otchefstroom residents took to social media this week to report a foul smell surrounding the Wasgoedspruit canal near Piet Bosman Street. On the popular ‘Hello Pietie’ Facebook page, residents were seen speculating that the stench was due to a sewage leak in the area, or from the Poortjie Dam. They pleaded with the Tlokwe City Council to investigate the matter as the condition was becoming unbearable. “I dodge my own house,” a resident told the NorthWest Independent. “Our children can no longer play outdoors and we are forced to keep our windows closed,” another added. MMC for Environmental Management, Ina Stolz joined the discussion and said that the stench in the Wasgoedspruit is caused by algae. “Council will clean the spruit and then request Dept. of Water Affairs and Sanitation to flush it,” she said. The NWI asked Stolz to elaborate on her explanation. “The Tlokwe City Council has identified blue-green algae to be present in the Wasgoedspruit. As the algae develops, it starts emitting a foul odour similar to that of sewage. It is a natural process that is currently being aggravated by the extreme heat Potch is experiencing. Foreign matter such as bird droppings also adds to the development of the algae,” she explained. A specialist in the field of algae, confirmed Stolz’s explanation. “Blue-green algae (Cyanobacteria) is a form of bacteria seen to have a seasonal occurrence and is linked to warm temperatures. to produce its own nitrogen but needs phosphorous from an external force to thrive. The current heat wave Potchefstroom is expe riencing can encourage the algae to bloom. Stagnant water and abundant sunlight also contributes to this growth,” he explained. This specialist source has also been conducting tests in the area as well as at Poortjie Dam for the past few years. He told us that he has discovered a definite increase of the blue-green algae in the Poortjie Dam’s water in the last two to three years. There has also been a spike in the salt concentration of the dam. “The cause of this is unknown and we

cannot yet link it to any one specific factor. However, the environment has a natural assimilative capacity to withstand problems arising from bird droppings,” he explains. He was also willing to share a few of his theories on the cause of the current Wasgoed spruit problem. “There is a possibility that it could originate from water flowing out of Poortjie Dam, which contains the same algae,” he said, adding that another theory is that phosphorous could have been distributed in the area from the gypsum dam, as a result of mining, causing the algae to multiply. “However, it is also possible that it is due to

inorganic nutrients entering the system” he said. The NWI was informed by reliable sources yesterday, that samples of the water from Wasgoedspruit had been taken and that traces of sewage had been found. However, a local microbiologist cautions that it is “impossible to deduct any concrete evidence from only one investigation. Many, extensive investigations are necessary before allegations can be made.” The City Council has set a plan in motion to resolve this matter. Ina Stoltz says that they will be working with the Dept. of Community Services and Infrastructure regarding this matter. “The algae occurring in the Wasgoedspruit (running from the railway track to the bridge at Walter Sisulu Street) will be removed manually by a force of trained workers and will then be flushed clean. The reason for the manual removal of the algae is because we do not want to flush any harmful substances into the Mooi River,” she said. “Once we have flushed the canal we will also be able to identify any obstacles causing blockages in the water flow. Vegetation inhibiting this water flow as well as litter will also be removed.” According to the council, residents can expect to see this plan in action as of tomorrow, Friday 13 November or at the latest, the following Monday. Our consultant microbiologist cautions against optimism, though: “What the City Council is proposing is only a ‘quick fix’. Further investigation is needed to correct this problem at the source,” he says. Whether unforeseen or anticipated, dealing with the death of a loved one is devastating. The last thing you need during this emotional period is to have to make complicated decisions. Fortunately, one of these decisions can be made in advance: that of saving lives through organ and tissue donation. There are three stages at which you are able to donate and help those in critical medical need. The first is by donating blood and bone marrow while you are alive and healthy. The second is when you are declared brain-dead, in a hospital, when your organs and tissue can be harvested for donation. However, there is a third stage that many people may be unaware of: a non-living donor can donate tissue during a window period of 12 hours and 5 days. This tissue includes your corneas, heart valves, skin, tendons and skeletal bone. One non-living donor can help up to 65 patients through donating their tissue. Bone tissue, in particular, is retrieved only from non-living donors and is the second most frequently-performed transplant. “Many families we contact after their loved ones have passed away have never heard of this possibility. It is a strange concept to some, as there is a lack of awareness around it,” explains Elize Scheepers, a former ICU Nurse and the current North West co-ordinator for the Centre for Tissue Engineering (CTE). Corneas comprise the clear tissue layer covering the iris and the pupil. They only have a 12-hour window in which to be used, once

