AI Feelings

T

here’s no question AI-enabled technology tools are helping agencies become more efficient. From chatbots to advanced data analytics and coverage comparisons, AI is making huge advances in efficiency for the insurance industry. “It’s sort of funny. If you asked me a year ago, maybe two years ago, ‘What am I thinking about AI?’ I would say I’m sort of ignoring it, hands over the eyes and the ears and the mouth,” Matt Masiello, CEO of SIAA, told Insurance Journal. “Now we’re implementing business intelligence and AI.” Even so, there seems to be a growing negative sentiment throughout the insurance industry, more notably at the carrier level. A new report, Glassdoor’s Employee Confidence Index, highlights insurance industry employees’ growing negativity toward AI job displacement, as sector employment dropped 21% year-over-year and entry-level adjuster positions dropped 50% YoY. Glassdoor noted that for its broader AI Report, confidence hit a record 10-year low in July, and a large percentage came from the insurance sector. From July 2025 to July 2026, employee confidence in insurance dropped 7 percentage points, noted authors Chris Martin, senior economist with Glassdoors Economic Research team, and Indeed Hiring Lab economist Feliz Aidala. The extremely negative sentiment toward AI is driven by fears of AI-based job replacement, the push to use AI tools, and AI degrading work or product quality. From late 2023 to early 2024, overall insurance industry employee confidence dropped significantly (in line with a broader decline in employee confidence) but rebounded until May of 2026. With the industry’s confidence at an all-time low, claims adjusters were found to be the most critical of AI (98%) in Glassdoor reviews. This is telling, since the industry’s confidence had been tracking higher than other industries historically. Postings for claims adjusters are down 55% from their post-pandemic peak, the report showed, compared to a 36% decline in the broader labor market. The study found that: • Claim adjusters represented 18% of jobs lost but comprised only 2% of the industry. • Insurance carriers shed nearly 75,000 jobs YoY. • Demand for inexperienced workers has collapsed, with entry-level adjuster job postings down 50% since 2025, data showed. • Inexperienced claims adjusters often follow specific formulas that can be outsourced to agentic AI, the report authors noted. • Senior-level job postings remain about 80% above 2017 levels. • Overall, Glassdoor reported that AI sentiment across all jobs/industries was 53% negative. The authors indicate that while there could be other factors at play, insurance industry employees are putting the blame squarely on AI. News & Markets GEICO Avoids Class Action Over Totaled Vehicle Payouts in New Jersey By Andrew G. Simpson

A

federal judge has declined to approve a class action lawsuit accusing GEICO of underpaying losses for totaled vehicles in New Jersey. The court declined to approve the class action after concluding that individual issues outweighed the commonality of the proposed class. The purported class action sought to challenge GEICO’s use of a factor, also used by other insurers, that adjusts the actual cash value (ACV) of a vehicle to account for the condition of the vehicle based on factors such as options and mileage, or as otherwise explained “to bring the ACV from retail to private party condition.” Jessica Dinicola-Ortiz alleged GEICO contracted to pay her and class members the actual cash value for their totaled cars, but GEICO’s condition adjustment unlawfully changed that value. She alleged that GEICO underpaid her, and she further maintained that GEICO similarly illegally adjusted the values for potentially tens of thousands of other New Jersey claimants. The GEICO policy defined ACV as “the replacement cost of the auto or property less depreciation or betterment.” GEICO determines a vehicle’s ACV using a report from CCC Intelligent Solutions that calculates a vehicle’s ACV based on the computed values of purportedly comparable vehicles recently sold or listed for sale within the insured’s geographic area. CCC starts with the average retail price of vehicles of the same make, model, and year as the insured vehicle. CCC then makes “adjustments” to that base value that may be upward or downward based on factors such as options, mileage, and others. That adjustment was the focus of the underlying claim in the class action case. Renée Marie Bumb, chief judge in the U.S. District Court for New Jersey, found that Dinicola-Ortiz could proceed with 8 | INSURANCE JOURNAL | SEPTEMBER 21, 2026

her individual claim alleging that GEICO underpaid her but that the class action against the insurer could not be certified. The judge had two recent federal appeals rulings to support her decision to deny certification. Judge Bumb looked to a 2024 Third Circuit Court of Appeals opinion (Lewis v. Gov’t Emps. Ins. Co.) that held only people who received less than their totaled vehicles’ ACV have standing to bring ACV claims. Even if the insurer’s process is flawed, standing demands an actual, not theoretical, injury. “Windfalls are not actionable,” the court noted. The district court judge also referenced a 2025 opinion (Drummond v. Progressive Specialty Ins. Co.) in Pennsylvania in which the Third Circuit held that courts generally may not certify a class challenging whether an insurer paid class members actual cash value for their totaled vehicles. The appeals court found that individualized questions predominate over questions common to the class. Applying Lewis, the judge held that Dinicola-Ortiz plausibly alleged the

The Drummond court found that courts generally may not certify a class challenging whether an insurer paid class members ACV for their totaled vehicle. To start, the amount an insurer must pay its insured is set by each individual vehicle’s ACV, and then how much an insurer actually paid each insured must be considered. “Because two essential elements of breach of contract—duty and breach—required plaintiff-specific proof, individualized evidence ‘overwhelmed’ class evidence, and the claims were unsuitable for class treatment,” the district court quoted from the Drummond case. Judge Bumb noted that the situation is the same in the Dinicola-Ortiz matter. That is, every proposed class member would have to furnish individual evidence of their vehicle’s ACV and that GEICO paid them less than that amount. “Those individualized assessments eliminate any efficiency gained through a class action,” she concluded. The agreement represents one of the largest data breach settlement amounts and, with 31.7 million potential members, one of the largest classes in a data breach case. Comcast customers complained about a data breach that occurred between October 16 and 19, 2023. Comcast did not notify affected customers until December 18, 2023 — roughly two months later.

A Delaware judge has ordered data analytics firm Verisk to try to complete the planned acquisition, with the order coming more than seven months after Verisk said it pulled the plug on the deal. The Illinois law prohibits e-bikes and micromobility devices such as e-scooters, electric skateboards, and electric unicycles from operating on sidewalks, and prohibits them from operating over 28 mph on roads, bike lanes, and bike paths.

Florida Saves Billions

Both are functions of declining costs promised by reforms.”

