I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, January 30, 2026 and February 27, 2026 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. VOTER REGISTRATION: Registration of voters for school district meetings and elections is conducted on a continuing basis, to wit: on any Monday through Friday during regular business hours at the Office of the District Clerk, and between the hours of 7:00 p.m. and 7:30 p.m. prior to each regular or special meeting of the Board of Education scheduled to take place at 7:30 p.m., at least five (5) days preceding any school district meeting or election, by the District Clerk, or the Assistant District Clerk, or Board of Registry. The register prepared for the Annual Election and Budget Vote of May 20, 2025 shall be used as a basis for the register to be prepared for this Annual Meeting and Election. In addition, all persons who shall have been previously registered for any Annual or Special Meeting or Election held or conducted at any time within four (4) years prior to the preparation of the register shall be included in such register. ABSENTEE BALLOTS: Applications for absentee ballots may be made at the District Clerk’s office. The District Clerk must receive such application at least seven (7) days before the vote, if the ballot is to be mailed to the voter, or by the day before the vote, if the ballot is to be delivered personally to the voter. Applications may not be submitted more than 30 days before the election (not before April 20, 2025). A list of all persons to whom absentee ballots shall have been issued will be available during regular business hours in the District Clerk’s office and will be available at the polling place on the day of the election. In order to be canvassed, an Absentee Ballot must be received in the District Clerk’s office no later than 5:00 p.m. on the day of the vote.

MILITARY VOTERS: Military voters who are not currently registered may apply to register as a qualified voter of the school district. Military voters who are qualified voters of the school district may submit an application for a military ballot. Military voters may designate a preference to receive a military voter registration, military ballot application or military ballot by mail, facsimile

POLL WATCHING: The following regulations will be in effect regarding poll watching:

Poll watchers shall be required to identify themselves to the District Clerk no less than seventy-two (72) hours prior to the election at which time they will be provided with an identification tag indicating “Poll Watcher”. Such previously identified poll watchers shall sign in with the District Clerk or her designee upon arrival at the polling place. One (1) poll watcher will be permitted per candidate at any given time.

Poll watchers will not be permitted near the voting machines at any time during voting hours.

An area, with a full view of the polls, will be designated for poll watchers.

Following the recording of the vote by the District Clerk, poll watchers will be permitted time to view the voting machines prior to the machines being closed and locked. Poll watchers are not permitted near the machines while the District Clerk, Election Inspectors, Business Official and/or District’s Attorney are taking the tally. Any questions regarding poll watchers are to be directed to the District Clerk. All actions of poll watchers shall be unobtrusive and may in no manner interfere with the orderly conduct of the voting.

e. That the reason for selecting this location is that a study and analyses by the Suffolk County Department of Public Works disclosed that the project would improve existing current sanitary wastewater disposal facilities.

4) Over 250 parcels (770 acres) are currently utilizing on-site sewage systems and will be hooked up to the expanded sewer facilities;

5) Traffic mitigation during the period of construction will be implemented; and

6) The Town of Smithtown has no objections to the Project and in fact has stated that the acquisition and related construction will not, of itself, have any adverse zoning impact on the property owner or their successors in interest;

7) After the SEQRA review was completed for the Proposed Improvement and Expansion of Suffolk County Sewer District # 18, Hauppauge Industrial (CP 8126) project, it was determined that a project pump station will be required to be located in the southwestern portion of the project area. This pump station is proposed to be located on approximately 6,285 square feet of land on a Suffolk County Tax Map Parcel 0800-180.00-01.00-044.000. Pursuant to Title 6 NYCRR Part 617.7 (e), this project change has not been determined by Suffolk County to constitute a substantive project change that would require the amendment of the Negative Declaration issued for the project;

8) Prior to the start of pump station construction at the subject property, all required regulatory permits/approvals will be required to be obtained.

f. That the general effect of the proposed project on the residents of the locality is positive because it will expand the sewer district thereby reducing risk of groundwater contamination.

g. That another relevant factor in approving this project is the fact that this project will further promote the goal of mitigating groundwater contamination by sanitary wastewater in Suffolk County.

Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW

A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at or about 12:01 a.m. on March 27, 2026 and continuing in effect for a period not to exceed thirty (30) days.

The State of Emergency has been declared as a result of the effects of environmental corrosion to the Smith Point Bridge in Shirley from salt, moisture and age, which has necessitated a three-ton weight limitation for vehicles using the bridge. Such limit restricts emergency vehicles, such as ambulances and firefighting vehicles from traversing the bridge.

Such conditions threaten or imperil the public safety of citizens of Suffolk County.

