TERMS AND CONDITIONS

I/We (the Vendor hereinafter named) hereby nominate the horses appearing on this form for inclusion in the 2025 Inglis Ready2Race Sale to be conducted by William Inglis & Son Limited (the Auctioneer) in accordance with the Conditions of Sale (which can be viewed at www.inglis.com.au/cos) and also other provisions appearing on this form.

The Vendor warrants the truth and accuracy of the details and other information furnished on this form and hereby agrees to indemnify the auctioneer in respect of any loss or damage it may suffer by reason of any false or erroneous or inaccurate matter being inserted on this form.

The Vendor hereby acknowledges that he/she has carefully read and understands the Conditions of Sale and other provisions contained in or appearing on this form; and agrees to be bound by such Conditions of Sale and other provisions.

The Auctioneer may in its absolute discretion accept or reject any nomination and its decision shall be final and binding on the parties. The Auctioneer shall not be bound to give any reason for its decision.

The following charges will be deducted from the Vendor’s sale advice:

a)Commission at the rate of 8.5% plus GST of the sale price up to $250,000 and 6.5% plus GST thereafter for the remaining balance on each Lot, whether sold by auction, private contract, bought in or otherwise.

b) This is a reserved sale. Any Lot not sold shall be subject to 2.5% pass in commission.

c) A promotional fee of 1% will be deducted from all bloodstock sold. 0.35% will be passed on to assist the funding of Thoroughbred Breeders Australia. 0.65% will be used to fund an inward buyers programme to this sale.

d) A contribution of $700 plus GST will be deducted from the proceeds of the sale of each Lot sold and put towards prize money for the Inglis Race Series.

e) Full commission is payable on any Lot catalogued and sold prior to auction.

The Vendor warrants that all security interests or other encumbrances including but not limited to foal shares, leases, PMSI’s general and specific security agreements which affect the horse(s) will be disclosed to the Auctioneer upon lodgement of this form and will be discharged on or prior to the sale.

The Vendor hereby acknowledges that prior to the sale all Registration Documents will be lodged with the Auctioneer and all Stud Book requirements will be complied with and all racing leases cancelled. This form must be signed by the Vendor or some party lawfully authorised by him/her to execute this form on his/her behalf and such party is able to transfer good title to the Lot free from any mortgage, lien, charges or other adverse interests.

Where a purchaser qualifies to have a Lot exported from Australia on a GST free basis, the Vendor appoints the Auctioneer to sign the Export Declaration form on their behalf.

ENTRY FEE

Entry fee of $1,000 (plus GST) is applicable for each horse nominated to the sale.

AUSTRALIAN STUD BOOK

ASB issued Documents of Description (passport or foal identification card) for each horse nominated should accompany this entry form. It is a requirement that all horses entered for sale be branded and microchipped in accordance with the new identification process from the ASB. This procedure must be completed prior to commencement of sale.

X-RAY REPOSITORY

X-rays are to be taken AFTER the two-year-old has completed its breeze up. All sets of x-rays must contain no less than 36 views as specified by Inglis. Full set of Hong Kong x-rays (minimum number of required views = 48) is recommended for colts.

BLOOD TESTING FOR STEROIDS

Under our Conditions of Sale all horses sold at this sale are eligible for a post-sale blood test for anabolic androgenic steroids and receptor modulators. This test will be conducted at the purchaser’s request and expense. For further information please read Condition 14 of the Terms and Conditions of Sale as listed on our website.

The vendor shall disclose to the auctioneer any medication/drug administered to the Lot during the seven days prior to the official breeze up gallop and shall further disclose any medication/drug administered in the seven days prior to the Lot being offered for sale at the Inglis Ready2Race Sale. This disclosure shall be in the form of a treatment sheet and lodged in the Repository no later than 5pm on the day prior to the horse being offered for sale.

DEFECTS, EMBARGOES AND BANS

Roarers, windsuckers, wobblers, bleeders or horses which have been or are under any embargo or racing ban must be stated on this entry form.

Prior to the sale, all horses entered will have their auction availability promoted on inglis.com.au. All passed in Lots will have extra promotional activity on the website 30 days after the Auction.
