Omaha Police Department Chief Todd Schmaderer will soon receive an honor several in this city — from Martie Cordaro to Mayor John Ewing Jr. and more — have called their favorite achievement.

The new headquarters for Mutual of Omaha, at 677 feet the city’s tallest building ever, is on track for opening in 2026. The project leads a list of major projects underway or in the planning stages, leading officials in the commercial real estate development field to forecast a robust year of positive growth ahead.

Schmaderer’s caricature is set to be the latest “Face on the Barroom Floor” at the Omaha Press Club, where more than 150 friends, family members and colleagues will gather to roast OPD’s longest-serving chief. The hand-drawn honor is reserved for those who have made a lasting mark on Omaha, and after 13.5 years leading the department, Schmaderer has earned his place among the likes of boxer Terence “Bud” Crawford and astronaut Clayton Anderson.
Schmaderer isn’t going anywhere soon. Last year, the chief secured a five-year extension past his mandatory retirement date, driven in large part by a juvenile justice crisis he wasn’t willing to walk away from.
MBJ recently sat down with Schmaderer for a closer look at his career, and life.

Local business owners have formed the Streetcar Impact Alliance in Omaha, which held its first official meeting on Feb. 23. The group is headed by Mercury owner Clark Ross, who has said he started it because businesses are losing money as the result of having construction downtown while the city builds the infrastructure for the streetcar. During Monday’s meeting, the group decided on three initiatives to present to the city. They would like: A direct mitigation grant fund, not a loan, to help offset costs to businesses showing revenue loss; a temporary pause on taxes, such as property, sales, and restaurant; and a validated construction parking program for those working at impacted business and/or those patronizing impacted businesses.

The Omaha Entertainment and Arts Awards announced trophy winners during a special celebration of local visual art, music and performing arts at The Admiral on Feb. 15.
This year’s award show was hosted by two board members: Nebraska Writer’s Collective co-executive director Zedeka Poindexter, and local musician and organizer Aly Peeler. Leading production behind the scenes was the award show’s co-directing team of Hughston Walkinshaw, a former board member, and current board members Lori Lynn Ahrends and Julian Adair.
Performances during the evening included a remix from The Lofte Community Theatre’s “Something Rotten!” cast to open the show and stand-up comedy from Rachel Ware. Also appearing was a musical performance by Hector Anchondo, and an original spoken word and dance performance by poet Allen Stevenson and Ever After Dance Company. An in-memoriam tribute to members of Omaha’s creative community who have passed, paired live music with a remembrance video.
For the third consecutive year, trophies were one-of-a-kind glass artworks crafted by Matthew Shrader, studio manager at Crystal Forge inside the Hot Shops.












