Kurt Shoemaker and the team from CBRE will present the Annual State of The Industry Report for 2026 during the Greater Cincinnati Northern Kentucky Apartment Association’s February General Membership Meeting scheduled for Tuesday, February 17, 2026, at Oasis Conference Center. This is by far the most popular meeting of the year answering all your questions regarding trends in the local apartment industry.

Kurt Shoemaker is a Senior Vice President and team lead covering the Cincinnati, Dayton, and Lexington markets. In this role, Kurt focuses exclusively on the sale of multifamily properties throughout the Central Midwest and Kentucky. He is responsible for listing and selling multifamily apartment complexes, accompanying prospective buyers on property site visits, maintaining current market knowledge, and negotiating contracts. A MESSAGE FROM THE PRESIDENT

It seems like I say this every year, but once again January has passed us by in a flash. The last ten days have certainly been memorable with all the snow and freezing temperatures.

One of the highlights of the month was our Annual Officers Installation Dinner on Tuesday, January 20 at the Madison Event Center in Covington, Kentucky. It was a humbling experience to be installed as President with so many family and industry friends in the crowd. I feel a tremendous responsibility living up to the example of past presidents and representing such a talented group. I truly enjoyed presenting our past president, Melissa Joy, with her gavel and watching Grant Saunders with Hays + Sons Complete Restoration win the President’s Award. Grant’s contribution and leadership of Associate Council made him an obvious choice.

February is a busy month for the Greater Cincinnati Northern Kentucky Apartment Association (GCNKAA). On February 11 we will be hosting “Seminar Slam” which is an exciting Education Event for our members. The day will be full of presentations, open discus-

sions, and moderated panels on a variety of topics. The Education Committee has put a lot of work into planning the event and I have no doubt it will be impactful for everyone involved.

On February 17, we have our annual “State of the Industry Dinner” and Presentation led by Kurt Shoemaker from CBRE. This is one of our largest events of the year and I look forward listening to Kurt recap 2025 and attempt to make sense of the current market we are all trying to efficiently operate in.

The month closes with an IRO Round Table on February 19, and a Maintenance Workshop focused on Laundry and Dishwasher sponsored by Proctor and Gamble on February 25.

On February 26, our Apartment Association of Kentucky (AAK) representatives will be participating in an industry Legislative Day in Frankfort. The day serves as a great way for our members to have facetime with legislators and influence policymakers.

Let’s hope the snow and cold weather takes a break this month. I know I speak for all of us when I say how appreciative we are for the hard work that goes into snow removal and keeping our sites clean and clear of snow and ice. Our on-site teams work so hard and few things are as thankless as snow removal. Here’s to a great month and some warmer weather!

Thank you for your generous support in 2025. Because of you, the Apartment Association Outreach (AAO) had a very successful year, raising more than $212,000 to support our six programs serving neighbors in need.

Thanks to these efforts, our four partner organizations - Freestore Foodbank, Jewish Family Service, Santa Maria, and CAIN (Churches Active in Northside) - received funding to help families facing very difficult times.

Our new slate of officers, including Rebecca McLean with GCNKAA, Alex Parlin with BRG Apartments, Lloyd Cobble with ePremium Insurance Agency, and myself - along with the entire AAO Board of Directors, were sworn in at the Officers Installation Dinner held on January 20 at The Madison Event Center. We’re excited to build on this momentum in 2026 by continuing to raise awareness of our mission and expanding our impact.

OHIO LEGISLATIVE UPDATE

The National Apartment Association’s Advocate in Washington, DC, is fast approaching. On March 24-25, GCNKAA members will swarm Capitol Hill, meeting with members of Congress from Ohio and Kentucky to discuss key issues impacting the industry.

This year, we will be asking members to pass two key pieces of legislation:

• S. 470/H.R. 1078, RESPECT State Housing Laws Actis a bipartisan bill that finally sunsets the 30-day required Notice to Vacate (NTV) requirement put in place as part of the CARES Act during the COVID pandemic.

• S. 2651, ROAD to Housing Act & H.R. 6644, Housing for the 21st Century Act - These two pieces of legislation are each congressional chamber’s comprehensive housing packages. While different, both housing packages are bipartisan and broad-based.

These meetings are also an opportunity to remind our elected leaders of the importance of private property rights and the critical role housing providers play in the health of our economy and communities.

We will conduct a “Know Before You Go” briefing via Zoom on March 12 to answer questions and fine tune our plan of action on The Hill.

The City of Cincinnati has gone live with a new website for residents to access information on available rental units. This is in addition to the dozen or so existing sites that allow apartment hunters to search for available space.

The City approved a contract with CityWise Software of Wisconsin. Listings are free for apartment owners with fewer than twenty units, but others pay a listing fee. The City keeps 20% of the fee under the three-year agreement with CityWise.

According to CityWise COO Jeremy Schmidt, the company is “working closely with Cincinnati’s team and rental community to create a platform that innovates on the housing search for renters across the financial spectrum.” GCNKAA was neither contacted nor solicited for input as the City planned and implemented this new platform.

The City and CityWise claim that the new website will be a searchable database technology specifically designed for affordable housing listings, and provide a modern, “equity-focused” housing search tool. The site claims it will provide real-time listings filtered for affordability (80% AMI and below) within the City’s Affordable Housing Dashboard. Other searchable information such as code violations may be added to the listings.

GCNKAA will monitor the development and adjustments planned for this new website and advocate for fair, unbiased market-driven information to be presented to renters.

Advocate – NAA’s annual advocacy conference – is the prime opportunity to meet with your representatives by joining rental housing suppliers, property managers, owners and operators in Washington, D.C.

