Dear Friends, The impending general election comes at a crucial time for our Country and for our Community. Only a vote for Boris Johnson and the Conservative Party will ensure that our kehillah continues to enjoy religious freedoms in our great Country. If the Conservatives don’t win a majority in this election, we face the terrifying prospect of a coalition government with Jeremy Corbyn as Prime Minister. Every vote and every seat is crucial in this election. Please make sure you use your vote and help elect a Conservative MP in Bury South and a Conservative majority government for the Country. The training will provide a recognised qualification from the University of Manchester’s IAPT training course and valuable experience of working in a high quality IAPT site. The successful applicant must have a good understanding of the Jewish Community. The TPWP will work in the Salford IAPT services to promote access to low intensity therapy for people with mild to moderate anxiety and depression and must be willing to work with clients on one to one basis as well as co-facilitate groups. Post-holders will receive training and supervision to deliver a range of low-intensity psychological treatments for anxiety disorders and depression. TPWPs will work toward treating and managing high volumes of people in a stepped-care model. The successful post - holder will be willing to travel across the city to our various locations and manage the demands of both work and study. All applicants require honours degrees (2.2 or above) or equivalent from a recognised higher education institution, or an approved and relevant post graduate qualification (minimum Postgraduate Diploma or equivalent – 120 credits at MSc level) or evidence of previous advanced study, research or professional experience. Places are available to applicants without a degree but are able to demonstrate evidence of appropriate academic ability please see University of Manchester website for details. Yisroel Isaacson The Organ Donation (Deemed Consent) Act 2019 is scheduled to take effect in 2020. It will allow the NHS doctors to remove organs and tissues from deceased persons for transplantation purposes, without having received prior consent. This will include the storage of a body, i.e. postponing its burial, if so deemed necessary. Organs such as the lungs, kidneys, the liver, or the heart, are generally removed from patients in intensive care after brain-death before the heartbeat stops, at a time when the patient may still be Halachically alive. On the other hand, eyes for corneal grafting, or tissues, may be removed at a later stage, even from persons who expired in other wards or private homes. If a person opts out of the NHS Organ Donor Register while still alive, the Organ Donation (Deemed Consent) Act 2019 will not apply to him/her, and the NHS may not remove any organs or tissues. The NHS’s website gives an impression, that even in the event where the deceased did not op out while alive, the NHS will first ask the deceased’s relatives for consent, prior to removing any organs. It has even been rumoured that the NHS has given a written legal undertaking to that effect, to a member of our community. Unfortunately, such an assurance or legal undertaking does not carry much weight, since no one can be prosecuted for breaching such an assurance or undertaking. Until now it would have been extremely difficult for the NHS to defend an unauthorised removal of organs. Now however, it can easily be excused, by claiming that an error occurred due to an oversight, not having realised that the deceased had indeed opted out. This has caused much concern in the Jewish community. Speeches relating to these concerns have been given in several synagogues. For the sake of public awareness, notices have been posted in some fifty synagogues in the Stamford Hill neighbourhood, and published in local newsletters in Manchester and London. There is much anger amidst the populace regarding the governments approach to this issue. Why is the government not investing in a public campaign to encourage the public to opt-in on the NHS Organ Donor Register (not that the author of this article would recommend such actions), but rather force people who do not wish to donate their organs, to opt out? Thus, potentially leaving room for much error, leading to people being dissected post mortem, against their will! Lay leaders and community activists are contemplating to present the government with a memorandum that would legally exclude Jews and possibly also other ethnic minorities from the Organ Donation (Deemed Consent) Act 2019. It is obvious that any orthodox Jew, or any Jew who is a member of a Jewish burial society or has opted for a Jewish burial, wants exactly that; a “Jewish” burial, without any post mortem intrusions into the body. This was clearly demonstrated, when recently all segments of the community joined forces to prevent the Coroner from conducting a post mortem examination on the body of a deceased Rabbi from abroad. 72

Comforting words or harsh reality?

The Human Tissue Authority (HTA) has set out guidelines for the NHS on how to implement the Organ Donation (Deemed Consent) Act 2019. This is currently in the draft stage, and can be viewed online by anyone who wishes to do so; “F Donation of solid organs and tissue for transplantation - Draft Code of Practice (Part two - Deceased organ and tissue donation)”. This Draft Code of Practice, has many paragraphs from where at first glance it would appear; that the HTA & NHS have great concern and respect for the feelings, religious beliefs and wishes of the deceased and his family, guiding the Specialist Nurses for Organ Donation (SNODs) to handle every situation with upmost sensitivity. A closer look will make a vigilant individual suspect that the HTA & NHS is trying to lull us into complacency, in order to slowly achieve their goal of more potential organ donors? A newspaper article is not the place for lengthy legal dissections of their code of conduct, so a few examples and quotations will have to do. It is important to note that a code of conduct, guidance or policy is not legally binding and can be revised without a need to inform the public. In Para. 192. of HTA’s code of conduct it says; “Failure to follow a Code of Practice is not in itself a criminal offence under the HT Act …”. In other words, if the policy advices that organs should not be taken (in a scenario where the new law does make allowance), a transgressor can no longer be prosecuted. In accordance with the new law, if the deceased did not opt out of the NHS Organ Donor Register and there is no other way to legally ascertain his wishes, he is deemed to have consented to his organs being removed. The family cannot object. Para. 73; “There is no legal right for anyone in a qualifying relationship to revoke a legally valid decision to give…”. Para. 79; “A family’s objection does not nullify appropriate, valid consent from the potential donor”. On the other hand, should close family or friends provide information that leads to the conclusion that the deceased would not have consented, organs may not be used. But alas this is no simple matter as to what is considered accurate evidence or not, and the decision rests with the Specialist Nurses for Organ Donation! (See Para. 95- 100 & 152-156). In circumstances where a person passed away and no personal identification was found on his body (e.g. in an accident), the concern is far greater. See Para. 171, I quote; "Section 43 of the HT Act allows for minimum steps to be taken to preserve parts of a potential donor’s body when it is, or may be, suitable for transplantation, but consent or the absence of consent has not yet been established". It may be hard to believe, but according to Para. 134; Yeshivah Bochurim and Seminary Girls from abroad who have been studying in England for twelve months and have not opted out of t NHS Organ Donor Register, are also deemed to have consented and their organs and tissues may be used! I would like to conclude this article by clarifying a common misconception. Many people presume that elderly people are not suitable to be organ donors and therefor there is no need for them to opt out. So please allow me to quote from the NHS’s website; “Am I too old for my organs to be donated? There is no maximum age for joining the register”.