the donor has passed away. This will give or restore sight to someone who is visually impaired. Skin and heart valves have a window period of 24 hours. When donating skin, the epidermis is used in the treatment of burn victims. Hard skeletal bone and tendons have a window period of up to five days. Bones from the limbs are used to manufacture a variety of bone products that will provide quality of life to patients who have suffered bone loss due to disease or trauma. No compatibility is necessary and any healthy individual between the ages of 16 and 80 can donate bone tissue to any recipient. “It must be noted that a medical record that includes cancer, Septicaemia, Hepatitis or HIV will exclude a potential donor,” says Elize. “The donor’s family will not incur any costs involved in the procedures, as the CTE covers all fees involved. All of the procedures are conducted by trained professionals, either in a hospital, mortuary or funeral home. The donor’s body will not be disfigured in any way and a prosthesis is used in all cases to reconstruct the area of retrieval,” explains Elize. She reminds potential donors that it is very important for potential donors to tell their family members about their willingness to donate. Hy dra ook deeglik kennis van die ekonomiese oorwegings. “Gewoonlik is ‘n verassing goedkoper as ‘n begrafnis, maar ongelukkig nie in Potchefstroom nie. Hier is dit goedkoper om te begrawe omdat die pryse van die grafte soveel goedkoper is as bv in ‘n stad soos Johannesburg, Wanneer daar egter na die totale koste gekyk word, sal ‘n begrafnis tog duurder wees want ‘n grafsteen moet dan ook nog ingereken word,” verduidelik hy.

Jy moet slegs jou begrafnisondernemer kontak wat dan die nodige reëlings sal tref om die doodsetifikaat te bekom asook die aansoek vir die verassing sal indien. Alle dokumentasie moet in orde wees voordat die verassing kan plaasvind. Wanneer die finale goedkeuring deur die betrokke dokters gegee is, kan die verassing plaasvind. Daarna word die as versorg en aan die begrafnisondernemer besorg wat dit dan weer aan die familie van die oorledene sal oorhandig. Die proses duur ± 14 dae, maar kan verkort word indien die familie so versoek. DA’s objection to merger a costly affair The drama surrounding the amalgamation of the Tlokwe City Council and Ventersdorp Municipality came to a dramatic conclusion last Friday when a court rejected the DA’s objections and ordered the party to pay costs which could amount to R1,2 million. In this opinion piece our special correspondent on legal matters, DANIEL CAINE, gives all the background.

he case was argued before Judge Kollapen in the Gauteng High Court division. The application from the DA dealt with an attack on the decision by the Demarcation Board (MDB) to establish several local municipalities either by amalgamation (in our area this would be the amalgamation between Tlokwe City Council with the Ventersdorp Municipality), or by division of other municipalities across South Africa. The Application (as it concerns the Tlokwe City Council and Ventersdorp Municipality for purposes of this article), was to seek an urgent order from the High Court that would prevent the MDB well as the MEC for Local Government in the North West Province to continue to amalgamate Tlokwe and Ventersdorp pending the outcome of a High Court’s decision. This ruling pertains to whether the decision taken by the MDB was made impartially and without fear, favour or prejudice. Such a review (appraisal) would probably take approximately one to two years by which time an appraisal, either way, would be water under the bridge. In 2014 the Department of Co-operative and Traditional Affairs assessed the functionality and efficiency of 278 Municipalities. The assessment concluded that there were many that could be described as almost or fully dysfunctional. This led to the adoption by government of what has been described as the ‘Back to Basics’ program with the improved functionality of municipalities as their objective. After this process the relevant Minister wrote to the MDB with a request for proposed boundary re-determinations. In February, the MDB issued a circular to all affected municipalities advising them of the Minister’s re-determination requests. Subsequent to this, the DA asked for additional information from the MDB requesting details of meetings held between the Minister and the various Members of the Executive

