Roundabout proposal for Midnight Pass and Beach Road By Rachel Brown Hackney intersection revived SarasotaNewsLeader.com
A proposal that was not even on a consultant’s list of traffic mitigation measures for Siesta Key has sparked new controversy. On May 5, the Sarasota County Commission was preparing to listen to a report on recommendations of a Tampa consultant whom county staff hired last year to study transportation issues on Siesta Key. First, however, Spencer Anderson, director of the county’s Public Works Department, stepped to the podium in the Commission Chambers in downtown Sarasota. Anderson explained that about five years ago, the Florida Department of Transportation (FDOT) proposed a roundabout at the intersection of Midnight Pass Road and Beach Road, near Siesta Public Beach. “We are currently having discussions with the DOT,” Anderson continued. “They’ve kind of reintroduced that effort.” He added that in 2022, FDOT plans to resurface Midnight Pass Road from the Stickney Point Road intersection to the intersection of Shadow Lawn Way. “That is the impetus,” Anderson continued,
for the revival of the roundabout discussion. “The biggest concern,” he noted, for leaders of the Siesta Key Association (SKA) and the Siesta Key Chamber of Commerce “has been pedestrian safety. We want to make sure that we evaluate all options before we eliminate anything in its entirety.” Anderson pointed out that better engineering designs have become available in recent years to facilitate pedestrian safety in roundabouts. In response to a SNL request for information about the latest proposal, Brian R. Rick, spokesman for FDOT’s District 1, wrote in a May 6 email, “The project you referenced for 2022 includes intersection improvements for Beach Road and Midnight Pass. We are looking at all options at this time; however, no decision has been made as to what improvements will be implemented. We will continue to work with our partners in the county and the community to arrive at the best possible approach.” On May 1, Catherine Luckner, the SKA president, sent an email to Paula Wiggins,

Siesta Key Transportation Study aims to move into phase two By Rachel Brown Hackney
SarasotaNewsLeader.com Sarasota County Transportation Planning Division staff is seeking funding for the second phase of the Siesta Key Transportation Study that it commissioned last year, so it can proceed with more detailed comparisons of feasibility, funding and permitting options. Kwamena Sankah, a county transportation engineer, gave that update to the County Commission on May 5, after it heard a presentation on the study. Sankah pointed out that public workshops would be a facet of that second
phase. Additionally, Sankah noted, staff will work to implement elements of proposed projects on the Key that are feasible, funding-wise, as it works on Capital Improvement Project budgets. Among those, he said, are bicycle and pedestrian safety improvements on the northern part of the barrier island, as well as trafficcalming measures. Turtle Beach and Siesta Key Drownings Tied to Rip Currents By Jane Bartnett
In late May, off-shore rip tides on Turtle Beach and North Siesta Key Beach, led to the tragic deaths of two swimmers. Both accidents occurred in the early evening hours. Neither beach is among the six Sarasota County beaches that are patrolled daily by lifeguards. The first incident occurred in the early evening hours of May 19. According to The Sarasota County Sheriff’s office “deputies responded Tuesday evening around 6:00 p.m., to Turtle Beach for the report of a possible drowning. Multiple units responded including our Marine and
Aviation Units, as well as the Venice and Sarasota Police Department’s Marine Units, and US Coast Guard.” The Sheriff’s office statement read that, “detectives believe an elderly woman was caught out in the water and unable to swim safely back to shore. A good Samaritan swam out in an effort to save her and was caught by the current. He was unable to return to shore and later pronounced deceased. He has been identified as Albert D. Hines participation key in planned shoreline hardening discussions By Rachel Brown Hackney SarasotaNewsLeader.com A little more than a year ago, as chair of the Sarasota County Commission, Charles Hines suggested that it was time for a discussion about the potential amendment of the Sarasota County Code to allow for shoreline hardening. Although he proposed a workshop on the issue, that never materialized. During the regular commission meeting on May 5, Hines again broached the subject, following comments Commissioner Nancy Detert made about a “white paper” that the Manasota Key Association had paid an attorney to draft, which the association then sent to the commissioners in early April. Detert suggested the appointment of a new county advisory board that could meet quarterly to deal with issues related to the county’s barrier islands. She proposed one or two representatives each of the Siesta Key, Manasota Key and Casey Key associations — “all volunteers” — plus a county staff member, with the advisory group members taking time to review all the county policies and regulations regarding steps property owners can take on the barrier islands to protect their investments. The staff member, she pointed out, could inform the island representatives about what county and state regulations allow. “People think up great ideas and then find out that’s an illegal great idea,” she continued, so having the staff assistance would eliminate proposals that would not be feasible. Hines, however, called for a staff report on how the County Code’s environmental regulations match those of the state, along with information about the rules that

go beyond state requirements. He specifically called for identifying “areas where there’s too much gray area in terms of staff interpretation” of county policies. For example, Hines noted, staff says that when the shoreline in front of a home has eroded to the point that only 25 feet of beach separates that residence from the Gulf of Mexico, then the situation is dire enough for emergency measures to be allowed. That 25-foot rule is not in the code, he stressed. “The elephant in the room here is shoreline hardening,” Hines pointed out. “Thirty years ago, previous [commissioners] didn’t want to have shoreline hardening for very good reasons — very good reasons,” he continued. Yet, 30 years later, he said, “Houses are getting ready to fall into the water.” Past commission discussions have noted that seawalls, for example, cause erosion of beach on either side of the protected property. As erosion has become more severe on Casey and Manasota keys, especially, Hines pointed out, homeowners are uncertain about
what the commission will and will not approve. “[That] makes it very difficult and uncertain for people to come forward and spend a lot of money, not knowing if they could do something to protect their homes.” Their expenses could range from tens of thousands of dollars to hundreds of thousands of dollars, Hines emphasized, just to reach the point of appearing before the board. The commissioners need to decide whether to amend the County Code to allow shoreline hardening, Hines stressed. After staff completes the board report and the commission has reviewed it, Hines continued, then a public hearing could be scheduled during which staff of the county’s Environmental Protection and Permitting divisions, as well as representatives of barrier island homeowner groups, could advocate to the commissioners for policies and regulations to be amended or removed. Detert responded that she felt a commission workshop should be held first, “for informational purposes.” Then the board members could provide direction to staff about how to proceed, including the scheduling of a public hearing. Detert added that she felt the hearing could be planned in September or October, as she anticipates “a lot of public comment,” which is not what county staff wants to deal with as the COVID-19 public health emergency continues. Commissioner Alan Maio then talked of all he has learned from Hines about coastal permitting issues, as Hines was elected to the board in 2012, two years before Maio. In fact, Maio said, after he took his seat on the board in
November 2014, Hines noted that the decisions the commissioners have to make on petitions related to the county’s Coastal Setback Code, which deal with construction on the shoreline, are the toughest. Maio added that he did not believe the comment until he began dealing with them during his commission tenure. “They’re enormously complex and tough, and, in most instances, [they involve] the most valuable asset anyone owns” — a home. Maio suggested to County Administrator Lewis that he “come up with the most streamlined
changes to the County Code. “This is not a new issue,” Lewis responded, adding that staff would undertake the board assignment calling for preparation of a report. “I think we can turn it around faster than 30 days.” Then, Lewis said, the commissioners could decide about conducting a public hearing. Detert agreed with Maio about the importance of Hines’ involvement in any hearings. Still, Detert told her colleagues that she did not want to weaken the County Code to the point where it would be easy for people

way” to get the staff board report to the commission “as quickly as possible.” He wanted to ensure that, before Hines steps down from the District 5 seat in November because of term limits, that Hines has had the opportunity to participate fully in all the pertinent discussions and public hearings. Maio added that it might take up to three public hearings before the board members could agree on any

