3632 S 10-15-26

PROCLAMATION 2026-37 PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 12:01 a.m. on October 9, 2026 and continuing in effect for a period not to exceed thirty (30) days as required by Section 24 of the New York State Executive Law. This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County. As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County. I hereby direct all departments and agencies of Suffolk County to take whatever steps necessary to provide emergency assistance as deemed appropriate. Edward P. BEACH NEIGHBORHOOD ROAD REVITALIZATION AREA, HAMLET OF MASTIC BEACH, TOWN OF BROOKHAVEN, SUFFOLK COUNTY, NEW YORK

NOTICE IS HEREBY GIVEN that, on October 1, 2026, following the public hearing held on July 7, 2026, the Town Board of the Town of Brookhaven (the “Town Board”) adopted a Determination and Findings (“D&F”) pursuant to Section 204 of the Eminent Domain Procedure Law (“EDPL”), concerning the acquisition by eminent domain of fee title interests in all or a portion of 127 parcels of real property located within the Mastic Beach Neighborhood Road Revitalization Area in the Hamlet of Mastic Beach, Town of Brookhaven, Suffolk County, New York (the “Acquisition Properties”), in connection with the urban renewal project described below (the “Renewal Project”). The following provides an overview of the Renewal Project and a brief synopsis of the D&F, followed by a list of the Acquisition Properties. This should not be considered a complete statement of the D&F. Copies of the complete D&F will be forwarded without charge upon written request to the Town of Brookhaven, One Independence Hill, Farmingville, New York. Background The Renewal Project is a comprehensive urban renewal initiative intended to transform the approximately 40-acre Neighborhood Road Revitalization Area (the “Project Area”), comprised of 143 parcels of real property and adjoining public streets, into a coordinated, walkable, mixed-use downtown. The Project Area generally extends along Neighborhood Road, Commack Road, and adjoining streets east of Flower Road and west of West Riviera Drive. The Conceptual Redevelopment Plan contemplates up to 630 housing units, including apartments, condominiums, and townhomes; 133,600 square feet of commercial space; 34,000 square feet of community and civic space; and 2,228 parking spaces, together with public open space, roadway and pedestrian improvements, stormwater and utility upgrades, and related infrastructure and public-realm improvements. Construction is anticipated to occur over approximately eight years in five phases. The Renewal Project follows decades of municipal planning and public engagement concerning the Project Area. A 2019 Blight Conditions Study documented widespread vacancy, abandonment, deteriorated and underutilized properties, undersized parcels, code violations, visible neglect, redevelopment constraints, and crime. Nearly 40% of the Study Area consisted of properties that were vacant, partially vacant, or abandoned, and the study found that 90 parcels—approximately 64% of the Study Area—were blighted, vacant, parking-lot parcels, or otherwise contributing to deteriorated conditions. The study concluded that the Study Area constituted a substandard or insanitary area appropriate for urban renewal. The Town thereafter selected Mastic Dev. Co. LLC, an affiliate of the Beechwood Organization, as master developer for the project (the “Master Developer”) and proposed an integrated revitalization framework to guide the Renewal Project. The framework consists of several interrelated planning documents and zoning amendments: an Urban Renewal Plan, which identifies the strategies and actions necessary to eliminate blight and implement coordinated redevelopment; a Land Use Plan, which defines the community’s redevelopment vision and the measures needed to achieve it; and a Regulating Plan, annexed to the Land Use Plan, which establishes the new form-based zoning district for the Project Area, as well as its development standards. Those standards are implemented through an amendment to Chapter 85 of the Town Code, while an amendment to the zoning map assigns properties within the Project Area to the applicable subdistricts of the new Mastic Beach Downtown District. The approved framework also included a Conceptual Redevelopment Plan, which depicts the Master Developer’s buildout vision. Environmental Review Pursuant to SEQRA The revitalization framework was refined through environmental review under the New York State Environmental Quality Review Act, Article 8 of the New York Environmental Conservation Law, and the implementing regulations at 6 N.Y.C.R.R. Part 617 (collectively, “SEQRA”), and through extensive public participation, including several public hearings and writtencomment periods. On April 30, 2026, the Town Board approved the final versions of the aforementioned planning documents and zoning amendments, accepted a Final Generic Environmental Impact Statement (“GEIS”), and adopted a SEQRA Findings Statement. The Findings Statement summarizes the Town Board’s completion of the SEQRA process and identifies the conditions, mitigation measures, development standards, phasing requirements, infrastructure improvements, permitting obligations, and future review thresholds that will govern implementation of the Renewal Project. Relying on the Draft GEIS, Final GEIS, supporting technical studies, public comments, and responses to comments, the Findings Statement concluded that the Renewal Project may proceed, subject to those requirements. In adopting the Findings Statement, the Town Board determined that the Renewal Project advances the Town’s long-standing public objectives of eliminating blight and transforming a deteriorated, underutilized area into a coordinated, walkable, mixed-use downtown with new housing, commercial opportunities, public spaces, and infrastructure improvements. The Town Board also found that the SEQRA record adequately evaluated potential impacts relating to traffic and transportation, water resources, ecological resources, community character, utilities, construction

