Banned for 25 years A MAN who threatened to put his former solicitor in a wheelchair has been spared jail but ordered not to communicate with him for 25 years. Colm Daly, 46, of no fixed abode, pleaded guilty at Dublin Circuit Criminal Court to harassing his former solicitor in a series of emails sent between March 1 and 26, 2010. The court heard that Daly had been suffering from a major psychiatric illness at the time. Garda Orla Cooper told Tony McGillicuddy BL, prosecuting, that Daly had been awarded a six-figure compensation for other matters in 2008, but that the money is now gone. Daly had been represented in those legal proceedings by his then solicitor, Pearse Mehigan. While the case was resolved satisfactorily in 2008, Daly became aggrieved about the outcome two years later. He sent several emails from abroad to Mr Mehigan in March 2010, complaining about how he had been represented and demanding monies that he claimed were still owed to him.

References were made in the emails to Mr Mehigan being put in a wheelchair. Another email made an oblique reference to his wife and children. Mr Mehigan became alarmed and notified gardaí that Daly was going to come back to Ireland and visit his offices on March 7, 2010. On that day, Daly was seen walking up and down the road on Upper George’s Street, Dún Laoghaire, where Mr Mehigan had his office. Gardaí arrested Daly, who acknowledged that he had sent the emails. He said he didn’t think they had been threatening, but later accepted they could be perceived so. Paul Greene SC, defending, said his client has a major psychiatric illness which had been ‘in full flow’ then. Judge Patricia Ryan took account of Daly’s tragic childhood and the nature of his illness. She ordered that he must not communicate with Mr Mehigan, or any member of his family or staff, for 25 years.
