The consequences of not confronting this inevitability and planning for it, however, are even less pleasant to contemplate. Without a well-documented plan in place, your loved ones will likely end up going through probate. That’s a very slow, costly – and very public – process. And, ultimately, a court will determine how your assets are distributed. Do you want a court to decide who gets what percentage of your money and property? Who gets custody of your children?
