Botanical Bounty By Stephen Guy
LIVERPOOL’S first botanic garden opened in 1802 on a five-acre plot in the Myrtle Street area – a leading founder was William Roscoe. By the time of his death in 1831 the town was encroaching on the garden and public support was declining. It was decided to move to the present Edge Lane site, still one of the city’s most atmospheric and historic open spaces. The son of an innkeeper, Roscoe was arguably the greatest Liverpudlian: his talents spurred cultural and social change. A one-time resident of Allerton Hall, as well as being a prominent botanist Roscoe had many other talents. The father of 10 was also a lawyer, poet, author, classicist, art collector, banker and politician in the campaign to abolish the slave trade. Wavertree Botanic Garden,
although opened in 1836 five years after Roscoe’s death, was very much part of his legacy. Nestling in the park is the curator’s house or lodge (pictured, now a nursery). Designed by local architect John Cunningham in the Greek Revival style, it originally housed the garden’s curator. He was responsible for recording and studying the collection as well as maintaining the plants. Like a museum curator, duties included labelling, cataloguing
and exhibiting specimens. Visitors not only admired the items for their beauty but also origins and botanical background. The lodge also contained an extensive library of reference books and archives relating to the collection – most is now sadly lost. One story goes that the building was occupied by air raid wardens during the Second World War and the archives were burnt to keep them warm. The garden was designed by the first curator John Shepherd and
paid for by subscription. However, it struggled financially before being bailed out by Liverpool Corporation. The Corporation eventually took charge in 1846, giving the public full access – previously they were only let in two days a week. Large numbers of people visited the garden – nearly 169,000 in 1850 alone. A conservatory built in 1870 was destroyed by German bombs in November 1940 and never rebuilt. Like many green spaces over the years, the garden has been threatened with development. Protests halted a planned Corporation housing estate in the 1930s. During the 1950s the idea of creating a model traffic area to teach children road safety was dropped. n Learn more about the history of Liverpool at the Museum of Liverpool, Pier Head, open 10 am to 5 pm every day, admission free.

Involved in a dispute concerning Money or Property? This month we meet Veronica Howley, Head of Litigation, at GAD LLP Solicitors. What have you found to be most important to Clients? Most clients involved in a dispute want to resolve it, as quickly and cost effectively as possible. The law, and the litigation process, can be complex, bewildering and frustrating for people going to court, but resolving a dispute is a practical discipline. It is my role as a professional, to guide the client through the legal issues, the litigation process, and provide them with solutions to help them settle and move on. How do you help? When clients approach me, they are usually looking for constructive advice to resolve a dispute that they are already locked into. Disputes are stressful to have to deal with, however they arise. The client needs their problem to be fixed, but in a complex case, may not be able to identify a way they can resolve their dispute themselves, or there may be some complicating factor which requires a lawyer’s assistance to get them to a satisfactory resolution. How would you describe your approach? I listen. It is essential that I give a client the opportunity to explain their situation, in their own words and at their own pace. Once I have a clear picture of the situation, and any background that has created the dispute, I am better placed to advise them on how the law will apply, and how we can work together to resolve the dispute. I really do enjoy this sort of challenge. Which areas of litigation do you advise upon? Most of the disputes that am involved with, are disputes involving substantial sums of money arising from contractual disputes, beneficial interests in land, or in the estate of someone who has died. I also deal with professional negligence claims involving those areas of law, and I regularly deal with cases where there are several separate, sometimes connected, legal issues to resolve within the same case. I have specialist expertise in the following areas: • • • • • • •
Contract/quasi contract and commercial Commercial landlord and tenant disputes Disputes about wills, administration of estates, and inheritance. Disputes over the beneficial interests in land and property Trusts and breach of trust/breach of duty Shareholder and Partnership disputes Professional negligence claims concerning professional advice in any of those areas.
