The family had been talking about dividing the ranch for years. One conundrum after another never led anywhere except to crippling arguments around the kitchen table. A sibling’s terminal diagnosis finally moved them to action. Time was running out. If decisions weren’t made, more heirs would soon be at the table. At sunrise, we unloaded the UTV and set up our surveying equipment as the aging siblings pulled through the ranch gate. Four of them. Three vehicles. Only the two sisters rode together. We spent the morning trying to settle division lines. By midday, two siblings were face to face in the pasture, fingers in each other's chests, arguing over where one line should fall. I looked past them and saw the ill sister sitting alone on the UTV, weeping. The ranch that was supposed to be a shared blessing had transformed into a curse that was tearing her family apart. She knew how little time she had left to spend on it. Later, she signed the partition deed from her hospital bed, a little while before she passed from this world. The morning’s outcome did not begin with those siblings. It began a generation earlier, with a parent who could not make the hard decisions necessary to divide the property, so the children inherited the decisions along with the land. When one or more people own a percentage of everything but none of it specifically, it is an undivided interest. Nothing defined on the ground. No one can point to a pasture and say, "That is my portion." A Texas A&M University AgriLife study found that while 69 percent of farms expected ownership to continue in the next generation, only 23 percent had a plan to make it happen. No plan and no survey lines mean no clarity and no peace.

The solution is defining each person's interest now so that each one has the agency to borrow against their own portion while preserving the rest of the family's interest. Where should a family start? By getting clear on what each person truly wants. It is impossible to give anyone what they want if they haven’t voiced their wishes out loud. Get input from professionals who see the land differently: an appraiser, a developer and a conservation land trust will each assign value differently to the same ranch. Understand that a 33 percent interest may not translate to one-third of the acreage when the water well, powerlines, structures, workable land, live water and road frontage all exist in different places. We opened this four-part series with Abram and Lot in Genesis 13, separating their households and choosing which portion each would hold. We will close with Psalm 16:6, "the lines are fallen unto me in pleasant places; yea, I have a goodly heritage." David borrows the language of land to express his gratitude and the peace that comes when people know what they are receiving. Long before plats and deeds, a portion (or a lot) was assigned by the casting lots to randomly determine who received what. This is not the best case for your family. You can decide what falls to whom, or you can push that decision to the next generation by leaving the land in an undivided interest. The pertinent question is not whether your family will divide the land, but whether you will lead the effort or leave it to chance. Clarity brings peace. Undivided interest in land does not. °

The Next Handoff Will Not Look Like the Last One Roughly 150 million acres of U.S. agricultural land is expected to change hands over the next 10 to 20 years. In Texas, an estimated 41 percent is projected to transfer by 2035. Previously, when the next generation kept working the land, undivided interest was tolerable because the best outcome was the land staying together. That is changing. Few of the generation now inheriting working farm and ranchland intend to operate it. Many are scattered across the country, holding non-agricultural jobs and having no plans to work the land for a living. At best, they hope to keep it intact for recreation or leasing so it still produces a yield. When the heirs are not operators, the land's highest value is generally realized in the marketplace, which often demands that it be subdivided to define each heir's ownership. It is difficult to sell an undefined portion of land.
