A “JUST” PAUSE

Ironclad? The Titanic lies deep in the Atlantic as proof that to stay adrift there is always an iceberg of a doubt. The Court of Appeal of Belize was that iceberg for the United Democratic Party’s determined attempt to quash the Chief Justice of the Supreme Court’s imposed Interim Injunction to the ICJ referendum then slated for a seemingly magical April 10. Inside the packed Court of Appeal this past April 8 Belize was once more the subject of litigation. This was to be Part II to the April 3 Interim Injunction ruling. It was nothing short of dramatic. The extremely rare mixing of PUP and UDP adversaries could only be brewed by such a historic occasion. The presence of OAS and Members of the Commonwealth as observers gave credence to the magnitude of the proceedings. By 3:45 in the afternoon, the trio of Appellate Judges returned after a prolonged adjournment to give to the nation their ruling on the Government’s appeal. The subject of this appeal had been called a “technicality.” Whatever it was, the Appellate Judges ruled that they do NOT have the jurisdiction to overturn the Chief Justice’s Interim Injunction. This pretty much melted the iceberg over PM Dean Barrow’s shoulders and made for a second post-ruling press conference where his fury was undeniable. Only five days before, even in clear disappointment, he seemed confident that the Court of Appeal would overturn the technicality. No so. He now dramatically announced that a referendum on the ICJ was not possible on April 10 but that the UDP is determined to give people their say. The People’s United Party leader offered this as he stepped out of the Courtroom: “Today the Court of Appeal upheld the decision of the Chief Justice to delay Wednesday’s referendum so that the case may be heard whether or not the Minister of Foreign Affairs had the authority to sign the Special Agreement. We believe this is necessary for us to ensure that the rule of law is upheld in our nation. We also want certainty that we are following the proper procedure and we demand that the loyal opposition be respected. Again we see today’s decision as a decision for the democracy and as a victory for the

people.” All these legal proceedings most likely have the people of Belize watching a ping pong match. An ICJ trial will be something similar but at a larger scale. The PUP has been blaring for months now that the UDP and the PM are not ready nor have they educated the Belizeans populace fairly enough. The PUP as seen in the People’s Declaration is on record suggesting pathways to be ready for the Referendum, and later on, for the International Court of Justice. We cannot stumble weakly into the Referendum and expect Guatemala to have pity. They are expected to spend approximately $90 Million in Belize dollars.

Belize, we are supposedly spending 25M. Belizeans, make a conclusion on those numbers. The Supreme Court will, this coming week, move on with the trial of the case on the writs of referendum. You are reading correctly, Belize. The main part, the trial, of the ICJ legal issue is just about to begin. We have all experienced as a country only the motions, injunction, case management and rulings on if the case(s) have merit. So the referendum is still being cooked. The UDP wants to eat it before it is fully done while the PUP is asking for patience so that Belize can get into the Referendum fully educated and with a strongly prepared case. The PUP leader is on record stating, “Let’s get it Right!”

PM Barrow summons House Meeting: NO Agenda given to the PUP As part of the Prime Minister’s move to get the ICJ referendum he announced publicly at the post Court of Appeal ruling press conference a House of Representatives Sitting before the trial. In his determination to get the Referendum a quick and hurry date, PM Barrow has, in what can only be versed as, threatened to “fix” the laws to fit his will. The PM’s legacy has been to amend, delete or reword any law that he may have just broken. This Friday April 12 he will move to add to that legacy. This is an opportunity for the UDP to truly govern. Up to this point, they have been in virtual opposition to Belizeans while feigning to be the elected government. The hope is that nonsense is NOT the agenda. Each Representative has his heart and the only Division Belizeans deserve is to hear from each one if they wish the laws of the land to be changed after a whim. Today we are wondering who is speaking Truth to Power. The Prime Minister seems to be misguided and refuses the overtures of the opposition to be at their rightful seat in this struggle. The legal kickbacks should end and we should place a Belizean Dream legal team guided by the tenets in the People’s Declaration. These were conceived in the hearts and minds of Belizean People and merely endorsed fervently by the People’s United Party. This definitely would be a Belizean pathway to victory even at the ICJ level. The People’s United Party issued a Press Release demanding the Order papers.

