Unmarried couples need an agreement before buying a home together Q: I’ve read your column weekly for years now. You have occasionally talked about steps that an unmarried couple should take before they purchase a home together. My boyfriend and I are now in escrow on our first home. I’ve tried to talk him into seeing an attorney but he says it would be a waste of time and money. Would you tell us what we should do and why we should do it? A: There is a gaping hole in the law when it comes to unmarried couples buying homes together. When a married couple purchases a home with community property money, and pays the mortgage, taxes and repairs from community property money, the law dictates how the property is divided up or disposed of in case there’s a divorce. But no matter how much you love each other, as far as the law is concerned you and your boyfriend are just real estate investors. When two or more investors purchase a property, the law provides a way for the partners to dissolve their partnership and equitably get rid of the property. This is known as a partition action. Currently, the law looks at a couple who breaks up the same way as it looks at two investors. Partition actions are treated as a business event, very cold and unemotional. It is also assumed that both the parties have a working arrangement for continuing to pay the mortgage, etc. even as the property is being partitioned. In other words, the law assumes the parties have money.
Tim Jones In the real world, when a couple owns a house together and breaks up, it is usually as emotionally and financially traumatic as a divorce. But the divorce laws don’t apply. Often, one party has paid more than the other for mortgage, taxes and repairs but the other paid more for food, utilities, gas, whatever. Since the income of an unmarried couple is not community property, the law doesn’t care who bought the food, it will only care how much money each individual put toward the house itself. For a couple who have lived as if they were married, but without actually tying the proverbial knot, this can be really unfair. Additionally, when a couple breaks up one person often moves out, leaving the other to pay the mortgage and taxes. Mortgage companies don’t take one-half payments so even if the party pays their half, if the other person refuses to make their payment, the house can go into foreclosure. This could result in a foreclosure on both person’s credit history and even a money judgment against each. Additionally, the equity that was in the property may be lost. efore you applied for a mortgage, you watched interest rates, compared multiple lending options and scrutinized the terms to make sure you landed the best deal. After all that research and carefully choosing a lender, you might be asking : Why did my mortgage get sold? While it may feel surprising, there is no need to worry. Mortgages are bought and sold all the time. Here’s why, and what you can do about it.
Why do mortgages get sold? Many lenders specialize in originating mortgages, but often the initial lender can’t afford to wait 15 or 30 years for you to pay it all back. By selling the loan, the lender no longer has to keep
your debt on the books and can offer loans to other prospective homeowners. The lender that originated the loan makes money through various fees charged at closing, then selling the loan enables them to turn around and do it again. Behind the scenes, your loan could be packaged with other loans and sold as part of a mortgage-backed security (MBS). This trading of MBS makes up what’s known as the secondary mortgage market. The workings of the secondary mortgage market may seem complex, but the goal is simple: to ensure that funds continue flowing through the housing and financing markets. MBS investors get income (from the mortgage payments of the MBS loan portfolio), and mortgage lenders get cash – with which they can extend loans to new borrowers.
What happens when your mortgage is sold? When a mortgage is sold, a new company is typically buying the servicing rights. Those rights include collecting and processing the payments, along with all the other regular duties that come with mortgages. Those duties may include making disbursements from an escrow account to taxing authorities and property insurers. Some entities specialize in taking care of those servicing obligations. Before your mortgage is sold, you’ll receive notice about the new servicer. Federal law requires that you receive a notice of the change at least 15 days before the switch. Then, within 30 days, the new mortgage owner must send you its name, address and contact number. See Mortgage, Page 8

eremy Nunes calls it the “money pit.” The three-bedroom, ranch-style home in central Illinois looked like a dream when Nunes and his wife purchased it in 2017, needing what appeared to be little more than a $10,000 bathroom remodel to be perfect. Then came the unexpected. A cascade of problems gobbled up their savings after the first year. Nunes spent $7,500 to waterproof the basement, $5,000 for gas line upgrades, $2,500 to repair the basement walls and $15,000 to fix his sewer line – an expense that forced them to borrow from family members. And he’s not done. The comedian and humor author estimates he’ll soon need up to $20,000 to replace his aging roof. How will he pay for it? “Sadly, I don’t know,” he says. Many homeowners find themselves in a similar predicament: pay for renovation costs that are near record highs or start another home search at a time when home prices have passed them by. As a result, homeowners in many corners of the country have been forced to temper their expectations of a perfect home and find new ways to adapt. That has meant learning how to fix what they can on their own, digging deeper into their finances than expected and, in some cases, redefining what a home is for their family. Here’s how four homeowners are navigating the decision to stay put and what they’re learning along the way.

