Reasonable, unreasonable –that’s the question

Q: I have a next-door neighbor who throws noisemakers into my backyard. I have called the police because I understand these are illegal. This has been going on since 2001. I have asked these people to please stop throw ing their noisemakers in my yard, but they continue to do it. I suffer from post traumatic stress disorder and the loud noise disturbs me to no end. I understand that you can’t have any fun on holidays such as the Fourth of July without loud noises, and I make allow ance for the revelers. However, I draw the line at my backyard. I have read your previous arti cles on injunctions. So how do I go about getting one?

A: You didn’t describe the “noisemakers,” but I assume they are explosive in nature. If that’s true, there is not only the noise, but the real danger that one of these bombs will either hurt someone or start a fire. Certainly, the police should be involved because the risk of injury to people and property more than justifies law enforcement’s involvement.

If the police won’t take action for some reason, demand to talk to police supervisors until you get the help you need. If the police are able to use their authority to stop the problem you won’t need to bother with an injunction or other civil remedy. However, if the noisemakers are not dangerous, you are left

with a nuisance claim against your neighbor. An injunction is nothing more than an order from a judge to do or not do something. In this case, you want the neighbor to stop throwing

Injunctions like these require that you file a lawsuit. There are three levels of injunctions. If the danger is grave and immediate, you need to get a temporary restraining order, or TRO. You first have to file your lawsuit and then make an appointment to see a judge, usually within 24 hours. Known as an ex parte hearing, because the defendant usually isn’t there, and you must convince a judge that the neighbor’s conduct is so unreasonable and you are most likely to prevail at trial. You must also make the argument that, without an immediate injunction, grave harm will result.

That shouldn’t be a problem here since throwing anything into your yard is wrong. Owing to the unique problems you experience as a result of your PTSD, you probably have a winner at this level.

The judge will then set a hearing date at which he can enter a temporary injunction. This is simply an order that the temporary restraining order will stay in place until the resolution of the lawsuit. The neighbor, and the neighbor’s lawyer, will attend this hearing and make

San Francisco, Fairfield are 2 different worlds

The “AI boom” has pushed singlefamily median home prices in my old hometown of San Francisco to a historic record of $2.15 million as of March 2026 per Google AI and per Realtor. com the median in my current home town of Fairfield for March was $620,000. Fairfield is only 46 miles away from San Francisco and you can buy a home here for one-third the cost.

The AI Boom has created hundreds of multimillionaires. Believe it or not, quite a few people bought $10,000 worth of Nvidia stock before St. Patrick’s Day in 2016 and now that investment is worth $1.8 million. Wow, talk about luck of the Irish!

This is the “AI Boom” that has created a ton of new wealth for investors and for the employees of these tech companies. It’s not the old San Francisco money that is paying $2.15 million for a 1,400-square-foot house on a 3,000-square-foot lot.

As of March, there are only 550 homes for sale in San Francisco and around 250 in Fairfield, while 5,000 real estate agents are working the big City and 1200 or are working in the Fairfield and Northern Solano County markets.

While the two cities are quite different, the one thing both have in common is a shortage of homes for sale.

Rather than building on site, a manufactured home is built in a factory on a permanent steel frame and transported to your property, where it will be affixed to a permanent foundation.

A new category of factory-built homes blends the affordability of manufactured

housing with the appearance and financing advantages of site-built homes. They are nearly indistinguishable from site-built homes aesthetically and are constructed using the same building materials. Safety and quality are top priorities in their construction; they are inspected to meet or exceed U.S. Department of Housing and Urban Development Code in such areas as durability, energy efficiency, thermal and electrical systems and fire resistance.

Offering Affordability

A manufactured home may make homeownership

possible for more American families. The average price of a new, single-section factorybuilt home today is around $200,000 including the land, versus more than $500,000 for a new site-built home.

Fortunately, this affordability does not come at the cost of quality. The process of building manufactured homes in a factory is quick, efficient and cost-effective, which accounts for their relatively low cost. It also does not come at the cost of long-term pay-off. According to the U.S. Federal Housing House Price Index, a manufactured home appreciates in value similar to a sitebuilt home.

Titling Considerations

Depending on who owns the land you live on, you can title your home as real property or personal property (also called chattel or home-only). Real property, often called real estate, refers to land and any structures affixed to the land. Personal property is a broader category that covers any property you own that is movable, such as vehicles, tools, furniture and other belongings. Finally, if you win your trial, the court will issue a permanent injunction making your neighbor guilty of contempt of court, which is a crime, if they continue with the noisemakers.

This is a huge oversimplification of the process. Any lawsuit is more complicated than this, but I’ve given you the basic outline of a nuisance action in which an injunction is sought.

Look, if the noisemakers are flying into your yard, you should have little problem prevailing in court. However, if the noisemakers are in your neighbor’s yard, but the noise

2026 celebrates the Year of the Impatiens

The National Garden Bureau has named this the Year of the Impatiens. I could not be happier. Very few flowers provide nonstop blooms from spring until frost in the deep South. From impatiens that look like a rose to riveting color in the shade garden and in full sun, the impatiens can do it all. Let’s go basic, and that is the bedding impatiens. I can remember a time in my horticul tural career when they were No. 1 at all garden centers, and then the plague set in with a spite ful mildew. But that has changed and toughness and resistance has been put back in.

I plant the Soprano impatiens every year and love mixing the Soprano Red, Orange and Salmon, creating what I consider a Santa Fe mix. The color is nonstop all summer and these vibrant colors light up the shade garden.

I love mixing the Soprano Violet and Salmon shades around colorful Shadowland Autumn Frost variegated hostas. But I like them with Heart to Heart caladiums. Chartreuse colored foliage plays well with any color of Soprano impatiens. I will always use them with Golden Delicious pineapple sage and Shadowland Coast to Coast hostas. Then I like to use them in proximity to the shocking blue blooms of Let’s Dance hydrangeas.

In the trials, visitors were amazed. At the Fall Flower and Garden Fest, I would just stand by the flowers and say, “SunPatiens.” SunPatiens with yucca for sure, SunPatiens with lantana— sure, why not? So now years later I am planting them with Rockin Blue Suede Shoes salvia. Some with Luscious lantanas. Son James uses them with Heart to Heart, Burning Heart caladiums and ColorBlaze Wicked Witch coleus. There seems to be no combination too wild to try. Now the one other secret. Nowhere will you find impatiens on a pollinator list, but I have photos of swallowtails and yellow sulphurs hitting on them. The sulphurs are particularly fond of both the Soprano and the SunPatiens. Fertile organic-rich beds will put you in the driver’s seat and of course water as it promises to be a hot summer. The Year of the Impatiens needs celebration at your house.