A lot of my work involves the resolution of multiple legal issues within a single case. I also regularly act in cases where the capacity, capability, or vulnerability of one of the parties is a key issue in the determination of the dispute. Are there any time limits on claims? Yes, and time limits can be complicated! Each type of case has its own specific time limit and they can vary from 6 months to 12 years, and subject to a 15 year long stop period for some specific types of case. There are some limited exceptions, where there is no specific time limit to bring a claim, but they are not common, and the claim must still be brought within a reasonable period time from the circumstances giving rise to it. To take the examples I have given, an inheritance claim may be brought before a Grant is obtained, but must usually be brought within 6 months of the date that a Grant is issued in the estate concerned – there is provision to allow this type of claim to be brought after the six months but the circumstances to allow this would have to be exceptional and it would be a mistake to delay bringing a claim in the hope that a court will allow the claim to be brought ‘out of time’. It will only do so if there was an exceptionally good reason for missing the time limit. At the other end of the scale, a claim for the recovery of land must be brought within 12 years from the date that the right to the land accrues. If a claim is brought outside of the limitation period allowed, then the defendant will have a full defence to a claim. If a lawyer misses a limitation date, then a negligence claim by his client is likely to follow so it is vital to get it right. How did you become involved in dealing with disputes? By accident! As a trainee solicitor I was fortunate to be given cases to work on that would test my problem-solving abilities, knowledge of the law, writing and negotiating skills. A lot of those cases involved a dispute that had already arisen, or which would result in a dispute if the problem was not resolved. I found that the more complex the problem, the more I enjoyed finding a way to resolve it. By the time I qualified in 2001, dispute resolution had become my specialism and I have stayed with it through 8 years in partnership at a Wirral firm before joining GAD. I could not imagine doing anything else now. Q What needs to be proved in order to bring a successful claim? It depends entirely on the kind of claim being brought.

The single common feature for almost all claims is that it is for the Claimant to prove their claim, not for the defendant to disprove it. This is called the burden of proof. There are some very limited exceptions where certain legal presumptions operate to switch the burden of proof to the defendant, but they are rare. The claimant must also prove their claim on the balance of probabilities, which means that the court will find that it is more likely than not that it prefers the claimant’s claim to the defendant’s defence. This is called the standard of proof. Again, there are very limited exceptions, such as where a claimant alleges that the defendant has done something that would amount to a civil fraud. In those cases, the standard of proof is not going to be satisfied without extremely convincing evidence of such a serious allegation, and in practice, lawyers are wary of making such claims on behalf of their clients unless the nature of the evidence cannot be explained in any other way. Q What is your focus for 2018? There has been a significant rise in cases involving beneficial interests in land, typically where one party buys a property but someone else, usually a former cohabitee, claims an interest in the property itself or the proceeds of sale. Such claims often arise from contributions to the purchase price, both direct and indirect, or from promises alleged to have been made to the claimant by the property owner about ownership, or future ownership, which they relied on, to their detriment. Frequently, these allegations are made in relation to property that would otherwise form part of a deceased’s estate. These are often complex claims that are difficult to resolve and involve going back and looking at the parties’ whole course of dealings with each other, over many years, frequently many decades, trying to establish who said what to whom, would it amount to evidence to prove their claim, how may that evidence be challenged. These are surprisingly complex claims and all of the evidence has to be organised before the claim is issued, so they involve a great deal of analysis, which is just the sort of work I like, though it does mean I spend much more time in the office than I do at home.