— A new actuarial report from the American Property Casualty Insurance Association that found, overall, Florida policyholders paid almost $3 billion less in premiums in 2025 than the year before. Average homeowner insurance rates in Florida did not decline in 2025, but they increased by less than 1%.

— U.S. District Judge Emily C. Marks denying State Farm’s bid to remove a case brought by 53 homeowners out of Houston County Circuit Court and into her federal court. However, she decided against ordering State Farm to pay the homeowners’ attorneys’ fees.

Fire Recovery Funding

— Traci Park, the city council member for the Palisades who sponsored motions to approve a move by nonprofit Uplifters Foundation to build new $3 million houses in the disaster area by issuing as much as $250 million in municipal bonds through the California Public Finance Authority. The bond deal requires no financial commitment from the city or other taxpayer-backed agencies.

— Miguel Rodriguez, chair of Texas’s Motor Vehicle Crime Prevention Authority and Laredo police chief, defending the state’s Flock camera policies. In 2023, the Texas Legislature passed a law raising Texas auto insurance costs by $1 to combat catalytic converter theft. The Motor Vehicle Crime Prevention Authority has turned the $1 fee hike into at least 3,200 Flock cameras.

Climate Repair Overreach

“New York’s law would have expropriated $75 billion from energy companies around the world during an energy emergency and in direct defiance of American foreign policy and federal law.”

— Adam Gustafson, a principal deputy assistant attorney general after New York’s attempt to make fossil fuel-producing industries pay into a $75 billion fund to repair the damage wrought by climate change was struck down by a federal judge. The judge said the law reaches beyond a state’s responsibility and into an area of federal interest. The law had required companies responsible for greenhouse gas emissions to collectively pay $3 billion a year over 25 years into a fund for infrastructure projects. Global Insured Catastrophe Losses Expected to Average $171 Billion Annually: Verisk By L.S. Howard

T

he insurance industry should be prepared to withstand $171 billion in insured catastrophe losses on average in a given year, up $19 billion from a year ago, according to Verisk. In its highest annual estimate reported to date, the data analytics and technology provider said the industry’s loss benchmark increased despite the fact that the U.S. in 2025 had no hurricane landfalls for the first time in a decade. The rise reflects continued growth in property values and insured values worldwide, Verisk added. “A quiet hurricane season can lead markets to respond as if risk has eased: rates soften, insurers keep more risk on their own books, and more capital competes to write new business,” said Rob Newbold, president of Verisk Catastrophe and Risk Solutions, in a state-

ment accompanying the report. “But 2025 reminds us that the underlying risk landscape has changed and years without significant losses from U.S. hurricane activity no longer signal a quieter catastrophe environment.” Verisk explained that a year without a U.S. landfalling hurricane can lull the market toward thinner pricing and looser underwriting terms, “precisely when discipline matters most.” “The $171 billion figure is not determined by the outcome of one hurricane season or one year of catastrophe losses,” according to Dr. Jay Guin, executive vice president and chief research officer of Verisk Catastrophe and Risk Solutions. “It reflects a wide distribution of potential events across perils and regions, using current exposure data and a view of hazard grounded in the near-present climate. That broader perspective helps the industry prepare for loss

scenarios that historical experience alone may not reveal.”

New Normal for Global Insured Cat Losses

For the sixth straight year, global insured catastrophe losses exceeded $100 billion—a result driven not by severity perils like earthquakes and hurricanes but by record-setting wildfires and significant severe thunderstorm activity, which produced widespread hail, wind, and tornado damage across many communities rather than a single catastrophic event. (Editor’s note: These frequency perils are also known as secondary perils.) “A more dynamic risk environment underscores how catastrophe models help insurers maintain underwriting discipline and make informed pricing, capital allocation, and risk transfer decisions based on the full range of risk, not just the outcome of a single season,” Newbold added. Verisk provided additional

insights to put the benchmark number into context. The United States accounts for the majority of modeled insured catastrophe risk—or 68% ($117 billion) of the $171 billion benchmark. Severe thunderstorm accounts for 40% of modeled insured catastrophe risk—more than any other peril. These so-called severe convective storms (SCS) remain the largest contributor to Verisk’s global insured AAL, ahead of tropical cyclone (at 27%), earthquake (10%), winter storm (9%), flood (7%), and wildfire (6%). Frequency perils, rather than a single hurricane, continued to drive industry losses in 2025. A severe catastrophe year could generate losses nearly three times higher than the global insured AAL. The report examined increasingly severe, but plausible, loss scenarios: At the 100-year return period—commonly used in the industry to describe a scenario with a 1% annual likelihood— modeled aggregate insured losses reach $477 billion. At the 250-year return period, losses reach $606 billion. Verisk explained that its global insured average annual loss (AAL) figure of $171 billion is not a prediction of losses in 2026, or in any other individual year. “Rather, it serves as a benchmark insurers can use to evaluate potential losses across a wide range of events, perils, and regions.” Since Verisk began publishing its benchmark report in 2012, the estimated global insured AAL has nearly tripled, rising from $59 billion to $171 billion, the report said. reflects its investment in expanding model coverage to more than 20 additional countries and regions; advances in science, data, and modeling methods; updates to Verisk’s view of risk; and growth in insured exposure.

Other Factors Driving Higher Losses

Catastrophe losses are shaped by more than the number or severity of storms, wildfires, or earthquakes in a given year, Verisk said, pointing

to higher property exposures, rising rebuilding costs, and the fact that more people and property are located in hazard prone areas. Verisk went on to detail the long-term trends that are combining to increase insured catastrophe losses independently of weather patterns. Property exposure in the countries Verisk models has grown roughly 7% annually since 2021, driven by both new construction and rising asset values.

In the United States, residential reconstruction costs have risen about 5% annually since 2021, outpacing consumer inflation and increasing the potential cost of catastrophe losses even when hazard activity remains unchanged. Population growth continues to be concentrated in catastrophe-exposed regions, while development expands in flood plains, wildfire zones, and other high-risk locations. In England, for example, 7.1% of single-family homes

already sit in the 100-year flood plain, and 1-in-9 new homes built between 2022 and 2024 were built in flood-risk areas, which Verisk warned could rise to 1-in-7 new homes by 2050. Verisk said its 2026 Global Modeled Catastrophe Losses Report is produced using the same suite of catastrophe models and software used by Verisk’s insurance and reinsurance clients, covering more than 120 countries and regions.

