Local Emergency Order:

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026 and May 22, 2026 as a result of damage to the Smith Point Bridge in Shirley, occurring on November 19, 2025, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by environmental damage and age of the Smith Point Bridge, resulting in a weight restriction limiting the passage of emergency vehicles over the bridge, and in furtherance of §103 (4) of the N.Y.

General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Chapters 1065 and 189

• Article IV sections A 4-13 and 14

Article V sections A5-1

• Charter section C5-2 (C) and (L)

Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance all related procurement laws, rules, and regulations required to comply with this Order; and further

Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further

Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Local Emergency Order:

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026 and May 22, 2026 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and

189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

HOLBROOK BUSINESS DISTRICT SEWER EXTENSION TOWN OF ISLIP AND TOWN OF BROOKHAVEN CAPITAL PROJECT NO. 8167

The work consists of the following:

A. The Work to be performed under this Contract and in accordance with these Specifications involves construction superintendents, labor, skilled workers, materials, equipment, and all other items necessary for the complete construction of the Holbrook Sewer District Gravity Collection System and conveyance system, the routing of which is described below:

1. Collection System – An eight (8) inch diameter PVC DR 18 gravity collection system will originate from a flush manhole to be located near at the intersection of Pine Street and Union Avenue in Holbrook, Town of Brookhaven and will complete the following pathways:

a. The gravity main will run easterly along Union Avenue to a proposed manhole at the intersection of Union Avenue and Main Street where it will make a turn on to Main Street.

b. Then, running southerly along Main Street will arrive at a proposed manhole at the intersection of Railroad Avenue and Main Street in the Town of Islip. The main will transition to ten (10) inch diameter PVC DR-18 at the outlet of the manhole, and

c. Thereafter, the ten (10) inch gravity main will continue to run southerly along Main Street in a common trench with a portion of the conveyance system force main and will arrive at a manhole near the intersection of Main Street and Broadway Avenue. From the manhole the main will turn easterly to enter a public right-of-way (proposed pump station site), located on the northwest corner of Broadway Avenue and Patchogue-Holbrook Road in the Town of Islip and will proceed approximately 113 ft. easterly through the pump station site to terminate in a sanitary manhole within the pump station site. From the transition manhole the ten (10) inch gravity main will be extended to connect to the proposed pump station. The ten (10) inch gravity main downstream of the sanitary manhole, the pump station and ancillary structures are to be constructed by others.

d. From the manhole at the intersection of Main Street and Broadway Avenue the ten (10) inch diameter main PVC DR 18 will be extended 336 ft. southerly along Broadway Avenue and will terminate in a Flush manhole for future connection.

e. The collection system also includes a 319.0-ft. long eight (8) inch diameter PVC DR 18 branch sewer which will originate from a flush manhole to be located on the west side of Patchogue-Holbrook Road and at the north end of Coates Avenue S and will run southerly along Coates Avenue S. The branch will terminate at a manhole to be located at the intersection of Coates Avenue S and Union Avenue.

f. Another 319.3-ft. long eight (8) inch diameter PVC DR 18 branch sewer will be installed along Grundy Avenue and be connected to the collection system at the intersection of Main Street and Grundy Avenue. The branch will originate from a flush manhole to be located in Grundy Avenue.

2. The principal features of the Work to be performed for this collection system under the Contract, include, but are not limited to:

a. Installation of the entire gravity sewer collection system following open cut trench method starting from a manhole to be located on Union Avenue, at the intersection of Pine Street and Union Avenue, up to and including the sanitary manhole to be located on the pump station site.

b. The installation also includes a 319.4-ft. long eight (8) inch diameter PVC DR 18 branch sewer along Coates Avenue S., a 319.3-ft. long eight (8) inch diameter PVC DR 18 branch sewer along Grundy Avenue, a 336-ft. extension of the ten (10) inch diameter main on Broadway Avenue and the sanitary manhole as described above. Work also includes pipe sizing, slope calculations, and alignment.