WILLIE and Fred were jubilant – they had scooped £5 million in the lottery using numbers based on their birthdays. They had known each other since primary school, living on opposite sides of the road in a drab district known as The Smellies because of its close proximity of a pie factory. Now it was time to push the boat out – literally. They bought a big yacht and entertained family and friends at the marina before going for a sail to the Isle of Man. The two, like countless others, had often talked about what they’d do with the money if they were successful. Willie’s choice was the yacht while Fred’s choosing was linked – as always – to his stomach. “I’m going to have lobster every day,” he announced. Willie didn’t expect his friend to make his dream a reality but it started when they celebrated the
win. Top caterers prepared a cold collation of fresh fruit, canapés and lobster washed down with champagne. Lobster was then permanently on Fred’s menu. He persuaded Willie to abandon life ashore and they moved on to the yacht permanently and their houses rented out. Fred said his contribution would be to supply the food. “We will live off the sea’s bounty,” he declared. Willie knew what this meant – lobster
morning, noon and night. Fred, a keen fisherman since childhood, caught them himself. The yacht – appropriately named Lottery – towed a rowing boat loaded with lobster pots. These were baited and dropped on lines to the rocky seabed where they lay among the sea urchins, occasionally examined by curious seals. The yacht hove-to off the Calf of Man and Fred eagerly collected his pots from the crystal-clear depths as puffins swooped overhead. Willie helped him haul them aboard the yacht watched by Dolly and Daisy, the friends’ devoted dogs. A huge covered tank had been constructed in the stern. The lobsters were carefully removed from the pots and placed in the tank to keep them alive ready for cooking. It was a year after the lottery win and Willie and Fred had got into a pleasant routine wandering around the Irish Sea. Then the
storm broke. Huge waves crashed over the yacht despite being anchored in a rocky cove. It went on all night. The Lottery pitched one way then the next, plunging and twisting as the sea boiled. Dolly and Daisy howled in their kennels. Willie sat smoking his pipe but Fred was down below being violently sick. He would have cheerfully died if given the option. His mind was filled with fiendish giant lobsters crawling all over him, their powerful claws tearing at his innards. Eventually the storm blew itself out and the yacht floated on a calm, glass-like sea. Fred looked wistfully into the tank. Local golf club fundraise for Hospice MARIE Curie have been nominated as charity of the year at Woolton Golf Club for 20182019. The Partnership, which started back in March has seen some fantastic fundraising efforts from the club so far and there are plenty more events planned for the remainder of the year. So far the club have raffled off the Presidents car parking space, held a Tea Party and a dinner. Fiona Marsden, the Lady Captain and Robert Owen, the President came into the hospice to present the first donation to the charity. Fiona Marsden, the Lady Captain at the Golf Club said “I’m aware of the fantastic job Marie Curie does and that it’s fully deserving of the support of the golf club. “I wanted to raise funds so that they can continue with the excellent work they do in providing care for people living with a terminal illness and their families. Celebrity article – Ray Winstone By Tim Saunders SUCCESSFUL English film and television actor Ray Winstone is renowned for his troubled hard man roles. Most recently he has been working on a film about the Hatton Garden robbery with Michael Caine and Jim Broadbent, due for release this year. Aged 12, Ray joined the Repton Amateur Boxing Club. Over the next 10 years he won 80 out of 88 bouts. He was London schoolboy champion on three occasions, fighting twice for England. Boxing provided a firm grounding when tackling his acting career: “If you can get in a ring with 2,000 people watching and be smacked around by another guy, then walking onstage isn’t hard,” he told boxrec.com. Deciding to pursue drama, Winstone enrolled at the £900 a term Corona Stage Academy in Hammersmith. Little did he anticipate that this would be the start of a career that would see him becoming the darling of ITV. He landed his first major role in What a Crazy World at the Theatre Royal, Stratford and his allegedly poor singing and dancing in this production apparently led his usually supportive father to say “Give it up, while you’re ahead”! One of his first TV appearances came in the 1976 ‘Loving Arms’ episode of
ITV’s The Sweeney starring alongside John Thaw. He played a minor part as an unnamed young thug and was credited as Raymond Winstone. His role in Scum, the 1979 crime drama about life inside a borstal pigeon holed Ray into countless further roles as a tough or
violent man. However, he does have a softer side as seen in Martha, Meet Frank, Daniel and Laurence where he played a comic part. In Fanny and Elvis he played the romantic lead. But it was his portrayal of King Henry VIII in the 2003 hit ITV series that won him a whole new audience. It took him weeks of tough physical training to get in shape: “People always think of Henry as this fat bloke, but in his younger days he was very fit,” Ray told the Radio Times. “So I was on a special diet to get my weight down.” In 2005, he appeared opposite Suranne Jones in Vincent, the ITV drama about a team of private detectives. He provided the voice for Mr. Beaver in The Chronicles of Narnia: The Lion, the Witch and the Wardrobe. Ray then appeared in Martin Scorsese’s 2006 film The Departed as Mr. French, an enforcer to Jack Nicholson’s Irish mob boss. Five years later Ray starred in The Hot Potato, a comedy thriller about two men who come into possession of a lump of uranium. The film, which is set in the East End of London in the 1960s, also stars Jack Huston, Colm Meaney and David Harewood as well as Ray’s eldest daughter Lois Winstone. In 2015, Ray played the role of ex-criminal Jimmy Rose in The Trials of Jimmy Rose, a three-part drama for ITV. Married since 1979, Ray has three children.

