Walvis Bay Airport expects first commercial flight on 14 October
Covid-response now handled by Public Environmental Health legislation Namibia's Covid-19 response is now governed by the Public and Environmental Health Act (Act 1 of 2015). The first regulations in terms of this act was published on Wednesday (Government Notice 233) which among others continues to enforce basic non-pharmaceutical interventions (wearing of face masks in public) compulsory. The regulations further make provision for the following:
“Even our attorney that usually advises us on the Covid-19 regulations, and how it affects travel, is confused”. This is how a local travel agent described the situation around the new regulations on Covid-19 measures. With the Covid-19 State of Emergency that lapsed last Thursday, new regulations announced under the Public and Environmental Health Act governs Namibia’s Covid-19 response. These new regulations is somewhat confusing if considering the do’s and don’ts for tourists entering the country. “We are waiting to see if the arrangements remain the same where tourists can enter the country (with a Covid-19 test not older than 72 hours), for the persons then to proceed to their first destination where on day 5 they get re-tested and the results available on day 7”. This is not clearly defined in the regulations, so we hope to have

Foreigner working for Jan Japan and police officer arrested for bribery A police officer attached to the criminal investigations unit of the Namibian Police at Walvis Bay and a Pakistani national were arrested by the Anti-Corruption Commission in Swakopmund, after they bribed a public prosecutor at the Swakopmund magistrate’s court. In a report the Police says the duo approached the public prosecutor to return a passport for an individual against who a criminal case is pending. The person’s passport was handed in, hence they needed to bribe the prosecutor to return the passport. Continues on page 2
*Face masks are compulsory in public places. A see-through face shield is also permitted, but it may only be worn with a face mask covering the mouth and nose. A police officer (either as a member of the Namibian Police Force or of a Municipal Police Force) can instruct a person to wear a face mask in public if the person is not complying. The person can be prosecuted if her or she refuses such request. (Whenever a person is refusing to wear a face mask in a place like a shop, he or she can be requested to leave such place as right of admission empowers the owner or manager to request such a person to leave the premises. The assistance of the Police can be called in as well). *Public gatherings: people can gather up to the number of 50 persons (51 means an illegal gathering). According to the regulations, the number of people can exceed 50, but only under the following conditions: *When the gathering constituted people from the same household gathered at their place of residence. That means people of one family, who live at different houses, can gather at one family member's residence, as long as they don't exceed the number of 50. *People working at the same workplace can be more than 50. *Gathering of people at a government institution (national, regional or local) or Cabinet or Parliament, as long as that gathering constitutes normal operations. *Gatherings for purposes of court or tribunal proceedings. *Gathering for the purposes of education and training at early childhood development centres, schools, or institutes of higher education. *A group of persons who coincidentally find Continues on page 2

New elevator for Antoniuz Residenz Sharlien Tjambari The Antonius Residenz (old age home) boasts a new elevator. Work started by Schindler Lifts Namibia on 29 June this year, to remove dismantle the old elevator, which was installed approximately 51 years ago. The new elevator was installed without trouble and launched on Wednesday. Kai Pritzen, the Regional Manager of Schindler Lifts Namibia said: “It was not a hard job to dismantle and install the new lift as it only took us a month. The biggest challenge was getting the government officials here for inspections, because of the lockdown period. We finally got them here when lockdown was lifted last week and with the inspection done the work could be concluded”.
Woman overpowered and gang raped by four men A 23-year old woman was robbed and gang raped in an incident in a deserted area in Mondesa in Swakopmund on 19 September. As Namibia opens following months of a Covid-19 lockdown and restrictions, violent crimes against vulnerable groups reemerge. The alleged rape incident occurred on a deserted plot of land between the Vrede Rede Primary school and Festus Gonteb Primary school between 05:00 and 06:00 in the morning. According to the Namibian Police's Police Regional Crime Investigations Coordinator, Deputy Commissioner Erastus Iikuyu, the victim was on her way home from a friend's house. The victim alleges a man approached her and demanded her cell phone. Instead of complying, she physically resisted the man. As the scuffle was continuing, three more males allegedly approached, overpowered the women, held her down and two of the suspects then raped her. The suspects then fled the scene. The Namibian Police is appealing to anyone who might have information regarding the incident to contact. Deputy Commissioner Iikuyu at 081 246 4757 or Detective Chief Inspector Shangula at 081 667 6820 or the nearest police station. Iikuyu says the information will be treated with strictest confidentiality.
AR says “away” with Bernhard Esau Street
The Affirmative Repositioning (AR) movement in Swakopmund says it is liaising with the relevant authorities to have Bernhard Esau Street in the holiday town removed. Bernhard Esau is Namibia’s former fisheries minister who is currently in custody with other accomplices in the #Fishrot case. #Fishrot is an alleged plot which involved fishing quotas for bribes, with Esau and former justice minister Sackey Shangala the alleged masterminds. The AR is going to participate in the upcoming local authority elections in both Swakopmund and Walvis Bay and is working towards political diversity in Namibia. Namibia’s political landscape has been dominated by the Swapo Party for three decades since Independence, but has seen a sharp decline in support in Erongo since the November 2019 Presidential and National Assembly Elections.
182 fishermen gets new lease on life at Tunacor A total of 182 fishermen of the now dissolved Namsov Fishing Enterprises were re-employed by Tunacor Fisheries. The fishermen form part of 1 000 fishermen believed to have lost their jobs in recent years due to the #Fishrot scandal through which fishing quotas were offered to a foreign fishing company in exchange for bribes. The #Fishrot scheme resulted in Namibian fishing companies having to close down because their quotas were taken and dished out to the foreign company. Tunacor Fisheries has received a fish quota from the Namibian Government to be able to create employment opportunities for these fishermen.