c. Installation and/or construction of new manholes and fitting accessories as necessary to constitute the gravity collection system, and installation of an eight (8) inch diameter PVC DR 18 gravity main to connect the termination manhole to the existing Ronkonkoma Hub manhole.

d. Jacking the eight (8’) main under the Long Island railroad tracks across Main Street following standard jacking methodology as described in the design manuals and the Contract Drawings. Provide twenty-four (24) inch diameter cast iron pipe for encasement of the eight

(8) inch diameter PVC DR 18 gravity main under the railroad tracks.

e. Backfill trenches after pipe installation in accordance with Section 02200.

f. All work shall be performed as described in the design manuals and the contract drawings.

3. Force Main – A six (6) inch DR-18 diameter force main has been designed for the conveyance system. The routing of the force main is as follows:

a. The force main will originate from the proposed pump station and will be placed in a common trench with the aforementioned ten (10) inch diameter gravity sewer main up to a Testing Pit to be located within the pump station site (which is currently a public right-of-way) approximately 135 ft. from its westerly border abutting Main Street. The pump station and ancillary structures, and the force main up to the Testing Pit on the pump station site will be constructed by others.

b. From the Testing Pit, the force main will exit the pump station site on to Main Street where it will make a 90o turn and run northerly along Main Street in the aforementioned common trench with the gravity sewer main up to the intersection of Main Street and Railroad Avenue and turn westerly at the intersection.

c. Then, running westerly along Railroad Avenue the main will arrive at the intersection of Knickerbocker Avenue and Railroad Avenue, south of the railroad tracks, where it will turn north and run along Knickerbocker Avenue after crossing the railroad tracks.

d. At the intersection of Knickerbocker Avenue and Union Avenue the main will turn westerly and run along Union Avenue up to the intersection of Mill Road and Union Avenue where it will turn south to connect to the proposed termination manhole to be located upstream of the existing Ronkonkoma Hub manhole.

e. From the termination manhole sewage will flow via an eight (8) inch diameter gravity main to the existing Ronkonkoma Hub manhole.

4. The principal features of the Work to be performed for this conveyance system under the Contract, include, but are not limited to:

a. Construction of the proposed force main following open cut trench method.

i. Installation of the proposed six (6) inch diameter DR-18 force main following open cut trench method including the Testing Pit on the pump station site. The main will be installed in the same trench with the 10-inch diameter gravity sewer main starting from the force main Testing Pit at the pump station site up to the intersection of Main Street and Railroad Avenue, from which the 6-inch diameter DR 18 main will be installed in trenches up to the proposed termination manhole to be located upstream of an existing Ronkonkoma Hub Pump Station manhole in Mill Road as described above. Work also includes pipe sizing, slope calculations, and alignment.

ii. Installation of cleanouts, valves, air relief manholes, drain manholes, supports, and fitting accessories as necessary along with jacking the main under the Long Island railroad tracks across Knickerbocker Avenue following standard jacking methodology as described in the design manuals and the Contract Drawings. Provide twenty-four (24) inch diameter cast iron pipe for encasement of the six (6) inch diameter PVC DR 18 force main under the railroad tracks.

b. Construction of the proposed force main - alternative method to reduce excavation, lane closure and traffic control during construction

i. The 6-inch diameter PVC DR-18 force main will be installed in the same trench with the 10-inch gravity sewer main starting from the other Testing Pit at the pump station site up to the intersection Main Street and Railroad Avenue where the main will transition to a 6-inch diameter HDPE 11 pipe. Thereafter, the 6-inch diameter force main will be installed following horizontal directional drilling method throughout its pathway to the termination manhole to be located upstream of an existing Ronkonkoma Hub Pump Station manhole in Mill Road as described above, except for crossing the Long Island Railroad tracks. At this location the pipe will be installed following jacking method. Provide twenty-four (24) inch diameter cast iron pipe for encasement of the six (6) inch diameter force main under the railroad tracks.

ii. Installation of cleanouts, valves, air relief manholes, drain manholes, supports, and fitting accessories as necessary along with installation of sending and receiving pits shall be done as described in the design manuals and the contract drawings.

