Trio files defence in biodigester suit By Mike Williscraft NewsNow The Town of Grimsby et al filed its reply to the defence submitted to the courts in the $18 million civil action regarding the Sobie Road biodigester project. In the suit filed in July in Ontario Superior Court by the Town of Grimsby, Niaga-

ra Power Inc. (NPI), Grimsby Energy Inc. (GEI), Grimsby Hydro Inc. (GHI), and 1938427 Ontario Inc. (HoldCo.2), three claims were made citing former Mayor Bob Bentley, James Detenbeck and Joe Panetta as defendants. The claims, in part, allege Bentley, Detenbeck and Panetta were negligent,

breached their duty of care and breached their fiduciary duty through their dealings regarding a “failed waste-toenergy project”. In an Oct. 31 filing, the trio defended their position, largely, claiming their processes were open to the Town and shareholders (town council) and their ac-

tions were approved by the appropriate hydro board and council. The defence filing went so far as to suggest the civil action was launched in bad faith and the matter should be dismissed with costs. In its reply, the plaintiff submitted more detail to refute See REPLY, Page 19

GBF, firefighters team up for Hamper Program The Grimsby Firefighters Association is once again lending a hand to help GBF with its Christmas Hamper program. The firefighters will be at the front of the Grimsby Christmas parade on Dec. 7 collecting bags filled with do-

nations for GBF. These donated items will be sorted out into hampers that will be given to households struggling with the added costs of Christmas in Grimsby. The community service group asks that people donate items of

basic necessity such as bed sheets, bath towels, winter wear and so on. They also ask that people donate “gift items” appropriate for various age groups. This would include age-appropriate toys for children, sports

MPAC assessments are coming to town By Tristan Marks NewsNow West Lincoln property owners should not be surprised if they receive a letter outlining their “property assessment notice” next year. A representative of the Municipal Property Assessment Company (MPAC) presented to the Township’s council on Monday about their upcoming 2020 property value assessment report. MPAC is an independant company owned by the Government of Ontario that administers property assessments and appeals of assessment across the province. Every four years they update their assessments for property values within given municipalities using a variety of methods such as direct com-

parison and property income data. Analysis is an on-going process, but MPAC sends out assessment notices to municipal residents every four years. When the upcoming notices go out, it will reflect the data as of Jan. 1, 2019. Assessment increases are phased in equally over four years, when the next valuation begins. Coun. Mike Rehner expressed concern at how the recent real estate market activity would affect the value assessment and therefore residents’ property taxes. He cited the township’s 5.1% tax increases for each of the past three years. “Will MPAC reflect the crazy market?” he asked. “During campaigning last year I had a lot of

people saying “I don’t think I can afford this”.” He specifically drew attention to the difficulty this would pose to retirees and others living on fixed incomes. MPAC account manager Lynne Cunningham, who presented that evening, said in response that property taxes are the municipality’s purview. Her company merely reports the value. Rehner also asked if the system would raise taxes on property owners who increase the value of their property by improving it. “Is penalization an incentive to beautify a property?” he asked. Cunningham’s reply was that such considerations are out of MPAC’s control. “We’re legislated this way,” she said.

Since then, the bonspiel has taken on new life and the proceeds to BBBS have nearly doubled,” BBBS special events coordinator Mary Champ said Sunday at the Grimsby Curling Club. “It all comes down to Marc Seguin and his tire-

less work to get the event sold out,” Champ said. “I am passionate about how much BBBS does for kids in the community,” said title sponsor, Marc Seguin, financial advisor, Edward Jones. Champ praised the work of community members. “Saturday, Brian Teichgraf from Durward Jones Barkwell (DJB) Chartered Professional Accountants, brought in eight teams. Brian represents and shows us the true spirit of community engagement.” “For the past 30 years the Grimsby Curling Club has given us the facility to curl at no cost and that has allowed us to raise almost $600,000.” That translates into 600

kids in the community matched with a mentor. Currently BBBS supports 1,000 youth with 200 on a wait list to be mentored. “We always need volunteers.” The newest and

The speaker was a special guest from the Royal Botanical Gardens (RBG). “This was our first group member appreciation luncheon,” said Angela Calixto,

president of the Lincoln Garden Club. “It’s one of the ways we have of saying ‘thank you’ to the members, because they really do help out.” That day the club honoured the accomlishments achieved through the hard work of its members this year. Among these achievements was the completion of landscaped gardens at Lincoln’s town hall.

“We had a ton of food, a ton of fun and a ton of dessert,” said Calixto. “It was very wellreceived.” Members took home free poinsettas as a Christmas gift from the club. The day also served as the club’s Annual General Meeting. The members voted for their 2020 board. Some members were reelected to their position, including Calix-

Toonies for Toys back for another year A couple of toonies will go a long way in Smithville right now. Until Dec. 9, the “Toonies For Toys” campaign will be in businesses throughout West Lincoln and during the Santa Claus Parade, coordinated by the West Lincoln Chamber of Commerce. Helpers will also walk the parade route with the “Toonies For Toys” milk bottles, collecting Toonies and any other change from generous members of the community. The West Lincoln Chamber of Commerce has distributed donation bottles throughout the community. The chamber has set out to with a goal to beat the $3300 they raised last year through this program.