First-Half US P/C Industry Underwriting Gain Jumps to $31.7B

he U.S. property/casualty insurance industry posted a much higher net underwriting gain of $31.7 billion for the first half of 2026, up from $11.6 billion the prior year. According to a report from data analytics and technology firm Verisk and industry trade association the American Property Casualty Insurance Association (APCIA), net written premium growth for the industry slowed to 2.1%, compared with growth of 5.2% a year ago, showing an overall shift to moderated rate increases. Property insurance softened during H1, but casualty lines such as excess liability, umbrella liability, and commercial auto remained under pressure from increased claim severity, nuclear verdicts, and medical costs, Verisk and APCIA said. Net income after taxes increased 53% to $77.8 billion for the first half of 2026. More gains from investments bolstered profitability, but “catastrophe exposure remains elevated,” the groups warned. “While overall industry INSURANCEJOURNAL.COM

profitability improved in the first half of 2026, largely due to a decline in insured natural-catastrophe losses compared to the first half of 2025 following the Los Angeles wildfires, insurers’ loss experience and profitability varied widely from state to state,” said Robert

Gordon, senior vice president of policy, research, and international at APCIA. “In states that have enacted meaningful legal system abuse reforms, including Florida, Georgia, and Louisiana, many policyholders have begun to experience reductions in auto

and homeowners insurance rates that are expected to provide hundreds of millions of dollars in premium relief,” Gordon added. Policyholders’ surplus increased to $1.30 trillion, compared with $1.13 trillion at midyear 2025.

News & Markets Judge Throws Out Bulk of Economic Claims Over Baltimore Bridge Tragedy By Andrew G. Simpson

A

federal judge has agreed with the owner and manager of the Dali cargo ship responsible for the collapse of Baltimore’s Francis Scott Key Bridge that the bulk of the remaining claims against them for economic damage are invalid. On August 25, U.S. District Senior Judge James K. Bredar dismissed most of the economic damage claims by the city and county of Baltimore and eight consolidated claims by private entities including insurers. Citing a 1927 Supreme Court opinion (Robins Dry Dock & Repair Co. v. Flint), Bredar found that the public and private entities that have sued are precluded from recovering economic losses resulting from physical damage to the Key Bridge because they had no proprietary interest in the bridge or other property. Instead, Dali owner Grace Ocean Private Ltd. and operator Synergy Marine Group can only be held liable for economic losses if there was damage to property owned by the claimant. In keeping with the Robins precedent, the city may pursue its claim related

to alleged damage to the 72-inch water main below the river and the county may proceed to try to prove it has a proprietary interest in damaged waterways and shorelines. Also, four cargo damage claims may proceed. Since most of the original 54 civil claims already have been settled or voluntarily dropped, the ruling actually dismissed a relatively small number of cases. None of the civil settlements contain an admission of wrongdoing by Grace Ocean or Synergy. The Francis Scott Key Bridge collapsed in the early morning hours of March 26, 2024, after being struck by the Dali as the vessel departed the Port of Baltimore. The collapse killed six construction workers, obstructed a major shipping channel, and disrupted commerce and traffic in the region. In addition to dismissing other claims by Baltimore city and county, the ruling throws out unsettled claims for private economic damages by longshoremen, energy, export, manufacturing, construction services, technology, sugar, molasses, and publishing firms along with related insurers including Markel, Liberty Mutual, QBE, AXA XL, Evanston, and Canopius. These parties had been seeking damages for losses due to business interruption, declines in advertisement and directory revenue, increased shipment costs, lost taxes and economic revenue, among other alleged losses. The private entities, except for those pressing the four cargo damage claims, were judged to have no proprietary interest in any damaged property.

Limited Liability

On April 1, 2024, Grace Ocean and Synergy Marine filed a petition to limit their liability for the bridge collapse.

They invoked the Limitation of Liability Act of 1851 to limit their liability to the value of the ship, about $44 million. Since then, they have settled claims far exceeding that limit. There have been civil settlements with the federal government ($102 million) for cleanup costs and the state of Maryland ($2.5 million) for environmental damage, lost toll revenue, and broader economic disruption. The families of the deceased workers settled for an undisclosed amount for wrongful death. Also, Baltimore Gas and Electric Co. settled claims over infrastructure damage for an undisclosed amount. There have been settlements for reimbursements of workers’ compensation payments made to employees killed and injured in the tragedy. Other settlements have been for cargo losses. Several claims have been dismissed. Soon after the tragedy, ACE American Insurance Co. (part of Chubb), the property insurer for the Francis Scott Key Bridge, settled a major claim with Grace Ocean Private Limited and Synergy Marine Group by paying out its policy limit of $350 million.

Economic Losses

Grace Ocean and Synergy Marine told the court in their June motion to dismiss that since the economic loss claimants did not have an ownership interest in the Key Bridge and have failed to identify a recognizable interest in any other property that sustained physical damage as a result of the casualty, their claims “must all be dismissed as a matter of law.” During the economic loss claims proceedings, the municipalities and private businesses argued in part that any ruling should be delayed until the overall limit of liability had been decided. But the judge said that was not necessary, especially given that so many claims have already been settled including claims for wrongful death, personal injury, and physical damage. Photo: NTSB. “The Robins rule is animated by policy concerns over the potential for boundless, indirect damage claims arising from maritime negligence and addresses those concerns by imposing a bar to recover for remote, purely economic harm, not flowing from damage to person or property,” Bredar wrote. “In the final reckoning, the petitioners’ assertion that Robins would be transformative has borne out.” In addition, the city’s claim for damage to the submerged water main and the county’s claim for damage to waterways and shorelines—both of which may proceed—the government entities had also claimed other losses and costs including for replacing the bridge, disruption of city traffic, economic interruption, INSURANCEJOURNAL.COM

increased road repair and maintenance, first responders, public nuisance, lost tax revenue and fees, hazardous materials monitoring and removal, and other effects. Baltimore argued unsuccessfully that it has had a “proprietary interest in the Key Bridge since the Key Bridge’s construction” and that it sought damages for the cost of replacement of the Key Bridge and its approaches. The city has criticized what it maintains is the attempt of the ship owner and operator to “shift the costs” of alleged wrongdoing onto Baltimore residents and taxpayers. In the 1927 case, Robins Dry Dock, a dry-docking company, damaged a propeller on a steamship, rendering the vessel

unusable for two weeks longer than anticipated. The vessel’s time charterer sued the dry dock company to recover its lost profits resulting from the delay while the propeller was repaired. The Supreme Court denied recovery, rejecting the argument that the charterer was a third-party beneficiary of the dry dock contract and rejecting tort liability. The court held that the injury to the propeller did not harm the respondents but only those to whom it belonged. The U.S. Department of Justice (DOJ) has brought criminal charges against Synergy for the tragedy. Synergy has called DOJ’s allegations in the indictment “baseless” and said they have “nothing to do with” the Dali’s collision with the Key Bridge. SEPTEMBER 21, 2026 | INSURANCE JOURNAL | 17

