Coming off of this most challenging and unprecedented year, I am looking forward to getting back to doing some of the things I suppose I always took for granted. I most look forward to getting together with family and friends, going to concerts and sporting events and meeting with clients and colleagues in group settings. DO YOU HAVE A RESOLUTION FOR 2021? I am going to do my best to limit my time on my electronic devices and more time having actual conversations with people. The pandemic has made it increasingly easy to get lost in communicating electronically and forget about the value a real conversation can have.

Letter from the Editor WELL, IT’S FINALLY 2021, AND WHILE THE SIGHT OF A NEW YEAR HAS NEVER LOOKED SO GOOD, THE LESSONS AND EXPERIENCES I AM TAKING WITH ME FROM 2020 WILL STICK WITH ME FOR A LIFETIME. Among the most impactful lessons is what I soaked up just a few weeks ago at a funeral. My husband’s cousin, Cole, received a terminal diagnosis at the age of 25, and while he lived for a year-and-ahalf with that diagnosis and had to endure treatments for his cancer, he lived every day of that year-and-a-half with purpose and intentionality, knowing that his time on earth

most likely would soon come to an end. What if we all lived that way? We all eventually will have an expiration date, regardless if we have been given a diagnosis, so what if we lived everyday like it could be our last, every moment precious and valuable? I listened at his service about how he faced this journey with perseverance, bravery and honesty. He told people how he felt about them and made sure to give that hug and say the important things that often go unspoken. Cole was a firefighter, and while I have heard about the brotherhood that occurs within the fire community, I was moved by the show of support every step of the way, from holding fundraisers to covering every single work shift for the year-and-a-half battle so that Cole could still get a paycheck but receive the treatment he needed. What if we showed up for people like that—selflessly giving of our time without accolades or recognition? We all have a daily choice of how we are going to spend our 24 hours. So as I begin 2021, I

see some kids playing, I may jump in, talk to them, and deal with them because where I am from if you could play, they let you play, if you couldn’t, move out the way. It didn’t mean they didn’t like you—it was just there was not always someone there to get you where you needed to be.” To be a lifelong athlete requires a commitment that extends well beyond loving sports. A true lifelong athlete continually grows in his craft, is humbled by the experiences presented to him, and willingly extends his knowledge to others so that they

This can only come from a seasoned competitor who is skilled enough to teach but also modest enough to meet each person where they are and to ultimately help them to grow. Coach Jay Graves has found his calling in doing exactly that. Graves gets his competitive spirit naturally. Growing up in Mexico, Mo. within a family of three boys and three girls, the youngest of the bunch had to learn to hold his own among a sea of baseball, football, basketball and softball players who daily battled it out at their local park. He adds that the competition was always present, but that they always rooted each other on. It was in the park that he would learn to love the athleticism that came with organized play. His love for football was parallel to that of basketball, but when Graves entered high school, basketball then took the front seat, earning him two All-State titles and a McDonald’s AllAmerican high school nomination. The colleges came calling, but with the camaraderie that comes from a small town also comes the hesitancy that Graves might not be able to compete in a larger arena. Of course, this simply was not true. Graves went on to attend Moberly Junior College and then Talladega College in Alabama where he earned another All-American title. It was in the early 1990s that Point Guard Graves was recognized as being an exceptional ball handler and encouraged to try out for the Harlem Globetrotters. Successful in that endeavor, he spent the next year traveling CONTINUED >

all around California, learning from Meadowlark Lemon, and entertaining children. It was a great experience that he was thankful to be a part of, but he felt he was missing one thing—the competition of traditional basketball. During his Globetrotter run, the fact that he was only six credit hours shy from his college degree always played in the back of his mind, so Graves returned to complete them. His reputation as a stellar athlete continued to follow him, and coaches were still calling. Naturally, he wanted to play. He extended his basketball career to Manchester, England and then Victoria City, Mexico where he won a championship. It was not until he saw a need within his own family that his professional expertise shifted again. Not mentioning the modesty that Graves possesses would be a disservice. The fact that he does not focus on helping navigate his nephew Tyronne Lue, former NBA player and current coach of the LA Clippers, is testament of this. Instead, he notes the sting of his son’s youth football team losing their Superbowl championship under his coaching as a moment that weighs heavy on his mind. After taking on the job through Lee’s Summit Football Association Flag Football League, Graves has learned to channel his competitive nature with a very talented group of 4th-graders. He notes that he wants all his players to be successful and that being fair to everybody is important. They are all his kids, and if there is something to be taught on the field, he will make it happen. He has even had ex-NFL players come out and show them things from an offensive and defensive standpoint. He hopes his coaching not only helps them today but also tomorrow. “It is not about me,” Graves says. “I had a great career. I am fine. But I wanted to make sure that they got all the benefits that I think is necessary for a kid to be successful. Like, just being able to be around an NFL player so the next time they will not be in awe. The next time they see them they will be like, ‘I should be here.’ In sports, it is mentality. It is not all skill because everybody can have skill.”