Specifically, the passage of the $2 trillion Coronavirus Aid, Relief and Economic Security (CARES) Act offers, among other provisions, the following: • Expanded unemployment benefits – The CARES Act provides $250 billion for extended unemployment insurance, expands eligibility and provides workers with an additional $600 per week for four months, in addition to what state programs pay. The package will also cover the self-employed, independent contractors and “gig economy” workers. Obviously, if your

employment has been affected, these benefits can be a lifeline. Furthermore, the benefits could help you avoid liquidating some long-term investments you’ve earmarked for retirement just to meet your daily cash flow needs. • Direct payments – Individuals will receive a one-time payment of up to $1,200; this amount is reduced for incomes over $75,000 and eliminated altogether at $99,000. Joint filers will receive up to $2,400, which will be reduced for incomes over $150,000 and eliminated at $198,000 for joint filers with no children. Plus, taxpayers with children will receive an extra $500 for each dependent child under the age of 17. If you don’t need this money for an immediate need, you might consider putting it into a lowrisk, liquid account as part of an emergency fund. • No penalty on early withdrawals – Typically, you’d have to pay a 10% penalty on early withdrawals from IRAs, 401(k)s and similar retirement
accounts. Under the CARES Act, this penalty will be waived for individuals who qualify for COVID-19 relief and/or in plans that allow COVID-19 distributions. Withdrawals will still be taxable, but the taxes can be spread out over three years. Still, you might want to avoid taking early withdrawals, as you’ll want to keep your retirement accounts intact as long as possible. • Suspension of required withdrawals – Once you turn 72, you’ll be required to take withdrawals from your traditional IRA and 401(k). The CARES Act waives these required minimum distributions for 2020. If you’re in this age group, but you don’t need the money, you can let your retirement accounts continue growing on a tax-deferred basis. • Increase of retirement plan loan limit – Retirement plan investors who qualify for COVID-19 relief can now borrow up to $100,000 from their accounts, up from $50,000,
provided their plan allows loans. We recommend that you explore other options, such as the direct payments, to bridge the gap on current expenses and if you choose to take a plan loan work with your financial adviser to develop strategies to pay back these funds over time to reduce any long-term impact to your retirement goals. • Small-business loans – The CARES Act provides $349 billion to help small businesses – those with fewer than 500 employees – retain workers and avoid closing up shop. A significant part of this small business relief is the Paycheck Protection Program. This initiative provides federally guaranteed loans to small businesses who maintain payroll during this emergency. Significantly, these loans may be forgiven if borrowers use the loans for payroll and other essential business expenses (such as mortgage interest, rent and utilities) and maintain their payroll during the crisis. We’ll be in a challenging

On March 24, 12th Judicial Circuit Court Judge Andrea McHugh issued what is known as a “final order” in the combined cases involving the Sarasota County Commission’s 2016 vacation of part of North Beach Road and the 2018 Sarasota County Charter amendments related to that road vacation. The order affirmed that all the Circuit Court rulings in the case went against plaintiff Michael Cosentino of Siesta Key and a nonprofit organization he founded in June 2016, Reopen Beach Road. Among those decisions was a ruling that one of the Charter amendments Cosentino wrote in 2018 was invalid because it “is contrary to Sarasota’s Charter and is therefore invalid.” A second Circuit Court judge who ruled on the amendments also ordered that the first sentence of the second Charter amendment be stricken, as it, too, was in conflict with state law. The rest of that amendment, Circuit Judge Hunter Carroll wrote in his October 2019 ruling, was aspirational, so it could stay in effect. Both amendments won voter approval during the November 2018 General Election. In response to a request for comment, Siesta Key resident Michael Cosentino told The Sarasota News Leader on April 11 that he was planning to file for a rehearing of McHugh’s final order, “based upon new evidence and fraud pursuant to [a section of the Florida Rules of Civil Procedure].” Nonetheless, he added, “Since the local judges have ruled in error every step of the way, we don’t have much confidence in these motions being fairly ruled upon, either. We are unsure as to whether the local judges don’t understand the law or simply don’t care, but the good news is that the appeal is based upon the record,

Big Pass dredging still scheduled for July 6th start By Rachel Brown Hackney SarasotaNewsLeader.com The U.S. Army Corps of Engineers team in charge of the Lido Key Hurricane and Storm Damage Reduction Project will stick to its announced schedule of “on or about July 6” for the dredging of Big Sarasota Pass to get underway, the SNL has learned. After hearing of the postponement of the Sarasota Powerboat Grand Prix — which had been set for late June off Lido Key Beach — David Ruderman, a spokesman for the USACE at its Jacksonville District Office, indicated to the SNL the potential of the USACE’s moving up the dredging timeline. However, Ruderman told the SNL that “the Corps and contractor are sticking to the originally projected start date …” (The Powerboat Grand Prix subsequently was postponed until June 2021.) The reason for staying with the early July time frame, Ruderman explained, is a requirement in the Florida Department of Environmental Protection (FDEP) project permit regarding sea turtle nest monitoring. The permit — issued in June 2018 to the USACE and the City of Sarasota — says, “Sand placement activities are authorized to occur on the nesting beach (seaward of existing coastal armoring structures or the dune crest) during the marine turtle nesting season,” provided that “[d]aily marine turtle nesting surveys shall be initiated 65 days prior to sand placement activities or by April 15, whichever is later.” Sea turtle nesting season runs from May 1 through Oct. 31 each

year. The USACE plans to remove up to 1.3 million cubic yards of sand from Big Pass and then place 710,000 cubic yards on about 1.56 miles of Lido Beach. The remainder of the sediment is expected to be lost in the dredging process, based on documents among the permitting application materials submitted to FDEP. Additionally, on May 18, FDEP spokeswoman Dee Ann Miller told the SNL that department staff was awaiting two key sets of unrelated information before it begins its 15day completeness review of all preconstruction submittals. However, she indicated in her email that those missing pieces were not a concern, noting, “Construction is not expected to commence until early July, at the soonest.” As of May 18, Miller wrote, FDEP had yet to receive the necessary details regarding turbidity monitoring or information about the mitigation of seagrass that may be destroyed during the dredging. On April 22, leaders of the Siesta Key Association (SKA) sent a letter to FDEP, pointing to “12 areas of
significant missing documentation or lack of compliance with the permit” as of that date. Among those the SKA cited was Section 5(c) of the Specific Conditions segment of the permit, which says the following: “Turbidity monitoring qualifications. Documentation that the person(s) who will be conducting the turbidity monitoring meets the following requirements: “i. Is independent of both the design contractor and the construction contractor(s); “ii. Has formal training in water quality monitoring; “iii. Has professional experience in monitoring turbidity for coastal construction projects …” A National Oceanic and Atmospheric Administration (NOAA) article defines turbidity as “an optical quality of light transmission through a fluid containing sediment particles …”
The seagrass mitigation proposal In regard to the second FDEP requirement that was unfulfilled as of May 18: The Sarasota City
Commission voted unanimously on July 15, 2019 to approve an agreement with the Manatee County Commission that allows the city to use a portion of that county’s Perico Preserve for the planting of new seagrass. City Engineer Alexandrea DavisShaw said at the time that she anticipated the mitigation area would need to cover up to 3.2 acres, as compensation for the 0.68 acres of seagrass that the USACE expected would be destroyed in Big Pass. DavisShaw added that the city’s projected expense would be $1,124,839.84. The USACE did end up eliminating approximately onethird of Borrow Area — or “Cut” — C in Big Pass in its solicitation for the Lido project. One reason for that decision, Trisston Brown, chief of the USACE’s Florida Projects Section in Jacksonville, told the SNL, was “[S]parse seagrasses exist adjacent to the dredge area with the potential to be impacted …” The SKA and the Suncoast Waterkeeper both opposed the city’s mitigation plan. Justin Bloom, founder of the Suncoast Waterkeeper, urged the city commissioners to “look at the larger picture of deteriorating water quality in our region,” adding that a decline in seagrass populations was documented in community waters from 2016 to 2018. Bloom called that a “significant concern.” SKA leaders have pointed to a Sarasota County policy — contained in Article XX of the County Code — that calls for any mitigation of seagrass destroyed in
Sarasota County to be undertaken in Sarasota County. When city commissioners asked DavisShaw about that policy last July, she said that Pansy Bayou was proposed as a mitigation site; it is located between City Island and Lido Key. However, she added, Mote Marine Laboratory staff asked that the bayou be excluded from consideration because it provides protection for small fish. Additionally, R. Grant Gilmore Jr., senior scientist with Estuarine, Coastal and Ocean Science Inc. in Vero Beach, offered caution to the City Commission via Siesta resident and SKA member Michael Holderness. Among Gilmore’s statements, he pointed out, “The Perico seagrass is located at the mouth of a large freshwater river, the Manatee River, so [it] is influenced by freshwater flows from that river. The Sarasota Big Pass seagrass is located at a large opening to the Gulf of Mexico, a major saline ecosystem … These widely differing salinity environments mean that even though the seagrass species may be the same, the creatures that associate with these two different ecosystems will not be the same. It is like stating that apples and oranges are the same fruit. Research over the past 50 years has demonstrated otherwise.” Regardless of the progress made with the FDEP permitting requirements for the Lido initiative, both the SKA and SOSS2 remain engaged in litigation in an effort to prevent the removal of any sand from Big Pass, which never has been dredged.