Advocate 2026 will be March 24-25, 2026, with NAA Governance meetings continuing March 26-27, 2026. Registration is now open by clicking here.

These awards emphasize exceptional service to both residents and to the broader community, while also considering financial performance as part of the evaluation. Supplier Company of the Year

NAA’s Supplier Company of the Year Award recognizes a supplier member that not only exemplifies excellence in their field but also demonstrates an extraordinary commitment to the rental housing industry. The winning supplier company must be a member of NAA in good standing.

INDIVIDUAL ACHIEVEMENT AWARDS

The National Apartment Association and the National Apartment Association Education Institute’s Individual Achievement Awards recognize individuals who have made noteworthy achievements within their professional career. Individual Achievement Awards are offered in seven (7) award categories, and only NAA members are eligible to apply.

There is no limit to the number of individuals that can be nominated. Self-nominations are allowed. If nominating more than one individual, separate nomination forms are required. Recipients, nominees and nominators are encouraged to attend the Excellence Awards ceremony at Apartmentalize on June 17, 2026.

Applicants will be charged $50 per entry for the Individual Achievement Award categories. MULTIFAMILY MARKETING’S LEGAL LANDSCAPE

Multifamily marketers face a complicated regulatory landscape when planning promotions and campaigns, and new laws seem to pop up by the month. Whether at the local, state or federal level, it can be hard to stay abreast of all the policies dictating how to attract new residents.

From Fair Housing compliance to recent developments in fee transparency and lingering questions about artificial intelligence use, the legal marketing environment is constantly changing. It is important to stay compliant and know how to avoid the most common headache-inducing mistakes.

FAIR HOUSING IN THE DIGITAL REALM

The easiest compliance box to check is to make sure your web pages and advertising materials include the Equal Housing Opportunity logo and the International Symbol of Accessibility.

Beyond that, Fair Housing advertising materials cannot tie messaging to certain protected classes. At the federal level, these include race, religion, sex (including gender identity and sexual orientation), national origin, disability or familial status. States and localities may have even stricter provisions.

The most prominent regulations that multifamily marketers face come in the form of federal Fair Housing laws, which were established by the Civil Rights Act of 1964.

“Multifamily is such a unique industry, in that we have these federal Fair Housing guidelines that we have to stay within,” said Christine Gustafson, vice president of marketing and public relations at The Breeden Co. “And that is when you’re working with both residents and prospects.”

Since digital marketing has become the first place a prospect engages with a property, legal compliance must start at the top of the funnel. A 2024 National Multifamily Housing Council survey found that 79 percent of respondents reported visiting a property

It can be easy for a marketer to inadvertently target a protected class or exclude certain groups in marketing materials, observed Shelly Steitz, a senior consultant partner at Cadence Marketing Solutions.

“Instead of saying something like, ‘We have a lot of young people who live here,’ highlight the community events and how you’re bringing your residents together,” she shared.

Another common marketing tactic that can prove troublesome is the use of photos of only one person, according to Gustafson.

“You should have a group of adults,” she added. “You can’t have a photo of just one person of one race and one sex. It should be a group, to show cohesiveness.”

THE TEMPTATION OF TARGETING

One of the main draws of digital advertising is that it allows marketers to target their content to hyper-specific demographics. While this might be the perfect way to help Lululemon sell a pair of leggings, commonly targeted demographics—age, sex, etc.— are protected classes under Fair Housing laws.

But there are other methods of digital targeting that avoid using protected classes, Steitz pointed out. For example, marketers can identify people who have recently visited an ILS page or searched on Google for information about a certain neighborhood.

“Hone in on what you can identify and base your targeting around that,” she recommended.

BEING TRANSPARENT WITH YOUR LISTINGS

Another burgeoning regulation impacting marketers is fee transparency. State and local governments, along with the Federal Trade Commission, have been increasingly targeting operators over fee disclosures.

In December 2025, Greystar reached a settlement with the FTC and the state of Colorado regarding the firm’s pricing transparency practices. While the settlement did not include an admission of wrongdoing, the FTC confirmed in the agreement that federal law requires disclosing all mandatory fees when advertising rent.

A challenge, according to Steitz, is that many ILS websites were not designed with fee transparency in mind, which could make compliance difficult in some cases.

“When we’re putting something into our property management system and it gets pushed out to our ILS platforms, it doesn’t always push out in the way that a regulation might require us to do it,” she said.

Marketers must now work with the providers of their property

websites and their ILS pages to make sure that rent prices and fees are displayed consistently, which can be a challenging catch-up game.

One action Steitz recommends to make the process less painful is standardizing fees across a firm’s entire portfolio, which makes coordinating pricing across platforms easier.

While the technology has the potential to dramatically reshape workflows, experts caution against relying too heavily on AI tools while the products are still in their early stages.

Raul Gastesi, a partner at the Miami law firm Gastesi, Lopez, Mestre & Cobiella, said he was skeptical of AI tools that communicate with prospects and answer questions, because you give up some control over what the bot may say. The key is quality control.

Gastesi advises landlords and owns multifamily property himself. “Make sure you put in the effort, so that you can take responsibility for what you send out or what’s communicated on your behalf,” he noted.

More and more properties are turning to these agentic AI tools, and proponents argue that having a bot communicate with prospects could actually improve legal compliance, because you are able to program more consistent responses—provided that the appropriate safeguards are engineered beforehand.

And from a content creation perspective, Gustafson said that while it can be tempting to quickly whip up art and copy using ChatGPT, marketers must still carefully review all materials for legal compliance.

“I’m not a proponent of AI yet,” Gustafson said. “I think it’s still in its infancy and hasn’t evolved yet in our market to be able to accurately push out communication that would keep us protected.”