LACKLUSTER AT BEST

“The whole Belize financial system is dead for offshore banking operations. Nobody will trust a bank in Belize after this.” This was the foreboding statement made by Dr. Giovanni Caporaso Gottlieb in response to the Central Bank of Belize’s (CBB) revocation of license for Choice Bank Ltd. The recent voluntary closure of Atlantic International Bank Limited (AIBL) certainly lends credence to the statement. AIBL was caught up in the Sanctuary debacle and was accused of helping to facilitate the Sanctuary Belize real estate scam shut down by the US Federal Trade Commission. All this in addition to losing its correspondent banking relationship with Bank of America. Since 2011, AIBL no longer has any affiliation to Atlantic Bank Limited, Belize’s largest bank, yet the international banking world is very sensitive to the smear of contamination. Even a whiff of impropriety could result in corresponding banks like Bank of New York Mellon to completely sever ties with Atlantic Bank Limited. This would in effect spell disaster not only for the offshore banking operations but for the entire financial sector in Belize. With two offshore banks closing within just the last ten months, Belizeans are left to wonder. What measures if any is the GOB, through its fiscal agent the Central Bank of Belize, taking to ensure financial stability for Belize? It seems that the Board of Directors at the Central Bank have twice been caught asleep at the wheel and are reeling instead to contain and clean up the mess after the fact. Certainly, there has been no effective or efficient compliance mechanisms in place to ensure that the integrity of Belize’s banking industry was not affected by de-risking. In November 2018, the IMF reported that between 2013 and 2016 Belize lost 83% of its corresponding banking relationships. The IMF also reported that incredibly even the Central Bank of Belize lost 2 of its 5 corresponding banking relationships. The newly appointed Chairman of the Board of Director’s at the CBB is Mr. Joey Montalvo and Belizeans are left to wonder exactly what he brings to the table with his area of expertise. Mr. Montalvo is retired from American Sugar Refining/Belize Sugar Industries (ASR/BSI) and was allegedly instrumental in the splintering of the Belize Sugar Cane Farmers Association (BSCFA) into smaller groups. This weakened the bargaining power of the once powerful association and allowed ASR/BSI to break the strike action of the ca ero in the North and to sign these splinter groups to disadvantageous agreements for cane deliveries. This all happened as the GOB seemingly stood on the side of big business instead of protecting the interests of small Belizean farmers. It is the same GOB that sent in military troops to disband the demonstration at Tower Hill. Belizeans should recall it was at this stand-off that Atanacio Gutierrez lost his life defending his livelihood and the livelihoods of thousands of his fellow cane farmers. Mr. Montalvo was also instrumental in lobbying for the sellout of BSI to ASR. The GOB was peculiarly interested that the sale materialized refusing to consider a proposal that would have allowed the industry to remain in the hands of Belizeans. It also did not consider the nationalization of this most vital industry in the North opting instead that it should be sold to private foreign-owned interests. It is also interesting and important to note that over the years the director’s fees for Central Bank of Belize has increased, in 2013 it was $31,500. In 2017 those same fees were at $93,300. Mr. Montalvo’s performance as Chairman of the Board of Directors of the CBB so far is remarkable only because it has been so dismal. It will be interesting to see however what the director’s fees for 2018 are at the CCB and to see if the PM coincides with us on the evaluation of Mr. Montalvo’s lackluster performance or chooses instead to reward him.///

MEDIOCRE EN EL MEJOR DE LOS CASOS “Todo el sistema financiero de Belice está muerto para las operaciones bancarias extraterritoriales. Nadie confiará en un banco en Belice después de esto.” Esta fue la declaración inquietante hecha por el Dr. Giovanni Caporaso Gottlieb en respuesta a la revocación de la licencia del Banco Central de Belice (CBB, en inglés) para Choice Bank Ltd. (CBL, en inglés) El reciente cierre voluntario de Atlantic International Bank Limited (AIBL, en inglés) ciertamente presta crédito a la declaración. AIBL fue atrapado en la debacle del Santuario de Belice y fue acusado de ayudar a facilitar la estafa de bienes raíces del Santuario de Belice la cual fue cerrada por la Comisión Federal de Comercio de Estados Unidos. Todo eso, además de perder su relación bancaria corresponsal con Bank of America. Desde 2011, AIBL ya no tiene ninguna afiliación a Atlantic Bank Limited (ABL, en inglés), uno de los bancos más grande de Belice, sin embargo, el mundo bancario internacional es muy sensible a la mancha de contaminación. En noviembre de 2018, el Fondo Monetario Internacional (FMI) informó que entre 2013 y 2016, Belice perdió el 83% de sus relaciones bancarias correspondientes. El FMI también informó que increíblemente incluso el Banco Central de Belice perdió 2 de sus 5 relaciones bancarias correspondientes. El recién nombrado presidente de la Junta de Directores en la CBB es el Sr. Joey Montalvo y beliceños se preguntan qué exactamente es lo que trae a la mesa con su área de especialización. El Sr. Montalvo se jubiló de American Sugar Refinery/Belize Sugar Industries (ASR/BSI, en inglés) y fue supuestamente instrumental en la fragmentación de la Asociación de Agricultores de Caña de Azúcar de Belice (BSCFA, en inglés) en grupos más pequeños. Todo esto sucedió mientras el GOB aparentemente se puso del lado de las grandes empresas en lugar de proteger los intereses de los pequeños agricultores beliceños. Es el mismo GOB que envió tropas militares para disolver la manifestación en Tower Hill. Los beliceños deben recordar que fue en este enfrentamiento que Atanacio Gutiérrez perdió su vida defendiendo su sustento y los medios de subsistencia de miles de sus compañeros agricultores de caña. El Sr. Montalvo también desempeñó un papel decisivo en el cabildeo por la venta de BSI a ASR. El GOB estaba particularmente interesado en que la venta se materializara negándose a considerar una propuesta que hubiera permitido que la industria permaneciera en manos de los beliceños. Tampoco consideró la nacionalización de esta industria, la más importante del norte y opto en su lugar la venta a intereses privados de propiedad extranjera. También es interesante e importante señalar que a lo largo de los años los honorarios del director para el Banco Central de Belice han aumentado, en 2013 fue $31.500. En 2017, esos mismos cargos fueron $93.300. La actuación del Sr. Montalvo como presidente de la Junta Directiva de directores de la CBB hasta ahora es notable sólo porque ha sido pésima. Será interesante ver, sin embargo, lo que los honorarios del director para 2018 son en el CCB y ver si el primer ministro coincide con nosotros en la evaluación del rendimiento mediocre del Sr. Montalvo o si elige en su lugar el recompensarle.