Sweat equity, strategy and savings In 2021, when Billy Heany and his wife bought their 1,700-square-foot home in Federal Way, Washington, it felt just right, although it needed some updates. However, since welcoming two daughters, the house has grown tighter. Instead of selling, the wedding DJ focused on repairing and renovating to make the home work better for their growing family. With a 2.6% mortgage rate and a $2,600 monthly mortgage payment (including taxes and insurance), he says moving isn’t exactly an option for them. “We really like our house, and
we think we’re lucky with what we have,” Heany says. “But I don’t think we really have another choice. I was comparing it to a friend who’s looking to rent in the area. He’s like, ‘We can’t find anything decent for less than $3,000 a month and your mortgage is less than that.’ Heany knew he couldn’t afford the estimated $120,000 it would have cost to renovate the kitchen, update the electrical and plumbing, and repair rodent damage in the attic and crawl space. So he turned to his family and friends. “I became the project manager,” Heany says. “I would have teams of friends and family show up to, like, help do certain things. In today’s market, maintaining a home, not even ren-
ovating, is incredibly expensive unless you do a lot yourself.” For some families, financing home improvements with a home equity loan, HELOC, renovation loan, credit cards or personal loan is the only way to afford it. But Heany knew he didn’t want to go that route because of the cost. “Many large companies offer financing, but often at really inflated rates ranging between 12% and 30%,” he says. Nevertheless, Heany says that his choices aren’t just about money. “It’s useful knowing what things add value to the home, but it’s more important to treat your house like a home rather than an asset. Assets don’t raise a family or bring joy, homes do!”
For homeowners, buying an older house can quickly turn into a expensive reality. Jamie Mazur of Lyle, Illinois, knows this all too well. She and her husband bought a 1939 home in 2019 only to discover that updating it would cost far more than they imagined. A kitchen remodel was quoted at $120,000, way outside their budget. Fixing the leveling in their basement? Another $50,000. An air conditioning system? Another $20,000. Six years later, the travel and lifestyle writer and her husband still can’t afford to pay for any of it. For now, they have updated all the kitchen appliances and will paint the cabinets when their budget allows. “We haven’t considered taking out additional loans simply because both my husband and I are averse to taking on debt when we’ve already got a home loan and a car loan.” However, as Rachel Drew, director of the Remodeling Futures Program at the Joint Center for Housing Studies at Harvard University, explains, delaying much-needed housing repairs comes with its own problems for homeowners. “One is the likelihood that the costs to do the work will go up in the future and be more expensive later on,” she says. “Another is that older systems may not work as well as newer ones, costing homeowners more in the interim in higher operating costs. demand of either party. If the now ex-couple can determine who is to buy who out the other party, the property will be listed and sold under a prearranged price structure. If one person put more money into the down payment and closing costs, then that can be laid out in the agreement so they can recoup their initial investment. Additionally, the agreement can dictate that each party will be presumed to have contributed one half, or any other percentage, to the purchase and maintenance of the property, regardless of who actually writes the check. This makes dividing the final proceeds from the sale a lot easier and more equitable.

The only problem with these agreements is that couples in love are hesitant to contemplate breaking up. Just like in prenuptial agreements, no one wants to allow for the possibility of a breakup. Maybe it’s a karma thing? But it’s just plain crazy to pay hundreds of thousands of dollars for a house when, if the relationship ends, your financial life could be ruined for many years to come. A 2023 study conducted by Brown Jordan Outdoor Kitchens found that 63% of homeowners indicated they would prioritize an outdoor living space if they were to remodel their homes. What to do if your mortgage is sold If you receive a notice that your mortgage has been sold, the first step is simple: Don’t panic. The terms of the loan – your interest rate, monthly payment and remaining balance – will not change. In fact, the only significant changes will be where you make your payment and who you’ll call if you need assistance. But it’s still important to keep an eye on your information during this transition. While selling mortgages is fairly common, mistakes and errors can happen. Make sure to: •Read the notice carefully: Some lenders retain servicing rights even after selling a mortgage, so look for any mention of the mortgage servicer changing. If it is changing, confirm that all of your contact info is up to date so you don’t miss any important communication. •Update your payment process: You may need to redirect your ACH withdrawal – if