There’s Still Time to Complete The 2020 Census By Jane Bartnett In mid-March 2020, U.S. Census mailings began arriving in the mailboxes of Siesta Key and Sarasota residents. At the same time, the Corona virus also became a part of our everyday lives. The Siesta Key beach closed to the public on March 21, and 10 days later on April 1, Florida Governor DeSantis ordered all Floridians to stay at home. Despite this unfortunate coincidence, as mandated by the US Constitution, The Census Bureau continued to work toward completing a census every 10 years. This summer, Census workers will reach out to residents who have not responded to the 2020 Census, either online or by phone. Outreach to officials at colleges, senior centers, prisons, and other facilities with large groups of people also continues. When responding to the Census questions, The Bureau asks residents to keep the date of April 1, 2020, in mind. “Tell the Census Bureau where you lived as of April 1, 2020, and include everyone who usually lives and sleeps in your home,” reads an official Census statement. For those who have not completed the Census, it is not too late to be counted. “We are encouraging everyone to respond as soon as you can,” said Census Bureau Director Steven Dillingham. After two more reminder mailings, The Census Bureau will send out paper questionnaires. According to the Bureau, all personal data reported on Census forms is protected and sealed for 72 years. The deadline for responding to the 2020 Census, by mail, phone, or online, is October 31, 2020. By law, in December 2020, The Census Bureau must deliver apportionment counts to the President and Congress. As Siesta Key and Sarasota residents move beyond the time of Covid-19, the results of the 2020 census data will have far-reaching effects on the lives of Siesta Key and Sarasota residents for the next 10 years. During this time of recovery, a new Census webpage (https://2020census.gov/en/ community-impact.html) sheds light on how Census data will shape our lives on a local, regional

With months left to complete the effort before the October 31, 2020 deadline, The Census Bureau has been teaming up with private sector businesses and other government offices to get the word out. Even “The Count” on Sesame Street has been urging parents and kids to “Make Your Family Count,” ensuring an accurate count that includes every baby and child. Catherine Luckner, President of The Siesta Key Association of Sarasota, Inc., noted that completing the Census forms in the midst of the Covid-19 shutdown may have slipped the minds of many Siesta Key and Sarasota residents, but now she says, “we are waking up - lets be
counted and get this done!” Sarasota County is working to communicate with residents about the 2020 Census. To date, some 95,000 utility bill inserts have been made and 8,500 book marks and postcards created. They are being distributed through county library curbside pick-up and in coordination with Sarasota County Schools meal distribution. Special signage for SCAT buses, pop-up quick screens, sandwich boards, feather flags and posters for display at county facilities and partner agencies was also designed. “I am urging Sarasota residents to participate in the Census because there is so much at stake,” said Florida State Representative Margaret Good, who represents Siesta Key and Sarasota in the Florida House of Representatives. “The Census determines how much federal money goes to our community for infrastructure, healthcare, education, public transportation, and most importantly disaster relief. I am counting on everyone to do their part and ensure that our district is fully represented, so we can get the resources we need to sustain our growing community.” “When you respond to the census,” The Census Bureau reports, “you help your community get its fair share of the more than $675 billion per year in federal funds.”

Coral reefs are natural treasures that cover less than 1% of the ocean floor, but support about 25 % of marine life. Florida’s Coral Reef stretches almost 350 miles. With the Sarasota County Commission’s recent approval of the contract for the work, the replacement of a water main along sections of Midnight Pass Road near the Beach Road intersection on Siesta Key is expected to begin in June, county staff says. The bid award went to Douglas N. Higgins Inc. of Naples, according to a May 5 staff memo provided to the commissioners in advance of their meeting that day. The completion of the $409,708.50 initiative is anticipated in October, according to the most recent project fact sheet, which the SNL obtained through a public records request. The county paid $149,840 to Giffels-Webster Engineers Inc. of Englewood for the project design, that fact sheet notes. A water main, Trenchlesspedia.com explains, “is a primary underground pipe in a municipal water distribution system. It is a major artery that supplies water to smaller pipes on the way to homes and businesses. Water mains take clean water from a city’s [or county’s] water treatment plant to communities
that need it, and it is a critical piece of a nation’s utility infrastructure.” “The Midnight Pass Road water main replacement project … is for the relocation and replacement of the existing aged and undersized potable [drinking] water lines,” the May 5 staff memo noted. “The new lines [also] will provide improved access for maintenance,” the memo added. Further, “The new lines will provide improved water quality and increased capacity to residents [and] reliable fire protection,” the project fact sheet pointed out. Residents in the immediate project area “will be notified by postcard of upcoming construction at least two weeks prior to the start of work,” the memo said. Funding for the work will come out of money dedicated to the county’s Capital Improvement Program, the memo said. A public meeting was conducted on Siesta Key on Jan. 16 to provide residents information about the Midnight Pass Road initiative, the memo added.

which clearly demonstrates we are and have been legally correct on everything.” As it turned out, Cosentino did not seek a rehearing. Instead, he proceeded with an appeal, which he filed on April 23 with Florida’s Second District Court of Appeal. In his statement to the SNL, Cosentino also wrote, “Thankfully, the trial court’s rulings mean nothing on appeal. I look forward to presenting our evidence to a panel of judges that will actually look at it and rule based upon the applicable law and statutes.” The Appeal Court on April 24 formally acknowledged the filing of the case. As of the deadline for this issue of Siesta Sand, no other documents had been filed in the Appeal Court’s case docket. During the April 8 County Commission meeting, Commissioner Charles Hines noted McHugh’s Final Judgment and commended county staff. “Great work by our County Attorney’s Office,” Hines said. “We’ve prevailed with that case.” Hines and Commissioner Alan Maio are the only two members of the board still serving who participated in the 2016 public hearing on the road vacation. Three sets of property owners on North Beach Road sought the vacation of a 373-foot-long segment, which had been closed to vehicular traffic since 1993 because of repeated storm damage. Only then-Commissioner Christine Robinson voted against the petition, arguing that, as of that time, the county’s Comprehensive Plan prohibited a road vacation in circumstances where the segment was on a shoreline. Cosentino used that section of the Comprehensive Plan as the basis for his initial complaint against the commissioners, which he filed in June 2016. Hines pointed out on April 8 that he voted for the road vacation in part because North Beach Road is bordered on the seaward side by private parcels, including property owned by the petitioners. Therefore, Hines argued during the May 11, 2016 public hearing, the segment at