Statement by Leader of the Opposition John BriceĂąo My fellow Belizeans, we in the Peopleâ€™s United Party believe that the referendum to submit Guatemalaâ€™s unfounded claim to the International Court of Justice is one of the most important decisions that we as a people will have to make. We know that a referendum must be held for the people of Belize to make this fundamentally critical decision. We are therefore fully committed to the holding of a referendum for we know having a referendum is the right thing to do and is in keeping with our democratic principles. We regard the recent judgments in the Courts as victories by the people of Belize, and not as a victory for the Opposition. We hold sacred the rights of Belizeans to vote in a Referendum to decide whether we go to the ICJ. We also stand firm to our sacred duty to ensure that Belize is on the strongest legal footing if we go to the ICJ. I am seriously concerned about comments made by the Prime Minister during his press conference yesterday. He attributed comments to me that were totally untrue. In addition the PM blamed the Opposition for the judgments and at times he openly attacked Chief Justice Kenneth Benjamin for his decision to grant an interim injunction, which effectively put the Referendum on pause. We are of the view that the Prime Minister should not so openly criticize the Chief justice and so blatantly attack the judiciary. I have said again and again that we have to get this right. We all agree that this is an issue of national importance; as such we should be addressing it not as PUP or UDP but as Belizeans. I remain willing to meet with the Prime Minister for us to find a way to work together to address this very important national issue.

Barrow vs. the Feather Here at the Belize Times, we figure if it wasn’t for his old age and bad back, the big, bad Barrow would have given the feather a better fight. But it was not to be, sadly. Barrow was knocked out in the first round, cold. And when he finally woke up and walked into the ring again, he was knocked out again, without even throwing a punch. How did Eamon put it? Barrow got a right hook at the Supreme Court, an uppercut at the Court of Appeal and if he feels big and bad enough to go to the Caribbean Court of Justice, he would get knocked the hell out. What a lame-duck Prime Minister Dean Oliver turned out to be, defeated by a feather. It is time for him to go. House of Cards The people of Belize are getting set to blow Barrow’s house of cards down. Because he couldn’t make any headway in the highest courts in Belize, the lame duck is trying to pull off a magician trick by pushing a bill through the House, with a motion hidden in it. He wants to get the House to agree to let the ICJ determine our borders without having to change the Constitution, which is the supreme law of the land. But he should know by now that the people don’t trust him at all, and they don’t trust the UDP, so nobody’s taking their eyes off this trickster. If he thinks that Friday’s House meeting will be a walk in the park, he’s got another thing coming. Benched The Prime Minister may act the fool, but he doesn’t take loss well, and poor Lisa’s fate was sealed after that Supreme Court defeat. No ‘if,’ ‘and’ or ‘but’ rolled in a tortilla to make tacos could save her. She was benched, forced to play second fiddle to Rodwell Williams, who is the lame duck’s go-to guy when brother Barrow isn’t in country. But Rodwell’s glory days seem to be long gone, and as he stammered and stuttered and blustered in the Court of Appeal, it was clear that while Barrow may have shut down Lisa out of pure spite, maybe he should have given her another chance to feed a new set of judges her special tacos. The judges weren’t having any of Rodwell’s wind pies for sure. Follow the Money Barrow may not have two good feet to stand on, with his bad back and all, but he sure does know how to feather his bed, pun intended. Remember all those long years of BTL/Ashcroft litigation. The lame duck made sure that only his people handled those cases, first his ex-wife Lois and then his brother Denys. They made millions from it. When it came time for that secret agreement with Ashcroft in Miami, though, the one which cost Belizeans about $600 MILLION, the Prime Minister took care to ensure that his law firm got in on it. If you look at that agreement, you will find Barrow’s signature, right there with that of his law partner, Rodwell Williams. To this day, Barrow has not disclosed how much his law firm made from that almost $600 MILLION settlement. But just to give an idea of what kind of figures we’re talking about – if Barrow’s law firm charged a conservative 10% to handle the settlement, they got away with almost $60 MILLION, give or take a few dollars. And it’s the same thing now. Barrow again brought in his law partner to share a piece of the litigation pie, and if they do go to the Caribbean Court of Justice, no doubt the law firm will be creaming from the public purse there too. You want to know why the Prime Minister is always in court? Just follow the money. Who called? Who called the Police in Punta Gorda and told them to release those Guatemalans caught by the Coast Guard in Belizean waters? The Belize Times has tugged some lines, but the only thing we’re getting is that it was somebody big. So big that the Police released the twelve Guatemalans, the $40,000 they were found with and their boat, without even a hint of an investigation taking place. It is somebody so big that the usually very vocal Commissioner of Police suddenly has nothing to say. The Police don’t want to talk. The Coast Guard doesn’t want to talk. All the Financial Intelligence Unit will say is that by the time they got there all the men had been released, end of story. We know that the names of senior Ministers have been called when it comes to the smuggling of cigarettes, and we are told by a very good sources that it is believed that is what the men were up to. But we at the Times won’t let this one go.