Graves is a firm believer that any competitive activity can build self-esteem, friendship, and confidence—are skills imperative in building up a child. He has always practiced a healthy lifestyle that includes not drinking or smoking and continues to play basketball even with the aches and pains that go along with growing older. For him, he would rather have the discomfort that comes from something he loves than the suffering that would come from no participation at all. But in the long run, he says what he does comes down to reaching youth, taking his passion for sport, and helping them develop their full potential.

Should I Text My Lawyer? Text messages are a common way of communicating. Instead of picking up the phone or drafting an email, many like the ease and quickness of sending a text. For this reason, many clients text their lawyer in a divorce or family law matter. Text communications can be short and to the point. Clients can also attach photos and videos to texts. Is texting an effective form of communication for clients going through a divorce or family law matter? There are no black and white rules in terms of texting. There are also no rules or statutes that explicitly prohibit lawyers from texting their clients per se. Some lawyers might be willing to text their clients, while other lawyers might not want to do so. Some lawyers may not even be techsavvy enough to text with their clients. First, texting is often short and to the point, as explained above. The lawyer or the client could misinterpret the shortness of the communication, causing miscommunication, an increase in fees, or frustration. Many conversations instead require a lot more dialogue and analysis than a short text message exchange. Second, texting is not always the most secure way of communication. Texting is not encrypted communication.

This fact makes it easier for others to intercept or read the conversation. Third, it is possible a client puts the phone down and somebody else picks it up and reads the communication. With texts, it can be quick and easy to see recent communication and attorney-client privilege could be jeopardized. Fourth, text communication often does not make its way into a client’s file. It can be hard for a lawyer to print off the texts and actually get them into the file. It can be cumbersome for the law firm or lawyer (and expensive for the client in terms of legal fees) to print the text communications. Thus, when a client requests their file at the end of the case, the texts might not be there. As it relates to important matters, the client may want that text communication if they did not retain it on their own device. Fifth, text communication lacks the formality of other types of communication. The lack of formality can cause some clients to say things spontaneously to their lawyer. This can be damaging to the attorney-client relationship if they are upset or angry about something. Email is typically more secure because it is encrypted. Email is also a bit more formal and allows for lengthier communication. The lengthier communication can often lead to better and more effective communication. Additionally, it is easier for a lawyer to print off an email

chain and put that chain into the client file. For most clients, they appreciate this on the back-end when the case is over. Finally, while texting is easy and convenient, with most smartphones, a client can send an email just as quickly as a text. In terms of convenience, sending an email versus a text is comparable. Of course, phone calls, video conferences, or in-person meetings can often be more effective than email or text communication. While many clients want instant answers in the heat of the moment, if the situation can wait, the best communication can often take place by phone, video conference, or in-person. After growing up in Michigan, Fee moved to Kansas City and spent a career as a communication arts teacher at Oak Park High School and Staley High School. Now he’s retired and teaches chess full time. For Fee, as for so many people, chess is about more than winning. “I’d say [I enjoy] the competition and then also, I made a lot of friends. I’m still friends with my chess team all these years later. So it’s just not playing. It’s a social activity. You travel around the country, and then you see some of the same players wherever you go, just like the Queen’s Gambit,” says Fee. More than just an interest in the game, The Queen’s Gambit has inspired a new generation of female players. “I can tell you one thing that I’ve seen recently; we’re getting a lot of girls. I run the Regal Chess School. And we’re getting tons of girls signed up. So that’s awesome. Both my two daughters play,” says Fee. So why play chess? Fee says it teaches analytical skills as well as life lessons. “The first thing they learn is you can’t win every game. If players are equally rated, you play 10 games; you win five, you lose five.
