I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency last issued on November 19, 2025 as a result of damage to the Smith Point Bridge in Shirley, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by environmental damage and age of the Smith Point Bridge, resulting in a weight restriction limiting the passage of emergency vehicles over the bridge, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Legislature of the County of Suffolk New York will meet at the County Center, the William H. Rogers Building, 725 Veterans Memorial Highway, Smithtown New York 11787 in the Rose Caracappa Auditorium, in said County, on the 16th day of December, 2025 at 2:00 p.m., prevailing time, for the purpose of conducting a public hearing upon a proposal for an amendment to the map and plan for the increases and improvements to the facilities of Suffolk County Sewer District No. 6 – Kings Park (the “District”); in and about the Town of Smithtown, substantially in accordance with the amended maps, plans, report and recommendations (the “Map, Plan and Report”) prepared by the Suffolk County Sewer Agency, with the assistance of the Suffolk County Department of Public Works, and filed with the Legislature of the County of Suffolk, at which time and place said County Legislature will consider such proposal and hear all parties interested therein concerning the same.
In Suffolk County Resolution Nos. 739-20178, 1279-2019, 7552020, 833-2021 and 586-2024, the Suffolk County Legislature determined that it was in the public interest to increase and improve the facilities of Sewer District No. 6 – Kings Park (the “Project”) at a maximum cost of $20.55 million. Additional funds are needed to complete all work. The public hearing is being held to address a proposed cost amendment to the map, plan and report for the increase and improvement to the facilities of Sewer District No. 6 – Kings Park last amended in 2024.
Notice of Cost
The cost of the increase and improvement to the facilities of Sewer District No. 6 – Kings Park has risen from an estimated cost of $20.55 million in 2024 to an estimated cost of $30.55 million as set forth in the Map, Plan and Report. The additional $10 million needed to complete the project cost will be funded by American Rescue Plan Act (ARPA) funds.
There will be no fiscal impact to the benefited properties within Suffolk County Sewer District No. 6 – Kings due to the increase in the cost to the Project since ARPA grant funds will be used to cover all of the increase in costs. The projected increase in the total annual cost to the ratepayers in the District is independent of and separate from the increase in cost of the Project. In the case of Suffolk County Sewer District No. 6, the 2025 total annual cost per typical one- or two-family home, which is the typical property within the District, is $379, and expected to be $429 in 2026 and the increase for 2026 is unrelated to the increase in the cost of the Project.
Copies of the map, engineering report, the public hearing report and the project summaries are available in the Office of the Department of Public Works, located in Yaphank and the Office of the Clerk of the County Legislature where they can be reviewed during normal business hours Monday through Friday. PLEASE TAKE NOTICE that the County Legislature of the County of Suffolk, New York, will meet at the County Center, the William H. Rogers Building, 725 Veterans Memorial Highway, Smithtown New York 11787 in the Rose Caracappa Auditorium, in said County, on the 16th day of December, 2025 at 2:00 p.m., prevailing time, for the purpose of conducting a public hearing upon a proposal for the extension of a Suffolk County Sewer District No. 3 – Southwest (the “District”) for the Holbrook extension in and for said County, substantially in accordance with a certain report, map and plan and recommendations (the “Report”) transmitted to said County Legislature by the Suffolk County Sewer Agency, with the assistance of the Department of Public Works at which time and place the Suffolk County Legislature will consider such proposal and hear all parties interested therein concerning the same.
Project Description
The proposed project is to extend the boundaries of Suffolk County Sewer District No. 3 – Southwest (the “District”) to include the business district of Holbrook as an extension area to be known as Suffolk County Sewer District No. 3 – Southwest, Zone D – Holbrook. With the extension of the District, it is intention of the proposed project (the “Project”) to revitalize the business district of Holbrook with the construction of sewer infrastructure along Union Avenue and Main Street between Knickerbocker Avenue and Broadway Avenue in the Towns of Brookhaven and Islip. The extension of sewer infrastructure will increase opportunities and business investment in the community, which has been limited in part by restrictions regarding wastewater disposal and minimize possible impacts to the environment. The connection of properties to sewer and the Project will reduce the environmental impact caused by underperforming cesspools and sanitary systems by replacing such on-site systems with more reliable and efficient sewage treatment for the proposed Project area. The Project is being performed in coordination with the Towns of Brookhaven and Islip. The proposed extension area to the District is approximately 65.6 acres, and the Project will construct sewer collection facilities within the proposed extension area that will enable connection to the existing facilities of the District for sewage treatment and disposal. The Project more specifically includes the construction of spurs and connection laterals totaling over 6,550 linear feet within the extension area to the property lines, a pumping station and a force main of over 10,880 linear feet. Wastewater will be conveyed to the District via the Ronkonkoma Hub Pumping Station.