8 08 8 BELIZEANS DETAINED IN GUATEMALA Thursday, April 11, 2019 Four Belizeans had their day in Guatemalan court on Wednesday April 10th, 2019, for illegal fire arm offenses. The four Belizean men identified as Police Officer Fabian Laurie, 33 years old, Coast Guard Officer Pedro Colomer, 25 years old, Kevin Hernandez and Jerilee Laurie were detained on Saturday April 6th, 2019 by Police in Livingston, Guatemala. According to an article by “El Puerto Informa” from Guatemala – a report was made to police on all four men who were allegedly intoxicated and were allegedly misbehaving inside a hotel room. Reports are that Police responded and when they arrived at the room a search was conducted which resulted in the discovery of the illegal weapons and ammunition. COMPOL Chester Williams said “currently coordinating through the Ministry of Foreign Affairs which you would know as a matter of protocol, we normally, when it comes to nationals of other countries, the communication normally goes through the Ministry of Foreign Affairs to see what can be done to assist the officer”. However, there is a Coast Guard officer, resident of Dangriga, also involved and his commander has a different perspective. The officer had ditched work the previous Friday and the Coast Guard will not be responsible for the actions of their officer. In a public statement Elton Bennet stated: “The status as is right now is absent. We have our internal disciplinary mechanism that will take its toll as it relates to any absentee. In addition to that, there are more infractions as it relates to the disciplinary code of conduct in which he is obviously in violation of that will come to play as well. Indeed we are very embarrassed about this situation, he is a member of the Belize Coast Guard and the infraction committed by him is an international violation in that weapons and ammunition is something that the coast guard is involved with enforcing those illegal weapons and firearms, so for a member of the coastguard to be involved with such incidents definitely is a black eye for us. We will treat the incident with the level of diligence that it deserves in terms of proper investigation to see exactly what the outcome would be based on the criminal aspect coming out of Guatemala. However, it has already, as you mentioned, brought the Coast Guard into disrepute. So we will also look at that possible breach of discipline because of this incident.” It must be mentioned that all this is so opposite to the 15 Guatemalans found in Belize in a boat on the Moho River with approximately $40 thousand US and 11 cellphones. They were released and there is only speculation as to how comes it was such an easy Catch and Release. Now our four Belizean men are spending time at the main prison in Puerto Barrios, Guatemala. Are they guilty?

Belizeans at home, the Belizean diaspora abroad, and all friends and well-wishers have every reason to be proud of the performance of the Belize National Police team in the 2019 Baker-to-Vegas (B2V) 120-mile relay footrace. In the 34 years of the B2V event, which exemplifies the “gold standard” in physical fitness competition for law enforcement officers (LEOs), the winning teams were exclusively from the state of California. That all changed during the weekend of March 23 and 24 when Team Number 2, also known as “Team Belize” won the gold and the rest is, as they say, history. At the end of the 35th year, 20 young and superb runners, five alternate runners at the ready, and a support team that is second to none, competing in a 289-team lineup, were able to convince the world that when we say: “We can do this!” we should be taken seriously. For the first time, the “Challenge Cup” trophy is not in California, and it is not anywhere in the United States— it is in Belize, the only country in the Caribbean/Central America to participate in this grueling test of physical and mental endurance. This winning attitude resides in the spirit of each of Team Belize B2V participants. Indeed, they exemplify the wisdom of the late great American football guru Vince Lombardi: “Winners never quit and quitters never win.” For example, Team Belize started out slower than expected and was in fourth place after the first stage. Then, Team Belize turned on the “Belize Heat” and won stages two through nine. Team Belize again found itself behind in second place after stage 10 but undeterred continued the chase with dogged determination—fruits of their collective efforts. Team Belize won stages 11 through 14. Yet again, after stage 15, Team Belize was in third place and remained in that position through

stage 18. My my !! What a difference a week makes. Last week we saw the Prime Minister in full fulmination and grandstanding mode, making his final full-court press for a YES vote from the Belizean people, praying in aid the updated opinion of Judge Schwebel and trotting out diplomat Alexis Rosado and newly-minted lead GOB/UDP counsel Lisa Shoman. I have to say, first of all that even in his ‘’glorifying” position, the PM was at least cautious in referring to the referendum in which the Belizean people will vote and its actual date. Would that Senior Counsel Shoman had been so. In singing loudly for her supper, she threw caution to the Belizean March and April breezes and opined very confidently that we WILL be having a referendum on April 10. Ouch !! Perhaps we will, but we must remember that it ain’t over until the fat lady sings. To be clear, at this writing I have no idea whether the plebiscite will actually be held on that date. But indeed, how different the whole complexion is now. I must confess how surprised I am. You could perhaps not knock me over with a feather, but as I sat in the Chief Justice’s courtroom last Monday for most of the submissions of counsel for and against the PUP motion, I could not have foreseen where we would be this weekend as I jot these thoughts. Unfortunately, I was not able to be with colleagues on Wednesday afternoon for the big moment. I was a little under the weather. Allow me to say that I have been consistent in my view that this whole thing needs to be postponed, for various reasons, chief of which is the unpreparedness of the Elections office and the new voter’s list. I remain bemused that many Belizeans are still being disenfranchised. Errol Gillett of Gales Point Manatee is not on the list through no fault of his own, and the Belize Rural Central registering officers seem unconcerned or unable to fix this. I also am annoyed that born Belizeans from Burrell Boom and so many other municipalities received letters telling them that they do not meet the requirements to be included on the new list. Let us get this right, people. I look now at a Commentary by Antiguan Sir Ronald Sanders, penned April 5, 2019. It is called “Belize: Put The National Interest First.” Of course we should all respect the views of such an eminent