Former AIG CEO and executive chair Peter Zaffino left the board effective September 15 to join Palantir Technologies Inc. as global head of financial services. Zaffino had just transitioned to the Peter Zaffino position of executive chair on June 1. Prior to that, he had been AIG CEO since taking over in March 2021, succeeding Brian Duperreault. Eric Andersen, most recently a member of Aon’s executive committee, became AIG’s CEO on June 1. AIG announced the succession plan in January. Zaffino will assume a role with AIG as senior advisor, the company said. To take his place on the board, John Rice, lead independent director, will serve as chair when Zaffino departs.

Aon plc confirmed a definitive agreement to buy USI Insurance Services from private equity firm KKR for $17 billion. Aon said the deal bolsters its goal to target the U.S. middle market segment, building upon its 2024 acquisition of NFP for $13 billion. The acquisition gives Aon expanded direct access to the excess & surplus market through MGAs and MGUs with USI’s wholesale capabilities. USI Chairman and CEO Mike Sicard will serve as president of Aon plc and global CEO of middle market once the deal is closed, which is expected to occur during the fourth quarter of 2026. The boards of each company have approved the deal, and the brokers will continue to operate separately until the closing date. Aon will fund the transaction and related transaction expenses with new debt. Aon expects to deliver about $395 million in annual run-rate net adjusted EDITDA from revenue and cost synergies from the deal. Aon is the third-largest broker in the U.S., behind Marsh and Arthur J. Gallagher, with about $8.15 billion in revenue.

Founded in 2019, Tower Title serves the telecommunications industry, while also servicing solar farms, wind turbines, data centers, and billboards. Telecommunications firms rely on title insurance to protect the land they lease or purchase for their data centers, cell towers, data centers, fiber optic lines, and rooftop equipment against boundary disputes, ownership claims, or legal defects. The acquisition strengthens and diversifies Stewart’s National Commercial Services (NCS), specifically the company’s Energy & Infrastructure group, by adding a complementary infrastructure business.

Pennsylvania-based Ignyte Insurance, a specialty insurance platform, has acquired InsureMyTrip, a travel insurance marketplace that helps travelers compare and purchase coverage from insurance providers. Terms of the transaction were not disclosed. Rhode Island-based InsureMyTrip reports it has served more than 6 million travelers. Its marketplace includes insurance for trip cancellation, travel medical, evacuation, cruise, student travel, and annual protection plans. InsureMyTrip will continue operating under its own brand name. Ignyte Insurance is focused on building and scaling specialty insurance brands in unique, niche markets. This acquisition enhances Ignyte’s global portfolio of travel

he race to provide more sophisticated intelligence to both agency members and carrier partners is hotter than ever among the nation’s top agency partnerships. Many partnerships are delivering better options including a path for agency members to sell their own agencies to other network members or to the network organization directly with the help of private equity investments. Nearly all are

developing technology platforms that will make the agency-network-carrier relations more effective in the future. Some are even eyeing the managing general agency (MGA) space for expansion. Insurance Journal spoke to a few agency network leaders for this special report, which also includes Insurance Journal’s Top 20 Agency Partnerships list.

Expansion

For SIAA, the future looks like an insurance ecosystem that builds distri-

bution opportunities. This could include traditional agency network distribution, wholesale distribution, retail agency distribution through its Sequel Insurance Agencies, as well as business intelligence and AI technology services for its entire distribution network. “What we’re trying to do is take the business and really develop distribution, network, retail, wholesale, product, business intelligence, and AI and wrap it all together in this one singular platform,” said Matt Masiello, CEO of SIAA. We owned two (agencies initially), and then we bought five more,” Masiello said. Then in July, Sequel announced the acquisition of Watkins Insurance Group in Austin, Texas, and at the same time SIAA completed its acquisition of Insurance Agents Alliance of Texas (IAAT), a smaller regional network. SIAA’s private equity partner since 2021, Odyssey Investment Partners, laid the groundwork for developing the retail agency channel as well as its investments in tech-enabled business intelligence through the acquisition of DONNA.ai last year.

Private equity backed acquirers have been leading the agency M&A world for years. The difference for agency network acquirers backed by PE investment is that the acquisitions often come from inside the network, and that’s a benefit to the network and its members, Masiello said. “We’ve touted ourselves as being able to help independent agencies through all the stages of their life cycle, but we’ve never really done a great job on succession,” Masiello frankly added. “We have a lot of members that sell to other (SIAA) members, and we’ll continue to see that, but for bigger agencies where we were competing with the other private equity-backed INSURANCEJOURNAL.COM

Other Opportunities for Networks?

W

hat’s next for the evolving landscape of agency networks? Could there be opportunities to expand into the world of underwriting given the vast amount of data networks analyze for their agency members and carrier partners? SIAA’s CEO Matt Masiello sees potential. “The growing MGA space is definitely interesting to think about,” he said. “We always viewed it as market access to E&S product and specialty capabilities for our member agencies…and we still look at it through that lens.” However, given the diverse array of services that agency networks now provide to agencies, carriers, and wholesalers partners, adding MGA capabilities to distribute product and build premiums for risk-bearing entities could enable networks like SIAA to become full-service distribution platforms, Masiello said. “It is good for our carrier and wholesale partners—and good for our member agencies to gain broad access to additional markets,” he said.

acquirers, we just didn’t really have a dog in the fight.” Having the capability to acquire larger firms keeps the business not only within the SIAA platform but also with its carrier partners, he said. So far, Sequel Insurance has only acquired current SIAA member agencies, but Masiello said the door is open to other acquisitions in the future if they make sense. For Greensboro, North Carolina-based Smart Choice, private equity investment has also helped the network build up a retail arm for the benefit of agency members. “It’s the reason we brought in private equity, to acquire agencies so they remain independent,” according to Andrew Caldwell, CEO of Smart Choice. Caldwell said it’s not uncommon for member agencies looking to retire to sell to other large private equity-backed acquirers. “So, we wanted to create a situation where those agencies could remain in the network, where we would retain the employees and continue to help grow the agencies,” he said. Smart Choice began acquiring member agencies in 2019 but ramped up its acquisition efforts since adding minority-interest PE funding during the middle of 2023. “That investment totally changed our business,” Caldwell said. “From a pure EBITDA standpoint, middle of 2023, we were a $10 million EBITDA company. We will finish the year at $60 million in EBITDA,” he added. In early September, Smart Choice announced that agency

membership peaked at 12,000 in 2026, up from 10,000 in late 2023.

