Local Emergency Order:

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026, May 22, 2026 and June 18, 2026 for a storm occurring on or about August 19, 2024, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Suffolk County Code: Chapters 1065 and 189

• Article IV sections A 4-13 and 14

Article V sections A5-1

• Charter section C5-2 (C) and (L)

• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance

• all related procurement laws, rules, and regulations required to comply with this Order; and further

Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

PUBLIC INFORMATION MEETING FOR THE REPLACEMENT OF CR 80, MONTAUK HIGHWAY BRIDGE OVER LIRR (HAMPTON BAYS OVERPASS) BIN 3019560, TOWN OF SOUTHAMPTON, SUFFOLK COUNTY

The Suffolk County Department of Public Works (SCDPW) will conduct a Public Information Meeting on July 30, 2026, to collect public comments and provide the public the opportunity to learn about the proposed replacement of the Hampton Bays Overpass carrying Montauk Highway (CR 80) over the LIRR, in the Town of Southampton, Suffolk County, NY. The public open house and meeting will take place at the Town Hall, 116 Hampton Road, Southampton, NY 11968, Town Board Meeting Room, beginning at 6PM.

The existing Hampton Bays Overpass bridge is a simply supported five (5) span steel through girder-floorbeam structure with concrete deck that was constructed in 1933 and rehabilitated in 1988. The existing bridge has the lowest NYSDOT condition rating of any bridge wholly or partially maintained by SCDPW and needs replacement in order to maintain the safety of the traveling public and serviceability of CR 80. The project was developed to address the safety and serviceability of the existing deteriorated bridge which is fracture critical and functionally obsolete. The existing non-redundant bridge framing system does not allow for staged construction. Therefore, a full detour is required from the start of demolition until the roadway is reestablished on a replacement structure.

The purpose of this public meeting is to present the project and its anticipated schedule, as well as explain the need for an offsite detour and related traffic impacts during construction. The Public Information Meeting also provides an opportunity for the public

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026, May 22, 2026 and June 18, 2026 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Brookhaven, Suffolk County, New York, held a public hearing at 5:30 P.M. on May 14, 2026, at Town Board Auditorium at Independence Hill, Second Floor, Farmingville, New York, and streamed live over the internet at Brookhavenny.gov/meeting, with respect to property to be acquired by the Town of Brookhaven for drainage purposes, situated at Neighborhood Road, Mastic Beach, Town of Brookhaven, County of Suffolk, New York. As a result of said public hearing, the Town Board of the Town of Brookhaven has made and adopted the following findings and determination:

1. The purpose for the acquisition is to design and construct a recharge basin for the retention of stormwater from Town roadways. As the area has become more developed, the drainage needs have increased accordingly. A review of the existing records and topographic maps, combined with runoff calculations and field investigations, indicate there is a need for a stormwater retention area. These lots have a contributing area of 22.8 acres based off gravity flow. This value could be increased with pipe extensions to low points in and outside the tributary area. This future recharge basin would be required to hold 199,040 CF of storage for an 8” rainfall. The proposed recharge basin design over lots 25.1 & 25.2 will be able to hold up to 98,689 CF of capacity at a depth of 7 feet for a 4” rainfall. More capacity could be provided should the existing Town-owned parcel to the East be included in the recharge basin design.

2. The location for the proposed acquisition is at Neighborhood Road, Mastic Beach, New York, further identified as SCTM No. 0200-980.40-09.00-025.001 & 025.002.

3. No negative environmental effect would be engendered by the project.

4. The Town Attorney of the Town of Brookhaven is hereby directed to proceed to acquire title to the aforementioned property through the exercise of Eminent Domain

NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 15312026, “A Local Law to Implement an Update to the Real Property Tax Law that Provides for a Property Tax Exemption for Seriously Disabled Veterans,” enacting a Local Law amending Section 775-14 of the Suffolk County Code to implement New York State’s most recent amendments to subdivision 11 of § 458-a of the New York State Real Property Tax Law, which will provide full exemption from taxation to seriously disabled veterans on their primary residence. The proposed law revises Section 775-14 to extend eligibility to any individual who was honorably discharged or released from active military, naval, space, or air service, including qualifying Army and Air National Guard service, and to clarify that an individual, to qualify, must be considered totally and permanently disabled as a result of military service by the United States Department of Veterans Affairs. The proposed law allows veterans to establish eligibility through a letter, official form, or other documents sent to such veteran from such department that specifically states such veteran is considered to be permanently and totally disabled as a result of their service.

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026, May 22, 2026, June 18, 2026 and July 17, 2026 for a storm occurring on or about August 19, 2024, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:: Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026, March 27, 2026, April 24, 2026, May 22, 2026, June 18, 2026 and July 17, 2026 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

(4) It shall be unlawful for any person delivering waste to a disposal facility operated by or on behalf of the Town of Islip or the Islip Resource Recovery Agency to represent himself or herself as a Special Garbage and Refuse District residence owner or occupant when the waste generated is from a location other than said residence.

(5) Refuse generated at residences in the Special Garbage and Refuse District that are rental properties and not owner occupied are subject to all disposal fees at a disposal facility operated by or on behalf of the Town of Islip or the Islip Resource Recovery Agency.

(6) It shall be unlawful for any person or entity to obstruct a Special Garbage and Refuse District service vehicle and/or individual from the duty of collection or inspection by physical presence of their person or personal property.

E. Refuse receptacles and containment.

(3) Garbage receptacles All household waste and receptacles are to be placed at the curb no earlier than 4:00 p.m. on the day before collection and shall be removed from the collection point to a location to the rear of the front line of the main dwelling no later than 10:00 a.m. the day after the day of collection.

(4) All household waste and receptacles set out for collection at a residence shall be placed to the paved roadway in one location along the property line of the residence generating said waste, extending no further than four feet into the roadway and no closer than four feet from any adjacent parcel. Household waste shall be placed in an area without overhead obstruction and no closer than three feet to any vehicles or other personal property.

NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 12792026, “A Local Law to Restrict the Sale, Manufacture and Distribution of Kratom in Suffolk County,” enacting a Local Law amending Section 423 of the Suffolk County Code (the “Code”) to add further restrictions on the sale, manufacture, and distribution of kratom and kratom products within the County. The proposed law adds definitions for adulterated kratom product, alkaloid, distributor, kratom leaf, kratom product, manufacturer, retailer, synthesized kratom material, third-party laboratory, and total alkaloids to Section 423-45 of the Code. The proposed law further amends Section 423-46 of the Code to prohibit the manufacture, distribution, sale, or offer for sale of kratom; kratom products; synthesized kratom material; adulterated kratom products; kratom products that are combustible or intended to be used for vaporization, aerosolization, or injection; and kratom products incorporated into or marketed or labeled as a conventional food or beverage product where 7-hydroxymitragynine exceeds 2% of total alkaloids in the product. The proposed law exempts from the list of prohibited food or beverage products kratom leaf prepared as an aqueous infusion or traditional tea preparation. The proposed law also provides that all kratom products sold or otherwise distributed in the County must be tested by a third-party laboratory prior to sale or distribution and found to be free from heavy metals, microbial contamination, pesticide residues, fentanyl and other controlled substances, and synthesized kratom material, and permits the County to test any kratom product for compliance purposes. Finally, the proposed law amends Section 423-47 of the Code to permit enforcement by the Suffolk County Department of Health Services, any policy officer as defined in §1.20(34) of the New York Criminal Procedure Law, and any peace officer as defined in §2.10 of the New York Criminal Procedure Law.