the heart of the hearing did not actually border Siesta Public Beach. Cosentino drafted the two Charter amendments, he told the SNL, as another means of trying to overturn the road vacation, in the event he failed to win his court case. One of the amendments called for the County Commission to rescind the road vacation or reacquire the 373-foot-long segment. The second amendment prohibited the board members from vacating any stretch of county-owned road that had so much as a waterfront vista. As the cases made their way through the Circuit Court, Cosentino lost one appeal of a decision that went in Sarasota County’s favor. He filed another appeal in 2018, but he ultimately asked the Court of Appeal in 2019 to dismiss that. At the time, he told the News Leader, “Now we have the opportunity to supplement the record with the county produced documents that prove the validity of our allegations.” He added that he believes that step moved him closer to ultimate victory over the county. Last year, Circuit Judge McHugh consolidated the remaining count in the road vacation case with the companion case filed in 2018 arguing that the Charter amendments were
invalid. During the more recent hearings McHugh conducted, Cosentino alleged on several occasions that the Office of the County Attorney had colluded with the private property owners for years to make the road vacation possible. Motions seeking attorneys’ fees As Cosentino works on this latest appeal, both Sarasota County and one set of the private property owners who intervened in the Circuit Court case have filed for payment of costs. The county asks that Cosentino and Reopen Beach Road pay $245, which is what the county says it spent on court reporters during three hearings. The other motion, filed by attorney M. Lewis Hall III of the Williams Parker law firm in Sarasota, includes a detailed accounting of expenses for Hall’s clients, Dennis and Wendy Madden. Dating from August. 2016, those add up to $8,072.85. Hall noted, “The trial court has broad discretion to award costs … upon a showing the costs were reasonably necessary to prosecute or defend the case.” Further, he wrote, “The Maddens reserve the right to amend this motion in the event of receipt of additional taxable costs.”

After New Pass sand from 2019, Lido now needs 260k cubic yards for an historic + 500k of “advanced nourishment.” What isn’t reported; dredging causes seagrass and marine life loss. Dredging 1.3M cubic yards creates a 30% loss of sand along the process. This lost sand suffocates seagrass and deprives marine life of food source and sunlight (‘turbidity’).

approved site. It now has plenty of sand available. There is a workable bid for trucking in (including the so-called 500k cubic yards conveniently called “advanced nourishment a.k.a. extending Lido out 200’ when the beach has a historic profile of 85’. Again, Go off shore to the DEP approved borrow site, do nothing approach, or trucking it in ($13,500,000 -3MM savings as seagrass mitigation is not needed) is the right solution. Both still viable options. However, City STAFF member “RED TIDE TOM” Barwin didn’t like the color of sand off-shore and the City, County and State FDEP refused submittal of the bid to truck in sand. Low fuel prices (COVID SPECIAL) would mean abandoning ALL the proposed dredging sites and saving 3MM in tax payer funds from damaging the crucial seagrasses. Lido may be BETTER off left alone; do nothing in this case! Again, something never considered as well as NO EIS (ENVIROMENTAL IMPACT STUDY). EVERYONE’s goal: MUST KEEP CITY OUTSIDE BIG PASS & EBB SHOAL even if that means making a deal with Tom Barwin and “his” local Government. WORKABLE SOULTION DREDGE CUT D just ¼ MILE OFF LIDO: Direct City/USACOE TO STAY OUTSIDE THE PASS: “GO TO CUT D (as shown in map). CUT D WILL SET A PRECEDENT that local requirements, rules, laws, ordnances and statues no longer apply to the City (City is a municipality
within the county); WHERE Dredging Cut C “inside the pass” WILL IMPAIR WATER-QUALITY! THAT IS THE SCIENCE. CUT D is a ‘workable FOR ALL’ solution that would get Lido sand, likely result in ALL pending and FUTURE lawsuits to be dropped: The definition of D3 has conveniently changed but what was modeled stopped at the south end of C. It does NOT create a cut through the Shoal and therefore leaves the full shield of the shoal protecting SK! Look at the attached which states the D3 -B has no different wave action than no action! (See attached). D may hold the 2MM of beautiful white sand, but the specific volume is 1,120,000 cubic yards (1.37MM minus 0.25MM in B. NO to B) by sculpting it at a 45 deg angle on the outer edge. Highly likely that the sand that erodes (eroded) off Lido ends up there! The earlier 0.45MM didn’t include the portion of Cut C when D3 is extended to the southern boundary of C but does not make the Cut C to through the shoal. Cut D Likely holds 5MM(?) cubic yards of BRIGHT white sand. Area circled in red holds 2MM (only needs 260k but wants 1MM+). This allows City to set new precedence that our local environmental requirement no longer pertain to the city (just as B, C and D would) once city dredges and county refuses to assume their legal obligations to the citizens under their jurisdictional authority. CHEAP TO HARVEST AND ELIMINATES THE NEED TO EVEN USE TED SPERLING PARK OR DRIVE TRACKTORS UP AND DOWN THE BEACH. This keeps them outside the pass and off the protective ebb shoal. SKA and SOSS2 would not object to D and likely all pending and future litigation over lack of an ‘EIS’ STOPS. Congress funds USACOE; This prevents the dredging of Congresses designated estuary of nation significant INSIDE the pass. NO CUT B (Siesta Key’s ebb shoal) & NO CUT C (Location is inside the pass (estuary designated national significant) and stay outside the protective shoal of Lido to Bird Key and Downtown SRQ). IT HAS NEVER BEEN ABOUT ‘SAND’ but more about setting said NEW precedence (WHICH CUT D DOES). See, if city destroys the Marina Park, water-quality, Ted Sperling Park and many beaches to the south a.k.a. Lido dredging projects, our local environmental regulations, rules, laws, ordinances and statues will no longer apply to the City (The city is a municipality within the county). This opens the door the BIG Development, which isn’t particularly my fight. Heck I’d love them to do the EIS and allow
it to speak for itself. Something Barwin and Alex-Davis Shaw are terrified of. Many remain confused why the public is paying for advance nourishment for a private beach and why they are refusing to truck in sand routinely done by Longboat Key. This would solve all the environmental issues from dredging (NO loss of sand from dredging = No Turbidity = No damage to water quality and LOW fuel prices right now makes this option. What is the remaining reason for the County and City to ignore a more environmentally friendly, less destructive option? Is there something hidden in this project not disclosed to the public? They have been advised through many Coastal Engineering studies to do only a ‘small sample’ of sand from the Pass. THEN, see how the Pass responds. Is this setting a precedent that may lead to changes in Environmental regulations? Are they attempting to create a large ship/yacht Cruise -in Community here? a.) We know now that CUT D sets their precedence so let us discuss b.) b.) Navigation…. New Pass is a coast guard navigational channel. It requires maintenance and dredging to keep the channel deep for sailboats. This provides a ready source of sand for Lido and for Longboat Key.If COUNTY AND CITY would learn to work together maybe they’d learn we already have a 16’ DEEP NATURAL, NEVER DREDGED, CHANNAL in BIG PASS. The only thing holding up the gulfend is that 1970 “failed by design” Groin located on North Siesta Key. The groin is causing the channel to hook around the front of Siesta; without groin it would direct strait out. This Big Sarasota Pass is a natural channel, open and functioning for hundreds of years. Charts reflect this back to the mid1800’s. The construction of Bird Key caused it to unsettle. Today it’s a stable 16’ deep. As of Feb 3rd, you’ll see (below) the dredge area from the current bid package. The “new D” is the western side of the shoal. It used to be called D3 in the FDEP Big Pass Modeling. In the final permit it was simply called D also i.e. “D3” is now known as just D is shown below. WORKABLE ANSWER FOR ALL: “CUT D western side of the shoal.” – by: MUST strategically be sculpted (circled in red) and DO NOT TOUCH Cut B, C, and the Shoal. What is shown below is a more than generous solution to protect the Estuary of National Significance, our water-quality, Siesta Key, Venice, Casey Key and beyond. Sergeant Arik Smith of the Sheriff’s office reported to the Siesta Sand that there was very heavy beach traffic on the Island on the Saturday of Memorial Day weekend. There was, however, significantly less traffic on Sunday and Monday, likely due to the cloudy and rainy weather. Sergeant Smith indicated that they were well prepared for the crowds and proactively implemented a procedure whereby the main beach parking lot closed after it was full. Thereafter, they only permitted entry into the lot when a parking spot became available. He indicated that this procedure was successful in limiting disputes over parking spaces and resulted in no calls for service to the beach parking area. This procedure also freed up resources to be deployed on the beach and in other parts of the Island. With respect to social distancing measures, Sergeant Smith indicated that he believed business owners on the Island were being responsible in implementing the measures mandated by the State and recommended by the Centers for Disease Control. Overall Sergeant Smith estimated the amount of calls for service to be in line with a normal holiday weekend.
Sheriff’s office discusses beach reopening Sarasota County Sheriff’s Office personnel probably could have used the phrase “So far, so good” to describe the public’s reactions to the initial easing of restrictions on the beaches as of April 27. About 1 p.m. that day, county Media Relations Officer Drew Winchester interviewed Cindy K. Turner, manager of the county’s Beaches and Water Access Division, on the Siesta Key shoreline. Asked about staff’s observations as of that time, Turner told Winchester, “It’s kind of slow and steady. People are adhering to social distancing.” As for the continued closure of the parking lots, Turner said, “We wanted to ease into this.” County staff had concerns about people coming to Sarasota County’s shoreline from other areas of the state where beaches remain off limits, she pointed out. In an email he sent to the commissioners just before 4 p.m. on April 27, County Administrator Jonathan Lewis wrote, “Our lifeguards, beach attendants and the Sheriff’s Office have been doing outstanding work. Our
Communications team did a great job getting the message out over the weekend. “So far it shows that once again our residents will do the right thing,” Lewis added. When the SNL checked in on April 29 with Kaitlyn R. Perez, community affairs director for the Sheriff’s Office, she provided the following information: “On Monday, we did issue a few parking citations, but were lucky enough to contact most drivers who were parked illegally and have them move their vehicle without issuing a citation. We had no major issues on any beach north to south. Most everyone we came into contact with was following the rules for social distancing. By all accounts, Sarasota County residents did very well with the modified opening.” Turner pointed out in the interview with Winchester that the county has 35 miles of shoreline. Perez did note that she saw one incorrect tweet from a local TV station whose helicopter had flown over Siesta Public Beach. That station reported that Sheriff’s Office personnel were “kicking people off the beach” who were set up with chairs and coolers, Perez wrote in her April 29 email. She added that she corrected that report “very quickly.” “Our guys and gals out on Siesta and all public beaches are informing folks that they must be participating in an ‘essential activity,’” Perez continued. “Not once have we told anyone to ‘leave’ the beach and I don’t believe we will anytime soon.” The SNL also checked in with Perez last week, after County Administrator Lewis announced the plans to allow essential activities once again on countyoperated beaches. She made it clear that the Sheriff’s Office’s top priority would be education. At first, county staff just allowed the essential activities of walking, running, biking, swimming, surfing and fishing on the beach, as denoted in the Executive Order Gov. Ron DeSantis issued on April 1. No congregating, sunbathing or lounging on the shoreline was permitted. In an April 29 email to the commissioners, Lewis noted, “Our activation of the open space with restrictions at the beaches has gone well. While some are frustrated by the parking, it has provided the right, safe, and measured platform to reactive the space in phases. There are pockets where our lifeguards have had a hard time getting people to follow the restrictions, but overall the anecdotal response has been good. Also, the Sheriff’s office has been a great partner,” he continued, noting, “they have had some pockets of parking enforcement challenges but they have dealt with them.” Then, as of midnight on May 3, Lewis authorized the reopening of the beach parking lots, and the county Communications staff announced that chairs, coolers and canopies again would be allowed on the countyoperated shorelines. However, staff emphasized the need for social distancing.

