BY KATHRYN BASSETT kbassett@kpcmedia.com AUBURN — Judge Kevin Wallace Wednesday dismissed criminal charges filed against a former police officer, ruling the charges are barred by Indiana’s statute of limitations. Sean Kahkola, of the 15000 block of Towne Park Run, Huntertown, stood trial in DeKalb Superior Court I Tuesday for two counts of criminal conversion, both Class A misdemeanors. He was accused of knowingly or intentionally exerting unautho-
rized control of a truck owned by the City of Auburn and a camper owned by the City of Garrett. But the original charges were filed more than two years after Kahkola allegedly took control of the property, Wallace said. That was too late for misdemeanor charges under Indiana law. During Tuesday’s bench trial before Wallace, Indiana State Police Detective Kevin Smith testified he was asked to investigate the case by Garrett Police Chief Keith Hefner, who checked a list of military-surplus items that
his department was supposed to have and became concerned. Hefner became Garrett’s police chief in January 2012. Smith said he first interviewed Kahkola 0n March 30, 2012, and again on April 11, 2012. Charges were filed Sept. 12, 2012, and because they were felony charges, a five-year Kahkola statute of limitations applied. When the charges were reduced to misdemeanors two weeks ago, a two-year statute of limitations took effect. The prosecution did

Choirs presenting Christmas musical GARRETT — Garrett middle and high school mixed choirs will present “A 1940s Radio Christmas Carol” in two performances Saturday in the Performing Arts Center with a matinee at 2:30 p.m. and an evening show at 7:30 p.m. This heartfelt musical is set in December 1943 in Newark, New Jersey at a small radio show broadcast of ‘A Christmas Carol,’ featuring Christmas music from the early 1940s era. The event begins with a dessert cabaret served in the high school cafeteria —the first at 1:30 p.m.
prior to the 2:30 show, and the second at 6:30 p.m. before the 7:30 p.m. show. Audience members will be greeted by live carolers and invited to choose from a wide variety of desserts and fruit salad, including kid-friendly and sugar free options. Coffee, hot chocolate, punch and water will also be served. Audience members will be entertained by Christmas songs sung by the middle and high school choirs prior to being guided back to the Performing Arts Center
for the musical. Reserved seating tickets are $10 each and include the dessert cabaret and the musical performance. “Showcase of Churches” Christmas walk Sunday GARRETT — Eight Garrett churches have joined together to present the first “Showcase of Churches” on Sunday, Dec. 8, from 1-4 p.m. The community is invited to take a Christmas walk through these churches in celebrating the birth of Jesus Christ. The event is at no charge to the public, but each church will have a basket for a freewill offering that will be combined and then equally divided between St. Martins’ and Community Care food pantries. By Sue Carpenter scarpenter@kpcmedia.com GARRETT — Garrett Police officers have arrested five people since Thanksgiving on charges of manufacturing and/or possession of precursors of methamphetamine, according to police reports. At 4:36 a.m. on Thanksgiving day, Garrett officer Jeff Arnett made a traffic stop at the corner of S.R. 327 and S.R. 8. Arnett recognized the passenger, Nathan Sturges, 27, of Garrett, as wanted on a warrant for possession of methamphetamine, officials said. After stopping the vehicle, the officer allegedly discovered two packages containing white powder that tested positive for meth. Arnett also discovered two handguns, one of which was reported stolen in DeKalb County, according to reports. The female driver of the vehicle, Braidon M. Hall, 19, of Columbia City was arrested for alleged possession of the handguns. During an investigation of the vehicle, a plastic tote containing several precursors to meth and a hydrochloric acid generator also were found by authorities. Indiana State Police officers were called to secure the materials, and the pair were taken to the DeKalb County Jail on multiple charges. Hall, of South Eagle Glen Hall in Columbia City, was charged with dealing in methamphetamine, a Class B felony; possession of precursors, a Class C felony; possession of a controlled substance and receiving stolen property, Class D felonies; possession of paraphernalia and carrying a handgun without a license, Class A misdemeanors; and visiting a common nuisance, a Class B misdemeanor. Sturges, of the 6900 block of C.R. 9-A, Garrett, was charged with dealing in methamphetamine, a Class A felony; and possession of methamphetamine, possession of precursors and maintaining a common nuisance, Class D felonies. Tuesday at 12:30 p.m., Garrett officers Jeff Arnett, Kevin Peeper and Justin Cornejo acted on information received from another agency and their own investigation and obtained a search warrant for a residence in the 900 block of South Randolph Street, police said. Two men were in the yard of the home when police arrived. Officers later found lab trash in the yard associated with production of meth, according to the report. During the search, officers reported numerous precursors to meth and several pieces of drug paraphernalia were at the scene. An active, one-pot meth lab allegedly was also found in the attic of the residence. The Garrett Fire Department was sent to the scene due to the Meth busts, Page 4