Ambassador of his country and of the whole Caribbean, but I do disagree with some of his views and conclusions. He does NOT know what is happening on the ground here. His thesis is that narrow partisan political ambitions and interests very often trump the national interest in “practically every country.” Without offering any proof or explanations he says in his article that the struggle for supremacy of one party over another in Britain is causing chaos there as the Brexit question continues to play out. But then he begins to focus his attention on our ICJ referendum issue here at home. He says that Britain is not alone that “this tragedy of political ambition over wider national interest is being displayed.” Hon. Sanders then glosses right over the possible reasons for the Chief Justice’s granting of the interim injunction, and he happily repeats that political divisiveness for short term gain is the order of the day. Says he: “most of the work to hold a referendum was done by the very PUP that sought the April 3 injunction to stop it.” Say I: yes of course. But you, Mr. Sanders, have no real idea why this has been done. I won’t trot out again the reasons our party issued the People’s Declaration, but I will repeat that a delay to get things right IS in the national interest. Mr. Sanders rightly points out alliteratively that “dissonance, distortions and disinformation” normally permeate political wars, and that the Caribbean, including Belize, is no exception. But I must add that when there are crucial issues of legality and due process, then it is the duty of interested parties to challenge this perceived mad rush by the Government. Let me say too, that the Prime Minster, due to his usual unfortunate displays of megalomaniacal conduct, is again losing the opportunity to provide leadership and guidance to our people. What a spectacle he created of himself, ranting and railing as he did after the CJ’s decision on Wednesday. He behaved like a spoiled brat, whose toy was taken away or who could not get his own way. What is the magic of April 10, PM ?? Do the right thing, man. Take this matter to the House, where it should rightly be aired properly, and then try, if you can, to be circumspect and respectful. If you do not, I will be forced to say that, once again, YOU ARE TONE DEAF !!///

It was signed by Guatemala and Belize, witnessed by OAS, May 25, 2015. But our leaders kept it away from the Belizean People till sometime early 2018; full 9 years afterwards, leaving us with insufficient time to adequately mount an information campaign to develop and establish informed consent by the Governed, that is, the Belizean People, albeit that this should have been going on years aback. Right after that lost time our leaders imposed a re-registration upon the population, again only last year around July 2018; giving even less time to ready the public for informed voting. To make matters even worse, the voter re-registration is completely rigged (no other way to describe it), by the governing party in its own favour. Re-registration by non members of the governing party is suppressed; it is restricted; it is denied; and too often re-registration records are not found to complete re-registration. Last week, March 11, 2019, I went to 4 different communities to verify reported accounts of irregularities in the re-registration process. One community reported that only 7 out of hundreds of voters who had gone to re-register had received their voter card - - all UDP members. The other three communities (not known to be UDP strongholds) reported not having gotten any information about their re- registration. Many people throughout the country who re-registered from July, 2018 reported not being able to get information about their re-registration. The Referendum voting is slated for April 10, 2019 and lobbyist for a “Yes” vote are busy increasing their pressure. But it should be obvious to anyone that rigging voter re-registration; denial of the right to vote; unfair manipulation of re- registration all doom the legitimacy of the Referendum. There is yet another major issue of prime significance in the current Guatemalan/ICJ/Belize territorial challenges that Belize should not lose sight of. Both the definition of the dispute stated for Mediation/Solution and the premises forwarded to conclude and solve the dispute are all centred and locked into and around Treaties and Negotiation between the British and Guatemala prior to the Independence of the Territory in dispute, namely Belize. Nothing is raised about the Belize after Independence, let alone the powerful liberating defense embodied in a futuristic National Self-Determination of Belize where the “People” and the Nation of Belize deter-

mine their own future and welfare. Self-Determination is a potent and fertile issue to include in the ICJ issue. It liberates Belize from colonial and antiquated practices and treaties and forms a solid foundation for an Independent Belize as it legitimizes and ratifies Belizean Nationhood and Self- governance. It will serve as a basic constitutional base/foundation for our leaders as well as our population at large while it sets a regularizing international relationship between our Nation and the International World. Self-Determination is rooted in philosophical principles of natural rights that have been adapted into law and international relationship. It is quite flexible to apply to governance with and by the consent of an informed citizenry as well as it will serve in peaceful settlement of disputes, such as, in military attacks and occupation. The principle of Self-Determination was used and later adapted by the League of Nations in 1919 to denounce occupation

by alien colonialists who subjugated peoples and nations as if they were their own property. UN Charter 4 and Convention on Human Rights also adapted that argument and were convinced to later forcefully state that all nations have the right to Self-Determination. The importance of Self-Determination and Self-Governance doctrine to the Guatemala/ICJ/ Belize issue is that it will be a significant addition for Belize to use in the very likely disaster of going into the ICJ arbitration. Belize must not disregard that ICJ is nothing less than a coercive imposition by alien powers and masters and will treat Belize as a colonial football kicked around by being freed into an Independent State from where now probably to be wiped out by the ICJ. It should be clear to Belize that the function and operation of ICJ is not to safeguard Belize or how to treat us favourably. Its function is to mediate and use its arbitration power; against us if it sees fit. ICJ is

