Langer Heinrich and Mineworkers Union at loggerheads over retrenchment packages Floris Steenkamp Langer Heinrich Uranium (LHU) and the Mineworkers Union of Namibia (MUN) reached a deadlock over the payment of retrenchment packages to employees, following a decision to place the mine under a care and maintenance program for an undisclosed period of time. Placing the mine under care and maintenance not only means massive layoffs but suppliers to the mine were also shown the gates, meaning more retrenchments downstream. LHU in April announced it would not resume uranium mining once its stockpile of ore runs out by mid next year. The weak market price for uranium is the major factor in this decision. After the announce-
ment, LHU and the MUN engaged in several meetings. Although MUN accepts the mining company is financially in dire straits, it disagreed over the retrenchment packages, particularly severance pay-outs, according to documents placed in the hands of namib times. LHU in the meantime reported the matter to the Ministry of Labour and the case was referred to the Office of the Labour Commissioner, according to the documents.
·During the meeting between Langer Heinrich and MUN it transpired once the mine is placed under a care and maintenance program, operational costs would drop to between N$36 million and N$60 million per month. Once economic conditions improve for the uranium mining industry, the process to start up again would require between six and twelve months to accomplish, at a current estimated cost of up to N$450 million.

The Director of Maritime Affairs Pinehas Auene revealed this week two vessels were identified as the possible culprits in an oil spill at Walvis Bay in March this year. Auene revealed this yesterday at an Oil Response and subRegional Shoreline Response to Oil Spill workshop at Swakopmund. Auene said major contributing factors to the risk of oil spills in Namibia's marine environment are: lack of proper funding of oil spill readiness infrastructure and training, the need for a new and updated marine pollution contingency plan and incomplete ship management practises. Auene stressed on the importance of having sustainable funding mechanisms in order to have a quick response in cases of oil spills as poor or lack of funding for such projects, hamper the rate at which oil spills are cleaned up as well as the investigation into what caused the oil spills. “Until today, we do not know who was responsible for the oil spill which happened in Walvis Bay in March. This is because even with the clean up, we had to get money from the Office of the Prime Minister as there weren't funds available in our department”, he said. Ministry of Works and Transport Spokesperson Julius Ngweda, shared Auene's sentiments and said that funding is not only needed to facilitate investigations, but also to secure quality machinery to clean the oil spills. He further stated: “We had hoped to get new machines in this financial year, but due to budget cuts we are unable to. The machines we currently have in Walvis Bay are worn out and outdated and that is a problem”. In response to a question on whether they have found the culprits responsible for the recent oil spill, Ngweda told the namib times that investigations are still underway and that two possible ships have been identified as the possible causes of the oil spills. He said that they are busy gathering evidence and will only approach the alleged culprits once they have concrete proof. He however said, that despite the challenges faced they are ready to deal with the consequences of two oil well drillings set for September and December this year in Walvis Bay and Lüderitz by Tullow Oil and Chariot Oil and Gas respectively. Tullow Oil has contracted the Ocean Rig deep-water drillship Poseidon to drill the Cormorant prospect in Walvis Bay, as is due to spud the well in the PEL 37 license on September 1.

Ohorongo Ensures Non-recyclable Materials Does Not End Up In Landfills

Many towns in Namibia are currently struggling to properly dispose of plastics and other non-recyclable material, which merely ends up in rubbish dumps and in landfills. This is detrimental to the environment and the health of Namibians countrywide. Plastic carry bags, for instance, takes between 10 – 20 years to decompose, while items such as Styrofoam cups takes up to 50 years before it is broken down. The Managing Director, Mr. Hans-Wilhelm Schütte, made this commitment, saying that this forms part of the company's contribution towards Namibia's quest to become the cleanest country in Africa. H E President Hage Geingob recently identified 25 May 2018 (Africa Day) to be reserved for a nationwide cleanup campaign, where all citizens are expected to participate in cleaning up their respective neighbourhoods. In 2017, the company entered into an agreement with Rent-A-Drum to supply & deliver selected and processed non-recyclable material to Ohorongo, which is used to burn as alternative fuel in the kiln during the cement manufacturing process. This reconfirms the company's commitment towards the environment and keeping Namibia clean. “We purchase the processed material and burn it along with other alternative fuels to fire the kiln, which is a key process of cement manufacturing. The kiln has gas temperatures of up to 2000 Degrees Celsius, which guarantees complete combustion and the destruction of all organic substances, resulting in no harmful emissions,” said Schütte. The move by Ohorongo to become part of the solution to keep Namibia clean has created in excess of an additional 80 jobs at Rent-A-Drum's Refuse Derived Fuel (RDF) processing plant outside Windhoek. The waste management company collects recyclable and non-recyclable materials at its centres in Khomas-, Erongo- and Oshana regions. Schütte added that “burning non-recyclable materials in the kiln will not affect the cement quality, as only non-hazardous material is utilised during this process and all activities are done in a sustainable manner, without compromising on quality or the safety of the environment.” During the planning and establishment phases of the cement manufacturing plant, the usage of alternative fuels was foreseen, and technical equipment, including the filtering systems, have been designed and built accordingly. The aim is to replace up to 80% of the fossil fuels with alternative fuels. RDF is the third alternative fuel in Ohorongo Cement's fuel mix, as the company has been using other alternative fuels, consisting of wood chips from encroacher bush, and charcoal fines since 2011 and 2015 respectively. Besides this commitment, the company will support the nationwide initiative and has made a contribution of gloves, rakes.

