Dear Lynn, What’s going on here? Please, explain this to me, please. I had a buyer for my house; the house was being sold “as is.” The buyer had a home inspector come and right out of the blue the buyer wants me to fix some stuff or lower the price of my house. I said, “No way,” I am not doing anything. So, then I get this paper that says they do not want the house anymore and they want their deposit back. $5,000! I said no way! I am selling my house “as is” and that means I am not fixing anything. They knew that when I listed it. I’ve been through a lot of stress and even told people it was sold and now this? I am keeping that deposit and no one is going to change my mind!

I will assume that you signed a Purchase and Sale Agreement for the sale of your home. The first thing you need to do is read that agreement and see what it may say about a home inspection contingency. If there is a deadline stated there then that would mean that the buyer has until that contingency date to have a home inspection and other types of “tests” such as lead paint, radon, sewer. Should the buyer decide that findings on any of those inspections and/or tests is a concern then the buyer may ask for repairs or a concession or may terminate the offer. Within your purchase and sale agreement it may state that the buyer

is entitled to their deposit being returned provided the termination in submitted prior to the end of the contingency date and time.
So, even if a real estate listing states “as is,” the buyer is still entitled to a home inspection and still has the right to terminate and receive their deposit back.

You’ll be amazed how much a super clean house has great appeal both to the eye AND the nose. Next, make sure all trash has been removed. 3, Open windows and let the fresh air in. And another, fish is probably not the thing you’ll want to cook before a showing. Lastly, if you want to do the old age practice, buy some ready to bake cookies and toss a few in the oven before the house is shown.
