retirement reform. “That,� Rotkin says, “will come later.� When it does, there’s no doubt it will be dominated by whether to include what’s known as a “two-tier system� for all employees, public safety and otherwise. Under this plan, current workers would keep the retirement plans they’ve been promised, but new employees would begin to get skimpier offers. It would mean savings, but it would take decades to realize them, and members from labor groups like SEIU Local 521 and Association of Firefighters Local 1716 say it would devastate morale by creating two classes of employees. “A two-tier system is a divide-andconquer strategy where you’d have two groups doing the same job, one getting lower benefits,� says Rob Oatey, president of the local firefighters union. (Full disclosure: Oatey is married to Santa Cruz Weekly graphic designer Jenny Oatey.) “We believe there are better and more immediate steps to take.� Wilson, nevertheless, argues in a letter to the City Council that “it would be unconscionable to leave the current (retirement) plans in place� and that advancing a two-tier system is imperative. Rotkin also supports a two-tier system, though he goes one step further, saying the minimum retirement age for all employees should also be delayed by five years. It’s currently age 50 for public safety workers and 55 for all other employees. Both options have the potential to lower the city’s employer contribution rates. Yet not all the city’s workers have the
abnormally high rates that its public safety employees do. The city’s 934 nonpublic safety employees—its maintenance workers, record clerks, IT specialists, attorneys, city manager, etc.—cost about the same as every other surrounding city’s miscellaneous workers do. The city pays 12.8 percent of each employee’s salary into the CalPERS fund; the employees themselves contribute 7 percent. The result is a rate of 2 percent of salary for every year of service, compared with cops’ and firefighters’ 3 percent. Yet by the sheer number of employees they represent, city leaders are still looking for major concessions from them as well, to the tune of $1.3 million in cuts. SEIU members have been attending recent city meetings in full purple-shirt-clad force, asking that cuts be made “from the top� and not from the rank-and-file workers. Whether any savings will come in the form of pension reform or not remains to be seen. And whether a left-leaning city like Santa Cruz has the political will to slaughter such a progressive sacred cow is certainly in doubt. But with a new forecast by Bartel himself saying that this year the city’s employer contribution rates will climb from 36 percent for police and 39 percent for firefighters to nearly 44 percent and 48 percent, respectively, the penny-pinching city manager is now of the mind that reform is less of a choice than a necessity. “Something has to be done,� says Wilson. “Statewide reform is politically impossible. Local municipalities just have to do it themselves.� 0

N FRIDAY, June 11, former Assemblymember John Laird left his home in Aptos at 6:45am and drove three hours south to San Luis Obispo, did an editorial board meeting, stopped by his campaign office there, raced 2 1/2 hours north to Monterey for two more editorial board meetings, stopped at the Monterey campaign office, and then spoke for an hour and a half at a live radio town hall before driving home. “I’m barely recovering,� he says the next day, which is, by comparison, a cakewalk: Greet a group of 100 California Young Democrats at the Santa Clara campaign office and send them off to knock on doors, walk the east Los Gatos precinct with District 10 San Jose City Councilmember Nancy Pyle, meet with the residents of a mobile home park in Los Gatos, then head up to San Francisco for a 5pm fundraiser. Above all the appointments on his iPhone calendar is a counter that reads “10 D.U.E.�—10 days until election, when he faces off with 33rd District Assemblymember Sam Blakeslee (R-San Luis Obispo) for the District 15 state Senate seat. Mark Hinkle, a Libertarian, and Jim Fitzgerald, an independent, are the small dogs in the fight.
