School water to be tested for lead TRACY BELL

he Stafford County School Board agreed Tuesday to award a service contract to Apex Companies, LLC, for lead testing of drinking water at all of the school division’s facilities. The board voted unanimously to award the $115,000 contract using annual operating funds. Effective July 1, the Virginia General Assembly enacted a Senate bill requiring school divisions to conduct lead testing of potable water to ensure that schools have a safe and clean water supply. The Virginia Department of Education also recommended that priority be given to schools built before 1986 due to a higher likelihood that pipes, solder and fixtures installed before the 1986 lead ban contain lead. The legislation requires school divisions to have schedules for water testing and a plan for remediation when needed. They were also directed to follow Environmental Protection Agency protocol for reducing lead. The threshold or action level for schools is 20 parts per billion, while it is 15 parts per billion for municipal utilities. The division will use the more stringent 15 parts per billion, according to school board background documents. A 30-second flush test helps

irginia Democrats are sounding the alarm about what they see as a pair of crucial electoral snafus that could decide a tight race for a House of Delegates seat in Stafford County, and perhaps even determine which party controls the chamber. Democrat Joshua Cole filed a federal lawsuit Nov. 15 to try and force the county’s elections officials to count dozens of controversial ab-
sentee ballots in his race against Republican Bob Thomas for the 28th District seat. Thomas currently holds an 82vote lead over Cole in the race to replace retiring House Speaker Bill Howell, and the two sides have been sparring for days whether to count 55 ballots that arrived via mail to the electoral board the morning after Election Day. The board voted 2-1 to reject the ballots on Nov. 14, and a circuit court judge threw out a
separate lawsuit to force officials to accept those ballots on the same day. But lawyers for the state’s Democratic Party think they have discovered another crucial error that could further throw the election results into question. They believe 668 voters at two Fredericksburg precincts within the 28th District received ballots listing the 88th District race instead, and they sent a letter to Virginia’s State Board of Elections seeking clarity on that point. Most Democrats didn’t expect to be tracking down errant votes in this race, until a surge of Democratic energy swept 15 other Republican incumbents out of the House ABSENTEE BALLOTS

on Nov. 7 and helped Cole pull within striking distance of Thomas, a Stafford County supervisor. Though Republicans currently hold a 51-49 majority, the 28th is one of three razor-close races Democrats are hoping to flip to either force a tie (and some sort of power-sharing arrangement) or even seize an outright majority. “This election is not yet over,” House Minority Leader David Toscano, D-57th District, said on a call with reporters. “The majority is still in play.” Toscano’s first step toward flipping the seat, and perhaps the House, is Cole’s new federal suit. The party retained high-powered law firm Perkins Coie and longtime Democratic lawyer Marc Elias (who also served as general counsel to Hillary Clinton’s 2016 presidential campaign) to pursue the case, in a bid to delay the state from certifying the election results and force the county electoral board to accept the ballots. Once that question is resolved, Cole would likely ask for a publicly funded recount in the race. “Virginians who cast their ballots in this fashion shouldn’t be disenfranchised because of errors by government officials,” Elias told reporters. “And we don’t know what’s in those ballots. They could help the Democrat or the Republican.” Stafford’s voter registrar, Greg Riddlemoser, wrote in a Nov. 12 statement that