Committees in each Province, the reasons for each re-determination of various municipalities etc. On 25 August 2015, the MDB published its notification in the Extraordinary Provincial Gazette of confirmation of its re-determination of municipal boundaries. The DA was clearly unhappy with the process at that point, hence its attack on the decisions of the MDB and the Minister. In essence, the DA stated that the MDB failed to comply with section 26 of the Municipal Demarcation Act (MDA) which required written representations and views from the public within (in our case the public of Tlokwe City Council and Ventersdorp) a specified municipal area. Section 26 of the MDA also requires that the MDB must publish a notice on a newspaper circulating in the area concerned and convey by radio or other appropriate means of communication the intention of the MDB to consider any determination or re-determination of municipal boundaries. The MDB decided to hold public meetings and conduct a formal investigation in respect of our municipality. Section 27 of the MDA states that the MDB may hold public meetings. The DA based its application and subsequent arguments before the court on the following grounds. 1. The alleged lack of sufficient information on 5 February 2015 and thereafter, in particular the complaint that the circular did not contain sufficient information. This deprived the public of the ability to make meaningful representations and compromised the process. The court struck this argument down by finding that although this may be required in the making of laws, what would be sufficient in the context of law-making would not necessarily be the same in the context of a demarcation. The information provided on 5

February 2015 constituted sufficient information. The radio advert with all its shortcomings provided the necessary information to the public, the judge continued. 2. The so-called Habitat-principle. This principle lays down that it was required of the MDB to consider other measures to assist municipalities that were dysfunctional or non-viable. The court replied that no record is before it as part of these proceedings and the DA never requested reasons and it would therefore be speculative to suggest that no alternatives were considered. In the judge’s view there is, in any event, no obligation on the Provinces to assist ailing municipalities. 3. The so-called Virginia v. Tennessee principle. This principle promotes that an alteration in boundaries has far-reaching impact and sentiments on people, which warrants serious consideration. Whilst the judge applauded this principle he considered this argument raised as speculative. 4. The invalidity of the timetable for the demarcation process. Whilst the judge accepted that any consultation between the MDB and the relevant Minister may not have been proved, this factor does not warrant a ground for a subsequent review 5. Lastly various allegations of bias and improper conduct against the Minister and the MDB were made. Although the DA indicated that it no longer relied on these allegations during argument it never withdrew these allegations. The judge expressed his frustration as follows: “The court must express its extreme displeasure at this kind of conduct. It constitutes an abuse of the litigation process and at the end of the day the questions that must arise is why such serious allegations are made and not pursued and relied upon.” The judge concluded by referring to Constitutional Court judgement which said “gratuitous claims of bias like the present are deserving of the strongest possible censure.” The DA was ordered to pay costs, including the wasted costs of 29 September 2015 (these ‘wasted costs’ turned out to be the result of the DA having incorrectly enrolled the matter). The total costs are estimated to be at least R1,2 million since it involved five senior counsel, two junior counsel and three firms of attorneys.

Daar is geen leidraad op die voorblad dat hierdie ‘n ironiese stuk advies is of dat die artikel gaan oor ‘n dwaas wie se idees uit prehistoriese tye kom nie. En wanneer jy die artikel lees, rek jou oë eers. Want Dedré Delport, ‘n “berader en teoloog” van die Shalom-kerk se giftige voorskrifte oor hoe vroue selfopofferend agteroor moet buig om mans gelukkig te hou, word in detail uitgespel en as nuus (let wel, nie satire nie) aangebied sonder noemenswaardige teen-argumente. White people will complain about anything it would seem, repeatedly too. Black people on the other hand will let things go for far too long and then take to the streets when we’re good and fed-up. I’m amazed at how tirelessly white folks complain about the queues at ABSA, although there are 3 branches in town. It seems to be one of the local pass-times in Potch. I don’t get it. If it’s that bad why don’t you move your account to another bank? Why send an SMS to the local newspaper about your neighbour’s dogs barking at night, when you surely must be living close enough to tell it to them personally? By now white people should have realised that a long queue, especially at government institutions, is more a probability than a possibility. Don’t sweat it, and don’t talk to the only other white person in the

queue as if there is a deliberate conspiracy to waste your precious time only. Everyone else is waiting just like you are. In all fairness, white people readily applaud good service and they tell other people too, so that’s a plus. For the sake of your general well-being accept that ABSA, the city council, the licencing department and hospitals are going to take more time and patience than you have readily available. Life is like this, my white brothers and sisters: Sometimes people are late, sometimes other people get there before you, sometimes the ones who serve you are not in a good mood; sometimes life happens. Where white people seem to live under the fear of the whole world ending if they don’t water it with generous complaining, black people are much too laid back. Black people assume that since everyone knows the right thing to do, they will just go about doing it. Black people are hesitant to point out mistakes, problems, or deviances of any kind