The Right Fit

Not everyone is in favor of the private equity funding wave in the agency network world. “For some, these transactions are horrendous for the agent,” said Eric Robertson, CEO of Agents Alliance Services. “I’ve heard a lot of horror stories as it pertains to PE and even some networks buying because then they come in and they’re focused more on the bottom line, not on the agent,” he said. “Our approach is different,” he added. “We’ve brought on several really great brokers in the last year, and they’re thriving.” For some agency owners, autonomy and independence matter, he said. “They love having their own business,” he said. That’s something large organizations do not offer, he said. “There’s a control aspect in bigger organizations, and that can create a lot of shakeup, resentment, and even poor work culture.” Overall, insurance agency mergers and acquisitions in the first six months of 2026 slowed down by 15% compared with the same period last year, according to OPTIS Partners. “Several of the big, most active buyers over the past several years have significantly cut back activity,” said Steve Germundson, a partner at OPTIS, in July when releasing their most recent analysis. He noted, however, that the buying pace

picked up for emerging private equity firms and those anticipating a recapitalization or a sale soon. A few large deals could open the door to opportunities for startup agencies that could benefit from those in the agency network world. These include Aon’s acquisition of USI Insurance from KKR for $17 billion, and the purchase of Australia’s Steadfast (also the owner of ISU Network) for $5.3 billion by a U.S. consortium, consisting of KKR, The Amwins Group, and Dragoneer Investment. Robertson said there are opportunities right now for agency networks to help unhappy brokers in these post-acquisition times, and he predicts more shakeup to come because of some larger M&As. That is spurring new agency startups that agency networks are well suited to help. “There’s not a lot of motivation from a larger corporate perspective to really pay attention to the things that they need to pay attention to,” Robertson noted. “You just become a number. You’re one of a thousand,” he said. Some agents come to resent the situation. “These guys are out there beating the pavement, drumming up business. So, why are those large firms getting 60% of the commission and the broker’s only

getting 40%, and in some cases 30%. Is service work worth 60%? Absolutely not.” Keith Captain, president of MarshBerry Networks, which includes the FirstChoice agency network, said not every network or agency is the right fit. “Networks come in all shapes and sizes. Some are very small and offer very little services other than aggregation of premium for revenue,” Captain said. “Others are very large and have moved to buying agencies in an ‘owned’ agency model. Some agents will love that model because they know they have a place to sell. Other agents will absolutely hate that model because they either a) want to maintain their independence, or b) don’t think their network is the right buyer.” Captain says FirstChoice is not looking to become a buyer. “We strongly believe in helping our members make the right decision based on their needs and desires for whatever that might be—perpetuation, ESOP, agency sale, equity partner, etc.,” he said. “We think agents that join a network to sell to them are being a little short-sighted on the possibilities of one of the biggest assets they will ever own.” There are plenty of choices for agency owners to find the best fit for their needs in the network world. “I think an independent agent needs some sort of network affiliation or relationship at this point,” Smart Choice’s Caldwell said. “It’s almost table stakes.” Whatever the choice, professionally run agency networks will continue to provide services and support that help

independent agents grow their business, MarshBerry’s Captain told Insurance Journal. “We (and others) are investing in tools and resources that will allow them to have access to compete against the much larger agencies in the market,” he said. “We want them to have the ability to compete at all levels, so that means helping them with producer training, education, technology consultations, new technology for quoting, AI work, market access, increased revenue, etc., etc.” Whatever agency owners want from a network is a personal choice, network leaders say. But most importantly, Agents Alliance Services’ Robertson advises agency owners to pay close attention to the details of the network contract. “Hands down, the most important elements of your contract are the buyout provision and the non-competes,” Robertson said. “That is overlooked in so many cases. I can’t tell you how many conversations we’ve had with agents that are unhappy that they essentially have to buy their agency back to roll it out or buy 30% of it back to roll it out, and then are hit with these non-competes,” he said. Renaissance Alliance CEO Bob Bondi said networks have become a critical component in the entire insurance ecosystem. “Networks represent an opportunity for the independent agent to do what they do best, which is stay independent, by helping agencies scale their business a little bit better,” he said. Carriers also rely on networks to help bring in more premium dollars, he added. “Carriers are working more closely than ever with networks to help drive the premium in a way that promotes growth,” Bondi said. “Networks can be very helpful with that because that’s what we do all day long. We promote growth not by getting more members but by helping our existing members with true organic growth.” And the competitive spirit among the network space is a good thing, he added. “I can never see a downside to competition,” he said. Competition really helps make the entire system better. “Network competition is making everybody better, and that’s good,” he said. INSURANCEJOURNAL.COM


News & Markets Insurance Again Dominates Number of Complaints to Oregon Consumer Advocates

I

nsurance continued to be the biggest generator of complaints to the Oregon Division of Financial Regulation, according to the division, which reported it recovered $3.88 million through the first six months of 2026. Insurance produced the majority of complaints filed with more than 1,000 complaints in each of the first two quarters. Credit unions (120 complaints) and mortgage servicers (87) were other areas regulated by the division high on the list. Consumer finance (40), banking (25) and securities (47) were other big industries on the list. A few examples of cases in which DFR advocates worked on so far this year include: • A consumer bought commercial truck policy in 2024, which included errors made when the policy was taken out resulting in the correct truck not being listed correctly on the policy. The truck was totaled, and the resulting claim was denied because the vehicle was not properly listed on the policy. When

the error was determined, a consumer advocate pressed the managing general agent and the insurance agent to file claims with their errors and omissions insurance policies. The E&O insurers for the agent and the MGA agreed to a 50/50 split of damages and paid out $52,952 in damages. • When a consumer suffered hail damage to their roof, the insurer denied there

was damage and closed the claim without payment. A consumer advocate later convinced the company to have an engineer inspect the roof, resulting in the deamination there was one slope of the roof with hail damage, and areas were noted as deteriorated due to wear and tear. The insurer issued payment of $15,306.21 for the replacement of one slope of the roof.