determine if the actual fixture is where lead is leeching from or if there are problems further down the line, said Scott Horan, assistant superintendent for facilities at SCPS. Some fixes will be as simple as replacing a faucet, he said. In the spring of 2016, SCPS staff developed a preliminary plan to test the schools over a six- to 12-month period, starting with pre-1986 schools and facilities. In August, staff executed a cost proposal from APEX to assist with the collection, sampling and testing. Testing began that month, with 14 schools and facilities tested at a cost of $55,000. Staff has also consulted with Stafford County Utilities and the Virginia Health Department. SCPS staff plans to continue testing
the absentee ballots in question arrived at his office on 10 a.m. Nov. 8, missing the deadline of 7 p.m. Nov. 7. He said that his office “typically continues to receive late absentee ballots for weeks--and sometimes even months--after an election has come and gone” and “cannot count these ballots without an order of a court [of] competent jurisdiction.” But Elias claims in the lawsuit that the fault likely lies with some sort of slowdown on the part of postal workers, who he believes should have been able to get the 55 disputed ballots to Stafford before polls closed. He cites an email written by Riddlemoser to state elections officials lamenting that “there is no possible way in my military mind” that the ballots weren’t delivered to the electoral board on Election Day as evidence that something was amiss with the postal system in particular. “Voters have the right to have their votes counted, regardless of what piece of government failed,” Elias said. “These voters did everything right.” Riddlemoser didn’t respond to a request for comment on his claims. Elias also called on Thomas and other Republicans to support the legal effort, though it would seem that any such support is not forthcoming. “The law on absentee ballots is clear and was applied fairly by a Democratcontrolled electoral board,” Parker Slaybaugh, spokesman for the House Republican caucus, wrote in a statement. “You don’t get to pick and choose which late
ballots to count, otherwise you will have chaos across the entire state. It is unfortunate that Democrats misled people about the types of ballots at issue and continue to pursue unnecessary litigation over ballots even they admit [they] missed the deadline required by law. We are committed to open, fair, and honest elections and believe all legitimate votes lawfully cast by eligible voters should be counted.” Slaybaugh--who also represents Del. Kirk Cox, R-66th District, the man set to become speaker if the GOP retains control of the House — is referring to initial claims by state Democrats that the 55 ballots came entirely from members of the military, fueling their calls that the electoral board count those votes. Riddlemoser wrote on Nov. 12 that the ballots were “a collection of all types of absentee ballots,” and Democrats have since walked back that claim. “We still don’t know yet the breakdown of which ones are military ballots and which ones aren’t, because they haven’t been counted yet,” said Trent Armitage, executive director of the House Democratic caucus. “We always referred to them as ‘reported’ military ballots because we weren’t sure. We’re only going on what we heard from local folks on the ground.” Regardless of what kind of ballots are at issue, Elias is hoping for a hearing on the matter no later than Nov. 17 and a decision no later than Nov. 20, when the state electoral board is to certify
all election results. In the meantime, Democrats are hoping for some clarity on the perceived discrepancy in the Fredericksburg precinct ballots, as Elias believes the results would “certainly seem to change the outcome of election.” In a letter to state officials, he noted that the state election reporting website seems to show that poll workers split three precincts in Fredericksburg between the 28th and 88th Districts, when only one precinct should have been split between the two. Elias concedes that there could simply be an error on the website, or he could be somehow “misinterpreting” the results, but he’s waiting on some clarity from state officials before proceeding. A spokeswoman for the electoral board didn’t immediately respond to a request for comment on Elias’ concerns. The lawyer wouldn’t say exactly how the party would proceed if the precincts were improperly split, and if the whole dispute would require more legal action, and he expects to have more information on the subject in the coming days. Democrats will be watching the result closely, as the four precincts in the city picked Cole by a 70.5 percent to 29.4 percent margin. “We don’t shoot first and then explain later,” Elias said. “Based on what their response is and the proposed course of action, we will look at what possible remedies or approaches are appropriate.”

Heim, Dixon Smith, Rodney Thompson, H. H. Poole and Gayle middle schools; Anthony Burns, Margaret Brent, Hampton Oaks, Rockhill, Park Ridge, Rocky Run, Conway and Winding Creek elementary schools; and other transportation, fleet services and support services. The cost proposal of not more than $115,000 includes initial testing for the 21 schools and facilities, estimated second- and third-round testing and final estimated testing after remediation. SCPS staff also recommended using Fiscal 2018 annual operating contingency funds for any remaining testing. All areas and locations that have lead levels higher than the 15 parts per billion are indicated with posted signs
and precautions have been made to ensure that no one is consuming that water, according to SCPS. The staff is now forming mitigation plans for all areas identified with levels over the 15 parts per billion. Once plans and cost are established for mitigation of the areas in question, a funding strategy will be produced, according to discussion. Also at the meeting, the school board: • heard from two Stafford citizens at a public hearing on SCPS Superintendent Bruce Benson’s fiscal 2019 funding request. • met Germanna Community College’s new president, Janet Gullickson, who addressed the school board on the college’s continuing relationship with Stafford County Public Schools. • discussed the possibility of a task force for SCPS equality and diversity concerns. Henrico County Public
Schools recently developed an Office of Equity and Diversity, and plans to hire a director to oversee it, according to discussion. • heard from school board Vice-Chair Scott Hirons, who ran for re-election in the Falmouth District but lost to his opponent, Sarah Breedin Chase. Hirons was good-natured about the outcome, offering to be a resource during the transition. He said he was happy and that the voting outcome “could have been a lot worse.” “I’ve gotten to know Sarah. She’s extremely capable. She’s going to be a real asset for this board,” Hirons said. “I told people when I found out she was running, ‘Wow, if I wasn’t running I’d vote for her.’” Chase was in the audience Tuesday when, drawing laughs, Hirons added, addressing her: “My wife may have voted for you.”