because we don’t want to appear to be critical of each other. We’d rather shake our heads and walk away unhappy, just to come back for more of the same treatment next time. Understand this, my black people; you have the right to speak up in your personal capacity. Tell them they were rude. Tell them they didn’t do what they were supposed to. Let them know you don’t have all day to wait around for them to do their job. Black people assume that we will all gang up to solve our problems together. We can’t all take to the streets in large groups over things that could have been nipped in the bud from the start. If they’re taking your hard earned money, you are not acting superior expecting to get what you paid for. We don’t have to tolerate the corrupt officials, uncaring nurses, lazy receptionists and pretend that because we share the same skin colour, complaining is prohibited. Speak up right then and there: mass action is not the only form of protest available. We’ve been raised to be understand-

he Cancer Association of South Africa (CANSA) aims to educate about prostate and testicular cancer with its Men’s Health campaign kicking off in November. Prostate cancer is one of the leading cancers in South African males with one in 27 men having a lifetime risk of diagnosis. ‘Protect Your Health: Your Manhood Matters’ is the theme for the campaign and CANSA hopes to encourage every man to look after his body and overall health. It’s important to notice any changes in the body, along with going for regular check-ups and having Prostate Specific Antigen (PSA) tests. “My message to other men, especially 40 years and older, is to go for regular screening and don’t neglect your health. I was diagnosed by chance after having had some blood tests done for another medical ailment. If I had gone two years later, I may not have been so fortunate and had less options in terms of treatment. Early detection is of great importance when it comes to effective treatment,” says prostate cancer survivor, David Lucas (58) who was diagnosed in 2013. Testicular cancer affects mostly younger men aged between 15 and 39. CANSA’s message for younger men is to conduct regular testicular self-examinations – feel for any lumps (can be as small as a grain of rice and are usually quite firm like hard rubber), changes in size or irregularities. MMIC shareholders are all persons who purchased the shares in the public offer scheme that the municipality facilitated through the services of Baji Investment Management during 2010. All the funds collected during this Mooirivier Mall Share Scheme have been used to buy Attacq listed shares on behalf of the individual MMIC shareholders. MMIC has a total of 1602 registered shareholders who hold a total of about 25 million shares in the company, in turn, MMIC hold on behalf of these shareholders about 110,000 Attacq shares.

PURPOSE OF MEETING

The General meeting is convened by the directors di of the company to propose to the shareholders a mechanism and process of realising the value (selling) of their shares. City Council takes on challenge to plant trees ¢¢ LYNDLE HAAGNER

he Tlokwe City Council took on the Global Miss Earth South Africa #Big02Challenge of planting 21 trees in 21

days. Ina Stoltz, The Potch MMC for Environmental Management, first came across this challenge when she saw a post on Miss Earth SA, Carla Viktor’s Instagram and Twitter accounts and was immediately inspired to take on the challenge. Participants in the challenge had to start this plant-athon on 9 November – giving them 21 days before the 21st annual United Nations Conference of Parties (COP21) that will be taking place in Paris later this month. “We at Tlokwe City Council also took up the challenge of planting 21 trees. We are here to plant the trees to contribute positively towards controlling climate change. There are so many factors that influence our climate, and we must make the difference,” says Ina Stoltz. As many Potchefstroomers have felt, this has been an incredibly hot week, with temperatures soaring above 38 degrees. According to an article on News24, Dr Francois Engelbrecht from the Council for Scientific and Industrial Research said that: “This will be the warmest year measured by humans on the planet.” The Tlokwe City Council decided to plant their 21 trees in the Dan Tloome Gardens and celebrated the event in a tree-planting ceremony attended by the Executive Mayor of Potchefstroom, Mrs. Africa Globe, Politicians and Council Members. “The trees that were planted were three-year old Celtis afrikana (white stinkwood) trees and are indigenous to South Africa,” said Potch mayor, Honour-

able Kgotso Khumalo. “We are going to make our town clean and green. We are going to make sure that buildings are in the context of the green building conventions. We will be saving water and reducing CO2 emissions. We want buildings to become relevant to the green movement. That is the direction we are taking. We will be glad to one day see the whole of Potchefstroom being green”.