B. Scheduling and completing routine inspections of constructed works as they progress with the regulatory agencies having jurisdiction over the project.

C. Providing monthly preliminary Red Line “as-built” documents to the County and the Engineer.

D. Performing gravity and force main testing and hydrostatic testing.

E. A portion of the existing guiderails on the northeast side of Broadway avenue and Main street to be removed as part of the demolition work prior to the proposed construction. Removal and Reinstallation of the portion of the guiderails is included with the scope of work for this contract.

F. Furnishing and installing painting and coatings.

G. Scheduling and completing final inspections with the regulatory agencies having jurisdiction over the project.

H. Restoring the excavated areas of the public rights-of way, except the pump station site, to their original condition as required by the County and the respective towns.

I. Preparing and submitting final “as-Built” documents to the County and the Engineer.

CONTRACT NO. S – SEWER COLLECTION & CONVEYANCE SYSTEM

A non-mandatory pre-bid walk through is on Thursday, June 25, 2026, at 10:00AM. Meet on-site at 600 Bergan Avenue West Babylon, New York 11704 at the Bergan Point Sewer Service area.

Note: This Project is to be bid as a single prime project, and a Project Labor Agreement is in effect in accordance with the Supplementary Conditions. Bidders shall submit with their bids, a separate sealed list that names each subcontractor that the bidder will use to perform work on the contract, and the agreed-upon amount to be paid to each as applicable, for: (a) plumbing and gas fitting (i.e., Plumbing Work), (b) steam heating, hot water heating, ventilating and air conditioning apparatus (i.e., HVAC Work which includes fire sprinkler) and (c) electric wiring and standard illuminating fixtures (i.e., Electrical Work). The apparent low bidder’s subcontract information will be opened and read aloud at the bid opening.

Bids for this contract shall be submitted in a separately sealed envelope with the name of the contract clearly noted on the outside of the envelope. Bids shall be accompanied by a certified check or bid bond in an amount not less than five percent (5%) of the total Base Bid, made payable to the Suffolk County Comptroller. This bid bond will be held as a guarantee that in the event the bid is accepted and contract awarded to the Bidder, the contract will be duly executed and properly secured. E-MAILED BIDS WILL BE CONSIDERED UNRESPONSIVE.

Note: This Project is to be funded by the Department of Housing and Urban Development (HUD). Bidders shall submit all documentation necessary for adherence to HUD requirements. Bidders shall incorporate the effort necessary to adhere to all requirements including but not limited to funding drawdown, reporting and all other requirements determined by the HUD Grant Agreement into their bid. This contract is also funded using New York State funds and those requirements are included in the specifications.

Note: This Contract is funded, in whole or in part, by the Coronavirus State and Local Fiscal Recovery Funds (SLFRF), as established by the American Rescue Plan Act of 2021 (ARPA) under Sections 602 and 603 of the Social Security Act. The County has determined that the Contractor is receiving ARPA funds under the Contract, and as such, the Contractor hereby agrees to adhere to and comply with ARPA and all applicable ARPA requirements and such terms as set forth in the attached Exhibit, and as may be amended in the future. As a condition of this Contract, any contracts with subcontractors

greater than $150,000 must also submit forms and adhere to ARPA requirements.

The bids shall be delivered in person, by the Bidder or his agent, at the time and place stated.

Raynis (“Raynis”). The purpose of this conveyance is to give Raynis the opportunity to pay all monies owed to the County of Suffolk, to reclaim the Property, and to avoid further hardship. The work consists of the following:

1. General Construction

a. Furnishing, installing and constructing a new 33.00 ft. deep (inside dimension) cast-in-place concrete equalization pump station with a length of 20 ft. and width of 20 ft. (inside dimensions) within the project site which is a public right-of-way located at the northeast corner of Broadway Avenue and Main Street in Holbrook, Town of Islip.

