkers are needed here. Which leads to another point. Why would CAOs, or staff of any nature, be vot-
ing members of a municipal working group in this instance? The Town’s bylaw, which was dealt with Tuesday night (bumped from Monday due to Labour Day) reads: B.4. COMMITTEE MEMBERSHIP B.4.1. The Joint Advisory Committee shall total eleven (11) members and shall be comprised of: (a) Eight (8) voting members: • The Mayor of each municipality; • Two (2) elected members of the Municipal Council of each municipality; • The CAO of each municipality; and (b) Three (3) non-voting members: • Fire Chief; • Two (2) Deputy Fire Chiefs Sure, staff support and input are needed on a committee such as this, but why would the fire department staff be non-voting members and CAOs be voting members? Again, this is Grimsby baggage, but generally these decisions should be made by elected officials. ******* A quick note about the passing of two very good people whom I knew from different areas of life. I was shocked to hear of Wendy Baarda’s sudden passing last week. Wendy, who many would know from Lincoln Library, was a “ray of sunshine person”, always super positive who I new since our days at Rannie newspapers in the 90s. Also, readers will have noticed Jack Martin, an absolute champion of the community, passed away also. Many will know him as the man behind a force in this area for decades, Shirley Martin. Jack was a class act all the way; soft-spoken but always on point. My condolences to both families!