Busy week ahead for Potch

The city brazes itself for a hive of intensive public activities this coming week when district and provincial politicians will descent upon the town. The city will host a provincial anti – fraud and corruption conference, another bout of service delivery outreach as well as a series of IDP meetings. The IDP meetings will especially be ground breaking coming just as a court application to halt the amalgamation of Tlokwe and Ventersdorp municipalities failed. Members of Tlokwe City Council will be out engaging with communities and explaining what the amalgamation means to the rate payer. Several of these meetings will be held throughout the week in various venues across the city. The schedule will be posted in the municipal website and publicized through the various media. In commemoration of the International Fraud Awareness Week the City Council of Tlokwe together with the Dr. KK Kaunda District Municipality will host an Anti Fraud and Corruption Summit on November 19 and 20 at the Tlokwe Council Chambers. The event is held to promote anti-fraud and corruption awareness and education. It

is spearheaded by the Provincial Anti-Corruption Forum (PACF) in the Office of the Premier. Fraud week was first organized 15 years ago by the Association of Certified Fraud Examiners (ACFE), the world’s largest anti-fraud organization and premier provider of anti-fraud training and education. During fraud week, government agencies and businesses are expected to engage in various activities including: hosting fraud awareness training for employees and the community, assess fraud knowledge and risk factors within organizations, post anticorruption articles on social media and also in newsletters, and team up with local media to highlight the problem of fraud. The targeted audience for the seminar is 200 including mayors, municipal managers, chief financial officers and heads of department. The event will be preceded by a motorcade through the city aimed to raise awareness. The Office of the Premier will in the coming week again undertake a service delivery outreach to the farming areas where residents will have opportunity to apply for identity documents, grants, birth certificates, etc.

Cape Town – The Chairperson of the Inter-Ministerial Committee (IMC) set up to look at migration, Minister Jeff Radebe, says government is reviewing South Africa’s migration policy in a bid to deal with the strain between locals and foreign nationals that has affected some communities. Minister Radebe, who is also responsible for the Ministry of Planning, Monitoring and Evaluation in the Presidency, said this when briefing Parliament’s Ad Hoc Committee on Violence against Foreign Nationals on Tuesday. He said a heavy influx of foreign nationals has led to migration laws not being adhered to due to border management laxity and the visa waiver to Southern African Development Community (SADC) countries, among others, which has led to foreign nationals staying in the country longer than they should be. This, coupled with other causes like socio-economic conditions and unfair business practices, has necessitated the IMC to look into this and other interventions. “The Department of Home Affairs is reviewing South Africa’s migration policy and intends tabling a green paper in the Forum of South African Directors-General during the third quarter of the current financial year. “Cabinet has also approved the Refugee Amendment Bill in September 2015 for

tabling in Parliament,” he said. The Minister said the review of the country’s migration policy was one of several interventions through which government was responding to underlying root causes and tensions that led to attacks on foreign nationals in April 2015 in various parts of the country.– Other interventions would include: * Addressing the asylum seekers’ backlog through the immediate funding and capacitating of the Standing Committee on Refugee Affairs and Refugee Appeals Board; * Restricting the movement of asylum applicants to a single magisterial district through the setting up of decentralised refugee reception centres at ports of entry; * Funding and capacitating of Immigration Services (IMS) to empower the inspectorate, revamp ports of entry as well as to create the necessary systems to deal with migration and. * Controlling the inflow of migrants by setting a tolerance threshold or a quota system. The Minister also said government would revisit South Africa’s accession to the relevant United Nation conventions without reservation and amend the country’s Refugees Act accordingly.

Feast of cricket at Senwes Park

Last Friday night Potchefstromers packed Senwes Park Cricket Stadium for the 20 overs match between the Unlimited Titans and the Highveld Lions. Although the Titans won by 4 wickets (with 13 balls remaining), the player who made a remarkable impact on the game was the captain and wicket keeper of the Lions, Thami Tsolekile. He managed to achieve 58 runs from 41 balls. Spectators were also excited about the R1 million up for grabs by a lucky spectator that could pull off a clean, one-handed catch off a “six” hit during this RAM Slam Cricket Match.