b. Furnishing, installing and constructing a force main from the abovementioned pump station pumps to a transition manhole for connection to the proposed conveyance system which will terminate at the existing Ronkonkoma Hub manhole located in Mill Road. The transition manhole will be located approximately 135 ft. east of the pump station site boundary line abutting Main Street. The conveyance system and the transition manhole will be constructed by others.

c. Furnishing, installing and constructing a gravity sewer main from a transition manhole to the pump station for connecting to the proposed collection system. The transition manhole will be located approximately 113 ft. east of the pump station site boundary line abutting Main Street. The collection system will originate from a proposed flush manhole to be located near the intersection of Union Avenue and Pine Street. Both the transition manhole and the collection system will be constructed by others.

d. Furnishing and installing pump valve box with associated mechanical valves.

e. Furnishing and installing pump station flow meter manhole and associated equipment.

f. Furnishing and installing two (2) new submersible pumps in the wet well with pump control panel and variable frequency drive as shown on the Contract Drawings.

g. Furnishing and installing grinding equipment.

h. Furnishing and installing a blower and an air diffusion system to aerate the liquid to be stored in the equalization tank and other ancillary equipment.

i. Furnishing and installing an intake fan on the top slab of the equalization pump station.

j. Furnishing and installing pre-cast control buildings along with concrete slabs, footings, and all the required plumbing work in accordance with contract drawings.

k. Furnishing and installing a chemical feed system and an emergency eyewash system.

l. Furnishing and installing a louver and ventilation fan in the chemical feed system room.

CONTRACT NO. G – PUMP STATION

Note: This Project is to be bid as a single prime project, and a Project Labor Agreement is in effect in accordance with the Supplementary Conditions. Bidders shall submit with their bids, a separate sealed list that names each subcontractor that the bidder will use to perform work on the contract, and the agreed-upon amount to be paid to each as applicable, for: (a) plumbing and gas fitting (i.e., Plumbing Work), (b) steam heating, hot water heating, ventilating and air conditioning apparatus (i.e., HVAC Work which includes fire sprinkler) and (c) electric wiring and standard illuminating fixtures (i.e., Electrical Work). The apparent low bidder’s subcontract

information will be opened and read aloud at the bid opening.

Bids for this contract shall be submitted in a separately sealed envelope with the name of the contract clearly noted on the outside of the envelope. 1. Action(s):

2. Construction Trailer:

ONSITE OPERATIONS

4. Affordable Housing:

At least 10% (2) dwelling units shall be set aside as affordable sale units subject to the following Town of Islip requirements in §68-3 in effect at the time of this grant. All affordable sale units shall be subject to covenants and restrictions that run with the land, and restrict the sale and resale of such units in

accordance with the above requirements. The property owner or management company shall enter into a contract with a not-for-profit HUD Certified Housing Counseling Agency to review and certify compliance with the above provisions. Evidence of compliance with the above referenced affordability provisions must be provided prior to issuance of rental permit(s) and/or upon request to the Town of Islip Planning Department.

5. Homeowners Association

Prior to the sale of any lots/units or the issuance of a Certificate of Occupancy, there shall exist in accordance with the general laws of the State of New York an Association of Homeowners that shall consist of all property owners. Each dwelling unit owner(s), by virtue of his/her/their holding of a unit shall be a member of the said Association and shall hold (or share) one membership for each unit so owned, and shall be bound by the by-laws of said Association; all unit owners shall be obligated to pay the common charges assessed by the Association.

Upon issuance of a Certificate of Occupancy, the Association of Homeowners shall assume all responsibility to comply with covenants provided herein. All future unit owners shall be made aware of their responsibility to comply with all of these covenants and restrictions by inclusion of the within covenants and restrictions in the Offering Plan. 6. Occupancy:

All units shall have no more than two bedrooms each. The residential occupancy of all units shall be limited to the number permitted by the New York State Building Code. Each unit shall have a clothes washer and dryer machine.