activities, and related environmental conditions. After considering the Draft and Final GEIS, technical studies, public comments, and responses to comments, and balancing environmental, social, and economic considerations, the Town Board concluded that the Renewal Project avoids or minimizes adverse environmental impacts to the maximum extent practicable, imposes appropriate mitigation measures and development conditions, and provides benefits that outweigh any remaining impacts. The Town Board therefore approved the revitalization framework and determined that SEQRA’s requirements had been satisfied in connection with the Renewal Project. EDPL Public Hearing In accordance with EDPL Article 2, the Town Board conducted a duly noticed public hearing on July 7, 2026, concerning the potential acquisition of property within the Project Area for purposes of facilitating the Renewal Project (the “Public Hearing”). At the Public Hearing, information was presented regarding the Renewal Project’s public uses, benefits, and purposes; the location and scope of the proposed acquisitions; the Town’s planning and environmental review; and the Project’s anticipated effects on the environment and residents of the locality. The Public Hearing was held open until July 8, 2026, and the public was afforded an opportunity to submit oral and written comments, which were made part of the record, reviewed, and accorded due consideration by the Town Board. The D&F summarizes the public comments received and, although not required by the EDPL, directly responds to the principal categories of comments raised during the Public Hearing process. EDPL Determination and Findings The D&F authorizes the Town to acquire fee title in all or a portion of the 127 Acquisition Properties, listed on Schedule A to the D&F, simultaneously or in stages, to the extent negotiated acquisitions have not been or are not consummated, pursuant to its condemnation authority under New York Town Law § 64(2) and Article 15 of the New York General Municipal Law. The D&F identifies sixteen (16) of the 143 properties located in the Project Area that are not authorized for acquisition at this time (the “Excluded Properties”). The Excluded Properties, listed on Schedule B to the D&F and below, comprise the thirteen (13) publicly owned parcels located in the Project Area and three (3) privately owned parcels. Public Use, Benefit, or Purpose to Be Served by the Renewal Project (EDPL § 204[B][1]) The Town Board found that the Renewal Project will serve multiple public uses, benefits, and purposes, including but not limited to eliminating and remediating blighted, substandard, and insanitary conditions; implementing the adopted Urban Renewal Plan; transforming the Project Area into a coordinated, mixed-use, pedestrian-oriented downtown; creating diversified housing opportunities, including affordable housing; encouraging economic development, employment, private investment, and long-term growth; strengthening the tax base and increasing local revenues; improving roadways, sidewalks, streetscapes, utilities, stormwater facilities, and related public infrastructure; creating publicly accessible open, civic, and community gathering spaces; improving pedestrian safety, circulation, and connectivity; and advancing environmental sustainability and the Town’s longstanding planning objectives for downtown Mastic Beach. The Town Board further found that acquisition of the Acquisition Properties is necessary to accomplish those public purposes. Although voluntary acquisitions are preferred, fragmented ownership and the need for coordinated, area-wide redevelopment create a substantial risk that reliance on voluntary acquisitions alone would prevent achievement of the Renewal Project’s objectives. The Renewal Project is not a parcel-by-parcel codeenforcement initiative, and limiting acquisition to properties that are presently vacant, visibly deteriorated, or individually blighted could leave irregular remnants, gaps in development, inefficient circulation patterns, and continuing conditions that would undermine the Renewal Project’s ability to eliminate blight and achieve meaningful revitalization. Any private benefit to the master developer was found to be incidental to the predominant public benefits of the Renewal Project. Location of the Renewal Project and Reasons for Selection of that Location (EDPL § 204[B][2]) As noted, the Project Area is located within the Neighborhood Road Revitalization Area in the Hamlet of Mastic Beach, generally along Neighborhood Road, Commack Road, and adjoining streets east of Flower Road and west of West Riviera Drive. The Town Board found that this location contains the concentration of blighted, vacant, underutilized, and redevelopment-constrained properties identified through the Town’s planning studies, blight investigations, public planning initiatives, and environmental review. The Town Board further found that the record showed continued deterioration after the 2019 Blight Conditions Study. At least