Sheriff’s Report 4/01 Identity Theft
4/09 Burglary Complainant stored various jewelry in small boxes in a chest of drawers in her condominium. The boxes were numbered and itemized to send to family members. She discovered that twenty boxes were missing, but there were no signs of forced entry in her unit. Authorities collected DNA evidence from the furniture and potential points of entry. Investigation continues. 4/26-Domestic Battery A deputy sheriff was called in to a domestic violence call that occurred on the victim’s boat near the Little Sarasota Bay. The defendant had punched the victim multiple times and choked her until she almost passed out. The victim was able to make a cell phone call without the defendant noticing. When the police arrived, there were red marks and scratches
4/27 Vehicle Burglary The complainant saw that the glove compartment and center console in his car were open when he was driving to play golf. He said that a car kit and his insurance and registration were stolen, and he believes the burglar mistook the papers for money while in the dark. There are no suspects, but the complainant said his wife’s vehicle was burglarized as well two weeks prior to his. Investigation continues.

The complainant reported that he was the victim of identity theft seven years prior. He said he had fraud alert messages on his credit, and said that the unknown suspect used his social security number and other personal information to open a DirecTV account. He said illegal charges were associated with the new account, and it was unknown the location at which the accounts were opened. The case remains open.

Police later found the defendant with his boat in the water at Turtle Beach. He argued that he didn’t hurt the victim, and that she was having a seizure on his boat. The only evidence found on the boat was blood soaked paper towels. Since the victim’s injuries did not seem to be those contracted in a seizure or falling down steps, the defendant was arrested. Charges are pending.

5/16 Burglary Complainant called 911 when she observed lights being turned off and on in a rental property that she knew should be vacant at that time. Police promptly arrived on the scene and surprised the defendant inside the property. The defendant claimed that he found the back door of the unit open and had no idea who broke the window next to the door. He simply let himself in to spend the night. Deputies located an ice cream spoon with residue later confirmed to be cocaine and a syringe needle on the kitchen counter, which the defendant claimed as his property. Charges are pending for drug violations, trespass, and criminal mischief.

Island Chatter Siesta Key July 4th fireworks cancelled
Predation continues to plague plover nesting
The Siesta Key Chamber of Commerce announced the annual 4th of July Community Fireworks Celebration, at Siesta Beach has been cancelled for July 4, 2020. After much deliberation, this difficult decision was made by the Chamber Board of Directors. Public safety, social distancing requirements, and crowd management were major factors considered.
In recent updates about the nesting snowy plovers on Siesta Key, Kylie Wilson, coordinator of the Audubon Florida Bird Monitoring & Stewardship Program in the county, once more has had bad news. On May 3, she reported that a nest had been discovered in the area on the beach owned by the Conservation Foundation of the Gulf Coast, which has a buffer around it to protect any nesting birds. “This nest was found with 3 eggs, so we can’t anticipate exactly when it will hatch but we do know the female has been incubating for at least one week,” Wilson added. “This plover seems to be in a good spot, very well camouflaged!!” she pointed out. Then, on May 11, Wilson reported, “Sadly our nest in the [Conservation Foundation] buffer failed,” and the cause is assumed to be predation …” She was uncertain of the culprit, she continued. However, she noted, “I did see crows in the enclosure as well as ghost crab holes, so it could have been either.” Nonetheless, Wilson added, “Ms. Sanibel has reappeared, and she had a one egg nest …” Ms. Sanibel is a plover so named because she has a band on one leg from a past sojourn on Sanibel Island. Unfortunately, that nest, too, was predated; the incident happened the same day the nest was discovered, Wilson noted. “The cause this time was definitely crows as I found a set of tracks next to the empty nest. I happened to be at the predated nest when Ms. Sanibel and her mate returned, likely to lay the next egg. It was pretty heartbreaking to watch her look confusingly at the empty nest, but she seemed to bounce back quickly; she and her mate copulated and then ran into the [Conservation Foundation] buffer and started frantically working on a new scrape to lay the remainder
A makeover for the Village A company under contract with the county to handle landscaping in Siesta Village has been making progress on beautification projects, the SNL learned. Lisa Cece, special district coordinator for the county, who oversees the Village upkeep in cooperation with the Siesta Key Village Maintenance Corp. (SKVMC), wrote in a May 8 email to the SNL, “You might notice the Village is getting a makeover with new plantings. Today, Wilhelm Brothers [employees] are grading beds,” leveling them to remove years’ worth of accumulation of various plants. Following that initiative, she continued, the SKVMC directors will decide on new plantings. “By early summer, the Village should have a much more colorful look …” During the original county beautification project — which was completed in early 2009 — coontie palms, for example, were among the landscaping features, Cece noted. New coonties have been added in the Village, including an area by Terrace East, Cece wrote. Bright green fountain grass, for another example, is growing near Beach Access 5, at the western end of the Village. After the planting has been completed, she added, “new mulch will be applied.”