Eddie Bauer closes at Nebraska Crossing
As part of closing nearly all of its 175-plus brickand-mortar stores in the U.S. and Canada following its operator filing for Chapter 11 bankruptcy, the Eddie Bauer store at Nebraska Crossing in Gretna has ceased operations. The Seattle-based retailer is transitioning to an all-digital platform, according to media releases. Onsite signage indicates the Nebraska Crossing space formerly occupied by Eddie Bauer will soon be home to The Buckle, a Kearney, Nebraska-based apparel retailer with more than 400 stores in 42 states.
Autozone to open in 84th and Center space
Auto parts retailer Autozone has announced plans to take over the former CVS Pharmacy space at 8315 West Center Road. It will be the company’s 14th Omaha-area store since the chain, originally called Auto Shack, established its first Omaha store in 1985.
Congressional Record recognizes two
Official copies of the Congressional Record were presented to community leaders and politicians Brenda Council and Fred Conley by Nebraska Rep. Don Bacon as part of the annual Congressional Resolution celebrating National Black History Month. Earlier this month, Bacon delivered remarks on the House floor honoring Council and Conley and entered their accomplishments into the Congressional Record.
North Omaha native Brenda Council’s historic career was marked by several firsts for Black women in Nebraska and Fred Conley was Omaha’s first Black city council member whose career was defined by breaking racial barriers and advocating for the revitalization of North Omaha.
The federal Bureau of Economic Analysis recently released its report on statewide gross domestic product growth for the third quarter of 2025. Nebraska’s GDP grew by over 5% for the second quarter in a row, ranking as the 13th-highest state GDP growth for the time period. Nebraska also showed personal income growth of 5.6% for the quarter, ranking No. 2 in the nation.
Personal finance company WalletHub has released its 2026 Property Taxes by State report comparing home and vehicle property taxes nationwide along with insights from a panel of experts. The study determined that the average U.S. household pays $3,119 in annual real estate property taxes, with residents of the 26 states that levy vehicle property taxes paying an additional $499. Nebraska ranked in the top 10 highest tax rates for both categories and Iowa also ranked in the top 10 for highest real estate property taxes.
Council Bluffs Community School District was awarded $100,000 from Google for STEM projects, which the district announced will be used toward an autonomous robot, new welding booths and specialized Project Lead The Way engineering devices, and IT hardware for interdisciplinary courses. A news release noted this contribution will provide students with expanded access to industry-standard equipment ensuring they are prepared for highdemand future careers.
PGSA Hospitality announced this week that a new hotel, Millwork Hotel, will soon join Millwork Commons. Expected to open in late 2027 at 1201 Nicholas St., the hotel will have 144 guest rooms as well as a restaurant and rooftop bar among its amenities. It will be part of Aparium Hotel Group’s Aparium Collection of lifestyle hotels across the country developed to reflect the character and culture of their surrounding neighborhoods. Other project partners include Alley Poyner Macchietto, interior design firm Curioso, and Lund-Ross Contractors.
The University of Nebraska has announced the launch of its Artificial Intelligence Institute. The institute is a systemwide initiative that positions Nebraska as a national leader in shaping the future of responsible, human-centered artificial intelligence, per a news release, and will harness emerging technologies to serve society, grow the economy and support future generations through education, interdisciplinary research, teaching, workforce development and public engagement. AII’s work will span sectors including health care, agriculture, rural and urban development, business and national security, placing Nebraska at the forefront of applied AI research and advancement.
CHI Health and the Omaha Economic Development Corporation have announced that a long-vacant building in north Omaha will soon transform into CHI Health’s Central Kitchen, bringing jobs to the community and meals to 2,800 hospital patients across the state.
The Omaha Economic Development Corporation owns the property at 1127 N. 20th St. in Omaha and has worked with CHI Health and the Empowerment Network for nearly a decade to develop a Community Innovation Campus. After securing $14 million in funding to renovate the space into a 19,000-squarefoot, USDA-certified kitchen, construction is expected to begin soon with CHI Health’s Central Kitchen slated to open next year.
Bennington Health Center to open soon
Nebraska Medicine’s new Bennington Health Center at 156th and State streets will open March 9. This gives Bennington families a Nebraska Medicine primary care facility in their own neighborhood. The facility will be open for appointments 8 a.m. to 5 p.m. Monday through Friday.
lauded for community engagement
The University of Nebraska Medical Center has been awarded the 2026 Carnegie Community Engagement Classification, one of the highest national honors recognizing an institution’s commitment to community engagement. UNMC, which first received the classification in 2015, is one of 279 institutions across the county currently holding it.
The Omaha City Council has approved a request to rezone a site at 46th Street and North Saddle Creek Road from industrial to commercial for the proposed Saddle Creek Marketplace development. The property is currently home to a Family Fare grocery store and two retail strips. The City Council also approved $9 million in tax-increment financing for the $103 million redevelopment plan, which includes renovating the Family Fare building into multiple tenant bays and constructing a new four-story building with 138 market-rate apartments to the south.
Paradise Bakery & Cafe opened a new location Feb. 9 at the Nebraska Medicine Village Pointe campus at 111 N. 175th St. The location focuses on takeout and delivery and also provides limited seating. A larger Paradise location at Village Pointe Shopping Center, now occupied by another restaurant, Early Bird, relocated to Gretna in 2025.

