All prospective Purchasers are urged to carefully examine any horse(s) (personally and/or by agents or veterinarians of their choosing) and any information provided by Vision, LLC (personally and/or by veterinarians of their choosing) for such horse(s), in which they may be interested BEFORE bidding.
All Purchasers, Agents, Sellers, Consignors and bidders acknowledge that they have read these terms and conditions of sale and agree to be bound thereby. If you do not understand any of these terms or conditions, please ask a staff member for clarification before registering.
DEFINITIONS:
1. Agent: An Agent is a person or entity who represents a Principal in a Vision, LLC Auction Sale, directly or indirectly, whether the Agent is paid by way of retainer, commission or other forms of remuneration, or has ongoing financial arrangements such as training, management or similar fees.
2. Consignor: Consignor means a person or entity who is a Seller or acting as an Agent for a Seller of a horse or horses at a Vision, LLC Auction Sale.
3. Fall of the Hammer: Fall of the Hammer means when the auctioneer recognizes the final accepted bid for the horse(s) during a Vision, LLC Auction Sale.
4. Vision, LLC Auction Sale: Vision, LLC Auction Sale means any sale conducted by or through Vision Arabian Horse Sales, LLC, either by way of auction via any bidding process or privately.
5. Principal: Principal means a person or entity who appoints an Agent to act as an agent on his/her/its behalf in a Vision, LLC Auction Sale.
6. Purchaser: Purchaser means a person or entity that buys all or any interest in a horse in a Vision, LLC Auction Sale.
7. Seller: Seller means the owner or owners who sell or sells all or any interest in a horse in a Vision, LLC Auction Sale.
BIDDING PROCEDURE: Unless waived by announcement, there shall be an upset price as set forth on the title page of the sales catalogue or $10,000, whichever is greater, on any horse in a Vision, LLC Auction sale. If an opening bid of the upset price is not forthcoming to the auctioneer’s call or the online platform, the horse shall be considered unsold. Minimum acceptable increases in bidding are determined at the sole discretion of Vision, LLC. Bidders may participate in a sale by bidding in person, via a pre-assigned agent, or by telephone, subject to approval by Vision, LLC in its sole and absolute discretion. To bid by telephone, Bidders must register for approval at least 24 hours before the start of the sale. Any bidder who places a bid by agent or by telephone expressly acknowledges and agrees as follows: (1) telephone bidding relies upon technology that may malfunction without warning and through no fault of Vision, LLC; (2) telephone bidding is being provided on an “AS AVAILABLE” and “AS IS” basis and Vision, LLC does not guarantee continual, uninterrupted or error free telephone bidding; and (3) Vision, LLC shall be absolved from any and all liability related to or arising from any interruption in service, errors and/or omissions with respect to telephone bidding and each bidder or Purchaser who places a telephone bid shall hold Vision, LLC harmless from any loss or claim resulting therefrom.
The highest bidder shall be the Purchaser and shall sign the Acknowledgment of Purchase when presented with it. The right of purchase of a successful bidder is not impaired in the case of signing the Acknowledgment of Purchase by an Agent, provided that such bidder acts in accordance with these Conditions of Sale. The right to bid is reserved for all Consignors unless otherwise announced.
BIDDING PROCESS AND DISPUTES:
Should any dispute arise between two or more bidders, the auctioneer shall forthwith adjudicate the dispute, and auctioneer’s decision shall be absolute, final, and binding on all parties. Bids received after the fall of the hammer are not grounds for dispute. Bids acknowledged by bid spotters employed by Vision, LLC are recognized as if tendered to auctioneer, but in case of a dispute the bidding on the horse shall be forthwith reopened for advance bids, and if there be no advance, the horse is sold to the person from whom the auctioneer recognized the last bid. In the case of such a dispute, advance bidding shall be restricted to the contending parties, but should the recognized bid be reduced below the bid of commencement of dispute, then the bidding is reopened to all bidders, regardless of whether or not the final bid exceeds the bid which was disputed. The auctioneer reserves the right to reject any or all bids. In the event of a technology issue of any type (including, but not limited to, malfunctions affecting or resulting in a temporary delay or inability to use bidding platforms, computers, telephones, servers, or any similar technological equipment or software), Vision, LLC reserves the right, exercisable in its sole and absolute discretion, to temporarily suspend bidding, extend the relevant bidding period, cancel the sale, re-offer the horse affected for sale, or continue with the sale for bidders participating in the sale.