Report: Medical Service Costs in California Comp Rising With Payments, Utilization

M

edical service costs in California workers’ compensation rose 5% last year on the back of growth in both average payments and utilization, a new report shows. The Workers’ Compensation Insurance Rating Bureau of California released its Medical Service Cost Trends report, which looks at factors shaping medical

cost growth in the state’s workers’ comp system. Medical costs accounted for 52% of the total loss payments in the workers’ comp system. Medical service costs rose moderately in 2025, and the WCIRB report shows emerging trends influenced costs across the system including: accelerating growth in certain services not subject to fee schedule reimbursement limits and increasing costs associated with cumulative trauma claims. The report shows that the categories of MedicalLegal services and Medical Equipment and Other Services were the largest

contributors to medical cost growth, with CT claims contributing to both categories. Southern California continued to drive statewide medical cost trends, with medical costs per claim increasing faster than in Northern California, the report shows. It breaks down the share of medical payments by service type. Physician Services leads with the greatest share at 48%, followed by Medical-Legal (17%) and Medical Equipment and Other Services (13%). Medical paid per claim has increased since 2020. The rise was initially due to the pandemic, which was followed by fee schedule updates, more recently increased service utilization. In 2025, the 5% paid per claim increase was driven by a 4% increase in paid per transaction and a 1% increase in transactions per claim, the report shows. emember when “candidate experience” was all the rage? It was about making applicants feel valued during the hiring journey. Unfortunately, I see most companies have shifted away from offering a personalized experience to a focus on numbers, prioritizing more resumes and applications over meaningful connections. Imagine if your recruiting process was shaped by candidate input. How different would interviews be? This guide encourages you to make small adjustments, not overhaul everything, by considering the candidates’ viewpoint.

Reimagine Interview Questions

Say goodbye to tricky “gotcha” questions. Instead, focus on inquiries that allow candidates to showcase their problem-solving abilities. Many feel blindsided by overly specific questions too early in the process, not to mention a string of profile assessments that can sometimes take hours. Initially, tailor your questions to topics that draw out their intangible qualities, determining first if they are a culture fit before getting into the technical minutia.

Re-evaluate Job Hopping

Job hopping often has a negative perception, but similar resumes can tell different stories. Market disruptions, cutbacks, and policy changes around remote work force

insurance professionals to look for new jobs. If you have hard and fast rules about job changes to screen applicants, I can appreciate the structure even if I might still argue it eliminates good people. If your review is case-by-case and based on feelings, then you’re better off having a conversation with some skepticism going in than not speaking with the person at all. In most cases, I find concern about job changes goes away with an impressive first interview.

Keep job ads concise. Most insurance professionals ultimately make a lateral move in terms of overall job responsibilities, which means a lengthy job ad is unnecessary and often goes unread. Candidates want the essentials: pay, location, and firm experience requirements. Use bullet points to highlight your must-haves and eliminate clutter. This way, you’ll attract top candidates without shifting through noise.

Spell Out the Interview Process

When you meet a candidate, this should be your first step after, “Hello, my name

is X.” Job seekers are incredibly busy, much like you are. They are interviewing other places. They have busy home lives. They work a full-time job. By Mary Newgard When you outline up front what every step will be, they become more bought in and engaged in your process. Failing to outline the process can be interpreted by candidates in two ways. One, you don’t appreciate the commitment required by them. If they start to feel this way, every request you make of them for references, applications, profile assessments, etc., will feel like a burden. Two, you don’t really know what the process will be because everything is different based on the team, hiring manager, position, etc., which is equally as problematic if they are looking for an agency they perceive to be efficient and organized.

Spin a Unique Tale

I could also call this section “The Hook.” It’s most evident when I work with agencies on producer recruiting because what sells to sales candidates isn’t the same Elevator Speech agency leaders are accustomed to using with other recruits. Why should a successful producer work for you and not your competitor? Please don’t say markets or client service because in 20 years of insurance recruiting, I’ve never had an agency tell me their market access and service staff stinks. Your value proposition must be less about what you offer and more about what you can do to solve the producer’s problems, which most commonly are earning potential, lack of growth, or lack of control.

Underwriting & Litigation Lessons Stem from NYC’s Pfizer Building Conversion Mishap

M

idtown Manhattan, the very heart of New York City, has recently been the center of attention for all the wrong reasons. As one of Gotham’s largest office-to-residential construction By Michael Coffey conversion projects, the former world headquarters of Pfizer Pharmaceuticals was found to be dangerously unstable, shutting down traffic and interrupting business along one of the 44 | INSURANCE JOURNAL | SEPTEMBER 21, 2026

nation’s busiest commercial corridors. The fallout from this event will likely not be limited to a single developer, contractor, or project. Rather, the impact will presumably reverberate throughout the industry responsible for underwriting the risks associated with this major economic activity. Insurers must now absorb and digest the forensic lessons to be learned from this event, and restructure how they treat office-to-residential construction conversion projects going forward. Office-to-residential projects have become a flagship of New York City and other metro areas around the country to

increase much-needed housing supply. New York is a city of skyscrapers, and when stately, historic pre-war buildings fall out of favor, you can’t just scrap them. Instead, you reinvent them for more modern usage—and that means residential conversion. Take the Wall Street area in Lower Manhattan. What was once a daytime hive of financial industry activity has transitioned into a thriving 24/7 neighborhood. Once gracious office towers that were home to major commercial and industrial powerhouses are now home to over 80,000 people. INSURANCEJOURNAL.COM