Pelicanus occidentalis Known for its distinctive pouched bill and portly stance, the brown pelican is one of Florida’s largest seabirds. With a span of 6 to 8 feet, powerful wings propel the pelican as high as 60 feet above water before executing a daring high-dive to catch fish below the surface. When this behemoth hits the water at 40 mph, you may wonder how it could possibly survive such a dangerous feat. In early March, the four girls from Sarasota were flying to London on their 9-day Riverview H.S. spring break trip to London, Paris and Barcelona. They all freaked out when two hours into their flight to London, President Trump broke in on the aircraft’s TVs and imposed the travel ban from Europe due to the coronavirus. They were fortunate to be on the last flight from London after cutting their trip to only 4-days. 8 Owner of Sandbox on the Beach, Roger Esslinger hanging on like every other business owner on Siesta Key. The property has been vacant for more than 2-months. He purchased the short term rental properties 20 years ago and in the last three years, he’s endured a hurricane, red tide and now the coronavirus.

Don’t feel blue, celebrate It’s funny how some holidays float around like boats at high tide. For example, Easter is the first Sunday after the first full moon after the vernal equinox. Try explaining that to a fouryear-old. One very religious holiday with a fixed date that is celebrated by 21-year-olds and above all over the world is Cinco de Mayo. In 1950, the separate celebrations for each of the armed services were consolidated to this day. There have been many heroes since the days of the revolutionary army, but we are not celebrating them. The ones we are saluting may not even be “heroes” in the accepted sense of the word, but we are celebrating their commitment to service, and without them we would be in deep, deep trouble. They are the living, still serving, men and women of today’s armed forces. While some are true heroes, our armed forces would not properly function in protecting us without all of them. They serve in Iraq, Syria, Afghanistan, and in many other places so we don’t have such conflicts. Now, they serve on the home front by providing logistical support against the new scourge, COVID-19. We give thanks. Yet another floater, Memorial Day, was on May’s last Monday. The celebration on the 16th is for the living, and this one is for those who gave it all - those who died serving our country. You don’t have to say much, but do think, remember, and give thanks to all.

Sarasota Garden Club awards college scholarships The Judith Woodbridge Schneider Scholarship Fund and the Sarasota Garden Club awarded three scholarships totaling $8,000 to Sarasota high school graduates who will enter study in Natural Sciences. The presentation was held at the Sarasota Garden Club on Monday, May 18, 2020. Neither Covid-19 nor rain dampened the enthusiasm of the gathering of students and club members. Two high school students were presented with $2,000 scholarships and a $4,000 college scholarship was presented to a student to complete a second year of college.

And most of the time, you stand at the toilet and nothing comes out!” “Ah, that’s nothing”, said the 70year old. “When you’re seventy, you don’t have a bowel movement anymore. You take laxatives, eat bran, you sit on the toilet all day and nothing comes out!” “Actually,” said the 80-year old, “eighty is the worst age of all.” “Do you have trouble peeing, too?” asked the 60-year old. “No, not really. I pee every morning at 6:00. No time is ever a good time to cross paths with a grizzly bear. But early spring, when the creatures are emerging after a long winter of hibernation, is especially bad timing. They’re hungry, mean and perhaps a bit groggy as they head out of their dens ready to reclaim their territories. Perhaps former FCCI CEO Craig Johnson was similarly disposed after too many weeks of self-imposed ‘Safer at Home’ exile with no televised or live sporting events, trips to the gym or golf outings with his buddies to help redirect his own animal spirits. Or maybe he just forgot how to act in public after being locked down for so long. It happens. Just ask Joe Biden. In any case, after a recent trip to the Wicked Cantina on the North Trail with his son Nathan Johnson, 22, and a friend of his son, Ethan McGregor, also 22, Johnson, 51 probably wishes he had extended his hibernation a bit. According to police reports, the trio got into an argument with the restaurant’s manager who said the men were drunk and belligerent with other restaurant patrons. The manager said he asked them to leave but they refused. Strike one. The police were called and after they too failed to get the men to leave, things allegedly turned physical. Strike two. According to the Sarasota Police Department report the three became physically
aggressive. The elder Johnson reportedly cited his friendship with Sarasota Sheriff Tom Knight and said the officers would ‘pay.’ Johnson was arrested and charged with trespassing, resisting arrest and battering officers. Meantime, his son was charged with battery on a law enforcement officer, resisting arrest and trespassing after allegedly punching an officer. Twice. McGregor was charged with resisting arrest. All three denied the charges against them. The men were released after posting bail, but the worst was yet to come for Craig Johnson. The Tuesday after his arrest, his employer, FCCI Insurance, one of Sarasota County’s largest with over 500 employees, released a statement saying it was in the best interest of the company to terminate him. Strike three... ...thus concluding a stunningly fast fall from grace played out against the backdrop of a modest Mexican cantina on Sarasota’s North Trail. One minute you’re sipping margaritas from a salt frosted mug. You’re the CEO of a major company pulling in the big bucks. In the words of Johnson’s attorney Derek Byrd you’re a respected ‘pillar’ of the community... The next? You’re a pillar of salt. What a hangover that’s gotta be.
Still Thrilled About Super Bowl Coming to Tampa Bay? If you look at the state of Florida’s online Covid-19 Data and Surveillance dashboard it clearly shows the epicenter of the state’s outbreak as being in South Florida. And if you zero in on the border between the two hardest hit South Florida counties, Dade and Broward, you’ll find Hard Rock Stadium and perhaps recall that was the site of a major event in early February just before the wheels fell off and the current coronavirus pandemic started ramping up. That right, Super Bowl LIV. Millions of visitors from around the world came
to the Dade/Broward area for a weeklong party leading up to the game. It stands to reason that may have contributed mightily to the elevated cases of the virus in that region compared to the rest of the state. So perhaps you might want to curb your enthusiasm about Super Bowl LV coming to this region this coming February.
Imprisoned by Fear? There is something to keep in mind to temper the dire warnings the media is bombarding us with daily regarding the current pandemic. If you’re under sixty, the chances of dying of it are about 1-in-a-1000. That is of course unless you happen to be a Chinese scientist who may know the truth behind its origins near Wuhan, China. In that case, well...you’re toast.
It Must be in the Genes... Imagine having one of your kids named Valedictorian at their high school and the other being named Salutatorian...at the same high school...in the same year. How is that even possible you might think, given the odds against two siblings even being in the same class? One got left behind? One skipped a grade? No...Vin and Nick Sherwin of Suburban Tampa are twins graduating this semester from Strawberry Crest High School in Hillsborough County. Not just twins, Identical twins. Even their GPAs are virtually identical. Vin’s grade point average was 851 while his brother Nick came in at 850. Both made their mama proud and will attend her alma mater, the University of Florida, in the fall; and both will study biomedical engineering. They even plan on rooming together and will certainly continue to motivate each other along the way. If past is prologue, I have a feeling we’ll be updating this story in four years...or given their competitive spirits, maybe three.