monthly statement – these usually include information about your loan servicer (the company that collects your payments). This document provides details about the current owner of your mortgage. •Review closing documents: Look through the papers from closing, including the promissory note and deed of trust. These documents may include information about the original lender and any subsequent transfers of ownership. •Contact your loan servicer: Reach out to your loan servicer directly by phone, mail or through its website. It is legally obligated to tell you who owns your mortgage or if it has been sold to another entity. •Use an online mortgage lookup tool: Fannie Mae and Freddie Mac, the government-sponsored enterprises that buy most mortgages, offer online tools that let you search for your mortgage by entering your loan number or property address. These tools also provide information about your loan servicer and the current owner of your mortgage. •Check with MERS: If your mortgage has been securitized, you can check the Mortgage
husband bought their 1910 Staten Island home in 2020, she fulfilled a lifelong dream. “My grandparents had an apartment for many years and never owned a home,” she says. “Always, this has been a lifelong, generational wealth type of dream for me.” They purchased the home using a VA loan, with her husband serving full-time in the Army National Guard. They also locked in an incredible 2.75% interest rate. But a decision that once felt like winning the lottery now seems more complicated. If they were to look for another house, “there’s no way we’re getting a comparable interest rate, and there’s no way we’re getting another home for the same cost of the home that we have,” she says. Soon after moving in, Mann
and her husband were hit with a $10,000 bill for a new furnace for their century-old home. That essential repair, along with a $7,000 bill for a water filtration system, wiped out their reserves and forced them to tap their emergency savings. There was also a $20,000 estimate to repair the aging electrical system in their 115-year-old house, though fortunately, she says those repairs aren’t needed right now. Mann recalls thinking, “‘What is wrong with you, Z? I don’t even have the money to really pour into the house.’” Now, the marketing and public relations leader can look back with a bit more perspective. She knows the role homeownership has played in helping Black families build wealth. Living through those unexpected expenses reinforced

Frequently asked questions • Can I stop my mortgage from being sold? No. As a homeowner, you typically can’t prevent your mortgage from being sold or transferred, and it’s a pretty common practice in the mortgage industry. Under federal law and under the terms of your loan contract (read the fine print), the lender has the legal right to sell the mortgage to another entity, lender or investor.While you can’t stop the sale of your mortgage, you do have rights under the Real Estate Settlement Procedures Act (RESPA) – the law requires your current and new servicers to provide you with notices and information about the transfer. To lower the chance of a future sale, consider choosing a mortgage provider that retains its loans, also known as a portfolio lender. • When your mortgage is sold, does it affect your credit score? No. Your mortgage being sold to another lender will not impact your credit score. However, it’s important to keep an eye on your her belief that the home is one of many ways she will pass on generational wealth for her three girls. “I see this home being the house that Mommy really wanted,” Mann says. “She got it, she fixed it up, she left us with something that we can make some money off of [renting it out]. The other side is maybe they all want to live here and be an intergenerational family in this home, as they are raising their own children, if they have any.”

What do I need to know about bathroom exhaust fans?
T
he bathroom exhaust fan might be the least glamorous item in your home. It’s small, it’s noisy and most days you probably flip it on without a second thought. But this modest little device plays a bigger role than you might expect, and it deserves a bit of care to keep doing its job well. A bathroom fan does more than clear out unwanted smells. Its real value is moisture control. After a hot bath or shower, humidity lingers in the air, settling onto walls, ceilings and fixtures. Over time, that moisture leads to mold, mildew, peeling paint, damaged drywall, and even warped trim. A good exhaust fan pulls that damp air out quickly, helping your bathroom stay clean, healthy and protected. Ventilation is key here. A fan must vent outside the home to do its job. If yours vents into an attic, crawlspace or ridge vent, the moisture doesn’t magically disappear. Rather, it just collects where you can’t see it,

Installers have several ways to route the airflow outdoors, including wall-mounted vents that push air directly outside or ceilingmounted fans that tie into ducts or vent through the roof. Ceiling mounts offer the most efficient airflow since warm, humid air naturally rises. If you’re considering adding a new fan, you have options. Handymen, electricians, and HVAC pros routinely handle this work. A typical installation takes three to four hours and costs between $100 and $900. Expect higher costs for first-floor bathrooms in multi-story homes because the installer may need to run longer duct lines. Silent or ultra-quiet models can also
increase the price; some run around $200 just for the unit. Some states require a licensed electrician to tie the fan into existing wiring. If drywall needs patching afterward, you may need a second contractor. Replacements usually cost less because the ductwork and openings are already in place. Whatever you choose, make sure your installer vents the fan outdoors and follows local building codes; proper venting is essential both for performance and safety. Once installed, your fan still needs attention. Dust, lint and humidity take a toll over time. A clogged fan has to work harder, shortening its lifespan and, in rare cases, becoming a fire risk. Give the exterior cover a quick dusting whenever you clean the bathroom. A few times a year, remove the cover and vacuum out built-up dirt.