Bergman wins national reading award Principal read books on school roof top FORT WAYNE — A local principal has won 101 books for her students by reading on the roof top of her school as part of the 2014 Pizza Hut “Book It!” Principal Challenge. Principal Alexandria Bergman of Most Precious Blood School will now receive 101 copies of the eighth book in the Diary of a Wimpy Kid serious called “Hard Luck.” Bergman read books for an entire school day and stood outside on the roof during lunch and recess in 35 degree weather. Bergman says she did it to be a role model to her students. “Book It! puts on the challenge during National Young Reader’s Week, and of course as principal of any school, we know the importance of reading for young children, and so, to be a model for the students and the teachers, and to show them that reading’s important to me too,” Bergman said. For winning the contest, students got a Pizza Party Monday and each family will get to take home a copy of the book. Bergman and her husband, Kelly live in Garrett with their children.

DEATHS AND TRIBUTES Dr. Gerald Ward FORT WAYNE — Gerald “Jerry” F. Ward, MD, 90, passed away on Wednesday, December 4, 2013, at Lutheran Life Villages, Pine Valley, in Fort Wayne. Born in Wheatland, Ind., he graduated from Dr. Ward Washington High School in 1941, DePauw University in 1945 and Indiana University School of Medicine in 1949. He was a lieutenant in the U.S. Navy serving during the Korean War. Dr. Gerald was a urologist in Fort Wayne along with his partners Dr. James P. Scudder and Dr. Phil Shriner. He was a practicing physician at Parkview Hospital from 1955 until retiring in 1986. During his early career he would also travel to Bryan, Montpelier and Paulding, Ohio, as well as DeKalb and Whitley County hospitals. Jerry was a member of American Legion, Masonic Lodge, Mizpah Shrine, Urology Association and American Medical Association. For many years he enjoyed going on fishing and hunting trips with his professional friends and just being outdoors. After his retirement he spent many hours managing his farms in the Garrett community. He was an outstanding
and devoted father, grandfather and person that will be dearly missed by his family, friends and patients. He is survived by his loving children, daughter, Georgia W. (James) Lemberg of Fort Wayne, Ind., and their children Elliott and Ian Lemberg, Travis M. (Faith) Ward of Garrett, Ind. and their children, Kendall, Cameron Ward and Corey Vendrely; son, Adam F. Ward of Fort Wayne, Ind.; and daughter, Brooke A. Ward of Fort Wayne, Ind., and her children Alyssa, Caleb Hogan. He is also survived by his sister-in-law, Sue Ward of Madison, Ind.; half sister, Linda (Dwight) Singer of Kokomo, Ind.; and several nieces and nephews. Gerald was preceded in death by his wife, Paula Bailey Ward, MD; his parents, Claude F. and Josetta Ward; his stepfather, Byron Donaldson; a brother, Donald E. John Gillespie AUBURN — John Gillespie, 86, of Auburn and formerly of Avilla died Monday, Dec. 2, 2013, at Betz Nursing Home in Auburn. Mr. Gillespie worked on the assembly line at International Harvester, retiring in 1983. He also worked for the Penn Central Railroad as a conductor for 10 years, while working at International Harvester. He was a U.S. Navy veteran. Mr. Gillespie was a member of the Garrett American Legion, Garrett Eagles and the UAW. He was a member of the Auburn Nazarene Church. He was born May 10, 1927, in Auburn to Eber A. and Valaria G. (Blevins) Gillespie and they preceded him in death. He married Vivian Custer on July 27, 1947, in Garrett and she survives in Auburn. Also surviving are three sons, Mike (Renee) Gillespie of Auburn, Jeff Gillespie of Auburn and Steven Gillespie; seven grandchildren; four great-grandchildren; two brothers, Clarence Gillespie of Twain Harte, Calif., and Richard “Bud” Gillespie of Dandridge, Tenn.; and three sisters, June Bauer of Clearwater, Fla., Marilyn Evans of Van Buren, Ark., and Sandy Winebrenner of Pine, Ariz. He was also preceded in death by his parents; two brothers, George Gillespie and Paul Gillespie; and two sisters, Pauline Stevens and Phyllis Deal. Funeral services will be at 1 p.m. Friday at Thomas Funeral Home with Pastor Dan White officiating.