After donning life jackets and given instruction, our flotilla of 7-persons-aboard- 4-crafts took off at 6 pm in the wake of our intrepid leader, Capt. Brian King. We pulled out from the Fish House dock, ducked beneath Blackburn bridge, and headed north up the inland waterway. Midway past Casey Key, we cut the engines to admire an Osprey nest built high atop a marker post. One tall, stately parent-bird stood glaring at us with glittereyes. Nearing the southern tip of Siesta Key, we slalomed along at a white-knuckled clip riding each other’s wake. Brian motioned us to throttle down and move slowly as we passed a small muffin-shaped island to watch as a vast collection of birds settled in for the night. I saw pelicans, cranes, blue herons, and redstarts, while roseate spoonbills added a spectacular splash of color. We passed beneath Stickney Point Bridge and flew like motorbike riders across a wide stretch of the bay before slowing through narrow waters near Siesta Key’s east side—water inhabited by manatees. We drifted past beautiful homes at rocking-chair speed, waving at people drinking margaritas on their docks. Ducking beneath Siesta Key Bridge we headed for Big Pass, our small flotilla racing through choppy waters. We circled the tip of Siesta and entered the open Gulf, whereupon sighting a group of dolphins, we turned off the engines to watch them play.
After cutting across the pass, we pulled our wave runners onto the sands of Lido Park, where we took turns riding solo for a cell-phone-video moment. The Johnson family of four from Richmond hammed it up for the camera, as did my son, Kevin, and I. Captain Brian King served as the experienced beachside videographer. Now it was home-again-homeagain through the bay to the northern tip of Casey Key, where we abandoned the crafts and ran up the dunes to witness a worldclass sunset. (Another photo-op!) Returning to the Casey Key Fish House dock at about 8 pm, we signed up for a table and headed for their Tiki Bar to wait. The Fish House lived up to its reputation, and the meal proved superb! What a way to end a perfect day! Capt. Brian King is the man behind the adventure. He and his wife, Sharon, started the business in 1993, after watching a guy run an incredible jet ski business in Ft. Meyers Beach. Brian had been into Motor Cross, engines, and going fast, so jet skis were a perfect fit. The King’s built a floating deck, bought 4 brand new jet skis with an assortment of life jackets, got a credit card machine, and opened at Fisherman’s Wharf in Venice. Brian knew he had found his niche: from the very first day, the business was successful,They opened a second location in 1995 in Englewood where they were the only game in town. They sold Englewood in 2016. Says Brian, “The new guy in doing fantastic! I trained him well!” Today, both the Englewood and Casey Key sites can be booked on line at www. IslandJetSki.com. In March of 2013, the King’s left Fisherman’s Wharf in Venice in and moved to Casey Key Fish House, just in time for Spring Break. They started with wave runners, kayaks, and paddle boards, and eventually moved into pontoon boats. (They now have a fleet of four.) These boats are good for up to 12 people, while their jet skis will hold up to 3. “We never charge per passenger,” says Brian. “We only charge for the boat.” Prices are available on their website. They will not start to incubate until all the eggs are laid so it is possible for there to be a nest on the ground and no adult at the nest. If a nest is predated before the entire clutch [has been] laid, the female will lay the remainder of her eggs elsewhere.” Wilson has asked that the public to please keep in mind the following: • Do not feed birds or leave trash at the beach. • Keep dogs off the beach. (County regulations forbid dogs on the public beach, anyway.) • Give the birds space and stay away from posted areas.
Pregnant manatee rescued Mote Aquarium’s Stephanie Kettle reported that an injured manatee was rescued near Harbor Towers Yacht & Racquet Club on Siesta Key on Mother’s Day weekend. After the manatee exhibited abnormal behavior, a concerned citizen called Mote’s 24/7 Stranding Investigations Program hotline (941-988-0212). After Mote arrived on the scene, it turned out that it was the same distressed manatee they had received calls about the day before, but they had previously been unable to locate her. The manatee had evidence of healed and fresh boat strike wounds, likely causing air to be trapped in its chest cavity, making submersion difficult. Given the heavy boat traffic and the likelihood of additional future collisions, the manatee was removed through the coordinated efforts of Mote, Florida Fish and Wildlife Conservation Commission, Sarasota Police Department, and Sarasota County Sheriff’s Office. Mote reported that the injured manatee was transported by truck to rehabilitate at SeaWorld Orlando, one of four critical care facilities for manatees in the state of Florida and a member of the Manatee Rescue & Rehabilitation Partnership. During the veterinarian exam at SeaWorld Orlando, the manatee was found to be pregnant. In a happy turn of events, on Tuesday, May 11, the manatee gave birth to a healthy calf. SeaWorld Orlando’s rehabilitation team continues to monitor both mother and calf around the clock. SeaWorld Orlando is proud to be one of four locations in Florida designated for critical care of manatees, and reports that this is the 17th manatee treated there so far in 2020.

recently awarded by the Martha Leiter and Nancy Streetman Fund of the Community Foundation of Sarasota County, Key Chorale was able to reach out virtually to thousands of singers with their Come Together Choir Online Choral Rehearsals. These rehearsals weren’t just for local singers, but could be experienced by anyone, anywhere in the country via Key Chorale’s YouTube channel. Viewers registered in advance to receive PDF copies of the music to be rehearsed during these online choral rehearsals. Vital components of Key Chorale’s mission are “transforming lives through innovative programming” and “service to the community”. Even after these two months of isolation, many organizations have entertained viewers online, but few organizations have enlisted actual participation at the level of this endeavor, nearly 400 registrants from throughout the country and beyond, and more than 4,000 views of the episodes. Though the weekly rehearsals have already premiered, all episodes are always available to watch on Key Chorale’s YouTube channel. If you missed it, you can still register to get PDFs of the music and sing-along with the 6 episodes. “Innovation and service are in the DNA of Key Chorale. We were pleased to provide the therapeutic value of making music, not only to our Sarasota friends of the Off Key Chorale and Where Are My Keys? A sign on the move, so to speak In late April, a reader told the SNL that it appeared that the Siesta Village welcome sign at the north entrance to the Village had been moved further from the entrance to the Whispering Sands condominium complex. When the SNL inquired about that, Lisa Cece, special district coordinator for the county who serves as the liaison to the Siesta Key Village Maintenance Corp. (SKVMC), had an explanation. “The Siesta Key Chamber of Commerce manages
and maintains the north and south Siesta Key Village signs,” Cece wrote in an email. Gabe Hartman, a member of the Chamber board of directors who also serves as manager for the Maintenance Corp., recently suggested that the north Village sign be moved to a more visible location, Cece continued. The area where the sign originally was placed has mature landscaping, she noted, which obscured the sign. Therefore, Hartman proposed the relocation
to Mark Smith, the SKVMC president. Both the SKVMC and Chamber agreed to that, Cece added. On April 22, the sign was relocated to the landscape bed just south of Whispering Sands Drive, she noted. Landscaping will be added, she continued, “and lighting will be extended to this location to feature the sign at night as visitors and residents enter the Village.” Cece also pointed out that a project is in progress in the Siesta
Village Public Improvement District to replace many landscaping areas in the midsection with new plantings, after the beds have been leveled and irrigation has been updated. “The District has also recently completed pressure washing of the walkway areas as requested by the SKVMC,” she noted. — surveyed their members on the paid-parking proposal. “Their surveys were slightly different,” Maio added. However, if he recalled correctly, he continued, “A very high percentage” of respondents wanted to ensure that if the commission chose to implement a paid-parking program, all county residents would be able to park for free. Moreover, Maio said, the vast majority of respondents wanted to see at least some of the funds the county collected go toward extending the life of the Siesta Key Breeze, the open-air trolley, which is free to riders. State grant funds have supported the Breeze’s operation since it was launched in March 2017. “I would agree with that observation, as well,” Collins told Maio, referring to putting the parking revenue to use on Siesta. Collins did recommend that if a paid-parking program were to be put in place, the commission implement it at both Siesta Public Beach and Turtle Beach at the same time. Otherwise, he said, too
should provide the answer about the percentage of county residents, compared to others using the parking lots. “We need that,” Commissioner Christian Ziegler said. Ziegler also concurred with Maio about parking revenue being directed to transportation projects on the island, including, perhaps, the operation of the Breeze. “Also makes a lot of sense to make [parking] free for all county residents,” Ziegler added.