nothing less than the cold iron hands of US and Britain. Our tradition, economy and national rights matter none at all to them. We are just objects to pick up or drop along the way. It is up to us therefore to recognize that we are the ones on the verge of a fatal disaster brought about by our reckless leaders. Guatemala and its military have been pushing their cause to the maximum. We need to push back and aggressively internationalize our Self-Determination and Self-Governance much more forcefully than they do their cause. We need to rise up to our own defense. We need to keep ourselves the farthest away from the remotest of disasters. We need to be determined to hold fast to our survival and keep it the safest and most secure in our own hands and Self-Determination. AND WE WILL. WE WILL REMAIN BELIZEANS -- NOT GUATEMALANS NOR REFUGEES. Way Forward 1. Every single voter: Vote to save Yourself, Family and Belize 2. How to vote: NO to ICJ 3. Could Be General Elections; Instead By: Dr. Gerald Zuniga, Political Science Studies, Universidad de San Carlos de Guatemala, Universidad Mariano Galvez, Guatemala City. Sunday April 7, 2019 Belize is travelling through some uncharted waters in its legal and political history. The uncleared politico legal atmosphere yesterday, which still hover, is very dangerous for the state of affairs because the government is pushing its agenda against all odds. This is not a Judgement Day matter but they can create their own political apocalypse. With a temporary injunction granted should be sufficient reason to use other strategies. The most prudent political measure should have been to inform the nation that the referendum is postponed until a better feasible date. That would have been a political gain. WE ARE NOT GOING TO THE ICJ FOR A SACK OF DIAMONDS NEITHER WILL A RESOLUTION FROM THE ICJ ENDS THIS CLAIM. DON’T SAY YOU WEREN’T WARNED. Article 19 Transitory in Guatemala’s Constitution will be the source for future challenges at their Constitutional Court. Which I have referred to over and over again. This is not fear mongering. I have no conflict of interest to fear monger anyone. There is a saying in Spanish and I quote “Errar es de humanos y de rectificar es de sabios” To err is human but to rectify is of the wise. This was precisely what the leader of the Opposition, Johnny Briceño, did. He rectified. This government has had many instances of challenging legal dispositions and have failed and at a cost of hundreds of millions of taxpayers’ dollars. The IQ can’t be that low and arrogance that high! It is imperative to emphasize that judicial resolutions in democratic countries are to be obeyed. It is the essence of a check and balance system. In despotic and fascist states, the judiciary functions as a total coercer and to the interest of government and the state. The obeying of judicial dispositions is a basic principle that lawyers and political scientist learn at the university. Another saying in law classes in Spanish that says “FALLOS JUDICIALES NO SE DISCUTEN. SE ACATAN.” You may not agree with the resolution but you have respect it, obey it, and comply with it. This is especially so for politicians in office in virtue that they should show the example and that they take the Oath of Allegiance. It is a sort of wing-clipping to control how high they can fly in the abuse of power or the usurpation of functions. If one don’t agree with the resolution, there are appeals. However, the due process must be followed or else it could be declared as disobedience to

the law. If the constitution is breached, for example, the Governor General as Head of State, in representation of Her Majesty the Queen, could have no other option but to revoke the appointment in this case of the Prime Minister and could dissolve the National Assembly and call for General Elections. So the Prime Minister’s capriciousness and/or temper tantrum could cause him his seat and his investiture or appointment and in that case his shot would have backfired. According to our Constitution in Art. 37 paragraphs (1 & 2) and I quote “ (1) There shall be a Prime Minister who shall be appointed by the Governor General. (2) Whenever the Governor-General has occasion to appoint a Prime Minister he shall appoint a member of the House of Representatives who is the leader of the political party which commands the support of the majority of the members of that House; and if no political party has an overall majority, he shall appoint a member of that House who appears to him likely to command the support of the majority of the members of that House. I would recommend that both paragraphs of this article be amended as soon as possible, but most likely by the next government. An amendment that will give us as voters our full sovereignty and make our choices be constitutional. Right now, the way our Constitution is, the tortilla can be turned over in the House and it would be constitutional because our practice in this respective, that is the election of our Prime Minister, is customary and not necessarily constitutional. So if the Governor General appoints the Prime Minister, he can also revoke his appointment or mandate and stripped of investiture. The Prime Minister can argue that he was elected but he was not necessarily elected to become Prime Minister of Belize because according to our Constitution being the Party Leader doesn’t automatically transpose to prime ministership. He was elected as a Representative and became Prime Minister as of appointment while in the House. Let me break this down, we have had this customary practice that political parties elect their party leader and based on tradition that person automatically becomes the Prime Minister of Belize. But Art. 37 (1 & 2) of our Constitution se da no so this thing go. Such practice has been unconstitutional but never challenged. According to our Constitution, it is the Governor General who appoints the Prime minister. But it has never been that way since Independence. We have had the practice and in our minds that whichever party leader wins he automatically becomes P.M. and I say he because only males have had that post but female leaders are springing up so we will soon say he or she. We should start to obey our Constitution. Ironically, not the Governor

General carries out his investiture as stipulated by our Constitution. Every Belizean should have a copy of our Constitution whether electronic or physical. A Constitution in its wording and use isn’t exclusive for lawyers, politicians, nor political scientists. It is written and for the use of every citizen. If both Belizeans and Guatemalans would have respected their respective Constitutions. There would be no referendum in Belize and the question in Guatemala’s referendum would have been different. Since such referendum practiced in Guatemala, and the one to be practiced in Belize violates the Constitution then our court on our behalf

should declare our referendum practice nulo ipse jure. That is, null and void and force. The government should do the things constitutionally right. In my opinion, all the agreements signed with Guatemala since 2008 violated our Constitution grossly and curiously by lawyers who should know better. I continue to say: OUR CONSTITUTION IS, UNTIL WE MAKE AMMENDMENTS. So the government must be careful with legal procedures, otherwise things could backfire and instead of having a referendum, we could end up having general elections.///