Charges dropped from Page 1 that he screened using his Garrett Police Department login number while he was employed by the Auburn Police Department. Titles for the truck and camper later were transferred into Kahkola’s name. He went on to sell the truck for $500 and traded in the camper and a vehicle he owned for $3,500 toward another vehicle, the court heard. On the witness stand Tuesday, Kahkola admitted obtaining the truck and camper for his own personal use. However, he said, he was given no written policy on how the program should operate by either the Auburn or Garrett police departments. His attorney, Kevin Likes, contended there was no unauthorized use of the items. In his ruling, Wallace noted that after the close of evidence Tuesday, but before final arguments, he noticed that by July 28, 2008, the date of one of the alleged crimes, Kahkola already had obtained title to the truck. “Therefore, the truck did not belong to Auburn, and defendant was free to do what he wanted with the vehicle. Likewise with
regard to Count II, by May 5, 2010, the date of the alleged offense, the defendant had obtained title to the 2002 Rockwood camper. Therefore the camper did not belong to Garrett, and he was free to do what he wanted with the vehicle,” Wallace said in his order. Wallace explained that if there was a crime of conversion, it would have occurred prior to the titles being transferred to Kahkola’s name, not after he obtained the titles. He said the alleged conversion would have been Kahkola obtaining the titles, not selling or trading the vehicles later. “In both counts, it was the court’s observation that if conversion occurred, it was in the defendant’s actions obtaining possession and title to the vehicles, not in the ultimate disposition of the vehicles by the defendant,” Wallace added. However, Wallace’s opinion that any crimes occurred earlier than prosecutors claimed allege was not a key to his ruling dismissing the case. Under Indiana law, prosecution for a misdemeanor offense is
barred unless it begins within two years after the commission of the offense, Wallace noted. Wallace pointed out that since the original charges against Kahkola were filed Sept. 12, 2012, prosecuting any conversion happening before Sept. 12, 2010, is barred by the statute of limitations. Count I alleged the truck conversion took place on July 28, 2008, and Count II alleged the camper conversion took place on May 5, 2010. The charges originally were filed as Class D felonies, but were reduced to Class A misdemeanors on Nov. 18 this year. “This defect is in the charging documents as filed by the State of Indiana, and arose when the charges were amended to misdemeanors,” Wallace said in his order. “It does not depend on the court’s view that if a conversion occurred, it would have been prior to the dates alleged by the state.” Wallace dismissed the amended charges “with prejudice,” which prevents the state from prosecuting Kahkola later on the same charges.

Hefner expressed his appreciation to the Indiana State Police and the Garrett Fire Department for their assistance in the two cases.

GARRETT — Garrett senior Brandi Dawson had a double-double with 29 points and 19 rebounds to lead the Railroaders past Prairie Heights, 57-33, on Tuesday night. Emily Somers knocked down a pair of 3-pointers and finished with nine points and seven rebounds. Kaitlin Wisel scored seven points, Rachel DePew had five points, Drue Bodey had three points, and Rachel Stafford and Megan Newby both had two points each. Dawson and DePew both had four assists each. Garrett also won the junior varsity game, 24-15. For the Railroaders, Newby led the way with eight points. Lyndsey Gibson had six points, Tori Baver had five points, Ally Gottfried had four points and Amanda Stump had one point. Both Baver and Sutton had five rebounds each.

