Do Both Parties Have to Agree to a Modification? After a divorce or paternity matter ends, one or both parties may want to somehow modify the judgment. Modifications can occur in regards to child custody, child support and spousal support, which is still referred to as alimony in some states. However, modifications to the property division in a divorce are generally not allowed. Once marital property and debt are divided in a divorce, that portion of a judgment is final. For this reason, property division must be thoroughly addressed in a divorce. Do parties have to agree to a modification for it to take place in regards to custody, child support, or spousal support? Or can a judge order a modification even if one party does not want it? This is a common question that some parties have. The reality is a judge can enter a modification even if both parties do not agree to it. To prevail on a modification, one party first has to file a motion to modify. In some states, they might call a petition to modify or for a modification.
The motion or petition is then served on the other party. The responding party can contest the modification. If that takes place, contested litigation then takes place. In some ways, this can feel like re-living the original divorce or paternity case for the parties involved. The legal requirements can vary by state. But in a general sense, a party has to show a change of circumstance of a substantial and continuing basis to justify the modification. In some jurisdictions, a certain amount of time from the judgment might need to elapse. In other jurisdictions, there is no such requirement if there is a substantial and continuing change. As to child support and spousal support, the change of circumstance might involve an increase or decrease in one or both parties’ income. It might involve a change in the expenses of one or both of the parties. In terms of spousal support, the party receiving spousal support may have gotten remarried. Perhaps there is not a remarriage, but maybe the party receiving child support is romantically cohabitating with another individual. In terms of child custody, the possibilities are endless. A party might end up relocating far away. It could
involve the wishes of a child. It might entail the educational needs of the children, the fitness of the parents, or a litany of other reasons. Contested custody modifications can often be some of the more acrimonious cases in family law. Many also wonder how do judges decide whether to modify a judgment if both parties do not agree. Ultimately, a trial or evidentiary hearing will need to take place where witnesses testify and evidence is submitted. A trial or evidentiary hearing could take a few hours, even an entire day and sometimes it can go on for days. After the trial or evidentiary hearing, the judge then has to decide whether there is a sufficient basis to modify the judgment. In some cases, the judge may decide to modify the judgment. But in other cases, they may not. Either way, most judges issue a written judgment explaining whether there was a modification and their findings of fact and conclusions of law. AFTER A DIFFICULT END TO THE 2019-2020 SCHOOL YEAR, HOLLAND HALL COMMITTED TO IN-PERSON EDUCATION. “Everybody was thrown into crazy town when COVID hit . . . but we all wanted to be back in person if at all possible this year,” upper School Teacher Phillipa Kelly recalls. “It’s just so much better than being virtual. You can engage in higher level conversations and discussions when you’re actually together.” Holland Hall took extensive safety measures to make that happen. They secured their ventilation systems, spread desks six feet apart, required students and staff to wear masks, implemented block scheduling and even created outdoor classrooms. Holland Hall Student Molly Gilmartin, whose mother is immune-compromised, says she’s happy with the measures her school has taken against COVID. “Being back in the classroom was nerve-wracking for me, but I could not have been more at ease once school started back up,” Gilmartin says. THEY DIDN’T LET PRECAUTIONS OBSTRUCT LEARNING Because of the school’s new block scheduling system and increased supervision, teachers spend more time in class with the same students. Middle school teacher Becca Parker says the safeguards created a silver lining. “It feels like a more intimate experience. We’re getting to know our students much better.” Her largest class has 13 students.

Given longer class periods, teachers have adapted to make sure their students stay engaged. Kelly says teachers break up activities and come up with creative ways for students to work in groups while distanced. Holland Hall’s surrounding 162 acres has been used to create a dynamic learning environment. Parker takes her students on a walk outside during every class. Primary School Head Vanessa Jones acknowledges they’ve made curriculum adjustments to accommodate last spring’s unfinished learning, but have been able to recover much of any lost ground just by eliminating field trips and other events they couldn’t have had during a pandemic anyway. “Students are learning at deep levels, and sometimes in different ways. ORDER OF OPERATIONS Groundwork is the most important phase and includes electric, plumbing, irrigation, drainage and lighting. If any of the future projects on the Master Plan include these utility lines, they should be installed during the first phase before any concrete, stonework or decking is installed. The utilities can be stubbed for later use. If a hot tub is on the Master Plan, a 220-volt line will need to be installed during the first phase. CONCRETE WORK Outdoor kitchens, fireplaces, structures and seat walls have concrete footers that need to be installed before the final concrete is poured. Have a plan for what you want the final concrete pour to look like. With so many ways to make concrete look great, make it a point to discuss this with your contractor. Dressing up concrete doesn’t have to be expensive. You can add an eight-inch border cut or diamond cuts to enhance the look.

Many pollinator populations are in decline globally due to loss of feeding and nesting habitats, pollution, misuse of chemicals, disease and change in climate. One of the world’s most beautiful, and soon-to-be endangered pollinators is the Monarch butterfly. Monarch butterflies are North America’s bestknown, most beloved butterflies. Weighing less than an ounce, each monarch can fly more than 250 miles a day to their annual migration to Mexico and Oklahoma is just one of their pit stops. How can we be more welcoming to our southward-bound friends? Pollinator gardens help reverse the decline of Monarchs as well as other pollinators. But, it’s important to choose the right plants that provide food and shelter. “Think native plants,” says Keep Broken Arrow Beautiful’s Beverly Forester. “Native plants acclimate better to our weather and are more likely to survive,” explains Forester. Milkweed is the No.1 food for attracting and retaining Monarch butterflies. They not only need the milkweed to reproduce, but it’s the only plant caterpillars will eat.