So instead of being contributing members of society, a once able and taxpaying Virginian becomes entirely dependent on the government. The economics of this argument are just about impossible to counter. Many of us don’t realize how many people in our own backyard benefit from the ACA or would benefit from Medicaid expansion. In Stafford County, according to the Centers for Medicare and Medicaid Services, 5,700 individuals and families are covered by ACA-based insurance policies. In Prince William County that number is 27,000 and in Fairfax County it’s 73,000. Estimating the number of people who would benefit from Medicaid expansion is difficult, but a working estimate, statewide, is about 400,000 people. Going into last week’s election, few thought enough Democrats would win to put Medicaid expansion back on the agenda. But politics is unpredictable and it seems more Virginians are interested in the future of healthcare than any of the pundits realized. The results in the 28th District along with the election in the 40th and the 94th all under the microscope, could give the control of the House of Delegates to the Democrats and could affect Stafford County regarding transportation and other issues. While folks may jump to conclusions and cast a suspicious eye toward the registrar’s office, their eyeballs perhaps should be directed to the election and political systems instead. The past gerrymandering by the politicos in Richmond has created a patchwork that complicates the layout in precincts. While this should be something election officials should be able to deal with, it only increases the chance Murphy’s Law will kick in and the human factor creates unintentional errors. numerous regulations imposed at the polling sites that must be carried out by honorable volunteers, albeit paid for their day’s work, who are confronted with continuing changes in election laws and procedures which they must become familiar with only at election times. Having served for many years as an election officer in Fairfax and Westmoreland counties and the City of Fredericksburg, I know how it is possible for an error to occur. However, to the credit of all those good folks who are at the polls from about 4:30 a.m. to 9, 10 p.m. or later, it is amazing that problems occur rarely. Issues like provisional ballots, absentee ballots and the required, somewhat complicated paperwork make it easy for serious errors to occur. But generally all goes smoothly, and the work of these folks goes unnoticed and unappreciated. The paid election staffs also don’t receive the credit they deserve. So, I for one, will hold my judgement about what has happened with ballots in both Stafford and Fredericksburg. I believe it is important not to lose faith in the election process itself, as well as the people who are responsible for implementing the process. If anything, all voters should be concerned about the process itself and direct their eyes to the fairness of how voting districts are established, how a candidate’s rhetoric and advertising stay within the law and ethical conduct, and how voters themselves need to be more
involved with learning what the candidates’ positions are on the issues that will affect them. We all must understand that our system of government and the elections that will decide who will govern are based on differences of opinion. But once the election is over, only unity of purpose will allow us to be successful. Currently, to paraphrase the words of Pogo, “We have met the election enemy and it ain’t the Russians, it is us.” In spite of how these contested elections finally end up, we can hope with Governor elect Northam’s call for unity, we can stop holding our noses and breathe fresh political air for a change. Robert Boucher, chief of staff at Quantico Marine Corps base, offered the opening remarks, before U.S. Air Force Gen. David Goldfein, chief of staff, gave the keynote address. Later, Goldfein, Boucher, Morris and Hess presented the memorial wreath. The commemoration concluded with firing detail salute and echo taps. Navy Lt. j.g. Brian E. Burd gave the benediction.

Sometimes it is the little things that can show how a college football program is improving off the field. That was the case for University of Virginia-Wise and Andre Hamilton, a defensive back from North Stafford High School. Hamilton was part of the first recruiting class at UVa-Wise as the program made the transition from the NAIA level to NCAA Division II. “When I first got here things were a little limited in terms of the amount of gear they gave us,” Hamilton said. “The program became more legit. The facilities are just better; things are on the rise.” That transition continued prior to the 2016 season when Dane Damron took over as the head coach. He replaced Dewey Lusk, who took the same job at Bluefield College. And what about the new head coach? “He is great. He made the transition a lot easier than it could have been,” Hamilton said of Damron. Cavaliers defensive coordinator and safeties coach Shap Boyd has been impressed by Hamilton. “As a senior he has done a great job of showing up and leading every day,” said Boyd, who came to UVa-Wise before the 2016 season. “He has had a bum shoulder; he has had [injury] issues in the past and I think he has played through a lot of pain, so to speak. This is something that the younger kids see; he is one of the tops in the conference in terms of pass breakups. This year he has taken his game up a notch, like you would want a senior to do.” Hamilton attracted attention out of high school from several Division III programs, including Bridgewater and Christopher Newport in Virginia and Salisbury in Maryland. But UVa-Wise was the only Division II school to offer him a partial scholarship. “When we came on our visit, we were able to see how things were changing for the program,” he said.

Hamilton is one of several Stafford residents in the program this season. He visited the school along with North Stafford High graduate Von Purvis, a junior running back this season. Other local products with the Cavaliers include Cedrick Watkins (North Stafford); freshman offensive lineman Jayson Waters (Stafford); and freshman linebacker Trey Heard (North Stafford). “He is being redshirted,” Boyd said of Heard. Hamilton is studying business administration and plans to graduate next year. For two summers he has had an internship with a government agency in Washington, D.C.
UVa-Wise lost 31-28 to Notre Dame of Ohio on Nov. 4 as Hamilton broke up one pass. He had a season-high three tackles in the season opener against Glenville State. “We know they have one of the most athletic quarterbacks in the conference,” Hamilton said. “Our defensive backs had to run. We had a lot of chances to win.” The Cavaliers ended the season at home with a 63-35 loss Nov. 4 against powerhouse Shepherd, a West Virginia school that made the Division II national title game in 2015. Shepherd entered the game ranked No. 2 in the nation at the Division II level. Hamilton had four tackles against
Shepherd as the Cavaliers ended the year 5-6 overall and 4-6 in conference play. He ended the season with 14 tackles. “That is who we are looking to be,” Hamilton said of Shepherd. “You have to beat the [best] racehorse. They have one of the best offenses in the nation.” “That is the barometer of our program. They are very good,” Boyd said of Shepherd. Hamilton had several family and friends at the game, and his mother made the drive of more than five hours from Stafford to Wise for nearly every home game.