DeKalb tops Garrett GARRETT — DeKalb improved to 2-0 on the season with a 50-23 victory over Garrett on Monday night. Alec Brunson and Colin Goebel led the Patriots with eight points apiece. Boone Bacon and Logan Kruse each added seven points apiece for the Patriots while Jared Reutebuch had six points. Adam Ellert added four points with Troy Hickman and Jackson Pyck Hontz each adding a 3-point basket. Logan Petre and Marshall Beard finished the scoring with a basket each.

By Phil Friend pfriend@kpcmedia.com GARRETT — Make no mistake, there’s plenty of talent on this year’s Garrett wrestling squad, even without the return of two-time state qualifier Hayden Lee. The loss of Lee — who moved to Ohio in the offseason — is a difficult one for the Railroader program. The would-be senior went 40-5 last year and finished in sixth place at 106 pounds in the Indiana High School Athletic Association state finals last season. Lee also placed third in the same weight class in 2012. Leading the charge for the coach Nick Kraus and the Railroaders this season is 195-pound junior Bo Davis, a semistate qualifier last year. Davis (27-11) actually finished fifth in the regional but advanced after another wrestler had to bow out of the semistate.
The drive is there for Davis to not only reach the semistate again, but make it to the state finals as well. Kraus said that Davis was a smaller 195-pounder last year but has filled out his frame in preparation for this winter. “It’s just his work ethic,” Kraus said. “He always wants to learn more. Bo will tell you he’s got a lot to work on but his strength was one of the biggest things over the summer and the offseason, not only in wrestling but in football. He’s got his numbers up there pretty good and grew into the 195-pound weight class. “He’ll get a hold of me after practice, look stuff up on YouTube, do research. He just put in a lot of work.” Over the summer, Davis also entered himself into the national tournament and went 11-1, wrestling a couple of state qualifiers from Michigan, and beating one of them. Davis also had knee surgery in the offseason, although he did play football in the fall without complication in the latter half of the season. Also expected to be among the top wrestlers is senior 160-pounder Gabe Gunion (20-12). Gunion was a regional qualifier as a sophomore, but last year Kraus said he was wrestling
two classer higher than he should have. “It was tough wrestling at the weight he was at,” Kraus said. “The weight class was stacked in our area. The first-place finisher in our sectional was a state-runner-up, and the second- and third-place finishers in his sectional and regional have graduated, and he’s got the possibility of making state if he can stay consistent in practice.” Sophomore Blake Davis (220) is another top returner, but his availability is in doubt due to a broke foot suffered during football season. He went 18-10 last year in the same weight class. “I don’t know if he’ll be back before sectionals,” Kraus said. Junior Kyler Perez is likely to wrestle at 220. Senior Dustin Alwine (138 pounds) went 9-16 a year ago, a record hurt due to the fact he was recovering from surgery. Kraus said he’s improved his bench from 185 pounds to 240. “That’s going to help him a lot wrestling at 138,” Kraus said. “He’ll be one of the stronger wrestlers in the area, directing younger and older kids on some things to do. I think he can go pretty far in the state tournament series.” Garrett also has a strong
incoming freshman class that went 13-0 last year in dual meets and won both the Tri-County Athletic Conference and Allen County Athletic Conference championships. “They’re used to being successful,” Kraus said. “They have high expectations coming in and spent a lot of time in offseason tournaments. A lot of them have been wrestling since they were younger and they know what their goals are.” Three freshman expected to start immediately are Dylan DeMarco (113), Jordan Barker (132) and Jordan Gunion (145) Replacing Lee at 106 pounds is sophomore Zane Hargrove. “He was around .500 last year and didn’t have much wrestling experience,” Kraus said. “He went to some wrestling tournaments this offseason and went to a club called Warrior Elite all summer long. He’s a guy I look to have some success.” Others in the mix to earn varsity time are senior Dustin Underwood (126 pounds), sophomore Michael Sexton (152), junior Ryan Hathaway (170), senior Sean Heiman (182), senior Ivan Jacobs (285), sophomore Samuel Lawrence (152) and senior Dalton Halferty (120).