THE 10th September sees World Suicide Prevention, but what signs should you look out for to help yourself or someone else who could be experiencing mental health issues: n Feeling down n Stress n Anxious and panicky n Angry n Winter blues Try these six tips to help you be happier, more in control, and able to cope better with life’s ups and downs: Manage your stress levels If you have a lot of stress in your life, find ways to reduce it, such as learning a few timemanagement techniques or talking to your boss about changing your working hours. Introduce regular exercise and time to yourself. These are positive changes. Taking control of your time in this way can effectively reduce stress. If you have feelings of anxiety along with your stress, breathing techniques can help. Use humour and enjoy yourself Try to see the funny side of situations and you’ll often be able to cope better. Jokes have a way of making worries seem less important. Doing things that you enjoy is also good for your emotional wellbeing. Simple activities like watching sports with a friend, having a soak in the bath, or meeting up with friends for coffee can all improve your day. Doing something you’re good at, such as
cooking or dancing, is a good way to enjoy yourself and have a sense of achievement. Boost your self-esteem Self-esteem is the way you feel about yourself. The best way to improve your self-esteem is to treat yourself as you would treat a valued friend, in a positive but honest way. Notice when you’re putting yourself down, such as thinking, “You’re so stupid for not getting that job”, and instead think, “Would I say that to my best friend?”. You probably wouldn’t. Tell yourself something positive instead, such as: “You’re a bright person, you’ll get the next job”. Have a healthy lifestyle n Limit your alcohol intake – When times are hard, it’s tempting to drink alcohol because it “numbs” painful feelings. But it can exaggerate some feelings and make you feel angry or aggressive. It can also make you feel more depressed. n Choose a well-balanced diet – Making healthy choices about your diet can make you feel emotionally stronger. You’re doing something positive for yourself, which lifts your self-esteem. n Do some exercise – Even moderate exercise releases chemicals in your brain that lift your mood. It can help you sleep better, have more energy and keep your heart healthy. Choose an exercise that you enjoy. If it helps, do it with a friend or listen to music. Adults should aim for 150 minutes a week.
n Get enough sleep – Around seven to eight hours is the average amount of sleep an adult needs for their body and mind to fully rest. Writing a “to do” list for the next day before bed can organise your thoughts and clear your mind of any distractions. n Talk and share – Communication is important, whether it’s with a friend, family member or counsellor. Talking things through helps you to release tension, rather than keeping it inside. It helps strengthen your relationships and connect with people. n Build your resilience – Resilience is what allows you to cope with life’s ups and downs. Making something worthwhile out of painful times helps your resilience grow. Starting a support group to help others, or making something creative out of bad experiences by, for example, writing, painting or singing, can help you express pain and get through hard times. A blanket approach to the giants... AN enormous picnic blanket is going to be created by youngsters across Liverpool and Wirral to form part of October’s Giant spectacular. Thousands of children from the two areas will become Dream Catchers as they prepare for Liverpool’s Dream which takes place from 4-7 October. Students, ranging from the ages of three to 16, will be encouraged to think about their own dreams – what their hopes are for their own future and that of their family and friends, what do they envisage for the place they call home, and what they dream will be their legacy for future generations. This will then inspire the design of an enormous picnic blanket which will form part of the show when it visits Princes Park and the New Brighton area. Those who have taken part in the creation will be invited to attend a picnic in October, and they may be joined
by a guest with a Giant appetite. As well as the picnic blanket, those involved will be invited to capture their dreams by designing their own t-shirts, football shirts or pyjama tops. These tops will be exhibited in a prime position in both Liverpool and New Brighton during the event, and will remain on display until the end of October.