Notice of Cost
The proposed extension is proposed to be a separate zone of assessment of the District, to be known as Suffolk County Sewer District No. 3 – Southwest, Zone D – Holbrook. Once the extension of the District is approved, capital improvement costs associated with being a part of the District will be charged to all rate payers within the proposed extension area on an ad valorem basis and as a per parcel charge. Once the extension Project is complete and properties are connected to the District’s facilities, a user charge (for operation and maintenance costs) will also be charged, consistent with the manner by which current rate payers of the District are charged user charges.
The total maximum cost of the proposed extension project is estimated to be $12.65 million, with $9,534,861 estimated to be funded with American Rescue Plan Act funds and $3 million by other Federal funds (the Housing and Urban Development). The remaining total cost of the Project not funded by the grants, which is $115,139, will be paid for solely by the rate payers within the proposed extension on an ad valorem basis, and the obligation will commence upon the establishment of the extension to the District.
As described in more detail in the Map, Plan and Report, under the current method of collection, the cost for the typical one or two family home within the extension area (calculated by using the mean assessed value of the residential properties within the extension area in order to approximate the mode) is $214 per year, including the ad valorem charge associated with the costs of being in the District ($161) and the
debt service for the costs for the extension of the District ($53). Once the construction of the Project is complete, which is estimated to be in 2027, under this current method of collection, property owners within the extension area that connect to the District’s facilities will also be billed a user charge (for operation and maintenance costs of the District), consistent with the manner that other residential rate payers in the District are charged. The user charge for the typical one- or two-family home at that time is projected to be $211 per year.
As described in more detail in the Map, Plan and Report, the cost for the typical commercial property (calculated by using the mean assessed value of the commercial properties within the extension area in order to approximate the mode), which is the typical property within the extension area, following the first year after the approval of the extension of the District, is $666 per year, including the ad valorem charge associated with the costs of being in the District ($479) plus the debt service for the costs for the extension of the District ($187). Once construction of the proposed Project is complete, which is estimated to be in 2027, commercial property owners within the extension area that are connected will also be charged a user charge (for operation and maintenance costs of the District) in a manner similar to other commercial rate payers within the District, which is prorated based on actual water use. For the typical commercial property within the extension area, the annual user charge at that time is projected to be $2,532 based on available water use records.
It is anticipated that the current method of collection of the costs for the District, and in turn the Holbrook extension, will be replaced by the method of the collection of costs for the Suffolk County Wastewater Management District (“CWMD”) approved by the Suffolk County Legislature pursuant to Resolution No. 636-2024, as amended by Resolution No. 408-2025, that is to become effective January 1, 2026, as set forth in the Map, Plan and Report upon which Resolution Nos. 636-2024 and 408-2025 were adopted. Under the approved Map, Plan and Report for the CWMD, all costs are collected through an annual fee for those properties actually connected to District facilities. Under the CWMD billing structure, the annual cost to the typical residential property, including within the extension area that is connected at the time the Project is complete in 2027 will be $678, which is comprised of both the portion attributable to debt service costs ($174) and the portion attributable to the costs for operation and maintenance ($504). The annual cost to the typical commercial property within the extension area is anticipated to be $8,136, which is comprised both of the portion of the fee attributable toward the District’s debt service costs ($2,088) and the portion of the fee attributable to operation and maintenance ($6,048) based on available water use records.
Each individual property owner within the extension area opting to connect to the District’s facilities will be responsible for the costs to connect their property to the constructed facilities and the abandonment of existing on-site systems, which is estimated to be $25,000 for a typical commercial property and for a typical one- or two-family home.
As stated above, the proposed Project will be largely funded with grant funding, and the remaining cost of the Project will be funded by sewer district serial bonds.
Copies of the report, map and plan for the proposed district extension are available in the Office of the Clerk of the County Legislature where they can be reviewed during normal business hours Monday through Friday.

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, May 2, 2025, May 30, 2025, June 27, 2025, July 25, 2025, August 22, 2025, September 19, 2025, October 17, 2025 and November 14, 2025 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and
189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