7. Property Maintenance

The Association of Homeowners shall be responsible for the supervision, restoration and maintenance and repair on the subject property in accordance with the approved building and site plans. These shall include, but not be limited to, on-site security, internal roadways, sidewalks, litter removal, provision of garbage collection, snow and ice removal, stormwater infrastructure, landscaping, lighting, walkways and buffer installation maintenance and replacement. The subject property shall be kept neat, clean, graffiti and litter free. The internal private roadway servicing the units shall not be offered for dedication. If the property is not being managed to the reasonable satisfaction of the Planning Board, the Planning Board reserves the right to require further maintenance, improvements and/or modifications on-site. 8. Solid Waste:

Declarant/owner, or subsequent Association of Homeowners, shall provide regular solid waste collection services to residents of the development. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, applicant/owner, or subsequent Association of Homeowners, shall provide designated containers for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates.

ARCHITECTURAL ELEVATION REVIEW & SIGNAGE

9. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by Bouler Pfluger Architects, PC and which is dated June 10, 2024. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and

surface mounted shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.

The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

10. Signs:

Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Applicant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN MODIFICATIONS & CONDITIONS

11. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The site plan shall be in substantial conformance with the plan prepared by R & M Engineering and dated November 3, 2025. Said plan shall also include the following elements:

a. The minimum setback for all buildings from all property lines shall be 25’, with the exception of Sunrise Highway (SR 27) which shall be 100’.

b. Parking shall be provided at a ratio of 2.5 stalls per unit, or a minimum of 23 stalls. Any proposed stalls in excess of 23 shall be designated as landbanked parking on the approved site plan and shall not be constructed without the review and approval of the Planning Board.

c. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.

d. Garbage cans shall be provided near all outdoor amenity areas. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.

e. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, applicant/owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:

i. natural retention area(s) such as vegetated swales and bioretention cells/rain gardens

ii. Permeable/porous pavement surfaces

iii. Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons

and other pollutants from stormwater runoff

f. 1 of the total number of parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.

g. A minimum of two onsite amenities for tenant use, which may include but is not limited to: i. A central green or court for lawn games (e.g. bocce)

ii. Shaded seating area/gazebo

h. Pedestrian connections, including sidewalks and ADA compliant curb ramps, shall be installed internally among the proposed site features and connecting the proposed site features to the external sidewalk system. Upgrades shall be made to the existing external pedestrian facilities/network to ADA compliance and incorporating elements typical to a downtown streetscape design.

i. Emergency vehicle access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

j. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.

The approved site plan shall supersede this plan for the purposes of regulating the subject property. Declarant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the applicant/owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

12. Parking:

The Homeowners Association agrees to maintain all residential parking onsite and limit any offsite residential parking. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner

of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:

a. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces.

13. Landscaping:

A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:

a. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be increased in consideration of the species selection after consultation with the Planning Department or waived in consideration of natural vegetation. Applicant/owner shall replace any diseased or dead trees.

b. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.

c. A vegetative buffer shall be provided adjacent to any residential use or zone. Within the 25’ wide buffer area, infill plantings shall be selected based on site conditions and shall create a naturalized area that does not consist of a monoculture. Existing significant trees and tall evergreen shrubs shall remain at the direction of the Planning Department. Applicant/owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas without the permission of the Planning Department. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board. The following areas shall be maintained as landscaped buffer areas:

1. Eastern property line: 25’ in width

2. Northern property line: 25’ in width

3. Southern property line: 20’ in width

d. All landscaped areas shall be maintained with permanent in-ground irrigation systems.

All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The applicant/owner shall be solely responsible for the cost of the maintenance. In the event applicant/owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the declarant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.

The above-mentioned covenants and restrictions shall be and constitute real covenants running with the land and shall be binding upon the Declarant and any and all subsequent owners of the said real property or any part thereof, and upon their heirs, executors, and administrators (or their successors and assignees) subject, however, to the right of the Town of Islip after a public hearing to amend, alter, annul or repeal any or all of the foregoing covenants and /or restrictions at any time with the consent of the owner or owners for the time being of the premises herein described, and such right shall be effectual and may be exercised without the consent of any adjacent owners or other owners or lienors of any other property.