Tax implications both the employer and employee should consider........... Are you thinking of downscaling or closing down your business and have to retrench employees? Or are you close to your retirement age and expect severance pay to be paid out by your employer? As employer and employee, you should consider the tax implications of these amounts paid / received. As an employer you are obliged to withhold Pay-As-YouEarn (“PAYE”) on all remuneration paid to employees. Amounts paid to employees for “relinquishment, termination, loss, repudiation, cancellation or variation of any office or employment or of any appointment” are specifically included in the definition of “remuneration”. This means that such payments made by the employer are subject to PAYE. An exemption of N$300 000 will apply provided the following conditions are met: *The employee is 55 years or older; or *The employee was dismissed as a result of superannuation, ill-
health or other infirmity; or *The employee was retrenched due to his/her employer downsizing the business or closing the business. The N$300 000 is for the employee's lifetime, can only be used once and does not apply separately to consecutive retirements/retrenchme nts. The employer should request and obtain a tax directive from Inland Revenue who will indicate the amount of PAYE to be withheld on the payment to the employee. On retrenchment payments, Inland Revenue also requires the office of the Labour Commissioner to confirm the employer's retrenchment program. If the termination of the services of such em-
ployee is due to retirement, ill-health or other infirmity and the amount paid out is more than N$300 000, the remaining amount may be taxed in three equal instalments in the year of payment and the two following years. Tax deductibility of severance payments by employer: Severance payments that are actually incurred, are deductible from the taxable income of your business. The term “actually incurred” implies you either already paid the employee, or they have already been dismissed and you have an unconditional obligation to pay the severance pay. A provision for possible future severance payments that might be incurred are conditional

Man dies in front of nightclub shortly after being stabbed with broken bottle in the neck A young man died in front of a nightclub in Swakopmund on Saturday night, shortly after he was stabbed in the neck with a broken bottle by another man. Raynes Raimanu Bekeur (28) was allegedly stabbed by a certain Shawn van Wyk (26). Horrified onlookers saw this violent incident unfolding. As Namibia's Covid-19 lockdown and restrictions were lifted, people return to public drinking places where many behave unruly and violent, often leading to incidents of assault, attempted murder, murder and sexual related crimes. Van Wyk was arrested at the scene and earlier this week made a first appearance in the Swakopmund magistrate's court on a charge of murder. Van Wyk remains in custody and returns to court on 25 November 2020.

Filing of individual income tax Debonairs Walvis Bay CBD returns extended to 1 March 2021 Seasoned income tax official Sam Shivute to head the Revenue Agency Individual taxpayers have till 1 March 2021 to file their income tax returns on the Ministry of Finance's new Integrated Tax Administration Systems (ITAS). The initial extension was from 1 March 2020 to 30 June and then it was again extended to 30 September. The additional extension was to provide employers the opportunity to file outstanding Returns for Remittance of Employee's Tax (ETXtemplate/Excel sheet). The Chief of Public Relations in the Ministry of Finance, Tonateni Shidhudhu, explained the ETX template/Excel sheet has to be filed by Employers first, Without that, it does not help employees file their individual tax returns, as the ITAS system needs to compare the Return For Remittance of Employee's Tax against the tax return filed by the employee. Shidhudhu added: “The previous deadline was 30 September, which was initially extended from 30 June. This extension only applies to the filing of returns, but not to the payment of tax which may be due by or after 30 September�.
Meanwhile, it was announced this week that Mr Sam Shivute, will become the founding Commissioner for the Namibia Revenue Agency that will be launching soon. Mr Shivute has extensive experience as official at the Bank of Namibia and served as the Acting Commissioner for Inland Revenue in the Ministry of Finance. The Namibia Revenue Agency will essentially become the revenue collection arm of the Ministry of Finance for income tax and customs revenues. The Namibia Revenue Agency will be autonomous and is not a division of the Ministry of Finance.