MBJ: You’ve pointed to 90 kids in the Douglas County Youth Center as your tipping point for staying. What will OPD do differently ?
TS: One of the aspects that drove this was juvenile justice, because at the time it was really plaguing our city. The last couple of years, we’re starting to see some declines, some progress in the reduction of juvenile violent crime. The data and the influence we’ve had with it, we feel, has worked.
What we notice is that a small percentage of kids are committing violent acts, doing it over and over again. We need a system in place so that after the first time, there’s some type of holistic process around these kids so it does not occur again. We’ve parsed the whole issue down to that one remaining piece.
MBJ: You’ve said the problem in policing is retention. What are you doing to hold on to experienced officers?
TS: After 2020, the profession took a real hit: a universal dip in applicant numbers. Now you’re starting to see a resurgence, especially within Omaha police. Applicants tell us they’re applying because of the reputation of the department. At any given time, 200 to 300 people could leave based on the sheer size of the agency. That’s why we put things in place like DROP (Deferred Retirement Option Program) and incentives within our collective bargaining agreements. As we bring in new officers, we need veterans to establish the culture.
MBJ: OPD has posted a 100% homicide clearance rate three years in a row. What does that mean beyond the statistic?
TS: The work done in Omaha on crime reduction has been held up nationally as a model. We have cities that reach out to replicate what we’ve done. The Obama Foundation gave us an award as one of the top cities in the country. As the longest-serving major city chief right now, I have an influence. All of that goes toward attractiveness; when we look for lateral officers from Kansas City, Chicago, Minneapolis, we can make that case.
MBJ: Your nephew just joined law enforcement. You’ve led this department through serial killers, the death of Officer Kerrie Orozco, what you’ve called “carnage.” What went through your mind watching your nephew take that oath?
TS: My nephew is somebody I am close to. I had a large influence in his life when he was young; he would travel with us, come on vacations. So it was a proud moment to see him put that badge on.
I look back at my career and I would not do anything different. The stress was there, the pressure was there, but when bad people step up in this world there have to be good people who step up to stop it. The job will chisel at you; when you lose support of a community, when you lose support of a country, that takes a toll. Most officers get into this for the intrinsic value … but you always have to guard against the piece that chisels away. When you enter people’s lives at the worst possible moment — that’s what a 911 call is — it has a way of getting into your head.
When bad people step up in this world, there have to be good people who step up to stop it.
MBJ: You recently met with FBI Director Kash Patel. Your public statement was diplomatic. What did you actually take away from that meeting?
TS: I’ve met with the last four FBI directors. Those meetings have to be private; you’re asking your police chief and the federal government to talk about sensitive matters to keep the Nebraska population safe. What struck me about Kash Patel was how friendly and down to earth he was. He kept the tone throughout: What can the FBI do to assist (the) Omaha Police Department in reducing violent crime? He wasn’t trying to give me priorities, he basically said let us help you address yours.
MBJ: You’ve worked for three mayors now. What does John Ewing’s police background give him that the others didn’t have?
TS: John Ewing has a skill subset that’s very refreshing. When I bring a matter to him, he has an instant understanding of all the layers that go into it. The other mayors understood the issues but I would have to explain them. John already has that. He’s also got an inner maturity that’s very impressive.
MBJ: The 2022 letter to Douglas County Sheriff (Aaron) Hanson was marked not for public dissemination but it became very public. What did writing that cost you?
TS: I don’t talk about it. It’s a leaked letter.
MBJ: What do you wish someone would ask you?
TS: A lot of times people have forgotten where Omaha has gone, where we came from. If we went back 13 years, you’re going to see a much different city crimewise and with police-community relations. There was a gray cloud over it. If you do a comparison between then and now, Omaha is a much better city.

“Omaha continues to show its stability and resiliency,” said Kristi Andersen, vice president at CBRE. “We are traditionally conservative in our approach; not overbuilding, which helps during economic downturns, and we’ve seen that play out in the latest numbers.”
Jason Lanoha, president and CEO of Lanoha, a real estate development company, said while capital markets remain disciplined and higher interest rates naturally temper some speculative development, there’s still much that’s positive in the local market.

“We believe Omaha continues to benefit from economic stability and diverse employment sectors,” Lanoha said. “We are not immune to national headwinds, but our market tends to avoid extreme swings. Projects that are well-conceived, appropriately capitalized and responsive to actual demand will still move forward successfully.”
According to statistics provided by Andersen, the office market ended 2025 with three straight quarters of positive absorption and is now sitting at a 10% vacancy rate, half of other markets.



“We’ve also seen sublease space come down significantly since 2022, which is a really good sign,” she said. “Companies looking to move are leaning into what we call ‘flight to quality’ and are looking for space that attracts and retains talent and is surrounded by amenities.”
The retail market ended 2025 with a vacancy of just 6%, much lower than at the height of the COVID-19 pandemic. Currently, there are 10 retail properties totaling 490,377 square feet under construction, according to Andersen. Approximately 70% of this space is either preleased or build-tosuit space.
The industrial market continues to be tight with vacancy at under 2%, Andersen said.
A towering achievement will occur in 2026 with the completion of Mutual of Omaha’s new downtown headquarters. The 800,000-square-foot building will soar 44 stories and is situated at the west end of the Gene Leahy Mall. The project remains on track for a 2026 opening, Lanoha said.

and in the future,” he said. “Beyond that, we, Mutual and the design team believe it is important to create something aspirational for the city that demonstrates best practices in performance, sustainability and workplace experience.
“The result is a transparent, elegant tower with an activated lobby, a multilevel sky lobby of shared amenities, and outdoor terraces that bring nature into the workday.”
Mutual’s new headquarters. combined with the adjacent streetcar project, will reinforce connectivity between Midtown and downtown and enhance accessibility for employees, residents and visitors, Lanoha said.
Infrastructure investments such as the streetcar will reduce friction and expand the perceived footprint of downtown, making sites more attractive for multifamily, retail, hospitality and additional office users, he said.
“The time is now,” said Garry Clark, executive director of Omaha’s Inland Port Authority, a public entity for inclusive economic development. Within the IPA’s boundary, covering 3,000 acres near Omaha’s Eppley Airfield, is a planned $90 million Airport Business Park featuring three properties for development. The first is a 150,000-squarefoot speculative building in the 5900 block of Abbott Drive. The shell of the building is up with interior work still needed, Clark said. The IPA, which is overseeing $90 million in state funds for this business park, has directed $40 million of that to the Omaha Economic Development Corp., which is in the process of closing on that property, he said.