“The hardest thing about this,� Laird says, “is that there are just under 500,000 voters in the Senate district and my opponent won’t agree to any joint appearances.� (Though Blakeslee acknowledges he has not tried to arrange joint appearances, he claims he’s not heard from Laird’s camp.) That’s not the only challenge. Overshadowed in the press by the June 8 primary and squashed into just 53 days by an order for a special election from Gov. Arnold Schwarzenegger, the inevitably tiny June 22 turnout does not diminish the significance of this race. Democrats are just two seats away from a twothirds supermajority in the state Senate. If Laird should pick it off of the Republicans, breaking up the yearly budget logjam could be that much easier. So as the final days tick down, it’s little wonder that Laird says he’s run up almost 10,000 miles on his car in two months. “This is one of our top priorities,� says CYD president Alissa Ko, who has brought in volunteers from as far away as Sacramento to stump for Laird. “It is really frustrating that they rushed this election. They really did disenfranchise people.� The special election, ordered by Schwarzenegger after Abel Maldonado

vacated his seat in order to become lieutenant governor in late April, is viewed by many as an effort to keep turnout low—a condition thought to favor Republican candidates. A lawsuit filed in San Jose last month sought to delay the election until November on the grounds that the counties don’t have enough time to prepare for yet another election, but it ultimately failed. Santa Clara County is in some ways a principal battleground, since voters in Almaden, Monte Sereno and Saratoga have never been represented by Laird nor his opponent. Early polling indicated that 32 percent of voters districtwide will go with Laird, with support concentrated in his home turf of Monterey, Santa Cruz and South Santa Clara counties, and 33 percent will go Blakeslee, mostly in San Luis Obispo County and Santa Maria. Though the district was gerrymandered for Republican control in 2001, its voters went for Obama and against Proposition 8 in 2008. Laird will capture the seat if those voters turn out for him. If neither candidate captures 50 percent—a possibility since two others are competing in the contest—it will go to an August runoff. “Any extra minute I talk is a minute you’re not talking to voters,� he tells the Young Democrats before sending them out the door. “We have a real shot at winning this if we turn out our voters. Santa Clara is in part the swing area.� The students troop out to their cars with a map and list of every Democrat in their assigned area, followed by Laird. It’s tough keeping up with him—both while following his silver Hybrid Camry with the “A 27� license plates as he races toward east Los Gatos and after he arrives in the precinct, beating a path up the hills between the plush homes in heavy-sounding dress shoes. For the most part, the people who are home recognize Laird as he approaches, clearing his throat with a little “ahem� at each door. One woman spraying her plants stops to take Laird’s f lier and says, “I’ve seen the negative ads. They’ve been pretty nasty, so you can tell they’re not true.� “Bless you for that,� says Laird. The barrage of ads blasting Laird as a “train wreck� for taking pay raises while in the Assembly and voting for taxes hit the airwaves last week, an indication, Laird believes, that Blakeslee has seen polling that indicates the race is slipping from his grasp. Laird credits that in some measure to his own ads linking Blakeslee—at a particularly newsworthy
time—to offshore oil drilling and his one-time employment with Exxon. Blakeslee says Laird is distorting his record. “I have consistently fought to protect the coast,� he says, citing his votes to extend a symbolic moratorium on offshore drilling, and defending his “yes� vote on the Tranquillon Ridge project, which he says would have prevented the expansion of some oil drilling platforms. Both candidates are also playing up their commitment to budget solutions and to saving the California education system. Laird is critical of Blakeslee’s hard spending-cap proposal—which is a cornerstone of Blakeslee’s budget fix strategy, including a rainy day fund— saying it would completely freeze any ability to shift money to education, and of his signature on the Grover Norquist Taxpayer Protection Pledge. For his part, Blakeslee says, “High and punitive taxes we currently exact have been ruinous to our economy and cause many head-of-household jobs to f lee.� Blakeslee accuses Laird of wasting taxpayer money by taking a job at the Waste Management Board, which was later disbanded, and his “F� grade from the Howard Jarvis Taxpayers Association. But in such a rushed election, the only letter the 15 to 20 percent of likely voters will be paying attention to is the R or D at the end of each candidate’s name. After tromping around east Los Gatos, spokesman Bill Maxfield hustles Laird back to his car in order to make it to the mobile home park in time, but there’s a problem: no one has directions. NYONE who isn’t already angry with AT&T, Verizon, T-Mobile and Sprint—the four national wireless providers that reportedly control 90 percent of the U.S. market— might consider this ridiculous news. One of the most outrageous cell phone scams is really very simple: Charge customers for being forced to listen to 15 seconds of unnecessary voicemail instructions reminding them how to leave a message after the beep. According to New York Times technology writer David Pogue, if Verizon customers leave voicemails or check their messages twice a day, the mammoth New Jersey–based telecommunications company takes in around $620 million. In return, you lose wasted hours of your life and have to pay for it.