MRS. MARTHA MARIA MARIN APRIL 6TH, 2019 SAN JOAQUIN ROMAN CATHOLIC CHURCH 10:00 AM

Portion Delivered by Son-in-Law Carlton Young Martha Maria Marin was born in Belize City on November 2, 1944, to Rupert and Maria Marin nee Galvez. She was the only daughter in a family of sons: Gustavo, Gary, Joe and Rupert Marin Jr. As such, she was very much protected by her family. Ms. Martha spent her early years attending Holy Redeemer Primary School and St. Catherine’s Academy from where she graduated. After graduation, she worked at Holy Redeemer Credit Union and shortly after, caught the eye of a young student from San Narciso village in the Corozal District. The relationship, however, did not blossom until several years later after the Miss Independence Pageant, in which Ms. Martha’s grace, beauty and eloquence placed her above the rest, making her Miss Independence 1964/1965. This did not deter, but rather emboldened a young Florencio Marin whose romantic interest grew and, shortly after, on January 11th 1969, Mrs. Martha walked down the aisle to meet her husband to be Florencio Marin Sr who was at the time already the area representative for Corozal Southeast. Later that year, they brought home Florencio Jr., and two and half years later, the twins Magali and John completed the Marin family. Ms. Martha briefly studied cosmetology in Houston, and in 1980 she actually opened a beauty salon in Corozal Town. How fitting, that one legendary for her beauty would impart beauty to others. Once the three children were old enough, Ms. Martha joined the People’s United Party team to re-elect her husband to the House of Representatives in 1984. She took charge of the San Joaquin, Calcutta, and Ranchito Polling Stations from 1984 to the 2003 national elections, putting together a team of young ladies that for four consecutive elections delivered victory for the PUP candidate. As a member of the PUP Executive Committee Corozal Southeast, not only was she vocal, but also contributed with fresh ideas. Once the three children entered university, Ms. Martha was able to accompany her husband on official business for the country, and so in 1983 the couple visited Africa and also attended the Nepal Agriculture Show Day in the United Kingdom. The working tour also included an invitation to the French Bastille on July 14, 1983 in Paris. Ms. Martha also accompanied her husband on official business to the Country of Brazil at the UN summit on the protocol establishing Protection of the Environment in Rio de Janeiro, in 1992. In January, 1999, the Papal Nuncio invited Florencio Sr. as Minister of Latin American Affairs and extended the invitation to his spouse to visit the Vatican in Rome for the year of the Jubilee 2,000. On June 14,

2000, Pope John Paul issued a Papal blessing that Martha, being the devout Catholic, was immensely proud of. She also felt greatly blessed to be able to attend mass and receive communion at the Basilica. In October, 2003, Ms. Martha accompanied Mr. Marin, who was at the time the Chairman of the Corozal Free Zone, on a working tour of the Indian Industrial Free Zone in Hyderabad in India. In 2004, Ms. Martha was also a part of a working tour of Industrial Office Zones in China that included visits to Beijing, Shanghai and Hong Kong. With her acquired knowledge, she was able to encourage and inspire her husband Florencio Sr. in laying out plans to renovate and reinvigorate the existing Free Zone while he was chairman. A little-known fact is that Ms. Martha was such a support system for Mr. Marin that in tribute, he named a village in Orange Walk, Santa Martha. This was to show her how grateful he was for her being such a stable force in his life. On a more personal note, I can recall back when I was courting Magali, I was once invited to the home for some chilmole soup from Xaibe Village. Now it happened that this chilmole had a “heat quotient” that far exceeded my own humble limits. Nevertheless, I could not lose face in front of my fiancée’s family, so I quietly sizzled as I ate. Just about the time that I could no longer feel my tongue, I heard a gentle voice say, “Carlton, you okay?” “Of course” I quickly replied, “Yes, yes Mrs. Marin, everything good!” Mrs. Marin just chuckled, and then quietly said, “bwai, dis ting bun fu true.. ih bun me too!” And just like that, my future mother-in-law helped me save face. A more thoughtful person there never was. If earth has lost a wonderful soul, heaven has gained an angel. Portion delivered by Daughter-inLaw Alva Marin Besides being able to be a great source of support to her husband, Mrs. Martha was a most devoted and dedicated mother. Florencio Jr. recalls that she shared with him that she had always been a deep sleeper but the moment she had him, she was able to hear his breathing throughout the night. He recalls the times she made bread for them when they were children. They would hang about in the kitchen eagerly waiting for the bread to come out and would want to eat it hot from out of the oven. She told them “You cuh eat it, on one condition, if you eat the hot bread, and ih du you bad, I wahn lash unu.” She was a firm mom who disciplined with love and who passed on that strength of character to her children. Florencio’s pride and joy was to take a bouquet of flowers on his birthday to thank her for having had him and for being such a great mom. John recalls that she was always loving and that she was never intimidated by anyone or any adversary and that she was a force to reckon with during election time. During the Heads of Agreement, she protected and comforted them while their dad was out facing the challenging social unrest of the time. She was quiet and unassuming but underneath there was a steely determination. She loved her sons dearly but there was always special place in her heart for Magali. No one can get between a bond between mother and daughter and Magali and Mrs. Martha had the strongest. They would talk on the phone on a daily basis about everything and anything and at Christmas time, the playful banter between Much and Mugs was something to look forward to

