New York State Department of Environmental Conservation Notice of Complete Application Date: 03/30/2021 Applicant: JAMES MURRAY Facility: MURRAY PROPERTY 839 OCEAN ST/SCTM #l03-25-3-97 LINDENHURST, NY 11757 Application ID: 1-4720-03744/00004 Permits(s) Applied For: 1 - Article 25 Tidal Wetlands 1 –Article 15 Title 5 Excavation & Fill in Navigable Waters I - Section 401 - Clean Water Act Water Quality Certification Project is located: in BABYLON in SUFFOLK COUNTY Project/ Description: Applicant proposes to replace a 23 linear foot, non-functional bulkhead where the mean high water is ten feet landward of the dilapidated bulkhead. That 10'x23' area will be filled in with both trucked-in clean fill and dredged spoil. The new bulkhead will be installed in-place, raised six inches, and one five foot return will be added. Maintenance dredge the area up to ten feet seaward of the bulkhead to a maximum depth of-4 MLW. Dredged spoil will be placed behind the new bulkhead. Establish a 690 square foot vegetated buffer that will be planted only with native species. Add a four foot by thirty foot gravel path with stepping stones through the buffer. The project is located at 839 Ocean Street (formerly 843 Ocean Street), Village of Lindenhurst, Suffolk County. SCTM# 1 03-253-100.05 (formerly 103-25-3-96). Availability of Application Documents: Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed. SEQR lead Agency None Designated State Historic Preservation Act (SHPA) Determination Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required. Why does NY State have such restrictive guidelines for animal hospitals?

We enjoy having you there too.

The NY State government has put detailed guidelines in place for all businesses, not just veterinarians. For example, medical facilities are required to screen patients before admitting them into the facility.

However right now we are required to follow guidelines issued by New York State that state “Curbside intake and pickup of animals should be used, wherever practical, to minimize the numbers of clients in waiting areas and exam rooms.”* Although that creates a lot of extra work for our staff, we are committed to complying with the NY State safety guidelines during the COVID-19 crisis, and to protect our client’s health and safety. *Exceptions can be made in situations like euthanasia

Are these still necessary? Restrictions are lifted on other things. By July 2020, restrictions like curbside check-in have helped reduce the number of people diagnosed with COVID-19 in New York State down from over 10,000 a day to below 1,000. At the same time we have seen infections rise dramatically in other states who had fewer restrictions.

Protect Your Pets With FRONTLINE AND HEARTGUARD

The government has lifted restrictions where it is essential to get other parts of the economy restarted, but we don’t expect to see change for a while on safety measures like curbside check-in that have been seen to be effective.

Curbside check-ins is inconvenient for you and creates a lot of extra work for our staff. It’s hard on all of us. We don’t get to see you like we used to.

Legislative Intent. §174-2. Definitions. §174-3. Permit Required. §174-4. Permit Application. §174-5. Standard of Review §174-6. Fees. §174-7. Penalties for offenses. §174-8. Severability. §174-1. Legislative Intent. The Board of Trustees has determined that it is necessary to regulate the distribution and sale of food vendors who operate on a temporary basis at a fixed location that are not otherwise regulated by Chapter 129. Issuance of a permit for persons or organizations engaged in the above-mentioned activities is required for the protection and maintenance of the health, safety and welfare of the inhabitants of the Village. SPONSOR The person or organization that organizes, controls and manages the event at which a temporary food service establishment provides food service. TEMPORARY FOOD SERVICE ESTABLISHMENT An individual food service establishment operating from a booth, stand, vehicle, or cart, in a fixed public or private, indoor or outdoor location, at an event, where foods are stored, prepared or held for service to the public. A temporary food service establishment shall also mean a person who vends, dispenses or distributes pre-packaged or other nonpotentially hazardous foods from a container or other equipment approved by the Village Administrator or his designee that is carried upon his or her person at an event. §174-3. Permit Required. It shall be necessary for any individual or organization that wishes to operate as a temporary food establishment to acquire a permit from the Village Administrator or his designee approved by resolution of the Village Board. §174-4. Permit Application. Every applicant for a permit is required to submit to the Village Administrator or his designee a written application supplying under affidavit the following information at least ten (10) days prior to the time in which they wish to use the permit: that he is a citizen of the United States; that he has

On all applications to the Village Administrator for permits in addition to other specific requirements, the Village Administrator or his designee shall consider the health, safety, convenience and general welfare of the Village. Any issued permit is subject to revocation by the Village Administrator or his designee, and any requested permit may be denied in the event it is determined the use is the subject of legitimate concerns for the public’s health, safety

§174-6. Fees. The amount payable by each applicant shall be established by resolution of the Village Board. §174-7. Penalties for Offenses. Any person, association, partnership or corporation violating any provisions of this chapter shall be guilty of a violation and shall be punishable by a fine of not less than $250 and not more than $1,000 for each violation, or by imprisonment not to exceed 15 days or a combination of both. §174-8. Severability. If any clause, sentence, paragraph, section or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in said judgment. Validity. If any section, sentence, clause, or phrase of this law is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this law. Contractors For Kids (CFK) is a non-profit organization, which was founded for the purpose of providing assistance to families in Long Island communities. Their goal is to assist children and their families overcome obstacles that have unfortunately changed or have impacted their lives through the sickness, injury or death of a child. They are committed to this cause and want to give hope and reassurance for the futures of Long Islanders. CFK was founded in 2005 by Kevin Harney and Alan Nahmias of Stalco Construction. Kevin and Alan, both long-time philanthropists, saw the growing need for financial assistance in our communities and knew that something more needed to be done. Through random acts of kindness, they were slowly changing the lives of others, however they thirsted to make more change so they decided to form this non-profit, Contractors For Kids. The Board of Directors, members, supporters and volunteers of CFK are all “Contractors For Kids.” They are all helping others and building futures for children and their families in need. Their organization runs on donations only and is volunteer based, they have no employees. One family at a time, they make sure that the financial hardship brought on by sickness, injury or death does not destroy an already hurting family.