RISK OF LOSS: TITLE PASSES TO THE PURCHASER AT THE FALL OF THE AUCTIONEER’S HAMMER, AND ALL RISK OF LOSS OR INJURY THEREAFTER SHALL BE THAT OF THE PURCHASER. Purchaser assumes all risk of loss for the horse at the fall of the hammer. Seller, Consignor and Purchaser agree to release, defend, indemnify and hold Vision, LLC, and the owners and/or operators of the facilities at which the horse is located at time of sale and their directors, officers, employees, agents and representatives, harmless from all losses, damages, expenses, claims, causes of action or attorneys’ fees arising out of or related to the possession, care, custody, control or maintenance of any horse either sold or purchased by them, including but not limited to any claims arising out of injuries or damage caused by the horse after the Fall of the Hammer, including those injuries or damages caused by the negligence, active or passive, of Vision, LLC or any of its directors, officers, employees, agents or representatives.
Solely as an accommodation to Purchaser, physical possession of each purchased horse may be retained by Vision, LLC until Purchaser makes settlement in full as set forth under Terms of Payment, Credit and Settlement Below. Vision, LLC shall not be liable in any way for any injury or damage to the horse(s) or any third person as a result of care needed pending full payment by purchaser.
INSURANCE: Immediate full mortality insurance coverage is effective upon the fall of the hammer, for the amount of the total purchase price. The insurance arranged by Vision LLC, with C. Jarvis Insurance Agency of Aurora, Ohio, will remain in effect until the purchaser signs the contract or until midnight of the first business day after the sale, whichever occurs first, by which time it is the obligation of the new owner to arrange permanent insurance if desired. TERMS FOR PAYMENT, CREDIT AND SETTLEMENT: Unless credit shall have been approved in advance by Vision, LLC, Purchaser shall make settlement following payment terms below. Purchase shall not obtain possession of any horse until payment terms are fully met.
A Deposit in the amount of $5,000.00 will be due upon the Fall of the Hammer to the winning Bidder. Deposit may be made by check, cash or credit card. An additional 3% convenience fee will be charged on the $5,000.00 Deposit if paid by credit card (for a total amount charged to the credit card of $5,150.00).
Full purchase price, less deposit amount is due to Vision Arabian Horse Sales, LLC by 5:00 PM EST on Thursday May 7, 2026. Acceptable forms of payment are Bank Wire, Bank Money Order or Cashiers Check.
All sales are strictly for cash in United States dollars (including U.S. currency, bank wire, cashier checks, eChecks, and bank money orders, and are subject to all reporting requirements. Credit Cards are accepted and will be subject to a 5% Convenience Fee on purchase balances due, less the required $5,000.00 deposit.
In the event that a Bidder’s payment is dishonored upon presentment(s), Bidder shall pay the maximum statutory processing fee set by applicable state law. If Bidder attempts to pay via check and the financial institution denies the transfer from Bidder’s bank account, or the payment cannot be completed using the selected funding source, Bidder agrees to complete payment.
If Vision, LLC refers any invoice to an attorney for collection, the Bidder agrees to pay attorney’s fees, court costs, and other collection costs incurred by Vision, LLC.
REMOVAL OF HORSE FROM VISION,
LLC: Once full payment terms have been met, purchaser must arrange removal of horse from designated Vision, LLC auction site no later than May 11, 2026. Any horses remaining thereafter will incur board & training charges of Fifty-five dollars ($55) per day required to be paid in full prior to departure. Purchaser is responsible for all transportation costs.
DEFAULT: Any Purchaser who fails to sign an Acknowledgment of Purchase when required to do so, or fails in any respect whatsoever to comply with conditions above, shall be in default. Any person in default shall immediately become liable to Vision, LLC for the full amount of the purchase price of all horses purchased, applicable sales tax, and any costs incurred by Vision, LLC in the collection thereof, including reasonable attorney’s fees. Although it shall not be obligated to do so, Vision, LLC shall have the right to resell any horse in default at public or private sale selected by Vision, LLC in its sole discretion, including any session of this sale, without prior notice, for the defaulter’s account. Any amount realized from such sale, after deducting the costs incurred in the resale shall be credited to the defaulter’s account, with the defaulter being liable for any deficiency.