Antonius Residenz Old Age Home launches new elevator after 51 years Sharlien Tjambari
51 Years ago, on 25 December 1969, the first elevator was installed at Antonius Residenz. On 29 June this year, Antonius Residenz Old Age Home dismantled the old elevator to make place for the installation of a new one. Yesterday, 23 September, Antonius Residenz Old Age Home launched their brand-new elevator. According to Vera Kutzner, the Acting Manager of Antonius Residenz, the new elevator has a capacity to carry 17 persons and can carry the weight of 1275kg. Antonius Residenz Swakopmund dates to 1907 and was first used as a Catholic Hospital until 1987, when it became government offices. The building was converted to an old age home in 2001. Antonius Residenz Old Age Home has 30 apartments and 2 floors, excluding the ground floor. Dismantling and installation of the new elevator took the Schindler Lifts Namibia group a month to complete. Rossmund up and running again The Rossmund Golf Club is up and running again and is look forward to seeing each and every one of you back on the golf course.

What a fantastic day we had on the golf course with perfect weather, sunshine, slightly overcast and minimum wind followed by that much missed cold beer/wine in the clubhouse to close off a great day of golf. The Monthly Sages Competition sponsored by Namibia Tracks & Trails was held on Sunday 20 September. The field was good with 25 players braving the cooler weather conditions – but a great day was had by all and what a super experience to be back in the clubhouse to enjoy the camaraderie. The Winner on the day was Bubble Burns with an excellent 38pts; 2nd: Hans Ovlisen 36pts (c/o) over Achmet Abrahams; 4th: Barbel von Klitzing 35pts (c/o) over Bertie Saunderson. There were 2 x 2-clubs both going to Tony Boesch on No.7 and No.12. Rossmund Golf Club is really thankful to the Gruttemeyer Family (Jockel; Mocha & Wiebke) for their ongoing sponsorship especially in these trying times in the tourism industry. A bit of information from the Committee Meeting held on Tuesday 22nd September: – It was decided to put the 2020 Match play Competitions on hold for this year - as it was felt there will not be sufficient time to play the tournament The junior development program will only recommence in 2021 – due to the tight school schedules in place for the remainder of the year. We were advised by NAGU that all their remaining tournaments scheduled to be played in 2020 have
been cancelled. The Summer Swing is still on the program and is expected to be played on 3 December. Destination Swakopmund will still hold a year end tournament on Friday 11 December. The Novanam Monthly Medal will resume – however due to unforeseen circumstances there will be no Medal Master crowned for 2020. As with everyone we are still finding our feet with the so called “new normal” the official Wednesday Competitions at Rossmund will kick off again on 7 October. The management, staff and all players at Rossmund Golf Club would like to congratulate Club Chairman- Marco Swarts on his appointment as the Vice President of the Africa Golf Confederation. Take care and remember to follow the protocols still in place. Rossmund Bowling Club Singles Tournament Rossmund Golfer gets top seat in Africa Rudi Bowe After a long wait for the lockdown to end, Rossmund Bowling Club hosted their 2020Club Singles Tournament with 8 men and 4 women bowlers at their bowling lawns last weekend in Swakopmund. The competition, sponsored by West Fire Training & Consulting was very tough and fielded a very high standard of 8 men and 4 women single players in the coastal town. In the women's final Bianca Lewis beat her sister Diana Viljoen (the defending champion) in the final round 21-19 to be crowned as the 2020 women's single champion. and Graham Snyman was crowned the 2020 single men's champion after he beat Axel Krähenbühl 21- 15 in the final. The two Singles winners will represent the Rossmund Golf Club at the National Champion of Champions next month, where they will fight it out for the Singles trophy, competing against all the champions from all bowling Clubs in Namibia and to be crowned as the Namibian The Singles winners of Rossmund Golf Club are Singles champion in the men Graham Snyman and Bianca Lewis and women sections.

Coastal golfer has been elected in the second highest position for Golf in Africa. Marco Swarts the General Manager of Corporate Services and Human Capital at the Swakopmund Municipality – the President of the Namibian Amateur Golf Union and Chairman of the Rossmund Golf Club is elected as the new VicePresident of the Board of the African Golf Confederation to replace reigning Vice President Naadir Agherdien who took a leave of absence due to medical reasons. Mr Swarts said “It is a special honour for me to serve golf through the Africa Golf Confederation and in Namibia. I am excited at the opportunity to build on the great work of my predecessors and deliver on our objective to grow the game of golf in Africa.” The Africa Golf Confederation (AGC) is an umbrella organisation dedicated to promoting golf on the Continent of Africa. Formed in 2001 and affiliated to the world governing body for golf, the Royal and Ancient Golf Club of St Andrews in Scotland, the AGC organises a number of national and regional events in conjunction with the host national bodies. The President of the Namibia Golf Federation Janneman Brandt said that “We applaud the
appointment of Marco and he will have the full support of the Namibia Golf Federation as he steps into his new role, and we have no doubt that he is ready and prepared to face the challenges ahead.”