13 parcels not previously identified as having violations were subsequently cited for Town Code or Building Code violations; in at least eight instances, structures were posted or reposted as unsafe for occupancy; and seven parcels received reduced assessments through tax certiorari settlements, further decreasing the Project Area’s aggregate assessed value. The D&F also recounts continuing serious crime within the Project Area, including a May 2023 shooting homicide outside 373–375 Neighborhood Road and shootings outside 310 Neighborhood Road in November 2023 and as recently as August 2026. These more recent conditions reinforced the Town Board’s conclusion that the selected location continues to suffer from deterioration, disinvestment, and publicsafety concerns warranting coordinated urban renewal. The Town Board found that the Project Area’s fragmented ownership, widespread vacancy, deteriorated conditions, infrastructure deficiencies, and long-standing disinvestment make it particularly appropriate for urban renewal and coordinated, area-wide redevelopment. The Acquisition Properties were selected because they are located within the area necessary to implement the Urban Renewal Plan, Land Use Plan, Regulating Plan, and Conceptual Redevelopment Plan. Isolated or piecemeal redevelopment would not adequately address the documented conditions or accomplish the Renewal Project’s public purposes. General Effect of the Renewal Project on the Environment and Residents of the Locality (EDPL § 204[B][3]) In its D&F, the Town Board found that the SEQRA review that culminated in its adoption of the Final GEIS and Findings Statement discussed above, addressed the same Renewal Project, including the property-acquisition component that is the subject of these EDPL proceedings. The Draft GEIS, Final GEIS, and Findings Statement evaluated the redevelopment contemplated for the Project Area, including anticipated acquisition, property assemblage, demolition and clearance where appropriate, infrastructure improvements, phased construction, and redevelopment of the Acquisition Properties. Accordingly, the Town Board found that the prior SEQRA review provides an adequate environmental basis for the acquisitions authorized herein. The Town Board found that the environmental and locality effects of the Renewal Project, including its property-acquisition component, were evaluated through the completed SEQRA review. That review considered potential effects relating to land use and zoning, community character, traffic and transportation, parking, stormwater management, groundwater and water resources, ecological resources, utilities and public services, construction activity, noise, air quality, contaminated materials and remediation, historic and cultural resources, socioeconomic conditions, housing, and public safety. The Town Board certified that the requirements of SEQRA have been satisfied and found that, among the reasonable alternatives available, adverse environmental impacts will be avoided or minimized to the maximum extent practicable through the mitigation measures, development standards, phasing requirements, infrastructure improvements, permitting obligations, and future review requirements identified in the Final GEIS, SEQRA Findings Statement, and related approvals. The Town Board further found that no substantial project changes, changed circumstances, or newly discovered information require a supplemental environmental impact statement. The Town Board found that the Renewal Project will provide substantial benefits to residents of the locality, including elimination of blighted conditions, improved community appearance and public safety, expanded housing and economic opportunities, enhanced infrastructure and pedestrian connectivity, new public and civic amenities, increased employment and tax revenues, improved stormwater management, green infrastructure, environmental remediation where necessary, and modern utility improvements. The Town Board acknowledged that implementation may require acquisition of occupied properties, but found that property assemblage, demolition and clearance where appropriate, phased construction, infrastructure improvements, and potential acquisition of privately owned properties were contemplated as part of the overall SEQRA review and are necessary to accomplish the Renewal Project’s public purposes. The D&F further explains that affected owners are protected by the EDPL’s appraisal, offer, negotiation, vesting, and just compensation requirements; that voluntary offers do not control compensation in a subsequent EDPL acquisition; and that the Article 2 proceeding does not prevent owners from selling or otherwise conveying their properties before an Article 4 vesting proceeding is commenced. Other Relevant Factors (EDPL § 204[B][4]) The Town Board considered the entire administrative record and the extensive opportunities for public participation provided through public workshops, community visioning sessions, online surveys, public hearings, and written comment periods. The Town Board also clarified that the separate Mastic Beach Sewer Project, although related to the broader revitalization effort, is a distinct municipal undertaking and that the acquisitions

Finally, the Town Board found that authorization to acquire all Acquisition Properties at this time is reasonably necessary for orderly implementation of the multi-phase Renewal Project. EDPL § 401(C) expressly contemplates that public projects may be carried out in stages over an extended period. Authorizing the acquisitions as a whole will provide certainty regarding project feasibility, allow challenges under EDPL § 207 to be resolved before substantial resources are committed to later phases, and minimize the risk of delay, increased costs, and disruption to future phases.

PROCLAMATION 2026-39 PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at or about 12:01 a.m. on October 9, 2026 and continuing in effect for a period not to exceed thirty (30) days. The State of Emergency has been declared as a result of the effects of environmental corrosion to the Smith Point Bridge in Shirley from salt, moisture and age, which has necessitated a three-ton weight limitation for vehicles using the bridge. Such limit restricts emergency vehicles, such as ambulances and firefighting vehicles from traversing the bridge.