Speaking of Verizon, one representative refused to shut down a dead man’s service, even though his daughter produced a death certificate and needed the account closed so settlement of his estate could proceed. Then there’s the rep who tried to collect an overdue $308 bill from customer Al Burrows by threatening to “blow your muthafucking house up.� Do we need to even talk about AT&T’s various controversies, from censoring Pearl Jam to allegedly helping the National Security Agency unlawfully monitor the American people’s communications? The telco giants’ latest offense, according to a recent Federal Communications Commission report, has been given the blunt name of “bill shock.� Which is a misnomer, actually: it’s certainly not shocking to the average cell phone user to find, as the FCC explains,
that “30 million Americans—or one in six mobile users—have experienced . . . a sudden increase in their monthly bill that is not caused by a change in service plan.� It’s even less of a surprise to learn that “nearly half of cell phone users who have plans with early termination fees (ETFs)—and almost two-thirds of home broadband users with ETFs—don’t know the amount of the fees they’re accountable for.� “In January, we sent letters to the major wireless providers asking the rationale for their ETFs,� FCC spokeswoman Rosemary Kimball says. “While the business model of subsidizing phones by the ETFs is the carrier’s choice, our position is that the ETF charge must be made clear to the consumer when he is signing the contract. And this does not seem to be the case in many instances.� ¨ "

Their contracts are dense with clauses that no selfrespecting human should have to wade through just to place a call or send a text. ETFs are a particularly blatant insult to wireless customers, who can’t leave an underperforming carrier (and that’s really all of them) without forking over hundreds of hard-earned dollars. In fact, AT&T just nearly doubled its $175 early termination fee to $325 in May. That cold, capitalist logic is built specifically for bottom lines and earnings reports, not for flawless customer service. ETFs are financial shackles to mediocrity, and they’re just the start.

Carriers and Their Carrion According to Wisconsin Democratic Sen. Herb Kohl, the telcos have fortified their industry monopoly with other scandalous pricing. Between 2006 and 2008, the cost of sending and receiving a text message rose 100 percent. The average American consumer pays approximately $500–$600 a year for wireless service, which is practically more than any other developed nation. Of course, iPhone addicts—who are chained to Apple’s exclusive contract with AT&T until the probably inevitable
Verizon contract arrives in 2011—pay around twice that annually in various subscription fees. This in spite of the fact that AT&T, Verizon and Sprint continually rank among the worst in the nation when it comes to customer service. Or that such early termination fees are arguably illegal, depending on which judge you ask. “We want consumers to know that they can avoid the ETF by using prepaid phones,� Kimball adds. “And we have recently released a public notice [PDF] asking for comments from consumers and the industry on how customers can be made aware they are about to incur unexpected charges. We asked whether a model like that used in the European Union, where customers must be alerted when they are about to incur roaming charges, would work in the United States.� Mandating that the wireless industry warn their customers before they variously fleece them is a great start. But bridging the price gaps between the carriers and their carrion is going to take a while. “A big part of the problem is that this country is such a huge landmass,� Pogue says. “No one cell phone carrier can cover it all, unlike in Europe and Japan. Therefore, people have to buy from the company or two with coverage where they live, so there’s very little competition. The cell companies can essentially get away with whatever they want.� “We don’t have equivalent providers in the marketplace,� says Consumers Union’s wireless, phone and Internet policy analyst Joel Kelsey. “There are tell-tale signs that this is not a competitive market: the ubiquitous existence of early termination fees that have been continually raised; the inability of consumers to bring their smart phone investments with them from carrier to carrier; parallel and consistent price increases in text messaging, despite the fact that the cost to provide that service is declining; the opaque nature of data overage charges. Everything seems randomly tacked on.�

But the new FCC regime is going to have its hands full bringing AT&T and Verizon to heel. The telcos aren’t giving up without a fight, especially when they can charge anything for whatever. “The FCC is talking about a common sense way of giving consumers more control to help them realize cost savings,� Kelsey said. “Consolidation is increasing and the market is dwindling toward a duopoly, because AT&T and Verizon have the best deals with the handset providers, who have the most consumers. And they have very little incentive to invest in their own network; investment in the network as a percentage of revenue has actually declined. And they own the lion’s share of the wireless spectrum.� At the 2008 wireless spectrum auction, Verizon actually sued the FCC for having the temerity to rule in Google’s favor that the five available spectrum blocks remain open to services, applications, devices and networks. Verizon eventually dropped the lawsuit, and nearly $5 billion on the FCC for the coveted open-access C-block, but we’re a long way from nonexclusivity. And further auctions kicking off in the years to come are sure to be as contentious, especially now that FCC chairman Genachowski has argued that the nation is due for a “looming spectrum crisis� because of the burgeoning desire for mobile broadband. “There are a number of political undercurrents at play,� Kelsey explains. “The government has been trying to get as much money as possible out of auctions, and that certainly raises the question about what is the most effective use of the spectrum and doesn’t take into account the interest in public use or social good. It’s not clear what the FCC wants or plans to do, but their actions over the last several weeks have been great. They’re showing that they’re interested in broadband mobile as a check on current practices.� Which is great, because the bill for current practices is getting larger and more unreasonable by the year. The check is going to need to be a big one. Those purposefully ridiculous fees and charges from the telcos aren’t going to pay themselves.

The reissued series—with showy new clip art covers—is being targeted at a younger demographic than the original release, based on the assumption that preteens who have been steeped in vampires simply won’t be interested in an innocent series about baby-sitting. Meanwhile, references to cassette players have been updated to iPods, cell phones have been added and Stacey’s bodacious signature perm has become merely an “expensive hairstyle.� Babysitting rates have gone up. And it is these changes that have met with the most vehement criticism from invested older fans. “I’m glad you’re reading and all, stupid Internet generation,� writes blogger and former reader Nora Leah Sherman. “But these aren’t bastions of fucking literary glory. They’re books about teenage girls and I am sad that we have to fucking SPOON FEED them to you so that they are relevant to your lives (OMG WHATS A WALKMAN????).� Ultimately, whether they are carrying cassette players or MP3 players, the BSC girls face the same enduring challenges of early adolescence as any generation: Stacey explores crushes on older boys, Mary Anne struggles to assert independence from her overprotective father and all the girls learn about building and keeping friendships. “There are so many books out there that involve sex and drugs for youngsters that don’t really have a good message,� Sharpe says. “There’s a lot of drama and fights in the series, but everything worked out in the end, and the message of true friendship remained. Their impact is evident in the multitudes of fans who grew up on the series who are now blogging and discussing the books on various sites and message boards. I have a friend who is a teacher and she has the entire series in her classroom.� After all, cultural is cyclical. The ’90s tweens revived ’70s velvet shirts and flared jeans while poring over thencutting-edge BSC books. Today, that first generation of BSC fans is settling down to have families; many of them are going to want to introduce their daughters to the baby-sitters. And that is exactly what Scholastic is banking on. 0