Africa Day – a day for SME's to reconsider their potential for our continent Contributed In light of Africa Day on the 25th of May, more African small and medium enterprise (SME) owners should be encouraged to look at how they could expand their operations into the rest of the continent. This is according to Mark Paper, Chief Operating Officer at Business Partners International (BUSINESS/PARTNERS), who says that Africa has for long been regarded as a region with untapped economic opportunity. “The African Development Bank1 reports that the economic growth in Africa is set to accelerate to 4.1% over the course of 2018 and 2019, which can potentially yield benefits for SMEs.” Paper points out that entrepreneurs should however firstly consider that each of Africa's 54 countries represents a unique market with differing challenges and intricacies for doing business. “The various economies, laws, languages and cultures need to be thoroughly assessed as part of the entrepreneur's expansion plan, which should be structured around the target region's strengths, weaknesses, potential opportunities and threats.” He says that once the enterprise is ready to start operations in a specific region, the entrepreneur needs to ensure that the regulatory requirements of the region are adhered to. “It is crucial to conduct due diligence and understand all relevant regulations. Most of the companies that make mistakes during this phase find themselves facing massive fines or potentially devastating legal action further down the line.” According to Paper, the information that should be at the entrepreneur's fingertips include the required permits, business and property registration processes, credit requirements, tax legislation, labour market regulations, and local content requirements. He adds that the entrepreneur should also know which laws are in place to protect foreign investors. “Developing robust contracts and using local attorneys to ensure that contracts can be enforced under local laws is therefore imperative.” Next, Paper says that it is essential to have a strong local presence, knowledge of the local market, and an understanding of customer expectations. “Employing workers from the region can potentially be one of the best ways to support the company's operations. It will not only benefit the business and its reputation, but the local economy too.” He notes that finding the right employees, creating cohesive teams and implementing skills training within the organisation relies heavily on understanding the culture of the region, and being able to effectively work around the potential language barriers. “It could help to consult local human resources firms and hiring agencies with strong track records in the region.” Another point for entrepreneurs to consider, is whether the country has reliable electricity supply, says Paper. “Electricity supply continues to be a challenge in various countries, and there are many regions that only receive electricity from their national power grids for a few hours per day. Where necessary, the entrepreneur will need to budget for the installation of generators, or even consider signing contracts with mobile fast-track power suppliers who can operate and maintain their own generators on the business's property.” While entrepreneurs need to consider a number of aspects when expanding across borders, he adds that the rewards for getting it correct are significant, and that the perceived challenges should not deter entrepreneurs from taking the leap, rather serving as a reminder of the amount of research that should be conducted beforehand.” “Africa is open for business. All it takes is enough drive, passion and perseverance to tap into its growing markets,” Paper concludes.

Remember to do your bit for operation clean-up tomorrow Namibians across the country will tomorrow answer the call of Namibia's Head of State, Dr Hage Geingob, to clean up neighbourhoods, towns, the city and even our country's national roads, beaches and protected areas.
The local authorities in the three central west coast towns of Walvis Bay, Swakopmund and Henties Bay, and also other urban areas across Erongo, have projects in place for today for operation clean-up. As it is the first year that a national clean-up campaign is launched, not only on such a scale but also the fact that it is now part of the annual Africa Day celebrations, there might not be as many businesses, non-governmental bodies and individuals taking part as what we wanted. However, that does not mean you cannot do your part tomorrow. Wherever you find yourself today on Africa Day, be that along the beach, somewhere at a picnic spot or even walking in the street or staying at home resting: you can clean up. Gestures from as small as walking your street block and picking up rubbish or organising in family groups to clear up litter - every inch of the effort is worthwhile and will contribute to a positive outcome. On the pictures herewith: DHL Namibia's Walvis Bay branch celebrated its 3rd Clean Up day on 12 May this year. The fact that the national clean-up day coincides with a public holiday did not deter this energetic group of staff members to congregate on the beach at Langstrand and do some serious clean-up. The emphasises this year was on plastics and the grave danger plastics holds for our world's oceans. Large volumes of plastics were collected by DHL staff from the beaches and there were even those who braved the cold to retrieve floating plastics from the shallow surf line.