All donations will go towards helping buy toys and give other assistance to families who need it this time of year. Those interested in participating in the

“Toonies for Toys” campaign can call the West Lincoln Chamber office at 905-9571606. If everyone give gives a little, it will help the cause considerably.

To committee of the whole, or not Grimsby Council got into a little debate Monday night about how to structure their 2020 budget process, namely, they are considering implementing a committe of the whole process. This process would somewhat remove individual department reviews and bring all matters through the committee of the whole sessions, which are open to the public and include all members of council. The upside of this process, as noted by CAO Harry Schlange, is all members of council will be privy to the wants and needs of all departments as the process evolves. As well, any sub-committee members who want to have input, would have full access to all documents and information up for consideration and could attend committee of the whole meetings to give their thoughts and views. Simply, committee of the whole is a great way to go. Lincoln has used it for years, too. M.W.

Hear that? It’s MPAC rollin’ down the track A couple of things to touch on, so let’s jump in. Yes, there is a new filing in the $18 million civil claim regarding the biodigester in Grimsby. No, I am not going to add a single thing to it. All docs – the claim, the defence and reply - are all on our website. You can read all to your heart’s content and hopefully we’ll see this issue coming to a courtroom not-so-close to you soon. ******* Number one this week is the looming spectre of new valuations to come from MPAC. If you don’t know who MPAC is, you will soon. The Municipal Property Assessment Corporation are the friendly folk who determine how much your property is valued at, a key component when it comes to arriving at how much each property owner will pay in taxes. West Lincoln got its first look (and conversation) about it Monday night with a delegation giving an overview of the upcoming process. Normally, and what is “normal” anymore, an MPAC valuation is not an earthshattering thing. Assessments are rolled out every four years. Usually, in that window of time values don’t fluctuate massively, but it can happen. Case in point was post2004 when Greenbelt legislation was announced. Property in Niagara West, especially Grimsby/Beamsville, shot up 20-25 per cent in the space of six months. The MPAC rolled through on the backend and taxes jumped significantly. In the last four years, Grimsby Lincoln and Smithville have seen major intensity on residential growth

MIKE WILLISCRAFT all timed prior to and after the greenlight being given to GO Transit coming to Niagara. When the station for Grimsby was announced, housing prices in town jumped another 15-20 per cent almost overnight. In the last couple of years valuations have continued to climb. Lincoln and West Lincoln, too, have had major developments come on line with even more in the hopper. This area is one of the hottest real estate markets in Ontario and the next round of MPAC valuations will show that. So why do I mention this now? I can guarantee you, there will be people literally taxed out of their homes. Seniors on fixed incomes and young families dancing on the poverty line will have their household incomes snowed under. It will be no fault of their own. They won’t have moved into a house they could not afford. Indeed, some folks may live in the only home they have ever known, but land values will have gone up all around them and economic tide will wash them away. I saw many examples of this in the early 90s in Rideau Twp, south of Ottawa, when I was working there. MPAC assessments came out when the proposed new

Hwy. 16 connection from Ottawa to Prescott was rolling right by Manotick, home of one of the community newspapers I served. Many seniors who lived in very modest homes on the Rideau Canal (which ran through town) were priced out their homes to the extent where the municipality agreed to register taxes owing on title, so people could live in the homes until they chose to sell. At that time, taxes owing were taken from sale proceeds. Rural West Lincoln will be susceptible to this as will some homes in Grimsby as I think they will see the largest swings in their property values. It is not pretty. So while many of you will have been wringing your hands in anticipation of your property value continuing to escalate, the day of reckoning for that windfall approaches. ******** Coun. Randy Vaine made a couple of points Monday night at council regarding the proposed expansion for Peach King Arena. While he noted his comments were somewhat in response to a Letter to The Editor in last week’s edition, he said it was important to clarify that the elements of the grant submission were based in the recreation Master Plan which was initiated last year and rolled out in the early summer. Simply, “needs” were based on considerable input from residents. I can say, Master Plans are not simple reports or documents. They are extremely comprehensive. As well they should be, given that they are expected to provide a road map for about 20 years of planning for the department for which they are created.

Another example, the reply claims was the failure to ensure “a site plan was completed by engineering professionals before construction commenced, or at all, and their failure to do so led directly to ponding, flooding, equipment damage, and drainage issues that added costs that otherwise would have been avoided, contributing to the damages suffered by the Plaintiffs.” Another major point surrounds disclosure to the Town of Grimsby and council, which is the shareholder of the hydro operations. The reply states that the defendants claim that all actions were

authorized by the Town “is simply not true.” The reply claims information which was provided to the Town was made difficult to access, was incomplete or “was deliberately misleading.” As an example, a July 2018 verbal update to council is cited when “at a time when the project was failing” council was promised dividends were pending. None were forthcoming. “Indeed, the Defendants, in the Statement of Defence, continue to contend that the project investment would have been recovered. This is simply not true; it would never have been recovered.” Now, a judge will consider the merits of the case to determine if it will proceed.