There is also what he termed Enterprise Park near north 16th Street with 41 developable acres for industrial use. The third project calls for 170 housing units, mostly multifamily designs, on north 16th Street. An announcement is expected soon on the Innovation District on Ames Avenue from 30th Street to the east.
“Our desire is to show action as opposed to more studies, more meetings,” Clark said. “We want to build the plane as we are flying it.”
Altogether, this may be the most significant investment in that part of Omaha ever, he said.
“This is about making significant economic and lifestyle impacts to that area, which will help all of Omaha,” Clark said.
It isn’t just new construction that’s making economic noise this year. There’s also major renovation/addition projects, headlined by the CHI Health Center.
“The approximately $200 million addition and renovation adds meeting rooms and function space that will enhance Omaha’s reputation as a convention destination,” said DLR Group Senior Principal and Global Sports Leader Don Barnum. “It positions the city more competitively with comparable markets to drive more business events and additional conventions to Omaha.”
The addition comprises two levels of new meeting rooms of various sizes and organizational flexibility and pre-function space for circulation, registration, food and beverage, and more, Barnum said.
There’s interconnectivity through a grand stairway and gathering space; hidden support space for servicing each meeting room; and kitchen additions and renovations to support and upgrade service to the full convention space.
“The addition is structured over the existing loading dock of the convention center and provides covered load in/out while also enhancing the aesthetic appeal of the east side of the facility,” Barnum said. “Recent development of private, civic, parks and cultural venues along the riverfront provided opportunity to reimagine the east side of the convention center.”
This new addition takes advantage of views along the river and presents a dynamic and beautiful facade becoming a great neighbor to the other exciting development on the river, he said.
“The pre-function spaces for two levels of new meeting rooms feature floor-to-ceiling glass overlooking the river, providing a wonderful light-filled event space and beautiful views to the bustling riverfront activity beyond,” he said.
Andersen said other development and construction hotspots include West Dodge Road and 204th Street from Gretna to Bennington; the West Maple corridor; and in Sarpy County along Highway 370.

Lanoha said Omaha benefits from steady, measured growth rather than rapid spikes. Additionally, developers and lenders first look at fundamentals such as purpose, place and long-term value when it comes to making important decisions on projects, he said “Development here is typically relationship-driven and grounded in long-term ownership perspectives,” Lanoha said. “Projects are often backed by strong local institutions and lenders who understand the market fundamentals.
“Omaha offers a compelling combination of central geography, a diverse and stable employer base, a strong workforce and predictable operating costs. Levi Carter Park Sports Complex (East Omaha): A 100,000-squarefoot indoor sports facility planned for 2027 completion.
Millwork Hotel and expansion (North Downtown): Newly announced, this 144-room boutique hotel is part of a further expansion of the tech/creative hub in 2027.
Tranquility Commons (Northwest Omaha): This $54 million project will add hotels, retail, and restaurant space, including the Chicken N Pickle pickleball-themed restaurant, to the youth sports complex area.

Employers watching federal agencies withdraw guidance and rescind DEI programs may feel the temptation to exhale; however, employment law attorneys advising Nebraska businesses say that instinct is precisely what gets companies into trouble.
“These developments should not give employers a false sense of security,” said Patrick J. Barrett, partner at Fraser Stryker. “The law remains the law.”
The agencies charged with enforcing federal employment law have shifted priorities and withdrawn guidance at an unprecedented pace. Statutes governing laws such as Title VII, the Americans with Disabilities Act, and the Pregnant Workers Fairness Act remain in place and employers who use the current moment to stand down may find themselves exposed.
The Equal Employment Opportunity Commission has undergone one of its most visible transformations. One of its core missions is enforcing civil rights laws but, Barrett said, they appear to be “attempting to declare what discrimination is not regardless of Supreme Court decisions and congressional statutes.”
One clear example is the agency’s treatment of sexual orientation and gender identity discrimination. The EEOC has moved away from treating those complaints as sex discrimination despite the Supreme Court’s ruling in Bostock v. Clayton County that, “An employer who fires an individual merely for being gay or transgender violates Title VII.”
Ruth Horvatich, a partner at McGrath North who presented at the Human Resources Association of the Midlands employment law update in February, offered a framing that every human resources professional in the room should heed. She said the EEOC is a stepping stone, not the final word.
“Once you get to court,” she said, “the judge is going to look at and interpret the statutes that are on the books.”
That distinction matters because the current EEOC appears to be sending different signals than its predecessor. Horvatich noted that under current EEOC chair Andrea Lucas, the commission has rescinded nearly 200 pages of Biden-era harassment guidance, overhauled its voting protocols to concentrate authority in the chair’s office, and