As Chief Executive of Suffolk County, I, Edward P. Romaine, have exercised the authority given to me under New York State Executive Law, Article 2-B, to preserve the public safety and hereby render all required and available assistance vital to the security, well-being, and health of the citizens of the County.

Local Emergency Order:

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with a Proclamation of a State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026 and March 27, 2026 as a result of damage to the Smith Point Bridge in Shirley, occurring on November 19, 2025, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by environmental damage and age of the Smith Point Bridge, resulting in a weight restriction limiting the passage of emergency vehicles over the bridge, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Suffolk County Code:

• Chapters 1065 and 189

• Article IV sections A 4-13 and 14 Article V sections A5-1

• Charter section C5-2 (C) and (L) Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance

• all related procurement laws, rules, and regulations required to comply with this Order; and further

Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further

Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

CONTRACT NO.1 – GENERAL CONSTRUCTION

Note: This Project is to be bid as a single prime project and a Project Labor Agreement is not in effect in accordance with the Supplementary Conditions. There shall be a one hundred and twenty-five (125) foot deep and natural and landscaped buffer area along the entire westerly boundary of the property with the exception that any required sanitary disposal system with required improvements and walking path may be permitted within the buffer area. 2. With the exception of roadways needed for ingress and egress, a one hundred and twenty (120) foot deep natural and landscaped buffer area shall remain along the southerly property line along the entire Montauk Highway frontage, except for driveway access with required drainage, curbing and sidewalk, a single monument identification sign, parking sign, and emergency access road. 3. A fifty (50) foot natural and landscaped buffer area shall remain along the north property line and a one hundred (100) foot natural and landscaped buffer area shall remain along the east property line, with the exception of the required drainage. 4. Use of the subject premises shall be limited to a planned retirement community, consisting of not more than 70 senior citizen housing units. Such senior citizen housing units shall be defined as a residential dwelling unit limited to persons who are 55 years of age or over, with the following exceptions: a. A couple, in which one of the individuals is under the age of 55, but who resides together with the other individual who is 55 years of age or older. b. Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years. c. Adults under 55 years of age may be admitted as permanent residents if it is established to the satisfaction of the Town Board that the presence of such person is essential for the physical care and economic support of eligible

older persons. 5. All Certificates of Occupancy issued for each of the senior citizen housing units shall include the following language: “This senior citizen housing unit is limited to persons who are 55 or over, with the following exceptions: a. A couple, in which one of the individuals is under the age of 55, but who resides together with the other individual who is 55 years of age or older.

b. Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years.

c. Adults under 55 years of age may be admitted as permanent residents if it is established to the satisfaction of the Town Board that the presence of such person is essential for the physical care and economic support of eligible older persons.”

6. All lease agreements shall advise tenants that the units herein are senior citizen housing units, as defined in Brookhaven Town Code Section 85-1, which state: “This senior citizen housing unit is limited to persons who are 55 or over, with the following exceptions: a. A couple, in which one of the individuals is under the age of 55, but who resides together with the other individual who is 55 years of age or older. b. Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/ are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years.

c. Adults under 55 years of age may be admitted as permanent residents if it is established to the satisfaction of the Town Board that the presence of such person is essential for the physical care and economic support of eligible older persons.” 7. An advisory covenant is to be placed on all deeds for the sale of any senior citizen housing unit, which state: “This senior citizen housing unit is limited to persons who are 55 or over, with the following exceptions: a. A couple, in which one of the individuals is under the age of 55, but who resides together with the other individual who is 55 years of age or older. b. Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years. c. Adults under 55 years of age may be admitted as permanent residents if it is established to the satisfaction of the Town Board that the presence of such person is essential for the physical care and economic support of eligible older persons.” 8. An advisory covenant or note is to be placed on the survey, which states that: “This senior citizen housing unit is limited to persons who are 55 or over, with the following exceptions: a. A couple, in which one of the individuals is under the age of 55, but who resides together with the other individual who is 55 years of age or older.

b. Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years.

c. Adults under 55 years of age may be admitted as permanent residents if it is established to the satisfaction of the Town Board that the presence of such person is essential for the physical care and economic support of eligible older persons.”

; and be it further RESOLVED, that the Town Board, as Lead Agency, has determined that pursuant to 6 New York Codes, Rules and Regulations Part 617.3 and 617.6, the proposed action is deemed to be an Unlisted Action for which a Negative Declaration has been issued.

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW

A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 12:01 a.m. on March 27, 2026 and continuing in effect for a period not to exceed thirty (30) days as required by Section 24 of the New York State Executive Law.

This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County.

I hereby direct all departments and agencies of Suffolk County to take whatever steps necessary to provide emergency assistance as deemed appropriate.

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 1, 2026, January 30, 2026, February 27, 2026 and March 27, 2026 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

I, Edward P.
