Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, and January 30, 2026 as a result of damage to the Smith Point Bridge in Shirley, occurring on November 19, 2025, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:
Suffolk County Code: Chapters 1065 and 189
• Article IV sections A 4-13 and 14
• Article V sections A5-1 Charter section C5-2 (C) and (L)
• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, and January 30, 2026 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.

Local Emergency Order:
Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, and January 30, 2026 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.
And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

BE IT FURTHER RESOLVED, that this application be granted subject to the compliance with the following:
DEED COVENANTS and RESTRICTIONS
ADMINISTRATIVE
1. Action:
a. A change of zone to designate a Planned Landmark Preservation District overlay for the referenced property description is granted as part of this application. The property may be used as multifamily supportive and affordable housing. Any change of use to uses not permitted in the Residence AAA District shall require the review and approval of the Town Board after a public hearing. Any use exclusive to the Business 3 District and/or any Industrial zoning district is expressly prohibited in addition to the following:
i. Bar, tavern or nightclub
ii. Psychiatric clinic
iii. Billiard Hall
iv. Adult Use
v. Transfer Station
b. A Town Board Special Permit to modify a use restriction is granted as part of this application. The property may be used as apartments dedicated for supportive and affordable housing. In addition, pursuant to Town Code Section 68-451 A (3), the height of the building may exceed 35’ but shall not be increased over the existing 70’, exclusive of cupola, and side yard setbacks may be 0 feet. This special permit shall only be valid for the life of the original structure.
2. Park Fees
Declarant/owner agrees to pay a one-time recreation fee of $1,320 per apartment unit prior to the issuance of site plan approval.
ONSITE OPERATIONS
3. Affordable Housing:
All dwelling units shall be permanently set aside as affordable units in accordance with the affordability standards set forth in Town Code §68-3, as in effect at the time of this grant. For purposes of this requirement, affordability shall mean that rental rates are restricted to households earning no more than 80% of the Area Median Income (AMI) for the Nassau-Suffolk Fair Market Rent Area, as published annually by the United States Department of Housing and Urban Development (HUD). The units shall be monitored by a not-for-profit HUD-Certified Housing Counseling Agency to ensure continued compliance with these provisions. In the alternative, a New York State agency with direct oversight of affordable or supportive housing, such as NYS Homes and Community Renewal (HCR), may fulfill this function, subject to the prior written approval of the Commissioner of Planning & Development. Written evidence of compliance with these affordability provisions shall be submitted to the Town of Islip Planning Department prior to the issuance of any rental permit(s) or at such times as may reasonably be requested by the Town.
4. Supportive Housing:
Eighty-eight (88) units shall be permanently set aside as supportive housing for individuals with intellectual or developmental disabilities, as defined by the New York State Office for People with Developmental Disabilities (OPWDD), or for other special needs populations certified as eligible by the New York State Office of Mental Health (OMH) or the New York State Department of Health (DOH). Tenant eligibility for such units shall be verified by the applicant/owner through documentation issued by the appropriate state agency, and such documentation shall be made available to the Town of Islip Planning Department upon request. These units shall include access to supportive services consistent with the requirements of the certifying agency.
5. Onsite Ride Service:
Two vehicles will be made available to residents for transportation for shopping, employment, medical appointments and recreational and other required necessary trips.
6. Occupancy:
The residential occupancy of the one-bedroom apartments shall be limited to two persons. The residential occupancy of all other apartments shall be limited to the number permitted by the New York State Building Code. The development shall be served by two (2) communal laundry rooms.
7. Property Maintenance:
The buildings shall be kept in good repair, including all exterior portions and all interior portions thereof which, if not so maintained, may cause or tend to cause the exterior portions of such improvement to deteriorate, decay or become damaged or otherwise to fall into a state of disrepair. Declarant/owner agrees to enter into a contract with a property management company to oversee the daily management of the property. The management company shall be responsible for the supervision, restoration and maintenance and repair on the subject property in accordance with the approved building and site plans. These shall include, but not be limited to, onsite security, internal roadways, sidewalks, litter removal, provision of garbage collection, snow and ice removal, stormwater infrastructure, landscaping, lighting, walkways and buffer installation maintenance and replacement. The subject property
shall be kept neat, clean, graffiti and litter free. The internal private roadway servicing the units shall not be offered for dedication. If the property is not being managed to the reasonable satisfaction of the Planning Board, the Planning Board reserves the right to require further maintenance, improvements and/or modifications on-site. The Planning Board will notify the property owner within 30 days certified mail notice identifying the problem(s) and request rectification. The property owner agrees to rectify any problems to the Planning Board’s satisfaction within sixty (60) days, weather permitting.
8. Solid Waste:
Declarant/owner shall provide regular solid waste collection services to residents of the apartments. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, applicant/owner shall provide designated containers for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates.
ARCHITECTURAL ELEVATION REVIEW & SIGNAGE
9. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by H2M Architects & Engineers and which is dated October 2023. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.
c. Materials used shall be consistent with the existing structure.
The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
10. Signs:
Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN REQUIREMENTS & MODIFICATIONS
11. Site Plan:
Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to: building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The site plan shall be in substantial conformance with the plan prepared by H2M Architects + Engineers and dated January 15, 2025. Said plan
shall also include the following elements:
a. Parking shall be provided at a ratio of 1.16 stalls per unit, or a minimum of 205 stalls. Any proposed stalls in excess of 145 shall be designated as landbanked parking on the approved site plan, and shall not be constructed without the review and approval of the Planning Board.
b. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area as needed. The subject site shall be maintained in a neat, clean, and litter free condition.
c. Garbage cans shall be provided near all outdoor amenity areas. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.
d. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, declarant/owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:
i. natural retention area(s) such as vegetated swales and bioretention cells/rain gardens
ii. Permeable/porous pavement surfaces
iii. Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff
e. Bike lockers and/or racks (“Inverted U” or “Post and Loop” in design) shall be installed near each entrance.
f. 3 parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.
g. Emergency vehicle access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
h. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
i. A minimum of six onsite amenities for tenant use, which may include but is not limited to:
i. Fitness room
ii. Walking trails
iii. Outdoor recreational areas
iv. Pergolas and community garden
v. Shaded seating area