Conversions Gaining Momentum

In 2025 alone, roughly five million square feet of New York City office space was converted to residential use, five times (5x) the number in 2022 and the highest such number in two decades. The number of office-to-residential conversions planned for New York City in 2026 is double that of its closest competitor, Washington, D.C. This particular conversion in Midtown Manhattan required complicated structural reinforcement work, as 11 floors were being added to the former office tower’s existing 22 floors. On the morning of July 7, 2026, a member of Steamfitters Local 638 noticed buckling support columns, leading to an evacuation of the building and the surrounding 12 city blocks. Inside, the 21st floor up to the 26th floor—much of the addition on top of the original circa-1960 structure—experienced a partial collapse due to the new weight exerted on them. For 24 hours, emergency construction and engineering crews labored to reinforce and stabilize the structure. A month later, the project remains paused, while parts of busy East 42nd Street, just blocks from Grand Central Terminal and the United Nations headquarters, were shuttered to pedestrians for much of the month of July. That means restaurants and stores could not open for business, nearby office buildings could not be occupied, and neighboring hotels were required to rebook guests into alternative lodgings at the last minute. The fallout has not stopped there. Since this construction project made the wrong type of headlines, the City of New York has issued 18 partial and one complete stop-work order to other office-to-residential conversion projects, after inspectors, on the lookout to spot potential hazards, found safety violations at 19 different worksites across the city. The aftermath of these events, and the growing prevalence of adaptive reuse projects that are far more complex than either new constructions or renovations, must undoubtedly result in greater scruINSURANCEJOURNAL.COM

tiny from insurers, just as it had caused for the city’s engineering and building inspectors. This brings about a serious need for industry to come together to address the unique underwriting, and potential litigation risks inherent in this booming sector of office to residential building conversations.

For starters, the building and fire codes for an office building are very different from any residential one, affecting everything from windows, ventilation, and entry and egress. Adding over a dozen floors certainly brings greater complexity to that process. Currently, one of the factors being scrutinized as a potential cause of the building’s instability is what the developer called a “scoop and stack” method of construction, which effectively removes sections of a building’s lower floors and relocates them to the upper levels. Modern building codes require any bedrooms to have at least one window to be habitable. That means interior space at the center of these office buildings, often where office lobbies would be located, requires removal to create lightwells. While this is a common practice to accommodate renovations necessary to add bedrooms to an office building, this can also add risk to already complicated projects in older buildings. Increased scrutiny in the early stages may have led to an alternative method being proposed, or for reinforcements to be added to prevent the buckling. This episode emphasizes the importance of insurance underwriters conducting independent structural engineering reviews before agreeing to

any binding coverage policies. Given the challenges of adaptive reuse projects, it is also advisable to require continuous risk assessments and engineering reviews to ensure that things are progressing smoothly. It is not just the structural integrity of the completed project that matters but the intermediary stages, as well. The Pfizer Building incident, and others like it, also underscores the need to preserve the chain of evidence. Even mundane construction projects in New York City involve a tangled web of contractors, subcontractors, and risk. This project was a massive undertaking, with a $720 million construction loan. Investigations and lawsuits will stem from this project, likely for years to come, and trace every piece of paperwork to find the parties at fault. Furthermore, the destabilization and near collapse of a major Midtown skyscraper forces insurers to re-examine the issue of liability. Multiple city blocks and dozens of businesses were forced to evacuate, incurring significant costs as a result. A nearby restaurant estimated it lost $300,000 due to its temporary closure, and is considering a lawsuit against the project’s lead developer, MetroLoft—and that is just one of over 100 businesses that were negatively impacted by the closures. Construction projects in major metro areas—be that New York City, Boston, Chicago, Dallas, or San Francisco—are already complicated beasts, and adaptive reuse projects even more so. Insurers cannot forget these facts and must increase their due diligence accordingly. For these projects, design and execution are paramount, as a single flaw in either can cause untold damage. Idea Exchange: Small Construction Claim Severity Is Outgrowing Small Trade Contractors

P

rior to the last decade, it was common practice for insurance agents to suggest limits to insureds based largely on their company’s annual revenue. In today’s litigation and construction environment, however, revenue alone is no longer a By Chris Ciccarelli reliable indicator of potential loss severity. For example, a contractor generating only a few million dollars in annual revenue may believe $5 million in total liability limits is sufficient. Yet, a single catastrophic loss, severe auto accident, or construction defect claim can quickly exceed those limits and threaten the financial viability of the business. Small trade contractors face many of the same risk exposures as their larger industry peers. They work on high-risk job sites, operate commercial vehicles and equipment, and assume similar liability on their projects. But one loss can quickly exceed the size of the business itself, especially as higher construction costs, labor shortages, and increasingly severe claims amplify costs. If revenue is no longer an indicator of potential claims severity, agents and brokers must dig deeper to understand the full scope of an insured’s risks, operations, the type of work they do, and the liability they assume and establish limits that truly address their exposures.

The Precarious Risk Environment

Small trade contractors is a broad term that defines a wide range of businesses such as heating, ventilation, and air conditioning (HVAC) professionals; plumbers; electricians; and more. Each of these businesses faces different exposures based on the type of work they perform. However, there are three clear challenges raising the stakes for small trade contractors today. 46 | INSURANCE JOURNAL | SEPTEMBER 21, 2026

Higher Material & Labor Costs. Contractors often agree to perform work at set amounts, but material and labor availability and costs can fluctuate during a project. Such budget pressures might encourage contractors to substitute materials or settle for less-skilled labor to balance costs and meet tight construction schedules. For small trade contractors looking to take on more jobs, balancing time constraints, budget pressures, and quality of work can be particularly difficult. Auto Exposures. While small trade contractors operate fewer vehicles than their larger counterparts, even one employee driving to and from job sites leaves the business open to auto risk exposure. Bodily injury claims as a result of auto accidents can quickly exceed an entire contractor’s revenue. As the auto sector remains volatile and claims remain severe, contractors cannot overlook fleet risks alongside the work they perform.

Skyrocketing jury awards in recent years have exacerbated potential claim severity. Investigating and defending a claim has become costly. Construction defect claims, for example, can impact several parties involved in a project to determine who performed the work, when damage began, and how far it spread. Electrical, HVAC, plumbing, and other subcontractors could find themselves brought into litigation, left to accrue significant costs to investigate and defend a claim.

