But once we leave the parking lot, I remember why we keep signing up every year. The sun will filter through the trees and make the snow sparkle. My kids will laugh and throw snow. And for minimal effort, I start Christmas with a simple family trip that reminds me to be grateful for the abundance and beauty in this world.

‘Please don’t sue me’ form just plain silly Q: My house is listed with a local real estate company. My agent has done a really good job of marketing the property and finally, last weekend, we got an offer with a good price from a fully qualified buyer. When my agent presented the offer I was anxious to sign and said something like, “just give me the pen.” That’s when she pulled out another form that was preprinted on her company’s letterhead. The words, “Hold Harmless” were printed across the top of the paper. She said I had to sign that document first before I could sign the contract. I’ve never sold a house before. When I bought this one my parents helped me buy it and, frankly, they did most of the work. So, when she presented the form I signed it and then signed the purchase offer. Last night I finally had a chance to read the paper. If I’m reading it right, it absolves my agent from any liability in the transaction, even if she screws up. In fact, there is a part that says I won’t hold the agent legally responsible even if, “the agent would otherwise be liable for gross misconduct, negligence, fraud, or breach of fiduciary duty.” Now I’m no lawyer, but it seems to me that if I’m paying my agent tens of thousands of dollars, they should be responsible for doing everything right. Am I missing something here? I don’t think anything has gone wrong with the sale so far, but if it does, what are the implications of this form I signed? A: None. That’s a silly form which we affectionately refer to as a “please don’t sue me” form. The form isn’t standard, but from time to time I see these
Tim Jones things crop up with individual real estate companies. The purpose is to alleviate any liability on the part of your agent, no matter how badly they make a mistake that causes you, their client, some harm. The thought is that, even if the hold-harmless agreement isn’t enforceable, you don’t know that. Then, if some kind of a problem crops up between you and your agent, you’ll read that form and think, “well, I guess since I signed the form I can’t sue my agent.” The reason there are no negative implications for you is that, as a matter of public policy, the courts will not enforce these agreements, especially when they refer to a residential transaction. And the law makes perfect sense. Like you said, if you’re paying for someone to perform a service, it’s pretty unreasonable to have you execute a release that in essence says, “even if I don’t do the job you paid me to do I still get to keep your money.” Regular readers of this column already know that your agent has a fiduciary obligation to you, meaning they must do their utmost to protect you, even to their own peril. Real recycling program, and in the spring, we collect a free trunk-load of mulch from the city to use in our yard. Which is the perfect segue into the best part of getting a fresh tree while living in a small house in Denver: no storage necessary. soft, not pokey (yes, they drop off, but not obnoxiously so); the color is rich and natural, not washed out or garish. A couple of pine-scented ornaments add to the ambiance, and voila! My fabulous fake is a thing of beauty. And easy to store, since it breaks into three pieces. As long as I have some help getting it in the bag and up in the rafters of the garage, that is. Of course, some will argue that an artificial tree isn’t as environmentally friendly as a real one. And they would be right. Still, I’ve had the same fake tree for more than 20 years now, so haven’t (yet) polluted a landfill with a plastic stem and branches. And it still looks as good as any real tree, IMO. With any luck, it’ll last another 10 years or more. Not bad for an investment of $129 for an 8-foot fake fir in 2001. Even Scrooge would approve of that.

fter the last winter season, I’ve started following several weather forecasting gurus. They all seem to be on the sensationalist side of journalism, but it makes it a lot of fun. It keeps me second guessing whether the collapse of the polar vortex is a good thing or a bad thing. As a horticulturNorman ist I know one Winter thing and that is that Snow is in the winter forecast. I made sure of that in September. As you can guess I am talking about plants, and indeed I am referring to Snow Princess lobularia or Sweet Alyssum. I first saw Snow Princess in 2009 at the California Pack Trials and a month or so later they were put in the Mississippi Medallion Plant Trials at the Truck Crops Branch Experiment Station in Crystal Spring, Mississippi. So, you can see I have already mentioned planting in the spring and the fall in the Deep South. Six or seven months ago, I wrote in this column about Snow for the Summer. It has won 113 awards, from North to South and East to West. The tag says cold hardy to zone 9 but I have never lost one to cold temperatures in zone 8. It is natural in mixed containers and yet is a tiger as a monoculture with the ability to reach 16 inches in height and spread to 4 feet, perfect as a floral groundcover. In September I planted Snow Princess in mixed containers throughout the landscape. By October they were already making a colorful impact. Their fragrant blossoms with their

Snow Princess sweet alyssum needs plenty of sun to live up to its potential; if you have part sun don’t fret, you’ll still garner the green thumb award. Next prerequisite is good drainage. This is normally not an issue in mixed containers with drainage holes and good potting soil. Raised beds with fertile soil typically drain well if you can build your beds with the prepared raised bed mixes. Can you imagine Snow Princess sweet alyssum with Supertunia Vista Bubblegum in a raised bed, how many hundreds of awards would that combo represent? he dawn of a new year is often characterized as a chance to wipe the slate clean and start anew. The tradition of making New Year’s resolutions reinforces that characterization, as many people resolve to turn over a new leaf and commit to a year of selfimprovement on January 1. While the phrase “wipe the slate clean” may be figurative, some also might take it literally, particularly in regard to their homes. Those who want to turn over a new leaf in a cluttered home can consider these storage solutions to give spaces a fresh and less claustrophobic feel in the year ahead. • Clear kitchen countertops. Kitchens are the most popular rooms in many homes, and that popularity can come with a cost. Clutter can quickly accumulate on kitchen countertops, which is both inconvenient when preparing meals at home and unsightly to residents and guests. Appliances used with frequency, such as coffee machines and toasters, can be given countertop real estate, but store lesser used items, like blenders and waffle makers, in cabinets or pantries. Mail or materials sent home from chil-
dren’s schools also can pile up in a kitchen, so resolve to go through the mail each day and discard unnecessary items. School papers can be read when children arrive home from school and any that need to be kept can be stored in a folder placed inside a drawer in the kitchen or a home office. • Install drawer dividers. Drawer dividers can help clear up cluttered spaces that might not be visible to the naked eye. Dividers inserted into kitchen drawers can ensure leftover containers are stored neatly and are easily accessible. Drawer dividers in a home office space can make sure desks don’t fall victim to disorganization, which can make it harder to find supplies and important documents. • Consider furniture that pulls double duty. Some home furnishings are more than meets the eye, and that multifunctional utility can help people conquer cluttered spaces. Storage ottomans are a prime example of furniture that serves multiple purposes. Blankets and throws left out on chairs and couches can make living areas feel more cramped and less organized. A storage ottoman can be a great solution in such spaces, providing both a place to put one’s feet and also a
clever storage solution for blankets and pillows. A coffee table with a small drawer or two can make for a multifunctional centerpiece to store remote controls, coasters and other small items that can encourage the buildup of clutter if left out when the room is not in use. A storage bench in bedrooms and guestrooms also can ensure these spaces stay clear of clutter. • Think vertical. It might be possible to work your way up if storage is a problem in certain areas of the home. Vertical storage solutions might be especially useful in areas like a garage, which can be difficult to navigate if garden tools and other outdoor items are left on a floor. Overhead storage racks that utilize a crank to raise and lower the rack when items need to be accessed and stored can be great ways to store holiday decorations and other items.