TITLE
Title to any lot remains with Consignor, any secured party of the Consignor, or assignee of Consignor, as the case may be, until the lot is paid for in full by Purchaser.
CONDITIONS OF LOTS SOLD:
All lots to be sold AS IS, WHERE IS. ALL SALES FINAL and without recourse. Vision LLC is committed to conducting an ethical, transparent auction. Every effort has been made to provide information and support to make this auction of the highest integrity.
All descriptions, photographs, illustrations, and terminology including but not limited to words describing condition (including any condition reports requested by Purchaser or Agent), authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition, and relevance, used by auctioneer, used in the Catalog, online, bill of sale, invoice, or anywhere else, represent a good faith effort made by Vision LLC to fairly represent the lots offered for sale as to origin, date, condition, and other information contained therein; they are statements of opinion only. They are not representations or warranties and Purchaser agrees and acknowledges that he or she shall not rely on them in determining whether or not to bid or for what price.
INSPECTION
Purchasers are accorded the opportunity to inspect the lots and to otherwise satisfy themselves as to the nature and sufficiency of each lot prior to bidding, and Vision, LLC urges Bidders to avail themselves accordingly. Each auction lot will have vet reports available prior to auction date, made available to Registered Bidders and/or Purchaser, at their written request to Vision, LLC. Vision, LLC will only forward documentation to a licensed veterinarian.
Bidders are invited to attend presale viewing for all Vision, LLC Lots. All lots to be auctioned are available for viewing prior to the sale for locations/dates specified on our website or by appointment.
AUTHORIZED AGENTS: Persons acting as Agents must file letters of authorization from the Principal stating the Agent is acting in their behalf and that said principal will be responsible for the Agent’s sales or purchases. These letters must be on file with the sales office 24 hours prior to the start of the sale. By signing the Acknowledgment of Purchase, an Agent agrees to be personally liable for the full purchase price of the horse if Purchaser does not have approved credit or fails to make settlement as provided.
AUTHORIZED AGENTS SALE COMMISSION: Vision, LLC agrees to pay Agent Commission of seven percent (7%) to those agents with letters of authorization on file 24 hours prior to the sale. Letters of authorization must be signed and submitted by the Principal/Purchaser to be valid. No more that one agent may be designated by any Principal or Purchaser. There will be NO MORE THAN ONE sale commission paid per lot. No payments will be made to agents until 5-7 business days after auction lot has been paid in full, horse has been removed from Vision, LLC AND until Authorized agent has provided Vision, LLC with a valid W-9.
SALES TAX: For horses sold in the state of Florida, any applicable Florida sales tax will apply and be the sole responsibility of the purchaser. For horses sold outside the state of Florida, applicable sales tax will apply according to their location, and is the sole responsibility of the purchaser.
PRIVACY NOTICE: Notice is hereby given to all participants and guests at Vision, LLC Auction Sales and activities, and permission is given by all participants and guests in such activities, that Vision, LLC may record, in any manner desired by Vision, LLC, or otherwise preserve any and all portions of the Vision, LLC Auction Sales and activities in and about the sales grounds, by video, audio, computer, or other means, and such recordings may be used by Vision, LLC in any manner it so chooses in its sole discretion and are the sole property of Vision, LLC.
All participants acknowledge and agree that the Catalogue, pedigree pages, website, portal, and other electronic and printed materials distributed by Vision, LLC are the sole property of Vision, LLC and shall not be reproduced or distributed to others without the express written consent of Vision, LLC. Except for copies made for use in connection with participation in the sale, recipients may not copy, reproduce, modify, republish, use, or distribute any information provided by Vision, LLC in any form or by any means without prior written consent. All participants further agree that no video, still photographs, or sound recordings of the sales grounds, horses, or participants are allowed without the written consent and authorization of Vision, LLC.
SEVERABILITY: If any provision of these CONDITIONS OF SALE is held to be illegal or invalid, such illegality or invalidity shall not affect the remaining provisions of these CONDITIONS OF SALE, and they shall be continued and enforced as if such illegal or invalid provision had never been inserted herein.