Transportation very little room to work …” He noted that the county will be assuming authority over Siesta roads later this year, in a swap with the Florida Department of Transportation (FDOT), so the latter has control over River Road in South County. “It’s important … we have some ideas,” Anderson continued, for more creative means to alleviate traffic congestion on the island. Among the 18 proposals identified in the study, Collins pointed out, are creating protected pathways for bicyclists, as five different sections of roadway provide slim space for them between motorists’ lanes and sidewalks. “It’s a very uncomfortable feeling,” he said, for bicyclists to have to be so close to vehicles. Collins also talked about the lack of sidewalks on the east side of South Midnight Pass Road in the vicinity of Old Stickney Point Road, a situation which prompts people to walk in the road. “I certainly support sidewalks,” Commissioner Nancy Detert told him. “We should have had sidewalks a

Commissioner Ziegler indicated strong interest in that idea. “I think that’d be a great service.” If motorists had such information, Ziegler added, that would eliminate “driving around for 30 minutes, trying to find a parking space.” “That roaming effect … does add to congestion,” Collins replied.

manager of the county’s Transportation Planning Division, to offer comments from her nonprofit’s board, the Siesta Key Chamber of Commerce and full-time residents “who utilize [the Beach Road/Midnight Pass Road] intersection frequently.” “There is no support for a roundabout at that intersection,” Luckner pointed out. “Everyone was familiar with roundabouts and most use them in other locations.” Among the comments she had received in regard to ways to improve the intersection, Luckner noted, were the following: • Extend the right turn lane farther along Midnight Pass Road on the approach from the north — in other words, for traffic heading to the public beach. “This might reduce traffic backup for left turns,” Luckner added. • Extend the right turn lane option farther south on Midnight Pass Road for traffic approaching the intersection of Beach Road from the south. “This could reduce [backups] for those driving north on Midnight Pass.” • Install crosswalk signals with a countdown feature, for pedestrian safety. • Remove vegetation to improve visibility at the pedestrian island; cyclists and pedestrians then would be safer as they traveled to and from the entrances to the public beach. “At present,” Luckner continued, “everyone agreed the timing of the intersection traffic light is efficient. The light timing responds well to the volume of traffic.” The only thing that would be better, she noted, would be having a Sheriff’s Office deputy directing traffic when the volume is high. Flashback to 2014 In 2014, after FDOT first proposed a roundabout at the Beach Road/Midnight Pass Road intersection, members of the County Commission at that time raised questions about the project. FDOT staff had let the board members know that the plans were “pretty set in stone.” However, then-Commissioner

Nora Patterson, who lives on Siesta Key, told the News Leader during a Jan. 10, 2014 interview, “Nothing’s set in stone if there’s a big uprising about it.” Additionally, thenCommissioner Christine Robinson, a Venice resident who regularly traveled the Key, conveyed to the SNL her fears about clogged traffic in both directions on Beach Road if the roundabout were constructed. “During season, it is not uncommon for traffic to be backed up,” Robinson noted. However, at least drivers who want to head south at the Beach Road intersection with Midnight Pass Road can take advantage of the traffic signal to do so, she continued. If motorists had to negotiate a roundabout, with heavy traffic feeding into it from both directions, Robinson asked how a person who wanted to head toward the southern part of the island would be able do so “without something there saying, ‘Your turn.’” Robin Stublen, then communications specialist for FDOT’s District 1 staff, told the SNL that he understood the roundabout had been the focus of presentations to the County Commission. Yet, Robinson told the SNL that the only discussion held about the project had been among the members of the Sarasota/
Manatee Metropolitan Planning Organization (MPO), which deals with transportation issues for the two counties. “We never talked about [the roundabout idea] at a commission meeting,” Robinson pointed out to the SNL. A year later, in 2015, FDOT had backed away from the roundabout proposal. During the Jan. 19, 2016 meeting of the Siesta Key Condominium Council, Commissioner Alan Maio — who won Patterson’s District 4 seat after term limits forced her to step down — noted the status of the plans. When FDOT held a public meeting in March 2015, which was “extremely well attended,” Maio said, a clear majority of attendees opposed the roundabout idea. Afterward, he added, FDOT staff members dropped the proposal. “They promised me that they would call me if it gets any life back to it,” Maio told the Condo Council members, referring to FDOT staff members. None of the commissioners — including Maio — offered comments on May 5 about the revival of the roundabout proposal. Protection for sea turtle hatchlings provided at Access 2 New questions arose recently about another issue involving Beach Access 2. In response to SNL questions, county Media Relations Officer Brianne Grant wrote that, on April 23, county staff put up fencing in the vicinity of Beach Access 2 that stands about a foot high and looks similar to a black tarp. The goal, she said, is to shield nesting female sea turtles and their hatchlings from light. “Hatchlings are especially vulnerable since the extra time spent crawling in the wrong direction depletes their small store of energy,” she wrote. The material actually is silt fencing, she noted, which is designed to keep sediment at construction sites from ending up in waterways. “Beach Access 2 is a unique situation where the road is directly adjacent to the beach and at the same low elevation,” Grant explained. No other such fencing is planned on the county shoreline, she added. “Sarasota County protects threatened and endangered sea turtles through the implementation of the county’s Marine Turtle Protection Ordinance,” she continued. “Staff conducts seasonal inspections during nesting season (May 1 – Oct. 31) working with coastal property owners and managers on lighting, recreational item storage, and coastal construction planning to reduce impacts to nesting females and hatchlings. These impacts may include disorientation due to artificial light sources or entanglement in various items on the beach, such as chairs.” Grant also pointed out, “Last year, the County installed a similar ground-level barrier” around the time sea turtle nests were expected to hatch. Staff erected the barriers earlier in the season this year, she explained, “to address issues during both the nesting and hatching windows. County staff will continue to work with Marine Turtle Permit Holders and the Florida Fish and Wildlife Conservation Commission for current nesting information and appropriate protection measures. We thank the coastal residents and visitors as they ‘Keep Light Out of Sight’ each year for turtles.”

Virtual Happy Hour Offers Real Discussion As it awaits a return to inperson networking, the Siesta Key Chamber of Commerce hosted a virtual happy hour May 22nd. The Zoom event served as a kick-off to the three-day weekend and gave Chamber staff an opportunity to connect with members, for all practical purposes, face-to-face. The happy hour invitation included cocktail recipes from Cafe Gabbiano Italian Restaurant & Bar, Gecko’s Grill & Pub at Stickney Point, and Mattison’s Forty-One. “These make-at-home recipes gave us another opportunity to spotlight some of our members during the COVID-19 crisis,” said Rachel Dixon, Promotion & Event Coordinator. The event was attended by Chamber members, volunteers and staff. The membership was largely represented by sales and marketing professionals. “If you’re a sales person you’re likely a people-person and working from home has been difficult for your personality, not to mention hard on your wallet,” commented Nancy-jo Manney, the Chamber’s membership director. Mia Leone, manager of the Siesta Key Visitor Center participated in the online happy hour. Several of her volunteers, who mentioned they’re now well-versed in the art of Zoom, joined in the dialogue which included discussion of when the Center may reopen. No specific date was confirmed but Leone was eager to open when safe for volunteers and visitors.