The ambassador addressed all those present on the importance of Medical Male Circumcision as well as the health benefits of getting the smart cut. The Dogg is on a campaign driven in the Erongo region and will be having charity shows in the aid of spreading the smart cut message. Speaking at the information session, Mr Tino Hanabeb,

Veteran traffic chief challenges Walvis Bay traffic chief Eben Platt on “spotlights” issue:
Walvis Bay traffic police to appeal 'spotlights' case The Chief Traffic Officer of the Walvis Bay municipality Mr Eben Platt says the town's magistrate's court made a wrong decision to strike two cases about the alleged illegal mounting of spotlights on vehicles off the court roll. Then Mr Platt told an English daily, his department would appeal this decision, as it is wrong and misleading. He explained that such summonses would be issued within the next two weeks to call back to court the accused persons for a proper hearing. I would like to know from Mr Platt the following: The Minister of Transport, in terms of GOVERNMENT NOTICE, No. 282 Promulgation of the Road Traffic and Transport Act, (Act 22 of 1999), which reads as follows: “ (1) For the purposes of this Act, the Minister may, subject to the Public Service Act, 1995 (Act No. 13 of 1995), and on such con-
ditions as the Minister may determine, appoint such persons as the Minister may consider necessary to be – Section 11, (d) traffic officers; And as Peace Officers in terms of Section 334 of the CPA, 1977 (Act no 51 og 1977) appointed as a Municipal Traffic Officer. Mr Platt, this refers to the two cases which were struck from the roll in the Walvis Bay Magistrates court, and which were issued by a Nampol Traffic
Officer” Therefore, Mr. Platt, you have no powers and jurisdiction in these cases. Only Nampol and the public prosecutor can appeal against it. You are acting inconsistently within your powers and jurisdictions. You and your department would appeal the decision because to you it is wrong and misleading. Mr Platt, does your Council know you made unlawful comments in the newspaper? This sounds like an offence
and could be subjected to discipline. Mr. Platt you also said that the two accused were charged with an offence under the Road Traffic and Transportation Regulations of 2001, because of fitted lamps not prescribed or authorised under these regulations. The offence on the summonses refer to Regulation 203, r/w, Act 22/1999. Neither Mr Platt, nor the offences on the summonses, define the additional lamp/lights, which were “illegally” fitted to the vehicles. (for example, LED, LID, Hella, Hellogan ect.) It can only be assumed there is a manhunt for drivers of vehicles which are fitted with such lamps. Regulation 203, which reflects on the charge sheet on summons 3398538, clearly refers to the fitment of lamps which are not