Designers have done well with this Toyota model By Tim Saunders LONG journeys are the best way of putting a vehicle through its paces, I find. On a short jaunt seats have little chance to prove themselves and cruise control can’t usually be activated. So a trip to Bath for the futuristic Toyota CH-R should highlight strengths and weaknesses. For looks, this compact sports utility vehicle (SUV) scores highly. It has a chunky, masculine front and an eye-catching rear. A designer’s job is increasingly tough but they’ve done well here; even if it does look similar to the rather more staid Honda HR-V from the side. Both share the hidden rear door handles that mislead the eye into thinking it’s a three-door. The children don’t like this because they can’t reach them. They seem a little flimsy, too. Keyless entry is helpful but this only works when opening the front doors. To the driver of a 16-year-old Ford Fiesta where there are pleasingly few blindspots, the CH-R takes a bit of getting used to but thanks to the reversing camera, life is not too difficult. I’ve
booked parking on a driveway and it’s a fairly tight spot meaning that I can only park head on. If I want to reverse into the space I must reverse down the long driveway. I’m not brave enough to do this at night but I do tackle it with success in the morning. Nevertheless it does feel a bit cumbersome and the turning circle is larger than I would hope. Its high ride height is enjoyable, providing a good view of the road ahead – probably most noticeably on approaching Bath itself,
travelling from the top of the hill that takes you down into the city. Here there is a panoramic view of Georgian splendour. My wife wants to fold the central information panel away because it annoys her. And trust me, annoying her is not a good idea. That said the satellite navigation is easy to use and it works. But we can’t figure out how to turn the radio off to listen purely to the navigation instructions. Driver and front passenger get plenty of space but the overall dashboard
design is a bit ‘boxy’. There’s a bit too much black plastic for my liking and I’m not a great fan of the electric blue strip that runs across the dash. With its six-speed manual gearbox it is a surprise to learn that the engine is a 1.2-litre petrol unit. It seems to be quite efficient, though, travelling to Somerset and back to Hampshire on less than half a tank. Cruise control, which also monitors the distance of the car in front, braking and accelerating accordingly, aids frugality while the turbo boosts performance. Cruise is cancelled out at speeds below 25mph. When activated it is possible to change between gears without cruise control stopping. This is useful, some systems don’t work like this. Ready for my work routine as summer is nearly over... HEY guys and welcome to September’s Life ‘n’ Style! Hope everyone had a lovely summer, I did but I am sooooo looking forward to the kids going back to school and getting my daily work routine back. Don’t get me wrong I love the odd lie in from time to time and even though I moan over the 6:30 wake up calls you do seem to get so much more out of your day. Over the summer we’ve spent a lot of time going on bike rides…and yes I bought a bike!!! Many people didn’t believe me but in-between the glitz and glamour lifestyle I do like to go on the bike tracks and venture out for the day. Luckily enough we had the weather for it. It’s really good for breaking down the fat cells and helping the appearance of cellulite. I’ve been having the front of my legs done, the backs and my bum lifted. September is always the hardest month fashion-wise in my opinion because it’s no longer summer but nor has winter set upon us. So I try to wear outfits that don’t look too skimpy but also not too heavy at the same time either. Ditch the scales
EVERY now and again I get a message from a client, feeling distressed, because they’ve not lost any weight or they’ve put weight on. Although they may be feeling a lot better within themselves, and they’ll list other benefits that they’ve had, they can be disheartened as they’ve not lost the weight they’d hoped. From my experience, when a client starts a program, or maybe if you’ve started some kind of exercise program, it can be pretty easy at the start to get an initial weight loss. If, however, a client has been doing some resistance work with me, or maybe you’ve been doing some resistance work on a program, the weight loss can be minimal or in some

Why neutering is important... NEUTERING your pets can be really beneficial to their long term health. It is known as castration in males and speying in females. Your dog or cat will have a general anaesthetic and be home to you the same day. ■ Male cats are less likely to roam as far and get into fights. Castration also stops strong smelling urine and spraying that entire male cats produce. We recommend this from 5-6months old. ■ Female cats are very good at getting pregnant, even when very young! For this reason we recommend speying at 6months old. They will also be protected from cancer and infections in these organs. ■ Male dogs can develop testicu-