Insuring the Actual Risk Exposure

Agents and brokers looking to serve as resources for their small trade contractor clients must start by looking beyond the general overview of the insured, and work to understand exactly what they do and how they operate. The description of HVAC company, for example, is not enough information to assess risk exposure. An HVAC contractor that works exclusively in single-family homes has different risk exposures to manage than a similarly sized company performing work in commercial buildings. Agents should work to understand where an insured operates, with whom they work, and how they perform work. How are labor and material shortages impacting operations? How are contractors keeping up with tight schedules? INSURANCEJOURNAL.COM


How does the insured vet subcontractors? Does the insured rely only on certificates of insurance, or do they review policies and endorsements? Agents should not be aiming to make their clients appear riskfree. Instead, agents should make sure the insured, agent, and carrier understand the actual risk exposures at play and the coverage in place to combat them. Understanding the contractual obligations insureds are navigating can also help agents ensure their insurance portfolio aligns with their commitments. For example, an insured might agree in a contract to maintain certain excess limits without realizing subcontractors are expected to carry the same. While insureds cannot control rising costs or how a jury might view a claim, they can make their business more defensible in the event of one. That begins with establishing a culture of safety. Regular safety talks, documented procedures, and visible safety practices can prove that a contractor prioritizes safety throughout an entire operation. These practices do not begin and end on a contractor’s property; they extend to fleets on the road and employees on job sites. Safety talks, particularly around driving techniques, how to manage other drivers in the field, and more, will help ensure that culture of safety spreads across the entire operation. Agents should advise that safety policies, practices, and discussions should be formalized, communicated to all employees, and documented for easily reference

to address employee questions and any potential claims. This way, contractors who are pulled into litigation can prove a documented history of effective safety practices and paint a more accurate picture of how the business operates. Smaller revenue does not necessarily mean fewer risks. Small trade contractors assume significant exposures by the nature of their businesses, the organizations for whom they work, and the vehicles on which they depend to perform their work. Then it happens. The campaign launches, the event ends, the webinar wraps up, and the marketing quietly disappears. On to the next thing. Sadly, this “one-and-done” approach is common. In this industry, marketing competes with renewals, submissions, client needs, regulatory changes, and endless other priorities on any given day. To get anyone’s attention, your messaging must be clear and coordinated, with content consistently optimized across all channels and timed for maximum impact. Consider the following tactics to ensure

you’re not leaving potential value from your marketing investment on the table.

Extend the Life of Every Campaign

Consider an insurance organization attending a major industry conference. It may spend months planning. There are registration fees, travel expenses, sponsorships, booth materials, client meetings, promotional emails, social media content, plenty of internal coordination … then the event happens, and everyone flies home. If the marketing strategy ends there, a significant portion of the opportunity goes

home with them. The conversations that happened at the booth can inspire follow-up content. Questions prospects asked can become articles or webinars. Photos and insights from the conference can fuel social media. New contacts can receive thoughtful follow-up communication. A presentation developed for the event can become an educational email series or downloadable resource. The event itself may last three days; the marketing value can last for months. The same principle applies to nearly every campaign.

Insurance folks often feel pressure to continually come up with something new to say. Fortunately, they usually don’t need to. One strong piece of content can become many things. • A webinar about an emerging coverage issue can become a short article, several social media posts, a FAQ, a series of emails, sales talking points, and a follow-up resource for prospects. • A detailed market update could become a shorter client email, a producer-facing summary, several graphics highlighting individual insights, and talking points for an upcoming meeting. • A frequently asked question from clients or producers might become a blog post, video, email, social media post, and sales resource. This isn’t simply recycling content for the sake of filling a marketing calendar. It’s giving valuable information more opportunities to reach the people who need it. Remember, your audience doesn’t see everything you publish. In fact, most people see only a small percentage of it. If an idea is useful enough to communicate once, there’s a good chance it’s useful enough to communicate more than once.

Closing Quote Subsidized Immigration Enforcement Insurance: What Could Go Wrong?

n August 18 the Immigration and Customs Enforcement (ICE) agency announced a plan to provide subsidized personal liability insurance for state and local police By Jerry Theodorou working with ICE in immigration enforcement. The plan would shield rogue agents from legal expenses they are obligated to pay when they are sued for improper excessive use of force, wrongful arrests, and unlawful search and seizure. The program would also cover legal expenses for officers facing criminal investigations. The program would provide eligible policyholders with $500,000 of liability limit. The premium is government-subsidized by $250 per year. Government-provided or subsidized insurance has a poor track record, as it weakens incentives for risk management. The ICE proposal is a bad idea for this

and more reasons. First, it would stoke moral hazard. Local police may be less restrained from violating immigration laws if they know that insurance will shield them from financial consequences when they are sued. When police do not bear accountability for their actions, the door is opened to violate immigration laws with impunity, as there are no financial consequences to the errant agents. Second, there are already structures for state and local police to cooperate with ICE in immigration raids and detentions. Section 287(g) of the Immigration and Nationality Act allows state and local police to partner with ICE. Third, covering officers who face criminal examinations crosses the line separating civil tort law from criminal law. Insurance is not meant to cover criminal or intentional acts. Policies can be voided if defendants seek to cover their criminal acts with insurance. In addition to the above drawbacks, there are unanswered questions regarding ICE’s proposed program. How

is underwriting done? Is there data on agents with a history of using unnecessary force? What private insurers will the government work with? Who devised the program? What is the targeted loss ratio? It was also unclear if the policy is a personal liability insurance policy or a professional liability (a/k/a errors and omissions) liability policy. If it is an E&O policy, is there a standard of care for those in the immigration enforcement business? We reached out to ICE for answers to these questions but received no response. Above and beyond the inherent folly of subsidized or free ICE personal liability insurance for immigration enforcers, this proposal was one of several misguided programs so far in 2026 where the federal government would get directly involved in the business of insurance, including a proposal from the Brookings Institution’s Hamilton Project in April suggesting the creation of a federal reinsurance program; the introduction of a minimum loss ratio by the Vanderbilt Policy Accelerator in May; and Leon Levy Economics Institute at Bard College’s assertion in April that the main cause of rising personal insurance premiums is climate change. The ICE/police personal liability insurance program shares the same weaknesses as the above trifecta of proposed intrusions in insurance markets. It

crowds out the private insurance market; it weakens incentives for risk management; and it causes cross-subsidization, where those with the most risk subsidize those with the least risk. It appears that wherever there is a hue and a cry about insurance being unaffordable, the government calls on the usual suspects in academia or consumer advocacy to invent programs for underpriced insurance or reinsurance. And as other government insurance programs have demonstrated—such as flood insurance and crop insurance—the inevitable result of selling government-produced, underpriced (re)insurance is growth in the national debt. The proposed ICE program could backfire in other unintended ways. If it becomes widely known that immigration enforcers carry $500,000 of insurance, enterprising personal injury lawyers could create a new profit center banked by frivolous, unmerited allegations. Liability insurers have always been thought of as “deep pockets.” To the extent the pockets are the government itself, strap yourself into another round of litigation gone wild.