Pedestrian connections, including sidewalks and ADA compliant curb ramps, shall be installed internally among the proposed site features and connecting the proposed site features to the external sidewalk system. Upgrades and repairs to the existing external pedestrian facilities/network to ADA compliance subject to the plans prepared by H2M and received by the Town of Islip on April 18, 2025. Said improvements shall be completed subject to the review and satisfaction of the Division of Engineering and the Department of Public Works. In the alternative, the applicant may, subject to review and approval by the Town Engineer, submit a mitigation fee in lieu of performing the required improvements. Said fee shall be equal to the full estimated cost of the improvements, as determined by the Town, plus an administrative
surcharge not to exceed ten percent (10%) of such cost.
The approved site plan shall supersede this plan for the purposes of regulating the subject property. Declarant/ owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the declarant/owner after due public hearing.
The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.
12. Parking:
A parking relaxation from 308 spaces to 205 spaces is granted as part of this application.
If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:
a. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner
of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.
b. Lease unused off-site parking spaces and/or enter into a cross-access agreement.
Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces.
13. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on February 20, 2026 due to a severe snow storm and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors as a result of a storm which is expected to bring heavy snow, strong winds, dangerous driving conditions, the potential for downed trees and power lines, property damage, unsafe conditions and a potential travel ban, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Charter section C5-2 (C) and (L)

