Many homeowners are puzzling over how the new tax bill will affect them. Key provisions that would have impacted the housing market were added, deleted, or retooled during the creaky legislative process, creating confusion about what remains in the final bill that passed on December 20th, 2017.
Here, then, is a look at what the final version contains and how it affects homeowners, both buyers as well as sellers.
The new law increases the standard deduction to $12,000 for single filers and $24,000 for joint filers. That might seem like good news, but for homeowners who itemize, and many do, this might no longer be a prudent option.
THE INCREASE IN THE STANDARD DEDUCTION WILL LIKELY HAVE A SIGNIFICANT IMPACT ON MOST HOMEOWNERS:
30.1 % of households chose to itemize their deductions (44 million returns).
68.5 % of households elect to take the standard deduction (101 million returns).
1.6 % of households had zero or negative adjusted gross income, and were unable to take any deductions. (2 million returns).
These statistics show that most American taxpayers choose to take the standard deduction. However, this is not the case for higher-income taxpayers. taxfoundation.org/who-itemizes-deductions/
The new law caps the limit on deductible mortgage debt at $750,000 for loans taken out after Dec. 14. Loans made before that can continue to deduct interest on mortgage debt up to $1 million. Homeowners can refinance mortgage debt that existed before Dec. 14 up to $1 million and still deduct the interest, but the new loan cannot exceed the amount financed.
The interest on a home-equity loan can be deducted, but here’s the catch: the money must be used to significantly improve the home. So we’re not talking a lick of paint here or a lick of paint there. Or a Hawaiian vacation. We’re talking structural improvements or a major remodel.
And what about second homes? Mortgage interest on second homes can be deducted, but it is limited to $750,000.
SALT was a big issue—state and local property taxes. After much haggling, the new law limits the property tax deduction to $10,000.
Capital gains was another big concern. The new tax bill allows home sellers to exclude up to $500,000 for joint filers or $250,000 for single filers for capital gains when selling a primary home, but the homeowner must have lived in the residence for two of the past five years. An earlier version of the bill would have increased that requirement to five out of the last eights years, but it was voted down.
Casualty loss deductions are restricted only to losses caused by a presidentially declared disaster.
The law eliminates moving expenses as a deduction except for members of the military.

The estate tax exemption has been doubled—to $11.2 million.
The HTC (Historic Tax Credit) has been tweaked. Although it continues to provide a 20 percent credit when the certified historic property is placed into service, the deduction is now spread out over five years. The HTC has been used to fund renovations in more than 40,000 historic structures since 1981.
As for the Low-Income Housing Tax Credit, the bill keeps it at 4 percent, which funds about a third of all affordable housing construction.
It is important to note that every taxpayer’s situation is different. There is no surefire way to predict exactly how the new law will affect you in 2018 and beyond, but after your 2017 taxes are prepared, your tax preparer or financial advisor should be able to estimate your tax liability for 2018 under the new law and advise you accordingly.
And lastly, should there be any question, the new law does not affect your 2017 taxes at all. Your 2017 filing still falls under the same laws that were in effect in 2016.

At Willis Allen Real Estate, we have been actively and successfully providing advice and expertise for 104 years in San Diego. Many of San Diego’s largest real estate transactions occurred because we were able to assist, counsel, study and advise our clients. Most important, the company that acts as their broker must have a reputation for supporting the needs of their clientele.
When any of this is lacking, less-than-successful agents are lured by promises from these new companies, thinking this change will solve their problems. But they haven’t necessarily considered the needs of the buyers and sellers they represent.