On the job, Vince encounters his own son Tony (Steven Strait) from a long-ago affair in Jersey and he decides to bring Tony home to do some day-labor without telling his wife his true identity. But Vince has another secret: he’s been taking acting classes in Manhattan, without informing his hostile, lynx-eyed wife, Joyce ( Julianne Margulies, never better). The rest of the family have secrets of their own: son Vince Jr. (Ezra Miller) is a chubby-chaser with eyes for the 400pound woman next door, and daughter Vivian (Dominik Garcia-Lorido) has been moonlighting as a stripper. The tangle of lies is resolved nicely. City Island has fine waterscapes; Emily Mortimer is very soulful as the acting partner with whom Vince shares a deepening friendship; the ageless Alan Arkin has six very good scenes as a weary acting teacher who has seen generations of Brando imitators come and go. Provoking a family feud at a dinner table, or gazing at a BBW porn site as if it were the Holy Grail, Miller is also outstanding. Noisy

He takes on well-guarded subjects of oppression, from the British pound note to the Israeli security wall. This has to be the least-sylvan Robin Hood ever made. Crowe looks less like a fox and more like a logy, depressed pit bull as the film tries to chug around him with more montages of burning villages and more meetings of angry Plantagenets. min.) Elegant but staid murder mystery nibbles around the edges of the Dirty War. It’s the “Forget it, Jacobo, it’s Argentinatown� view: the search for justice evaporating in 1974 Buenos Aires,
with present-day sequences to frame a reopened investigator. It’s leavened by a fine Mulder and Scully anti-romance between an attractive female criminal investigator for the government, Irene (Soledad Villamil), and her attractively crumbling, Mastroiannish male assistant, Benjamin (Ricardo DarĂn). Director Juan Jose Campanella is a regular director of House M.D. The film is as restless and jokey as a cop procedural show; every scene is on the mark, but there aren’t enough counterpoints to the assured f low of the story. The slick, vengeance-is-mine punch line isn’t very impressive either, though it’s probably why the Academy preferred this to the far better White Ribbon, where the fascist culprits got away. Saying that, though, would be assuming the voters didn’t have eyes for Villamil, an assured 40ish beauty whose performance is the secret in this movie’s success; her covert smile is the film’s signature piece. Many Turkish commuters take the 15-minute ferry ride across the Bosphorus Strait, traveling from their suburban homes in Asia to the urban sprawl in Europe. I’m seeing a comparable journey for you, Aries: a transition that happens casually and quickly, but that moves you from one world to another. Prepare yourself, please. Just because it unfolds relatively easily and benevolently doesn’t mean you should be nonchalant about the adjustments it will require you to make. B/C@CA (April 20–May 20): When you want to get rid of a weed that’s impinging on the autonomy of your growing tomato plant, you don’t just tear away its stalk and leaves; you yank it out by the roots. As much as I loved the arrival of each new spring, I endured a mourning period as the ground’s last patch of dirty sleet melted. Once in late March, though, I talked my mom into letting me store five snowballs in the freezer. It wasn’t until my birthday in late June that I retrieved the precious artifacts. I was slightly disappointed to find they had become more like iceballs than snowballs. On the other hand, their symbolism was deeply gratifying. I’d managed to invoke the tangible presence of winter fun in the summertime. I urge you to attempt a comparable alchemy, Aquarius. THE SACRED PATH After a 3 year struggle, the neighbors, with help from People Power and attorney Gary Redenbacker, were able to keep a small pathway between High and School street open. This pathway had been used over the years by Holy Cross Elementary students and parents, bicyclists, neighbors, history buffs, convent nuns, and the general public for more than 70 years. The adjoining neighbor, who lives out of the area, purchased the right away and boarded up the pathway much to the surprise and dismay of the neighborhood. Work was immediately begun to negotiate to keep the pathway open, including the City of Santa Cruz which sponsored a mediation session. A solution was not agreed upon, and later private arbitration resulted in a final settlement arbitrated by Judge Steven Volkman. The pathway will be open from 6AM until 10PM. To help defray legal costs, look for a “bicycle blender” near the bike valet parking area this Saturday at the Japanese Cultural Fair on Mission Hill. Smoothies will be made using bike power—by People Power— an organization dedicated to keeping bike and pedestrian walk-ways open. Buy a smoothie, enjoy the fair, and walk the path! On July 9th a celebration will take place at noon including a bake sale and a historic walk of the Mission Hill area with renown historian Ross Gibson, meeting at Mission Hill Park.