repositioned reverse discrimination and religious rights as top enforcement priorities. It now actively solicits charges from workers who believe they have been harmed by DEI policies, a complete reversal of the agency’s prior posture.
“The most common religious accommodation requests involve scheduling modifications so employees may observe religious obligations, as well as religious expression in the workplace that may conflict with a dress code or employer policy regarding employee appearance,” said Ellen Geisler, attorney with Lamson Dugan & Murray.
“The biggest mistake an employer can make is failing to take the request seriously and engage in a good-faith dialogue with the employee or job applicant to identify an accommodation that works for both the employer and the individual.”
Geisler said for the employer, the key question is whether agreeing to the religious accommodation would create an undue hardship on the business, a highly fact-dependent inquiry that varies based on the nature of the business and the employee’s role.
“For example, if wearing pants is required for safety reasons when operating a particular type of machinery, allowing an employee to wear a loose-fitting skirt for religious reasons while working near that equipment may constitute an undue hardship,” she said. “If a requested accommodation would pose an undue hardship the employer should work with the employee to explore alternative options.”
Marcia Washkuhn, a partner at Kutak Rock who leads the firm’s national employment practice group, said the volatility runs deeper than leadership changes. Agency directives and attorney turnover are making enforcement behavior unpredictable. In her own practice, Washkuhn said the strength of a case for the agency does not always appear to govern how aggressively it is pursued.
“They aren’t granting as many extensions on certain types of enforcement actions, even when there’s a shift or a government shutdown,” she said, “because they have certain agenda items they’ve been directed to pursue.”
Barrett’s guidance is to maintain anti-harassment policies and training, continue investigating complaints, and anchor policies to Supreme Court precedent rather than withdrawn agency guidance.
The administration’s executive orders have reshaped the DEI landscape and created HR risks on both sides. Attorneys say neither group is as safe as it thinks.

All this because Title VII’s protections against policies with discriminatory effects, regardless of intent, remain intact even as federal agencies pull back from pursuing those cases themselves.

warned in December 2025 that the agency would use archived web content to identify DEI programs that may have been rebranded rather than eliminated. Renaming a DEI initiative as a “culture and belonging” program, she said, is unlikely to provide cover.
Washkuhn focuses on what concrete action looks like. She advises clients to scrutinize any written DEI plan, policy or program for language that could be construed as using protected status in employment decision-making. Inclusion initiatives can continue, she said, but they need to be grounded in business objectives.
Affinity groups require particular attention: employers must ensure that membership is open and that people are not being excluded on the basis of protected characteristics, even where a protected characteristic is the basis for the group’s existence. To this end, manager training is essential.
“You need to be training managers in particular to ensure they understand they can’t have conversations that consider those kinds of characteristics,” she said.
The Pregnant Workers Fairness Act, which started in June 2023 and requires employers with 15 or more employees to provide reasonable accommodations for limitations related to pregnancy, childbirth and related medical conditions, remains an active enforcement priority and one that employers routinely misapply.
Barrett laid out the most common mistakes, saying employers frequently force expecting or postpartum employees onto leave rather than accommodating limitations that would allow them to keep working. Leave should be a last resort, he said, not the first option.
Companies also often require employees to return with no restrictions, when the PWFA allows workers to remain qualified even if temporarily unable to perform essential functions. Demanding unnecessary medical documentation is another sticking point; a doctor’s note isn’t required for sitting breaks or restroom access. Finally, failing to protect confidential accommodation-related medical information instead of storing like any other ADA medical record is on the rise.
As Washkuhn noted, even though the PWFA is still new and different enough from the ADA that revising policies often involve getting counsel involved, common PWFA accommodations aren’t that complicated including water access, additional restroom breaks, food breaks or alternating sitting and standing. Remote work accommodations, particularly late in a pregnancy, may require more deliberation but the employer is obligated to consider the request.
The immigration compliance picture requires no subtlety: the administration has targeted 12,000 to 15,000 I-9 audits per year and no industry is exempt. The ICE raid at Glenn Valley Foods in Omaha last summer, in which 100 employees were arrested, illustrates the enforcement posture, said Diana Morales McFarland, a partner at McGrath North, during the HRAM program.

information without realizing it.
“Hire counsel at the outset,” Washkuhn said. “Don’t wait until the end.”
“Receiving an EEOC charge of discrimination or notice of a DOL investigation can be intimidating, particularly for employers facing the process for the first time,” Geisler said.
Employers should contact an attorney immediately upon receiving a charge or notice of investigation, she said while noting deadlines to respond are often short and investigators typically request documents and detailed information. Early legal guidance is critical.
“An attorney can assess risk, advise on legal obligations, help prepare a thorough response, and advocate on the employer’s behalf during the investigation,” Geisler said. “A common mistake employers make is failing to properly investigate and document employee complaints at the outset. Employees often raise concerns internally before escalating them to the EEOC or DOL. Prompt investigation, thoughtful evaluation, consultation with counsel and clear documentation can significantly mitigate risk if a formal agency investigation later occurs.”