(3) The main beam and dipped beam of a headlamp fitted to a motor vehicle first registered on or after 1 January 2002, must comply with the requirements of standard specification of the South African Bureau of Standards, SABS 1046 “Motor vehicle safety specification for lights and light signaling devices installed on motor vehicles and trailers”, and standard specification SABS 1376 “Lights for motor vehicles”, Part 2: “Head lights”. (filament bulbs) Main beam: 176. Every headlamp emitting a main beam or light must be so adjusted and maintained that (a) it must be capable of adequately illuminating an area ahead of the motor
vehicle concerned, enabling the driver to see any person, vehicle or substantial object at a distance of at least 100 meters ahead; and it can be extinguished by the use of a device which simultaneously must cause or allow the dipped beam of light to be emitted or continue to be emitted from a headlamp. NB: A certain Mr AF Potgieter was charged with the same offence (Reg 203), on the 16th of September 2015, and a case was registered under SWKCRM 4348/2015, with the magistrate, Mrs Surita Savage. The case was withdrawn with the verdict, charge defective. The verdict was given on 5 November 2015, when the magistrate clearly indicated that such charge does not exist. On 22 June 2017, a verdict of “not guilty” was given by the Magistrate of Mariental, in the case, “State versus JJ Louw”, on the charge of fitting a lamp not prescribed or authorised, in terms of regulation 203 of the Road Traffic and Transport Regulations, 2001 (GN 53 of 2001). It seems that a revengeful manhunt is going on against owners of vehicles which are fitted with LED lamps. The Permanent Secretary of the Ministry of Transport issued a Public Notice under his own signature, referring to the Ministry of Works and Transport, and not the Minister, declaring that the LED lamps are illegal. Whereby it is the sole duty of the Minister to draft and submit a regulation amendment to the governmental legal drafters for promulgation in order to declare the LED lamps illegal. The Permanent Secretary wanted to play the role of a dedicated judicial officer, but in reality, he actually misused his powers issuing
such an illegal Public Notice. I want to add the following: In case of future incidents in which a member of the public is charged with the violation of illegal lamps/ lights and found guilty, please report the matter to the line Minister, quoting Section 9 of the Suspension or revocation of registration of authorised officer, with emphasis on number 9(2) a and b.“” Suspension or revocation of registration of authorised officer: 9(1) The Minister may suspend or revoke the registration of an authorised officer, if the Minister is satisfied that the authorised officera) has committed an act of misconduct, as set out in sub regulation (2), in the exercise of his or her powers or the performance of his or her duties; or b) in capable of exercising his or her powers or performing his or her duties or is incompetent to exercise his or her powers or to perform his or her duties, as an authorised officer, in the category in which he or she is registered. (2) An authorised officer commits an act of misconduct if he or she a) contravenes a term or a condition of this or her registration as an authorised officer; e) engages himself or herself, without permission, in any activity which conflicts with the performance of his or her duties as an authorised officer; Written by: Fanie Kruger. Sie weisen den Reiter an, sitzen zu bleiben, bis das Pferd wieder aufsteht. 3. Sie stellen dem Reiter eine Beförderung in Aussicht. 4. Eine alte Überschrift hat sich letzte Woche in den lockeren Hocker geschlichen. Sie sollte nicht “Diskrepanz und Ineffizienz” lauten, sondern sollte heißen: “Die Symbiose”
Locker vom Hocker Ein Garten mit Vögeln
Liebe Küstenleser! Während Sie diese Zeilen vor sich sehen, sitze ich in einem Silbervogel unserer Air Namibia auf dem Wege nach Europa. Viel lieber wäre mir eigentlich, auf staubiger, holpriger Pad ins Erongo zu sein, um unter einer Birkenrindenakazie dem Vogelgezwitscher zu lauschen. Und wo nun gerade von Vögeln aller Art, ob nun metallenen oder organischen, die Rede ist und ich mein Reiseziel in die BetonDschungel einiger Großstädte im hohen Norden vor Augen habe, denke ich so bei mir: Welch ein Privileg ist es doch, einen Garten zu haben. Ob Sie es nun glauben oder nicht, ich freue mich schon jetzt wieder darauf, die Maskenweber, Wellenastrilde, Felsentauben und Spatzen in meinem kleinen botanischen Paradies zu beobachten, die im Vogelhaus die gestreuten Körner wegpicken. Und die Europareise steht erst bevor, haha! Ja, ein Garten bedeutet Vögel, und was wären wir ohne den musikalischen Genuss der Gesangsvirtuosen der Natur, die völlig ungekünstelt die schönsten Melodien hervorzaubern. Wenn die Heuchler dieser Welt doch nur wüßten, wieviel süßer Echtheit klingt! Wenn ein Vogel stirbt, geht mir das sehr nahe. Und was habe ich schon für fedrige “Mund-zu-Mund-Beatmungen” auf diesem einen Grundstück hier in Kramersdorf machen müssen. Nein, nein, ganz so weit geht meine Liebe nun doch nicht. Aber wie oft habe ich in meinem
Garten erleben müssen, wie zerbrechlich solch ein Vogelleben ist. Einmal fiel ein kleiner Maskenweber aus dem Nest. Er konnte noch nicht fliegen und hüpfte auf dem Boden umher. Da ich nicht wusste, in welches der vielen Nester er gehört, baute ich ihm ein warmes Plätzchen in einem Schuhkarton im Garten auf. Sein Papa kam immer mal angeflogen und fütterte ihn. Leider überlebte er die Nacht trotzdem nicht. Einmal beschloss ich, das riesige Spatzennest
nicht lange mit ansehen. Also nochmal ‘rauf auf die Leiter und Nest mit Baby drin wieder zwischen die Balken geschoben. Leider wehte in der Nacht ein starker Wind, und so fand ich am nächsten Morgen das heruntergewehte Nest mit dem kleinen, toten Gelbschnabel darin. Bisher hat noch kein
