CASTING DOUBT THE lawyer of a man charged over the death of Newborough man Jarrad Lovison has raised questions about whether the 37-year-old was murdered, during a bail application in the Supreme Court at Melbourne on Tuesday. Andrew Price, 47, was charged with one count of murder on October 21, after Mr Lovison’s body was found in scrubland at Moondarra State Park on May 23. Mr Price’s lawyer, Julian McMahon SC, told the court “the forensic reports even leave open the question of whether there was a murder”. “We say to look at the forensic evidence which says essentially that GHB in combination with alcohol and
methylamphetamine or amphetamines will have caused the death,” he said. Mr McMahon also questioned the strength of the case against Mr Price, citing “an absence of all kinds of material which would typically make a case a strong case ... in terms of injuries and the toxicology and so on”. “Our intention is simply to say to make the general proposition that the case is not a strong one,” he said. “There are no relevant injuries.” In his submission, Mr McMahon requested Mr Price be bailed to a residential rehabilitation facility to address underlying issues with addiction before living at his parents’ farm. His parents also offered a property as surety, should he make bail. “It’s in his interests, and everyone’s
interests that that take place,” Mr McMahon said. “From there, there could be no excuse at any future time regarding drug use.” But Justice Paul Coghlan raised doubts about the legitimacy and timing of the request to attend a rehab facility. He referenced a previous breach of bail by Mr Price, claiming that alone showed he had “little regard for what was imposed upon him”. “Cynics like me have a bit of a view about people who don’t seem to find it necessary to seek any rehabilitation until it helps them get bail,” he said. Justice Coghlan also said there was additional concern about “unacceptable risks as it relates to the witness” if Mr Price was released on bail. Crown Prosecutor Mark Gibson SC
said Justice Coghlan’s reservation about witness safety was “definitely” a fair summary. “That’s because of the conduct ... in the past and things of that nature and approaching (a witness) afterwards,” he said. Justice Coghlan will make decision on the bail application on Wednesday. Co-accused Jake Brown, 28, and Samantha Guillerme, 24, were also charged with one count of murder in October last year. Ms Guillerme filed and then withdrew a bail application on December 8. The three are set to appear before a magistrate again on March 4.