Washkuhn reinforced the point that employers must actively monitor their workforces for workers whose previously authorized status has been revoked rather than waiting for an audit to surface the issue. Fines for substantive I-9 violations currently range from $288 to $2,861 per form, meaning errors on half the I-9s in a workforce of 1,000 employees could generate a penalty exceeding $1.4 million.
“You can’t dig a hole and put your head in the sand and pretend like you didn’t know,” she said, “if there’s reason to believe that a person is undocumented.”
McFarland’s prescriptions include to conduct an internal I-9 audit now, correcting errors in red ink with initials and dates. Never back-date a correction, she said, and establish a written ICE response plan before one is needed.
Washkuhn also flagged two other areas she believes Nebraska employers are systematically underestimating. These include employment laws governing remote workers in other states, especially those such as Colorado, that carry different requirements for classification, sick leave and paid family leave. The other is the risk of employees using web-based AI tools in ways that expose confidential company

Running a business is hard enough without worrying about hidden legal missteps. From misclassifying employees to overbroad agreements, a few routine errors can trigger costly disputes. Here are five common mistakes that I see businesses make, and what you can do to avoid them.
Q: What’s one of the most common employment law mistakes that businesses make?
A: Misclassifying workers. Businesses often misunderstand the difference between independent contractors and employees. The company’s characterization of the relationship does not determine whether the worker is properly classified. Instead, the analysis depends on the actual working relationship and the level of control over the worker. Misclassifying an employee as an independent contractor can result in back taxes, government penalties, wage claims for minimum wage, overtime and attorneys’ fees and other violations. If you have independent contractors who are paid on a 1099 basis, it is essential to conduct periodic audits of the relationship and applicable agreements.
Q: How does misclassification relate to overtime compliance?
A: Misclassifying employees is closely related to misclassifying exempt status under the FLSA. Many employers assume that salaried employees are exempt from overtime requirements, but that’s not always true. An employee’s exemption status is based upon their actual job duties as well as the compensation they receive. Non-exempt employees must be paid overtime for all hours worked over 40 in a week, including remote work and time spent working “off-the-clock.” Overtime violations can lead to significant liability, including back-pay, liquidated damages (double damages), civil penalties and attorneys’ fees. Accurate timekeeping and regular exemption audits are critical.
Q: Do I really need to review my employee handbook and policies again?
A: Yes! Employee handbooks and workplace policies set expectations and provide important legal protections. Outdated policies may not comply with the law, and they can create confusion and inconsistent enforcement. Regular policy reviews help reduce risk and prevent disputes before they start.

Q: What do businesses get wrong when handling workplace complaints?
A: Businesses often ignore complaints or fail to timely investigate because they don’t take them seriously. However, this can significantly increase legal exposure even for seemingly meritless complaints. Prompt, documented investigations and clear reporting channels protect both the business and employees.
Q: Can employment agreements create legal problems?
A: Absolutely. Overbroad non-competes, confidentiality, and non-solicitation provisions are increasingly litigated and scrutinized. If these restrictions are not carefully drafted and narrowly tailored, they may be invalid and unenforceable, which means that the business is not actually protecting itself with these restrictions. What’s more, you may be inviting employees to challenge your agreement.
Q: Any additional advice for employers right now?
A: Pay attention to immigration compliance. ICE is currently focused on worksite enforcement for both large and small businesses. Employers should ensure that their I-9 forms are accurate and up to date. Businesses should also train their personnel on how to respond to ICE inspections and raids at work. Preparation before this occurs is crucial to minimizing disruption and potential liability.

The Nebraska Library Commission recently awarded Nebraska Library Internship Grants totaling $20,000 to 18 Nebraska public libraries. These internship grants will support public library interns who will contribute to the scope and value of the diverse programs and activities in Nebraska’s public libraries.
“The internships are a great opportunity for students to get involved in library work. Beyond earning money and gaining valuable work experience, the student is exposed to the broad range of library services and programming. Internships provide an opportunity for the student to view the library as a viable and satisfying career choice. In addition, interns bring a fresh perspective and their own unique talents to the library,” said Nebraska Library Commission Director Rod Wagner.
Student interns will learn about library work as they shadow staff, assist with day-to-day library operations, and implement special projects.
Some of the activities that students will participate in include:
• Summer Reading Programs for youth, teens, and adults
• Public relations: website, social and print media, designing and posting flyers and other forms of marketing
• Various programming: Story hour, movie days, craft days, junior book talks, Lego Club, puzzle contest, preschool story time, after school programs, STEM activities and gaming setups