lar and prostate problems as they age which can be very severe, including infections and cancer. We can castrate at any age from 6 months old, but in large or giant breeds we recommend waiting until they are fully grown. If your dog is nervous, castration can make this worse so a consultation with a veterinary surgeon is recommended. ■ Female dogs are at high risk of mammary cancer (breast cancer) and life-threatening infections in the uterus (womb). Speying at 6months old (or 12-18months in large/giant breeds) will prevent these problems. It is an old wives tale that dogs need to have a litter! The Vet Liverpool, L11 1BQ

Dog of the month – Murray MURRAY is an 18 month old Crossbreed and he is a happy little fellow who hasn’t had the brightest start to his young life. He’s a little over a year old but has had a few homes already, and is looking for a family who can offer him stability. He’s a friendly lad who can be a little shy at first, but some gentle handling will make sure you are firm friends. Murray absolutely loves toys and will play with them for hours, and loves to carry them on his
walkies too! Murray needs a child free, adult only home. He can be quite vocal when he sees other dogs, but soon calms down, although he doesn’t like them to get too close. South rebuild for new season By Jim Stanway
AFTER a difficult close season in which South Liverpool FC lost many of their West Cheshire League first division winners squad, South start the new season with confidence after an influx of younger players hungry to retain the league championship. Having scheduled a very tough pre-season friendly programme involving five games against clubs from higher up the pyramid, the new look first team squad have acquitted themselves superbly with three draws, one win and only one defeat. In the opening game against Cymru Alliance highflyers Holywell Town, the match could have gone either way but ended goalless with South having two excellent chances to win the game in the dying seconds. The second match against Litherland Remyca, recently promoted to the first division of the North West Counties League, was a goal-fest in which South held the lead until the final seconds. Goals from captain Cameron Dalton and two from
the returning Sharif Yusuf saw an entertaining game end 3-3. Against North West Counties League second division outfit Ashton Town, another 3-3 draw ensued with two goals from the fleet-footed Sharif Yusuf although a 3-1 interval lead was thrown away in the second half. Despite hitting the post and crossbar South were beaten 2-0 by a powerful Bootle FC outfit, front runners for the North West Counties First Division title, but turned in an impressive performance. The final pre-season friendly saw
the team brush aside Liverpool Count Premier League team South Sefton Borough 5-2 with 2 goals on his debut for Danny Bulayima, 2 for Danny Ventre and one for Scott Corner. The reserves have played fewer friendlies but look in fine fettle. After a 3-0 defeat to Vauxhall Motors Reserves, the team have found their scoring boots with a 9-0 demolition of Helsby and a 4-1 win over Liverpool County Premier League Premier Division team, AFC Liverpool Reserves, with 2 goals by Neil Roach and Bobby Murphy and a double from Graeme Long, coming on as substitute for his first appearance for the club. Pre-Season Hots Up By Jen Ratcliffe
THE rest of Liverpool Sefton Hockey Club’s teams are following the W1s example and getting their pre-season underway as the first whistle of our 2018/19 campaign creeps ever closer. We’ve been delighted to see an increasing number of W2s players attending fitness sessions as this helps to bolster the elite squad’s overall strength and conditioning. We also know from past experience that those who train together stay together! The M2s and 3s are attacking their preseason training with aplomb as they prepare for a tough season ahead in their new leagues after both secured promotion. The W3s and 4s are rumoured to be entering the Tier 3 England Hockey knockout competition next year so they’ll also be keen to start working on their gameplay. The club is looking forward to the return of the Bill Chambers Trophy tournament that takes place near the end of August. This year has a theme of ‘World Cup’ which ties in with the Vitality Women’s World Cup taking place in London. Despite footballing heartbreak earlier in the summer, the country has another
chance at World Cup glory as a young England squad fixates their attention on winning a medal for the 4th time in 3 years. Getting into the spirit of things will mean each team will dress in the theme of a country taking part in the Women’s World Cup. Themes could include England, Netherlands, Germany, Ireland, USA, Argentina, Australia and India amongst others. The day is a fantastic mix of quality hockey and socialising. The club will be running a small bar to keep players refreshed and lunch will be included in the entry fee. Afterwards the club will head to our new social home, Aigburth People’s Hall, for a BBQ and the trophy presentation.