during gift opening time. When it became difficult for her to get around, in true Mrs. Martha fashion, she did not take to complaining. Instead Magali got her a pair of binoculars and a field guide and introduced her to the joys of birdwatching. She spent her mornings and evenings enjoying birds on her porch. She would religiously make sure her hummingbird feeder did not go dry and got excited in seeing lifers. Magali says she developed her love of nature because of her mother. Personally, I have always stated that I won the jackpot when it came to mothersin-law. I could not have asked for a kinder, more respectful, and more involved mother in law than Ms. Martha. We became very close and would take trips to Chetumal or to Orange Walk, first just the two of us and then with my daughters as they became older. We would have a girls’ day out and go watch movies, eat at the food court and eat Nutrisa ice cream which she introduced to them. We would chat and laugh the entire way as she was always very jovial. She was a confidant and a best friend. She was, also, greatly involved in the lives of her grandchildren and could be heard singing the loudest at birthday parties. To her, all her grandchildren were the most beautiful, most talented and smartest and she was their greatest cheerleader. Any news about their achievement, whether big or small, would bring that familiar sparkle of pride to her eyes. Mrs. Marin was also a woman of great faith, and as such was mentally ready to join her parents and brothers, Gustavo and Gary. Before she became really ill, she made sure she completed knitting the last blanket for her granddaughter, Gianna. She knitted a blanket for each of her grandchildren, and was proud to leave them with a ‘recuerdo’ of hers made by her own hands. The happiest day for Mrs. Martha, was 12th of January of this year when she celebrated her 50th wedding anniversary. One could tell from her glow and demeanor that she was so happy to be celebrating this momentous occasion with friends and family. She was the happiest person witnessing her children come together to celebrate this milestone, and was even prouder to have her granddaughters serenade her with her special request ‘Solamente Una Vez’ and “The Hawaiian Love Song.” Most of all she was proud to be next to her soul mate of the past 50 years, that young student from San Narciso. She was so proud of achieving this milestone with Mr. Marin, that she made her own souvenirs and corsages for the small family gathering. She loved arts and crafts and was happy and proud to do this for her family. She loved Mr. Marin dearly and she mentioned that after she celebrated this very important milestone, the Good Lord could do with her as He pleased, as she was ready. Mrs. Martha was a classy lady. She never had any airs. She was simply beautiful inside and out. She was not into destructive behavior either through gossip or bad mindedness. She was about uplifting people and being positive and being cheerful and everyone who came into contact with her was positively impacted as evidenced by the show of love here today. The legacy she leaves behind with her children and grandchildren are her strength, love and gratefulness. Mrs. Martha, you were the center around which the family revolved. We received more love than we needed or deserved. They say that the more love you received, the bigger the pain at the loss and although we are devastated, we know and accept that your journey on this physical plane has come to an end. We will not say good bye but ‘til we meet again Mrs. Martha. See you later, Nana. May you rest in blissful peace with your beloved Infant Jesus. PORTION DELIVERED BY GRAND-

DAUGHTER, NATHALYA MARIN My grandmother was the most beautiful soul on earth. She was the kindest, sweetest and most generous person. Words could never truly express how much I miss her and love her every single day. Before we close off this celebration of her life, I would just like to share a few memories of her that make me smile. I remember when I had to spend about 5 days with her when my mom busy having my sister. I remember being so scared that I’d miss my mom but Nana took care of me. We would watch my Bratz movies over and over again and not once did she complain. She comforted me when I needed it the most and for that, I cannot thank her enough. I remember when she and I sat down and ate a whole bag of ‘kinep’ right after I had finished teaching her how to use her laptop and her phone one summer. My Nana always wanted to remain up to date with the newest technology and if she didn’t understand something, I would be there to teach her. She would eagerly write down notes while my grandpa would come and ask “How is my student doing?” How I wish I could go back to that day to teach her one more lesson and have one more conversation with her. I’d also like to thank her for all the times that she was ready to help. If anyone needed anything, Nana was the one to call. Anything you needed, she knew someone that could assist. She always kept you in mind when she knew that you needed something. If you’d tell her you needed something on Monday, by Tuesday she’d call you back with all the details of where you could get it. I learnt a lot of things from Nana, I learned to remain positive in all situations and I try to live by that, even now when being positive feels like the most impossible thing to do. I learned that having a sister was a blessing because she never had one. I learned that education was one of the most important things and that family always came first; and lastly, I learned to give to others even when I am not in the best condition either. I wish I could call my grandma one last time and hear her voice ask me how my family and I were doing. I wish I could hug her one last time and smell her perfume while she complimented all of us. I wish I could have one more day with her and tell her that I love her and that she was one of the most important people in my life. I will forever admire my grandma’s strong, independent, loving and beautiful soul. She will forever be my role model and now my guardian angel. Rest in peace, Nana.

It has become impossible to say which side is the bully and which the bullied. Political allies have turned on each other. Insults and taunts and aggression and threats are the order of the day, handed out as generously as the nauseating propaganda. And that, against the backdrop of a brazen display of arrogance by the Government which has ended up in the Courts and will obviously go to the House of Representatives. Justice erred in his decision, he said. And then he took potshots at the Chief Justice for his lack of timeliness in delivering judgments. It was all in all a display of pure petulance. The Prime Minister did not get his own way, and he threw a hissy-fit. He threw a tantrum. Plain and simple. That’s what it was. The dynamics have changed, without a doubt, following back to back losses by the Government in Court. It may be just aesthetics, or it may be more. But it is what it is. Because the Government was confident of

a victory at the Supreme Court. And they lost on a simple technicality. The Government was confident of a victory at the Court of Appeal. And their attorneys, like spurned, clumsy suitors, did not make it past first base. So a lot of people are taking a step back. Nobody but the almighty Barrow and his insiders know what will happen in the House on Friday. And the truth is that the people of Belize have no say.