If there’s one thing John “Buzz” Garlock loves, it is a comeback story. Garlock, who founded Garlock Wealth Planning Group, has lived the ups and down of entrepreneurism for decades, leading the firm to Barron’s recognition as one of the top 1,200 financial advisors in the country multiple times.
But Garlock’s business success only scratches the surface of his story, itself a tale of the underdog made good, built on an unshakable platform of character and ethics.
“My father, John ‘Jack’ Garlock, was a B-24 crewman who flew missions over Indonesia in World War II,” he said of one of his earliest role models. “He taught me everything that mattered: duty, respect, integrity. His values became the compass I’ve followed ever since.”
At then-Bellevue High School Garlock was an overachieving athlete, the scrappy work-harder type who delighted in taking charges and sliding headfirst into second base. He’d carry that into a decorated two-sport career at Bellevue University where he graduated with honors, amassed the school’s 1976 Athlete of the Year award and still holds school records for most assists in a game, season and career. Seven years ago, he was enshrined in the Bellevue University Athletic Hall of Fame.
All this coming after the tragic loss of his father when Garlock was a junior at Bellevue High, a gut punch that nearly derailed all that was to follow were it not for another monumental figure in his life.
“My dad died of a heart attack driving the family to my first varsity basketball game,” he said. “After that happened, I didn’t always make the best decisions. I was young for my grade — when I was a freshman at Bellevue University, I was still 17 years old until the end of October — so I was immature and made immature decisions.
“Jerry Mosser, my coach at Bellevue University, said, ‘You know, if you cut your hair and you play your cards right, you’re gonna have a successful career here.’ He was such a mentor to me, and I will be forever indebted to him for that. Would I have been able to play at Creighton or Nebraska? Probably not, but I got to play two sports there, and I wouldn’t change a minute of that because of relationships like that with my teammates and coaches.
A few years after graduation, Dan Wolfgram hired him on to start his career in financial planning and Garlock never looked back. Today, he’s joined in the firm by his son, Cory, and surrounded by longtime employees such as Janelle Ford, associate vice president, whose tenure is measured in decades. Building such a business over that long of a period boils down to the fundamentals, he said.

“My business philosophy came from sports: show up, do the work, make your teammates better and understand success is measured over seasons, not single games,” he said. “I also learned from my parents that character matters more than credentials.
“My ethics philosophy is simple: ‘Would I give this advice to my own kids?’ If the answer is no, I don’t give it to clients. Your reputation is built over decades and can be lost in a moment so do the right thing, even when no one’s watching — especially when no one’s watching.”
For Garlock, “doing the right thing” isn’t limited to one’s personal interests. Right alongside building a successful business he’s also been very active in the community, looking to be the inspiration and mentor for succeeding generations of underdogs.
“I spent 10 years as a volunteer assistant basketball coach at Boys Town, including our 2006 Class C-1 state championship season,” he said. “For over 30 years, I’ve sponsored a stock-picking contest for junior high students at Boys Town, teaching kids about investing but really teaching them about discipline, patience and long-term thinking.

four years as chairman. NorthStar serves inner-city boys with mentoring, tutoring and after-school support. Watching a kid who struggled in school gain confidence and graduate is a better return than any stock I’ve ever picked.”
Garlock has also invested his time and talents in issues that reach beyond Omaha, Nebraska, speaking out on national political issues that he feels strongly about. These include volunteering with organizations that advocate for fiscal responsibility in Washington and for term limits.
“I want to be clear: my civic engagement and political views are completely separate from my professional work as a financial adviser, but I do believe citizens have an obligation to speak up on issues that matter,” he said. “I’m deeply concerned about our $37 trillion national debt and what it means for our country’s financial future and for my grandchildren’s generation. I also believe term limits could help reduce careerism in politics and restore accountability to voters.
“I was raised with the belief that each generation has an obligation to leave the next generation better off than we found things. With retirement around the far turn, Garlock is looking ahead to more time traveling with his wife, Becky, and time spent with the couple’s three children and three granddaughters. When all is said and done, he said he hopes to be remembered for the kind of personal success money can’t buy.
“I’ve spent 40 years helping people build wealth, but I’ve learned that success has nothing to do with your account balance,” he said. “It’s measured in relationships, friendships, whether your grandkids want to spend time with you, whether your clients trust you, whether your community is better because you showed up. You can’t measure real success on a spreadsheet.”

The AI narrative is turning out to be bigger than anyone could have imagined. When ChatGPT was released in November 2022, few expected the pace and magnitude of change that would ensue. In just a few short years, AI infrastructure spending has surged past $600 billion annually, roughly a 2% boost to U.S. GDP1. Large language models (LLMs) are used by nearly 2 billion people worldwide and have changed the way content is created. Now, the rise of agentic AI — systems capable of executing complex, multistep tasks autonomously — is sending ripples through one white-collar industry after another.
Recent stock price reactions appear to reflect that anxiety. Shares of some wealth management companies pulled back after Altruist introduced an AI-powered tax planning agent. Insurance brokers sold off when an AI rate-comparison tool demonstrated how quickly policies could be evaluated across carriers and legal software businesses saw valuation decreases after Anthropic’s Claude released a legal department model.
Investors are grappling with an obvious question: if AI can analyze, compare, draft and advise faster and cheaper than ever before, what happens to traditional intermediaries?
At the same time, this transformation has renewed attention on the physical economy. For much of the past five years, the digital economy has dominated while capitalintensive sectors have languished. It seems that the unprecedented growth in AI is starting to be governed by physical limitations. We are becoming less constrained by computing and more constrained by power and infrastructure; as some put it, “the byte has met the atom.”
AI’s expansion depends heavily on physical infrastructure like energy grids, data centers, semiconductors, industrial equipment and materials. The digital boom is fueling a revival in the very sectors that power it.
Despite the turbulent sorting of individual businesses, the overall market remains buoyant and over the long term we remain constructive. In fact, our conviction that AI could represent one of the largest technological leaps of our lifetimes has only grown.

Transformational technologies can create disruption along with prosperity but they have the potential to expand productivity, lower costs and generate new opportunities. The market is attempting to sort winners from losers and that process can be volatile. What feels uncertain today often becomes obvious in hindsight. We believe leading U.S. largecap companies that are quick to shift and harness AI’s potential are positioned to benefit from the disruption rather than be displaced by it.

Patrick Leahy joined Firstar Fiber three years ago after decades in for-profit, nonprofit and government roles. The Omaha native graduated from the University of Nebraska Omaha with a bachelor’s degree in political science and economics.
These roles included serving as a risk analyst for 3Ai, a defense contracting firm, consulting with U.S. Strategic Command as it modernizes its NC3 (nuclear command, control and communications) systems. He has also spent time in the nonprofit sector as chief operating officer of the Cloisters on the Platte, a retreat center located in Gretna, and as interim executive director for the Omaha-based ethics education nonprofit, Business Ethics Alliance.
Prior to his time in the private sector, Leahy served in community engagement and public policy roles for U.S. Sen. Ben Nelson. An elected official himself, serving on the Papio-Missouri River Natural Resources District Board from 2013 to 2018, he also has a distinguished career in the U.S. Army Reserves where he serves as an intelligence officer and holds the current rank of major.
Under his leadership, First Star Recycling was one of five companies to be awarded Keep Nebraska Beautiful’s Sustainability Seal in 2025.
Leahy was born and raised in Omaha and volunteers with a handful of community organizations including the Humanities Nebraska board. His hobbies include playing hockey, listening to podcasts, reading and traveling. He and his wife Emily have three children.
What do you enjoy most about your work?
The people who work here and the work we do. Recycling is not an easy industry. Challenges range from battery fires to commodity pricing swings and more. The work is very difficult and sometimes dangerous but the future of our environment and our economy depend on recycling be successful. The people who do this hard work are heroic and inspiring.
How did you hear about the Sustainability Seal and what made you want to go after this designation?
First Star has a longtime relationship with Keep Nebraska Beautiful. We believe in their mission as it aligns well with ours. We wanted to be one of the first to be recognized with the Sustainability Seal because there is a lot of negative press and misconceptions about recycling and certain recyclers. We wanted the community that we serve to know that when you send recyclables to First Star, we do everything we can to make sure it gets recycled the right way and we want to help you if your goal is to be more sustainable.
What led you to your chosen field?
I have always been sustainability minded. Recycling is all about making materials get multiple uses and lives. In many respects, it is the definition of sustainability.
What specific practices or initiatives at Firstar Fiber earned you the seal?
While our overall core business of taking in materials, sorting and getting to manufacturers to make new materials is aligned with sustainability at its core, our innovative work takes in challenged materials most other material recovery facilities do not like to touch, like film and flexible plastics, and turning it into plastic lumber here locally. That sets us apart from other recyclers and shows we don’t just talk about sustainability, we do it ourselves, too.

What does sustainability mean to you personally? Sustainability means that a system, whether it is discarded resources, other environmental, budgetary or anything else is strengthened to endure internal and external challenges and preserve over the long-term.
What is your advice to other businesses for following your lead and earning the Sustainability Seal?
Start with knowing why you are implementing a specific sustainable practice: is it because it will save costs, allow you to tell a better story to customers or help retain/recruit employees? There are many reasons to be more sustainable and typically a person or company chooses to do it for more than just one reason. You need to know why you are doing it and the how will reveal itself. With those things set, you can start measuring the success your sustainability practice is having.