A change of zone from Residence A District to Residence CA District is deemed granted as part of this application. The use of the subject parcel(s) shall be limited to nine (9) attached single family dwellings and accessory amenities. Each unit shall be limited to two bedrooms.
2. Construction Trailer:
Prior to the issuance of any construction or demolition permits, applicant shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans, and be accessible to all Town personnel and contractors for review of plans and meetings. Should the applicant wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.
3. Park Fees:
Declarant/owner agrees to pay a one time recreation fee of $1,320 per apartment unit prior to the issuance of site plan approval.
ONSITE OPERATIONS
4. Affordable Housing:
At least 10% (2) dwelling units shall be set aside as affordable sale units subject to the following Town of Islip requirements in §68-3 in effect at the time of this grant. All affordable sale units shall be subject to covenants and restrictions that run with the land, and restrict the sale and resale of such units in accordance with the above requirements. The property owner or management company shall enter
into a contract with a not-for-profit HUD Certified Housing Counseling Agency to review and certify compliance with the above provisions. Evidence of compliance with the above referenced affordability provisions must be provided prior to issuance of rental permit(s) and/or upon request to the Town of Islip Planning Department.
5. Homeowners Association
Prior to the sale of any lots/units or the issuance of a Certificate of Occupancy, there shall exist in accordance with the general laws of the State of New York an Association of Homeowners that shall consist of all property owners. Each dwelling unit owner(s), by virtue of his/her/their holding of a unit shall be a member of the said Association and shall hold (or share) one membership for each unit so owned, and shall be bound by the by-laws of said Association; all unit owners shall be obligated to pay the common charges assessed by the Association.
Upon issuance of a Certificate of Occupancy, the Association of Homeowners shall assume all responsibility to comply with covenants provided herein. All future unit owners shall be made aware of their responsibility to comply with all of these covenants and restrictions by inclusion of the within covenants and restrictions in the Offering Plan. The Planning Board reserves the right to modify the Association requirements within these covenants, subject to compliance with the offering plan approved by the Office of the New York State Attorney General.
6. Occupancy:
All units shall have no more than two bedrooms each. The residential occupancy of all units shall be limited to the number permitted by the New York State Building Code. Each unit shall have a clothes washer and dryer machine.
7. Property Maintenance
The Association of Homeowners shall be responsible for the supervision, restoration and maintenance and repair on the subject property in accordance with the approved building and site plans. These shall include, but not be limited to, on-site security, internal roadways, sidewalks, litter removal, provision of garbage collection, snow and ice removal, stormwater infrastructure, landscaping, lighting, walkways and buffer installation maintenance and replacement. The subject property shall be kept neat, clean, graffiti and litter free. The internal private roadway servicing the units shall not be offered for dedication. If the property is not being managed to the reasonable satisfaction of the Planning Board, the Planning Board reserves the right to require further maintenance, improvements and/or modifications on-site. The Planning Board will notify the property owner within 30 days certified mail notice identifying the problem(s) and request rectification. The property owner agrees to rectify any problems to the Planning Board’s satisfaction within sixty (60) days, weather permitting.
8. Solid Waste:
Declarant/owner, or subsequent Association of Homeowners, shall provide regular solid waste collection services to residents of the development. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, declarant/owner, or subsequent Association of Homeowners, shall provide designated containers for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates.
ARCHITECTURAL ELEVATION REVIEW & SIGNAGE
9. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by Bouler Pfluger Architects, PC and which is dated June 10, 2024. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
b. Use of EIFS and concrete block shall be limited to
accent bands and shall not comprise more than 10% of the building’s façade.
The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
10. Signs:
Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN MODIFICATIONS & CONDITIONS
11. Site Plan:
Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The site plan shall be in substantial conformance with the plan prepared by R & M Engineering and dated November 3, 2025. Said plan shall also include the following elements:
a. The minimum setback for all buildings from all property lines shall be 25’, with the exception of Sunrise Highway (SR 27) which shall be 100’.
b. Parking shall be provided at a ratio of 2.5 stalls per unit, or a minimum of 23 stalls. Any proposed stalls in excess of 23 shall be designated as landbanked parking on the approved site plan and shall not be constructed without the review and approval of the Planning Board.
c. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.
d. Garbage cans shall be provided near all outdoor amenity areas. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.
e. All stormwater drainage shall be contained on-site in accordance with the current SLDR. In addition, declarant/owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:
i. natural retention area(s) such as vegetated swales and bioretention cells/rain gardens
ii. Permeable/porous pavement surfaces
iii. Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from
stormwater runoff
f. 1 of the total number of parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.
g. A minimum of two onsite amenities for tenant use, which may include but is not limited to: i. A central green or court for lawn games (e.g. bocce)
ii. Shaded seating area/gazebo
h. Pedestrian connections, including sidewalks and ADA compliant curb ramps, shall be installed internally among the proposed site features and connecting the proposed site features to the external sidewalk system. Upgrades shall be made to the existing external pedestrian facilities/network to ADA compliance and incorporating elements typical to a downtown streetscape design.
i. Emergency vehicle access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
j. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
The approved site plan shall supersede this plan for the purposes of regulating the subject property. Declarant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the applicant/owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.
12. Parking:
The Homeowners Association agrees to maintain all residential parking onsite and limit any offsite residential parking. If substantiated complaints
regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:
a. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.
Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces.
13. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/ design elements:
a. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be increased in consideration of the species selection after consultation with the Planning Department or waived in consideration of natural vegetation. Declarant/owner shall replace any diseased or dead trees.
b. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any
activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.
c. A vegetative buffer shall be provided adjacent to any residential use or zone. Within the 25’ wide buffer area, infill plantings shall be selected based on site conditions and shall create a naturalized area that does not consist of a monoculture. Existing significant trees and tall evergreen shrubs shall remain at the direction of the Planning Department. Declarant/owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas without the permission of the Planning Department. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board. The following areas shall be maintained as landscaped buffer areas:
1. Eastern property line: 25’ in width
2. Northern property line: 25’ in width
3. Southern property line: 20’ in width
d. All landscaped areas shall be maintained with permanent in-ground irrigation systems.
All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The declarant/owner shall be solely responsible for the cost of the maintenance. In the event declarant/owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the declarant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF
A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at or about February 22, 2026, and continuing in effect for a period not to exceed thirty (30) days.
The State of Emergency has been declared as a result of a major snow storm forecasted for the weekend of February 20, 2026, which is expected to bring heavy snow, strong winds, dangerous driving conditions, the potential for downed trees and power lines, property damage, unsafe conditions, and a potential travel ban.
Such conditions threaten or imperil the public safety of citizens of Suffolk County.
As Chief Executive of Suffolk County, I, Edward P. Romaine, have exercised the authority given to me under New York State Executive Law, Article 2-B, to preserve the public safety and hereby render all required and available assistance vital to the security, well-being, and health of the citizens of the County.

Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, and January 30, 2026 for a storm occurring on or about August 19, 2024, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Article IV sections A 4-13 and 14
Article V sections A5-1
• Charter section C5-2 (C) and (L)
• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. UNDER § 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW
Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, and January 30, 2026 as a result of damage to the Smith Point Bridge in Shirley, occurring on November 19, 2025, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by environmental damage and age of the Smith Point Bridge, resulting in a weight restriction limiting the passage of emergency vehicles over the bridge, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Chapters 1065 and 189
Article IV sections A 4-13 and 14
• Article V sections A5-1
• Charter section C5-2 (C) and (L)
Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance
• all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:
