Uno degli 87 cosmogrammi preparati per la missione spaziale Apollo 12, ma per motivi tecnici non imbarcati e restituiti dopo un periodo di quarantena al capitano della missione Charles Conrad, che li fece annullare a Houston TX. Lo stesso Conrad, capitano a terra della successiva missione Apollo 15 li allegò a quelli specifici predisposti per quel volo spaziale. Le buste, una volta rientrate a terra, non vennero sottoposte a quarantena in quanto questa pratica venne sospesa a partire dalla missione Apollo 14. Durante l’esposizione il personale de Il Ponte sarà a disposizione dei potenziali acquirenti per fornire – su richiesta degli stessi - una illustrazione aggiornata dei beni stessi, ove disponibile. 1.5 Ad integrazione delle descrizioni contenute nel catalogo, Il Ponte rende disponibili, a richiesta, condition report sullo stato di ciascun lotto. 1.6 Tutti i beni di natura elettrica o meccanica sono da considerarsi solamente sulla base del loro valore artistico e decorativo e non sono da considerarsi funzionanti. E’ importante prima dell’uso del lotto oggetto di aggiudicazione che il sistema elettrico eventualmente in esso presente sia certificato da un elettricista qualificato, non assumendo Il Ponte alcuna responsabilità al riguardo. 1.7 Né Il Ponte, né suoi amministratori, dipendenti, collaboratori o consulenti saranno responsabili per atti od omissioni relativi alla preparazione o alla conduzione dell'asta o per qualsiasi altra questione relativa alla vendita del lotto. 1.8 Dopo l’aggiudicazione Il Ponte non potrà essere ritenuta responsabile per eventuali vizi dei lotti, relativi tra l’altro anche allo stato di conservazione, all’errata attribuzione, all’autenticità, alla provenienza, al peso o alla mancanza di qualità dei lotti. I potenziali acquirenti e l’aggiudicatario rinunciano espressamente alla garanzia di cui agli artt. 1490 e 1497 c.c., liberando Il Ponte da ogni relativa responsabilità; per l’effetto, né Il Ponte né il suo personale potranno rilasciare una qualsiasi valida garanzia in tal senso. 1.9 In ogni caso, l’eventuale diversa responsabilità de Il Ponte nei confronti dell’Acquirente (la persona fisica o giuridica che fa in asta l’offerta più alta accetta dal banditore e si aggiudica il lotto) in relazione all’acquisto di un lotto da parte di quest’ultimo è limitata al Prezzo di aggiudicazione e alla commissione d’acquisto pagata a Il Ponte dall’Acquirente. 1.10 Il colpo di martello del banditore determina l’accettazione dell’offerta più alta ed il prezzo a cui il lotto viene aggiudicato dal banditore all’Acquirente. Il colpo di martello del banditore determina inoltre la conclusione del contratto di vendita tra il Venditore e l’Acquirente e in particolare dell’obbligo dell’Acquirente di pagare a Il Ponte l’intero ammontare dovuto per l’aggiudicazione del lotto, incluso il prezzo e la commissione; resta espressamente previsto che solo a

seguito dell’integrale pagamento a Il Ponte di tutto quanto dovuto dall’Acquirente la compravendita si intenderà perfezionata e la proprietà e il possesso del lotto aggiudicato potranno passare in capo all’Acquirente (salvo le eventuali diverse disposizioni di cui al D.Lgs. n. 42/04, anche in tema di prelazione dello Stato; si rinvia anche al § 11.4 delle presenti condizioni). 2. Offerte per l’asta 2.1 Le offerte per l’acquisto dei lotti possono essere presentate personalmente in sala durante l’asta, mediante un’offerta scritta prima dell’asta, per telefono oppure via internet (in quest’ultimo caso solo se possibile in relazione alla specifica asta). 2.2 L’incremento delle offerte è del 10% rispetto a quella precedente, salvo diversa scelta del banditore comunicata prima dell’inizio (o nel corso) dell’asta. 2.3 Nell’ipotesi di offerte di pari importo e presentate attraverso la stessa modalità (vale a dire presentate in sala, per telefono, per iscritto oppure online), Il Ponte terrà in considerazione solo l’offerta ricevuta per prima. 2.4 Ove sorga contestazione in merito all’aggiudicazione di un lotto, quest’ultimo, ad insindacabile giudizio del banditore, potrà essere ritirato dall’asta oppure rimesso in vendita all’asta nello stesso giorno (in questa ultima ipotesi le offerte aventi ad oggetto il lotto in precedenza formulate non saranno più tenute in considerazione). 2.5 A sua completa discrezione, Il Ponte ha il diritto di rifiutare a chiunque di partecipare alle aste; in particolare, Il Ponte può rifiutare la partecipazione all’asta di potenziali acquirenti che in precedenza non abbiano puntualmente adempiuto alle proprie obbligazioni, anche a titolo risarcitorio, nei confronti de Il Ponte. 2.6 Il banditore conduce l’asta partendo dall’offerta che considera adeguata. Il banditore può fare offerte consecutive o in risposta ad altre offerte nell’interesse del Venditore, fino al raggiungimento del Prezzo di riserva (il prezzo minimo concordato in via riservata tra Il Ponte e il Venditore al di sotto del quale il lotto non verrà venduto). 2.7 In qualsiasi momento Il Ponte ha facoltà di ritirare dall’asta qualsiasi lotto offerto in vendita. Il banditore ha la facoltà, a suo insindacabile giudizio, di abbinare o separare i lotti e di variarne l’ordine di vendita rispetto a quanto indicato in catalogo, purché il lotto non sia offerto in asta in una giornata anteriore rispetto a quella indicato nel catalogo d’asta. 2.8 Nei confronti di ciascun potenziale acquirente, Il Ponte si riserva il diritto di subordinare la partecipazione all’asta alla esibizione di una lettera di referenze bancarie, oppure al deposito di un somma a garanzia dell’esatto adempimento delle obbligazioni previste dalle presenti Condizioni Generali di Vendita, la quale verrà restituirà una volta conclusa l’asta. 3. Offerte in sala 3.1 3.1 Per partecipare all’asta in sala è necessario munirsi dell’apposita paletta numerata, che viene consegnata al banco di registrazione dal personale de Il Ponte in seguito alla compilazione del modulo di iscrizione all’asta e alla esibizione di un documento di identità del potenziale acquirente. L’offerta per aggiudicarsi il lotto è espressa mediante alzata della paletta numerata. 3.2 Il Ponte invita i potenziali acquirenti a munirsi per tempo della paletta numerata e informa che è possibile effettuare l’iscrizione all’asta anche nei giorni nei quali si svolge l’esposizione che precede l’asta. Lo smarrimento della paletta numerata dovrà essere immediatamente comunicato a Il Ponte, che provvederà ad attribuire al potenziale acquirente una nuova paletta numerata. La paletta numerata dovrà essere restituita a Il Ponte al termine dell’asta. 3.3 Subito dopo l’aggiudicazione del lotto, l’Acquirente dovrà sottoscrivere un verbale di aggiudicazione. 3.4 Ciascun lotto aggiudicato in sala sarà fatturato in base alle generalità e indirizzo rilasciati al momento dell’assegnazione della paletta numerata. 3.5 E’ possibile partecipare all’asta in qualità di rappresentante di una terza persona. Il rappresentante, in occasione della registrazione all’asta dovrà esibire una delega sottoscritta dal rappresentato con allegati copia del documento di identità e del codice fiscale del rappresentato e del rappresentante; nell’ipotesi in cui il rappresentato sia una società, la delega dovrà essere sottoscritta dal legale rappresentante o da un procuratore dotato di potere di firma, la cui carta di identità e codice fiscale dovranno essere allegati alla procura. In ogni caso, Il Ponte si riserva la facoltà di impedire la partecipazione all’asta al rappresentante quando, a suo insindacabile giudizio, non ritenga dimostrato il potere di rappresentanza. 3.6 In nessun caso verranno accettate offerte “al meglio” o “salvo visione”. 4. Offerte scritte 4.1 E’ possibile presentare offerte scritte mediante la compilazione del “Modulo offerte scritte e telefoniche” (Modulo) allegato al catalogo d’asta o scaricabile dal sito www.ponteonline.com (Sito).

4.2 Il Modulo deve essere inviato a Il Ponte almeno entro 24 ore prima l’inizio dell’asta: via fax al numero +39 02.72022083 (per le aste organizzate presso la sede de Il Ponte di Milano via Pontaccio 12) oppure al numero +39 02.36633096 (per le aste organizzate presso la sede de Il Ponte di Milano via Pitteri 8/10), oppure in formato pdf via email all’indirizzo info@ponteonline.com (ovvero all’indirizzo email del dipartimento di riferimento de Il Ponte come risultante dal Sito ovvero dal catalogo dell’asta) in ogni caso allegando la documentazione richiesta nel Modulo; in difetto Il Ponte non garantisce la partecipazione del potenziale acquirente all’asta, né che darà esecuzione alle offerte indicate nel Modulo. Il Ponte darà esecuzione solo ad offerte che siano pari o superiori all’80% della stima minima indicata in catalogo e riferita al lotto per il quale l’offerta è presentata. 4.3 Le offerte scritte verranno accettate solo se arrotondate alla decina; in caso contrario, Il Ponte considererà l’offerta come fosse arrotondata alla decina per difetto (ad esempio, una offerta scritta pari ad euro 238,00 verrà considerata da Il Ponte come formulata per euro 230,00). 4.4 Il Ponte, nel dare luogo ai rilanci per conto del potenziale acquirente, terrà conto sia del prezzo di riserva, sia delle altre offerte, in modo da cercare di ottenere l’aggiudicazione del lotto oggetto della proposta scritta al Prezzo di aggiudicazione più basso. Gli importi indicati nel Modulo verranno intesi come importi massimi. Il Ponte non terrà conto di offerte con importi illimitati ovvero prive di importo. 4.5 Il Ponte non è responsabile di eventuali errori compiuti dal potenziale acquirente nella compilazione del Modulo. Prima di inviare il Modulo a Il Ponte, il potenziale acquirente è tenuto a verificare che la descrizione del lotto indicata nel Modulo corrisponda al bene che si intende acquistare; in particolare il potenziale acquirente è tenuto a verificare che vi sia corrispondenza tra numero di catalogo d’asta dell’opera e descrizione del lotto. In caso di discrepanza tra numero di lotto e descrizione, Il Ponte formulerà l’offerta per conto del potenziale acquirente con esclusivo riferimento al primo. 4.6 Al termine dell’asta, l’Acquirente sarà informato da Il Ponte via email dell’avvenuta aggiudicazione del lotto; in ogni caso, ciascun potenziale acquirente è invitato a contattare Il Ponte ai numeri indicati all’art. 15 per verificare se la propria offerta sia risultata la più alta. 4.7 Nel caso di una offerta scritta e di una offerta in sala, di una offerta telefonica oppure online di pari importo, queste ultime prevarranno rispetto alla offerta scritta. 5. Offerte telefoniche 5.1 Mediante la compilazione ed invio del Modulo, un potenziale acquirente può partecipare all’asta formulando offerte telefoniche. 5.2 Il Modulo deve essere inviato a Il Ponte almeno entro 24 ore prima l’inizio dell’asta via fax al numero +39 02.72022083 (per le aste organizzate presso la sede de Il Ponte di Milano via Pontaccio 12) oppure al numero +39 02.36633096 (per le aste organizzate presso la sede de Il Ponte di Milano via Pitteri 8/10), oppure in formato pdf via email all’indirizzo info@ponteonline.com (o all’indirizzo email del dipartimento di riferimento de Il Ponte risultante dal Sito o dal catalogo dell’asta), in ogni caso allegando la documentazione richiesta nel Modulo. 5.3 A seguito della ricezione del Modulo e della sua corretta compilazione, Il Ponte provvederà a contattare il potenziale acquirente al numero di telefono indicato nel Modulo prima che il lotto per il quale il potenziale acquirente intende formulare offerte telefoniche sia offerto in vendita all’asta 5.4 La stima minima indicata in catalogo riferita a ciascun lotto per il quale si intende formulare offerte telefoniche deve essere pari ad almeno euro 100,00; in difetto, Il Ponte non ricontatterà il potenziale acquirente e quest’ultimo non potrà formulare offerte telefoniche ad oggetto il lotto. 5.5 Qualora, per qualsiasi motivo, anche di natura tecnica, Il Ponte non riuscisse a contattare telefonicamente il potenziale acquirente, Il Ponte, in relazione a ciascun lotto indicato nel Modulo, avrà facoltà di effettuare offerte per conto del potenziale acquirente sino ad un Prezzo di aggiudicazione pari alla offerta massima indicata dal potenziale acquirente nel Modulo o, in mancanza di questa alla base riferita al lotto. offerta massima, della stimad’asta minima indicata in catalogo con riferimento al lotto. 5.6 Il Ponte non risponde in alcun modo per il ritardo o mancata esecuzione di ordini telefonici derivanti dal malfunzionamento della linea telefonica. 5.7 I collegamenti telefonici durante l’asta saranno registrati. Il personale de Il Ponte è in grado di effettuare telefonate in italiano, inglese, francese, cinese, spagnolo e portoghese. 6. Offerte online 6.1Il Ponte comunicherà sul Sito (almeno 24 ore prima l’inizio dell’asta) e/o sul catalogo d’asta se è possibile formulare offerte anche online, tramite il Sito o siti gestiti da terzi. 6.2 Le offerte online sono disciplinate sia dalle presenti Condizioni Generali di

Vendita, sia dalle “Condizioni ulteriori per la presentazione di offerte online” disponibili sul Sito o su richiesta. In caso di difformità tra le presenti Condizioni Generali di Vendita e le “Condizioni ulteriori per la presentazione di offerte online”, queste ultime prevarranno. 6.3 Per informazioni in merito alla registrazione all’asta e alla presentazione di offerte online si prega di far riferimento al Sito. 6.4 In caso di partecipazione all’asta e offerte formulate attraverso piattaforme e/o siti internet diversi dalla piattaforma Il Ponte Live (si rinvia per ogni altra informazione al sito www.ponteonline.com) sarà applicata e dovuta dall’Acquirente una ulteriore commissione pari al 5% sul Prezzo di aggiudicazione, oltre le commissioni e spese previste dalle presenti Condizioni Generali di Vendita. 7. Pagamento 7.1 In caso di aggiudicazione del lotto, l’Acquirente dovrà corrispondere a Il Ponte il Prezzo di aggiudicazione del lotto, oltre alle commissioni di acquisto pari al 25% (qualora l’asta si sia tenuta presso la sede de Il Ponte sita a Milano in via Pontaccio 12) oppure al 35% (qualora l’asta si sia tenuta presso la sede de Il Ponte sita a Milano in via Pitteri 8/10) del Prezzo di aggiudicazione (in entrambi i casi IVA inclusa se dovuta) e oltre al pagamento di qualsiasi altro importo eventualmente dovuto a Il Ponte ai sensi delle presenti Condizioni Generali di Vendita (v. anche § 6.4) e connesso alla aggiudicazione del lotto (Ammontare dovuto). 7.2 L’Acquirente è obbligato a versare l’Ammontare dovuto entro e non oltre dieci giorni, decorrenti dal giorno successivo a quello della aggiudicazione. 7.3 In caso di mancato o ritardato pagamento da parte dell’Acquirente, in tutto o in parte, dell’Ammontare dovuto entro il predetto termine essenziale, Il Ponte potrà risolvere la vendita ex art. 1456 c.c. mediante semplice comunicazione scritta. In questo caso, Il Ponte avrà comunque diritto al pagamento di una penale pari al doppio delle commissioni di acquisto che l’Acquirente inadempiente avrebbe dovuto pagare, oltre l’eventuale maggior danno, e potrà comunque trattenere gli eventuali acconti versati dall’Acquirente. 7.4 Ciascun lotto può essere pagato a mezzo assegno circolare, carta di credito, bancomat, bonifico e contanti, nel rispetto dei limiti di legge. 7.5 Il pagamento del lotto può essere effettuato a Milano presso la sede de Il Ponte di via Pontaccio 12 o di via Pitteri 8/10 (a seconda del luogo in cui si è svolta l’asta) ai seguenti orari di ufficio: Lun.-Ven. 9:00-13:00; 14:00-17:30 (esclusi i giorni di festività nazionale in Italia). 7.6 Le carte di credito accettate sono le seguenti: American Express, Diners, Visa e MasterCard. Il pagamento può essere disposto solo dal titolare della carta di credito. 7.7 Le coordinate bancarie per i bonifici sono le seguenti: IBAN IT 51H0832950860000000011517; Swift code n. ICRAITRR950; beneficiario Il Ponte - Casa d’Aste s.r.l. Nella causale si prega di indicare il proprio nome, cognome, numero di lotto e asta. 7.8 Il Ponte si riserva la facoltà di controllare la provenienza dei pagamenti ricevuti e di non accettare pagamenti provenienti da persone differenti dall’Acquirente. 7.9 Ai sensi del D.Lgs. n. 231/07 e successive modifiche ed integrazioni e nel pieno rispetto delle disposizioni del D.Lgs. 196/2003 (Codice della Privacy) e del Regolamento UE 2016/679, Il Ponte richiederà a tutti i Clienti i dati necessari ai fini dell'adempimento degli obblighi di adeguata verifica del Cliente e del titolare effettivo. In caso di formale richiesta da parte delle Autorità e della Pubblica Amministrazione, e in ogni altro caso previsto dalla legge, Il Ponte potrà comunicare il nominativo e i recapiti dell’Acquirente. 8. Consegna e ritiro del lotto 8.1 Il lotto sarà consegnato da Il Ponte all’Acquirente solo a seguito dell’intero pagamento dell’Ammontare dovuto (salvo le eventuali diverse disposizioni di cui al D.Lgs. n. 42/04, anche in tema di prelazione dello Stato; si rinvia anche al § 11.4 delle presenti condizioni). 8.2 Il Ponte non assume l’obbligo di provvedere alla spedizione del lotto oggetto di aggiudicazione, il quale dovrà essere ritirato dall’Acquirente a Milano presso la sede de Il Ponte di via Pontaccio 12 o di via Pitteri 8/10 (a seconda del luogo di svolgimento dell’asta), entro dieci giorni successivi al giorno dell’avvenuto pagamento dell’Ammontare dovuto. 8.3 Qualora l’Acquirente non provveda al tempestivo ritiro del lotto saldato entro dieci giorni dall’avvenuto pagamento o dall'ottenimento dell'attestato di libera circolazione e/o della licenza di esportazione, Il Ponte avrà facoltà di procedere all’eliminazione del lotto, previa comunicazione via raccomandata a.r. o Pec. L’acquirente riconosce ed accetta che nell’ipotesi di eliminazione del lotto, non avrà titolo per promuovere alcun tipo di azione o reclamo, innanzi a qualsiasi autorità, nei confronti de Il Ponte, il quale è pertanto manlevato da qualsiasi responsabilità.

8.4 Nel caso in cui l'Acquirente incarichi un terzo di ritirare il lotto, quest'ultimo dovrà essere munito di delega scritta rilasciata dall'Acquirente nonché fotocopia del documento del delegante e del delegato. 8.5 Su espressa richiesta dell'Acquirente, Il Ponte potrà organizzare, a spese e a rischio dell'Acquirente, l'imballaggio, il trasporto e l'assicurazione del lotto, previa comunicazione e accettazione scritta da parte dell'Acquirente delle relative spese. La spedizione potrà essere effettuata da un trasportatore incaricato da Il Ponte, su indicazione dell’Acquirente, ovvero incaricato direttamente dall’Acquirente, a seconda degli accordi. 8.6 Nell’ipotesi di morte, interdizione, inabilitazione, estinzione/ cessazione, per qualsiasi motivo, dell’Acquirente, debitamente comunicata a Il Ponte, quest’ultima acconsentirà a riconsegnare il lotto previo accordo di tutti gli aventi causa dell’Acquirente ovvero secondo le modalità stabilite dall’autorità giudiziaria. 9. Passaggio del rischio 9.1 Un lotto acquistato è interamente a rischio dell’Acquirente a partire dalla data più antecedente fra quelle in cui l’Acquirente: (i) prende in consegna il lotto acquistato o (ii) paga l’Ammontare dovuto per il lotto; qualora nessuna di queste ipotesi si realizzi, il passaggio del rischio avverrà in ogni caso dalla data in cui è decorso il termine di dieci (10) giorni dalla avvenuta aggiudicazione del lotto. Con il passaggio del rischio in capo all’Acquirente quest’ultimo esonera espressamente Il Ponte da ogni responsabilità circa la sorte del lotto aggiudicato, anche per eventuali danni, furti, incendio, perimento, smarrimento del lotto stesso (totale o parziale). 9.2 L’Acquirente sarà risarcito per qualsiasi perdita o danno del lotto che si verifichi dopo l’aggiudicazione ma prima del trasferimento del rischio, ma il risarcimento non potrà superare il Prezzo di aggiudicazione del lotto, oltre alla commissione d’acquisto ricevuta da Il Ponte. In nessun caso Il Ponte si assume la responsabilità per la perdita o danni di cornici/vetro che contengono o coprono stampe, dipinti o altre opere, a meno che la cornice o/e il vetro non costituiscano il lotto venduto all’asta. 9.3 In nessun caso Il Ponte sarà responsabile per la perdita o il danneggiamento (totali o parziali) del lotto aggiudicato: (i) verificatisi a seguito di un qualsiasi intervento (compresi interventi di restauro, interventi sulle cornici e interventi di pulitura) da parte di terzi da chiunque incaricati; (ii) derivanti, direttamente o indirettamente, da: (a) cambiamenti di umidità o temperatura; (b) normale usura o graduale deterioramento derivanti da interventi sul bene e/o da altri eventi (inclusi i tarli e i parassiti del legno); (c) errori di trattamento; (d) guerra, fissione nucleare, contaminazione radioattiva, armi chimiche, biochimiche o elettromagnetiche; (e) atti di terrorismo; (f) casi di lockdown e simili, disposizioni da parte delle Autorità, ogni altra causa di forza maggiore estranea al controllo de Il Ponte. 10. Contraffazione 10.1 Nel caso in cui, dopo l’aggiudicazione, un lotto risulti essere una contraffazione, Il Ponte rimborserà all’Acquirente che abbia fatto richiesta di risoluzione del contratto di vendita - previa restituzione del lotto a Il Ponte - un importo pari al Prezzo di aggiudicazione e alle commissioni di acquisto corrisposte, in entrambi i casi nella valuta in cui questi importi sono stati pagati dall’Acquirente. L’obbligo de Il Ponte è sottoposto alla condizione che, non più tardi di cinque (5) anni dalla data della aggiudicazione, l’Acquirente: (i) comunichi a Il Ponte per iscritto, entro novanta (90) giorni dalla data in cui ha avuto una notizia che lo induca a ritenere che il lotto sia una contraffazione, il numero del lotto, la data dell’asta alla quale il lotto è stato acquistato e i motivi per i quali l’Acquirente ritenga che il lotto sia una contraffazione; (ii) sia in grado di riconsegnare a Il Ponte il lotto, libero da rivendicazioni o da ogni pretesa da parte di terzi sorta dopo la data della vendita e il lotto sia nelle stesse condizioni in cui si trovava alla data della vendita; (iii) fornisca a Il Ponte le relazioni di almeno due studiosi o esperti indipendenti e di riconosciuta competenza a livello internazionale, in cui siano spiegate le ragioni per cui il lotto sia ritenuto una contraffazione. 10.2 Il Ponte non sarà vincolata dai pareri forniti dall’Acquirente e si riserva il diritto di richiedere l’ulteriore parere di altri esperti a proprie spese. 10.3 Il Ponte non effettuerà il rimborso se: (i) la descrizione nel catalogo era conforme all’opinione generalmente accettata di studiosi ed esperti alla data della vendita o indicava come controversa l’autenticità o l’attribuzione del lotto; o (ii) alla data della pubblicazione del catalogo la contraffazione del lotto poteva essere accertata soltanto svolgendo analisi generalmente ritenute inadeguate allo scopo o difficilmente praticabili, il cui costo era irragionevole o che avrebbero ragionevolmente potuto danneggiare o altrimenti comportare una diminuzione di valore del lotto. Ai sensi del presente articolo, per contraffazione si intende, secondo la ragionevole opinione de Il Ponte, l’imitazione di un lotto offerto in vendita, non

descritta come tale nel catalogo d’asta, creata a scopo di inganno su paternità, autenticità, provenienza, attribuzione, origine, fonte, data, età, periodo, che alla data delle vendita aveva un valore inferiore a quello che avrebbe avuto se il lotto fosse stato corrispondente alla descrizione del catalogo d’asta. Non costituisce una contraffazione un lotto che sia stato restaurato o sottoposto ad opera di modifica di qualsiasi natura (tra cui la ripitturazione o la sovrapitturazione). 11. Esportazione dal territorio della Repubblica italiana. Dichiarazione di interesse culturale 11.1L’esportazione dal territorio della Repubblica italiana di un lotto può essere soggetta al rilascio di un attestato di libera circolazione ovvero di una licenza di esportazione, ai sensi di quanto previsto dagli artt. 68 e ss. del D. Lgs 22 gennaio 2004, n. 42 (Codice Urbani). L’Acquirente sarà tenuto, per i lotti sottoposti al procedimento di dichiarazione di interesse culturale (c.d. “notifica”) ex artt. 13 e ss. D.Lgs. n. 42/2004, all’osservanza di tutte le disposizioni di cui alla legge e di ogni altra normativa speciale applicabile, anche in materia doganale, valutaria, tributaria, e di specie protette. È esclusivo onere dei partecipanti all’asta e dell’Acquirente verificare le eventuali restrizioni alla circolazione e/o esportazione del lotto di proprio interesse e comunque del lotto aggiudicato, ovvero le eventuali licenze o attestati previsti dalla legge, in Italia e nel Paese di destinazione, nonché provvedere alle eventuali formalità e obblighi di legge previsti per la circolazione e/o l’esportazione del lotto aggiudicato, con espresso esonero di ogni eventuale obbligo e/o responsabilità in capo a Il Ponte. 11.2 Il mancato rilascio o il ritardo nel rilascio dell’attestato di libera circolazione e/o della licenza di esportazione non può costituire una causa di risoluzione o di annullamento della vendita, né giustificare il mancato o ritardato pagamento da parte dell’Acquirente dell’Ammontare dovuto. 11.3 Su richiesta e a spese dell’Acquirente, Il Ponte può accettare di presentare la denuncia per ottenere l’attestato di libera circolazione e/o la licenza di esportazione, a condizione che l’Acquirente abbia già corrisposto l’Ammontare dovuto. L’importo che l’Acquirente deve pagare a Il Ponte per la presentazione della denuncia ammonta ad euro 150,00 (oltre IVA ed eventuali spese di trasporto), per ciascuna opera oggetto della denuncia. In ogni caso Il Ponte non assume alcuna responsabilità, né obbligo, né garanzia, circa il buon esito della relativa pratica e il rilascio di quanto richiesto dall’Acquirente. 11.4 Ciascun lotto offerto in vendita all’asta può essere stato già oggetto di dichiarazione di interesse culturale da parte del Ministero dei beni e delle attività culturali e del turismo ai sensi dell’art. 13 del Codice Urbani. In tal caso - o nel caso in cui in relazione al lotto sia stato avviato il procedimento di dichiarazione di interesse culturale ai sensi dell’art. 14 del Codice Urbani - Il Ponte ne darà comunicazione in catalogo e/o mediante un annuncio del banditore prima che il lotto sia offerto in vendita. Nel caso in cui il lotto sia stato oggetto di dichiarazione di interesse culturale precedentemente alla aggiudicazione, il Venditore provvederà a denunciare la vendita al Ministero competente ex art. 59 Codice Urbani. La vendita sarà sospensivamente condizionata al mancato esercizio da parte del Ministero competente del diritto di prelazione nel termine di sessanta giorni dalla data di ricezione della denuncia, ovvero nel termine maggiore di centottanta giorni di cui all’art. 61 comma II del Codice Urbani. In pendenza del termine per l’esercizio della prelazione il lotto non potrà essere consegnato all’ Acquirente in base a quanto stabilito dall’art. 61 del Codice Urbani. In ogni caso, resta inteso che l’eventuale dichiarazione di interesse culturale (o anche solo l’avvio del relativo procedimento) che dovesse intervenire successivamente alla aggiudicazione non potrà inficiare o invalidare l’aggiudicazione, né l’obbligo di pagamento dell’Ammontare complessivo e in generale la compravendita del lotto. 11.5 Il lotto contrassegnato con il simbolo “§” è in temporanea importazione doganale. E’ soggetto ad IVA (secondo legge) sul valore di aggiudicazione solo per gli acquirenti residenti nell’U.E. La chiusura della temporanea importazione doganale del costo di euro 300 è a carico dell’Acquirente. Il Ponte non è responsabile per le tempistiche burocratiche. 11.6 Il lotto contrassegnato con il simbolo “#” è in temporanea importazione artistica. 12. Diritto di seguito 12.1 Qualora dovuto, il pagamento del c.d. “diritto di seguito” (introdotto dal Decreto Legislativo 13 febbraio 2006, n. 118, attuativo della Direttiva 2001/84/CE) sarà corrisposto dal Venditore. 13. Specie protette 13.1 Indipendentemente dall’ottenimento di un attestato o di una licenza di esportazione ex art. 68 e ss. del Codice Urbani, tutti i lotti costituiti da o contenenti parti di piante o animali (es.: ossa di balena, coccodrillo, avorio, corallo, tartaruga), a prescindere dall’età e dal valore, potrebbero necessitare di

una licenza o un certificato prima dell’esportazione e/o di ulteriori licenze e/o certificati per l’importazione nei paesi Extra UE. L’ottenimento di una licenza o di un certificato di importazione non garantisce l’ottenimento di una licenza o di un certificato per l’esportazione e viceversa. Il Ponte consiglia i potenziali acquirenti di controllare le proprie legislazioni circa i requisiti necessari per le importazioni nel proprio Paese di beni fatti o contenenti specie protette. Prima di effettuare qualsiasi offerta, è responsabilità dell’Acquirente ottenere tali licenze/certificati di importazione o esportazione, così come ogni altro documento richiesto, con espresso esonero di ogni eventuale obbligo e/o responsabilità in capo a Il Ponte 14. Garanzia legale di conformità 14.1 Ove previsto per legge, i lotti venduti tramite Il Ponte sono coperti dalla garanzia legale di conformità prevista dagli artt. 128-135 del Codice del Consumo (Garanzia Legale), se applicabili. 14.2 La Garanzia Legale è riservata al consumatore (vale a dire, ai sensi dell’art. 3, I comma, lett. a) del Codice del Consumo, la persona fisica che agisce per scopi estranei all’attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta). 14.3 Il Venditore è responsabile nei confronti del consumatore per un difetto di conformità esistente al momento della consegna del prodotto e che si manifesti entro due anni da tale consegna. Il difetto di conformità deve essere denunciato al Venditore, a pena di decadenza dalla garanzia, nel termine di due mesi dalla data in cui è stato scoperto. Salvo prova contraria, si presume che i difetti di conformità che si manifestano entro i sei mesi dalla consegna del prodotto esistessero già a tale data, a meno che tale ipotesi sia incompatibile con la natura del prodotto o con la natura del difetto di conformità. A partire dal settimo mese successivo alla consegna del lotto, sarà invece onere del consumatore provare che il difetto di conformità esisteva già al momento della consegna dello stesso. Per poter usufruire della Garanzia Legale, il consumatore dovrà quindi fornire innanzitutto prova della data dell’aggiudicazione e della consegna del lotto. E’ opportuno, quindi, che il consumatore, a fini di tale prova, conservi qualsiasi documentazione idonea a dimostrare l’aggiudicazione (ad esempio la fattura di acquisto) e la data di consegna o ritiro del lotto. 14.4 Con riferimento alla definizione di “difetto di conformità”, si rimanda a quanto indicato all’art. 129, comma II, del Codice del Consumo. Sono esclusi dal campo di applicazione della Garanzia Legale eventuali difetti determinati da fatti accidentali o da responsabilità del consumatore ovvero da un uso del lotto difforme rispetto alla sua destinazione d'uso. 14.5 In caso di difetto di conformità debitamente denunciato nei termini, il consumatore ha diritto: (i) in via primaria, alla riparazione o sostituzione gratuita del lotto, a sua scelta, salvo che il rimedio richiesto sia oggettivamente impossibile o eccessivamente oneroso rispetto all’altro; (ii) in via secondaria (nel caso cioè in cui la riparazione o la sostituzione siano impossibili o eccessivamente onerose ovvero la riparazione o la sostituzione non siano state realizzate entro termini congrui ovvero la riparazione o la sostituzione precedentemente effettuate abbiano arrecato notevoli inconvenienti al consumatore) alla riduzione del Prezzo di aggiudicazione o alla risoluzione del contratto, a sua scelta. Il rimedio richiesto è eccessivamente oneroso se impone al Venditore spese irragionevoli in confronto ai rimedi alternativi che possono essere esperiti, tenendo conto: (i) del valore che il bene avrebbe se non vi fosse il difetto di conformità; (ii) dell’entità del difetto di conformità; (iii) dell’eventualità che il rimedio alternativo possa essere esperito senza notevoli inconvenienti per il consumatore. 14.6 Nel caso in cui il lotto, nel corso del periodo di validità della Garanzia Legale, manifesti un difetto di conformità, il consumatore può comunicare la circostanza a Il Ponte ai contatti indicati all’art. 16. Il Ponte darà tempestivo riscontro alla comunicazione del presunto difetto di conformità e indicherà al consumatore la specifica procedura da seguire. 15. 16. Foro e legge applicabile 16.1 Il rapporto contrattuale tra Il Ponte e l’Acquirente è regolato dalla legge italiana. In caso di traduzione in altra lingua delle presenti Condizioni Generali di Vendita, prevarranno e resteranno valide e vincolanti le condizioni di vendita nel testo in lingua italiana in caso di conflitto con la traduzione in lingua straniera. 16.2 Nel caso di Acquirente consumatore, per ogni controversia relativa all’applicazione, esecuzione e interpretazione delle presenti Condizioni Generali di Vendita è competente il foro del luogo in cui il consumatore risiede o ha eletto domicilio. 16.3 Ai sensi dell'art. 141-sexies, comma 3 del Codice del Consumo, ove applicabile, Il Ponte informa l’Acquirente consumatore che, nel caso in cui egli abbia presentato un reclamo direttamente a Il Ponte, a seguito del quale non sia stato tuttavia possibile risolvere la controversia così insorta, Il Ponte fornirà le informazioni in merito all'organismo o agli organismi di Alternative Dispute Resolution per la risoluzione extragiudiziale delle controversie relative ad obbligazioni derivanti da un contratto concluso in base alle presenti Condizioni Generali di Vendita (cc.dd. organismi ADR, come indicati agli artt. 141-bis e ss. Codice del Consumo), precisando se intenda avvalersi o meno di tali organismi per risolvere la controversia stessa. 16.4 Il Ponte informa inoltre l’Acquirente consumatore che è stata istituita una piattaforma europea per la risoluzione online delle controversie dei consumatori (c.d. piattaforma ODR). La piattaforma ODR è consultabile al seguente indirizzo http://ec.europa.eu/consumers/odr/; attraverso la piattaforma ODR l’Acquirente consumatore potrà consultare l'elenco degli organismi ADR, trovare il link al sito di ciascuno di essi e avviare una procedura di risoluzione online della controversia in cui sia coinvolto. Sono fatti salvi in ogni caso il diritto dell’Acquirente consumatore di adire il giudice ordinario competente della controversia derivante dalle presenti Condizioni Generali di Vendita, qualunque sia l'esito della procedura di composizione extragiudiziale delle controversie relative ai rapporti di consumo mediante ricorso alle procedure di cui alla Parte V, Titolo II-bis Codice del Consumo. 16.5 L’Acquirente che risiede in uno stato membro dell’Unione Europea diverso dall’Italia, può, inoltre, accedere, per ogni controversia relativa all’applicazione, esecuzione e interpretazione delle presenti Condizioni Generali di Vendita, al procedimento europeo istituito per le controversie di modesta entità, dal Regolamento (CE) n. 861/2007 del Consiglio, dell’11 luglio 2007, a condizione che il valore della controversia non ecceda, esclusi gli interessi, i diritti e le spese, Euro 2.000,00. Il testo del regolamento è reperibile sul sito www.eurlex.europa.eu. Condizioni ulteriori per la presentazione di offerte online Queste Condizioni ulteriori per la presentazione di offerte online (Condizioni) si applicano alle aste per le quali Il Ponte - Casa d’Aste s.r.l., società con sede legale in Milano, via Pontaccio 12 (20121), P. Iva e Iscrizione Registro Imprese di Milano n. 01481220133, capitale sociale interamente versato pari ad Euro 34.320,00 (Il Ponte), consenta la formulazione di offerte online tramite il sito www.ponteonline.com (Sito) ovvero siti di terzi (Piattaforme). Ciascun lotto è offerto in vendita da Il Ponte. I contratti di vendita all’asta conclusi online mediante il Sito e/o le Piattaforme sono esclusi dalla disciplina del Capo I, Titolo III del Decreto Legislativo 6 settembre 2005, n. 206.in quanto conclusi in occasione di una vendita all'asta. Istantaneità ed irrevocabilità dell’offerta online. Eccezione al diritto di recesso Per registrarsi all’asta è necessario inviare una copia della propria carta di identità in corso di validità all’indirizzo info@ponteonline.com. In difetto, non sarà possibile registrarsi all’asta. Il Ponte si riserva il diritto di rifiutare o revocare la registrazione all’asta a sua esclusiva discrezione. Il procedimento per effettuare un’offerta tramite il Sito e/o la Piattaforma è istantaneo; l’offerta è inviata non appena l’offerente clicca il relativo bottone ed è definitiva. Sottoponendo un’offerta online tramite il Sito e/o la Piattaforma accettate che l’offerta sia finale e che non sia in alcun modo possibile modificarla o revocarla. Inoltre, ai sensi dell’articolo 59, comma 1, lettera m) del Codice del Consumo, qualora il contratto di vendita all’asta sia concluso con un offerente che abbia formulato un’offerta online tramite il Sito e/o la Piattaforma e possa essere qualificato come consumatore in base all’art. 3, comma 1, lett. a) del Codice del Consumo, l’Acquirente non disporrà del diritto di recesso, in quanto il metodo di vendita

utilizzato è un’asta pubblica, come definita dall’art. 45, comma 1 lettera o) del Codice del Consumo. Se l’offerta inviata a Il Ponte è la più alta, l’Acquirente irrevocabilmente accetta di pagare l’intero prezzo di acquisto, incluse le commissioni di acquisto e tutte le tasse applicabili e qualsiasi altro addebito. 2. Modalità di pagamento e di consegna Modalità di pagamento: si rinvia alla clausola 7 delle Condizioni Generali di Vendita. Consegna: si rinvia alla clausola 8 delle Condizioni Generali di Vendita. 3. Offerte incrementali Ogni offerta incrementale comparirà sullo schermo del Sito e/o della Piattaforma. Il banditore ha la facoltà di variare gli incrementi per gli offerenti presenti nella sala d’aste e tramite telefono, ma coloro che formulano un’offerta tramite il Sito e/o la Piattaforma potrebbero non essere in grado di fare un'offerta per un importo diverso rispetto a quello di un’intera offerta incrementale. Tutte le offerte all’asta saranno espresse in Euro. 4. Responsabilità dell’offerente Coloro che formulano offerte tramite il Sito e/o la Piattaforma sono responsabili della loro conoscenza di tutte le comunicazioni e gli annunci effettuati durante l’asta. Tutte le comunicazioni effettuate saranno lette dal banditore, all'inizio, se del caso, o durante l’asta, prima che il lotto rilevante sia offerto in vendita. Il Ponte raccomanda che coloro che formulano offerte tramite il Sito e/o la Piattaforma si autentichino tramite log-in almeno dieci minuti prima dell'inizio dell'asta per assicurarsi di ascoltare tutte le comunicazioni effettuate dal banditore all'inizio dell’asta. Tutte le comunicazioni di modifiche relative all’offerta in vendita del lotto (“sale room notices”) e gli annunci in sala eseguiti dal banditore sono parte delle presenti Condizioni e delle Condizioni Generali di Vendita. Il Ponte si riserva il diritto di rifiutare o revocare il permesso di fare offerte online attraverso il Sito e/o la Piattaforma, nonché di revocare i privilegi di offerta nel corso di una asta. Gli aggiudicatari dei lotti riceveranno una conferma dell’aggiudicazione e l’estratto conto in relazione al loro acquisto dopo la vendita. 5. Esonero di responsabilità de Il Ponte Il Ponte non sarà responsabile per eventuali errori o malfunzionamenti nella presentazione delle offerte tramite il Sito e/o la Piattaforma, inclusi, a titolo esemplificativo ma non esaustivo, errori o malfunzionamenti causati da: (i) una perdita di connessione a Internet o al software del Sito e/o della Piattaforma da parte de Il Ponte ovvero del cliente; (ii) un malfunzionamento o un problema con il software del Sito e/o della Piattaforma; oppure (iii) un guasto o un problema di connessione internet, rete mobile o computer del cliente. Il Ponte non è dunque responsabile per qualsiasi impossibilità di formulare un'offerta online o per gli eventuali errori o omissioni in relazione ad essa. La partecipazione all’asta tramite il Sito e/o la Piattaforma avviene pertanto a esclusivo rischio degli offerenti e potenziali acquirenti, che assumono ogni rischio e responsabilità sulla ricezione e il buon esito delle offerte formulate e/o da formulare. Trattamenti effettuati e base giuridica I dati di natura personale, liberamente forniti dal Cliente alla società in ragione dell’attività svolta in virtù di apposita regolamentazione contrattuale saranno trattati in modo lecito, secondo correttezza, nonché a norma di quanto stabilito dal Regolamento, per la finalità di: - espletamento del mandato a vendere e/o dell’adesione alla partecipazione alle aste in programma; - per le finalità previste dalla vigente normativa in materia di antiriciclaggio (D.Lgs. 231/07 e successive modifiche).

Il conferimento dei dati sopra indicati è obbligatorio affinché il Titolare possa espletare l’incarico affidatogli. In caso di rifiuto a fornire i dati richiesti, il Titolare si troverà nell’impossibilità di eseguire le prestazioni contrattualmente previste, per fatto e colpa del Cliente interessato. I dati di natura personale quali l’indirizzo e-mail, forniti facoltativamente dal Cliente alla società in ragione di apposito consenso rilasciato dallo stesso, saranno trattati in modo lecito e secondo correttezza, nonché a norma di quanto stabilito dal Regolamento per la finalità d’inoltro di informative, aggiornamenti e novità in merito alle nuove aste e/o eventi futuri. Per tale trattamento la società raccoglierà il consenso con modalità elettroniche e /o cartacee. L’immagine verrà ripresa, mediante sistema di videoregistrazione e come da informativa regolarmente esposta, nell’interesse legittimo del Titolare, ovvero allo scopo di tutelare la sicurezza delle persone e la tutela del patrimonio dell’azienda. 3. Strumenti di trattamento e modalità di conservazione dei dati I dati trattati (che potranno avere natura: comune ed identificativa) sono aggiornati, completi, pertinenti e non eccedenti rispetto alle sopracitate finalità del trattamento. I medesimi dati saranno trattati, nel rispetto della sicurezza e riservatezza necessari attraverso le seguenti modalità: raccolta dei dati presso l’interessato, registrazione e conservazione dei medesimi per gli scopi predeterminati, espliciti e legittimi. Gli stessi dati saranno trattati sia con strumenti cartacei che con mezzi elettronici ed automatizzati. I dati personali saranno trattati dal Titolare del trattamento nonché dai dipendenti e collaboratori autorizzati al trattamento medesimo. I dati potranno essere comunicati, oltre che agli enti pubblici destinatari delle comunicazioni/dichiarazioni oggetto del presente contratto, anche agli organi ispettivi preposti, ove richiesti in seno a fasi di verifiche e controllo, inerenti alla regolarità degli adempimenti. I medesimi dati, oggetto della presente informativa, potranno essere comunicati a professionisti e/o collaboratori del titolare per l’espletamento dell’incarico affidato e per le stesse finalità. Per contro i dati in discorso non saranno oggetto di diffusione, oltre i limiti ivi specificati, salvo diversa indicazione dell’interessato, fornita per iscritto. Non è intenzione del Titolare trasferire i dati oggetto della presente ad un paese terzo o ad una organizzazione internazionale. Si precisa che anche il backup esterno è eseguito da società italiana, quindi tenuta anch’essa al rispetto della normativa privacy in discorso, tramite l’utilizzo di server siti in territorio italiano. Non è presente alcun processo decisionale automatizzato. Infine, si informa l’interessato che Il Titolare ha posto in essere una gran varietà di misure di sicurezza per proteggere i dati contro il rischio di perdita, abuso o alterazione. 4. Periodo di conservazione dei dati I dati, oggetto della presente informativa, saranno conservati: - per 10 anni (dieci anni) dalla conclusione del rapporto contrattuale, per trattamenti aventi base giuridica contrattuale; - 5 anni dalla revoca del consenso per i trattamenti aventi base consensuale - non oltre le 72 ore, relativamente al trattamento delle immagini della videosorveglianza. 5. Diritti dell’interessato L’interessato ha diritto: - di chiedere al Titolare del trattamento la conferma o meno della detenzione di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile, nonché l’accesso ai dati personali, il loro possibile aggiornamento o integrazione, la rettifica o la cancellazione degli stessi, la trasformazione dei medesimi in forma anonima ovvero il blocco di quelli trattati in violazione della normativa, la limitazione del trattamento che lo riguardano o di opporsi al loro trattamento, oltre al diritto alla portabilità dei dati. Ha altresì il diritto di ottenere l’indicazione dell’origine dei dati personali, la loro finalità e le modalità di trattamento, nonché la logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici; - potrà inoltre opporsi in tutto o in parte al trattamento dei dati che lo riguardano ai fini dell’invio di materiale pubblicitario, vendita diretta o ricerche di mercato o comunicazione commerciale; - ha il diritto di revocare il consenso in qualsiasi momento, senza pregiudizio alcuno per la liceità del trattamento eseguito in ragione del consenso prestato prima della revoca, nonché il diritto di proporre reclamo ad una autorità di controllo.

Bids in the auction room 3.1 To participate in the auction in person, it is necessary to have the appropriate numbered paddle, which is issued by the staff of Il Ponte at the registration desk, upon filling in the auction registration form and upon exhibiting the identity document of the potential buyer. Bidders shall place their bids by raising the numbered paddle. 3.2 Il Ponte invites potential buyers to pick up their numbered paddle ahead of time and informs them that they can also register for the auction during the exhibition period held prior to the auction. The shipping may be carried out by a carrier hired by Il Ponte, in accordance with the instructions of the Buyer, or hired directly by the Buyer, depending on the agreement between the parties 8.6 In the event of death, disqualification, incapacitation or termination, for any reason, of the Buyer, duly notified to Il Ponte, it is agreed that Il Ponte will deliver the lot on the basis of an agreement between all the assignees of the Buyer or in compliance with the procedures established by the judicial authority. 9. Transfer of risk 9.1 A purchased lot is entirely at the risk of the Buyer starting on the earliest of the following: (i) the date the Buyer receives the lot purchased, or (ii) the date the Buyer pays the Amount Due for the lot; if none of these events takes place, the transfer of risk will in any case have effect after the ten (10) day-period of the sale has elapsed. The transfer of risk to the Buyer expressly exonerates Il Ponte from any liability regarding the fate of the adjudicated lot as well as in the event of damages, theft, fire, destruction of loss of the lot itself (partial or total). 9.2 The Buyer will be compensated for any loss of or damage to the lot that occurs after the adjudication but before the transfer of risk, but the compensation may not exceed the Hammer Price of the lot plus the buyer's premium received by Il Ponte. In no event will Il Ponte be responsible for the loss or damage of glass/frames containing or covering prints, paintings or other works unless the frame and/or the glass is part of the auctioned lot. 9.3 In no event will Il Ponte be liable for any loss or damage (partial or total) of the adjudicated lot: (i) that occurs as a result of any action (including restoration or cleaning of the work or the frame) carried out by third parties appointed by anyone; (ii) arising, directly or indirectly, from: (a) changes in humidity or temperature; (b) normal wear and tear or gradual deterioration resulting from interventions on the object and/or other events (including woodworms and wood parasites); (c) errors in treatment; (d) war, nuclear fission, radioactive contamination, chemical, biochemical or electromagnetic weapons; (e) acts of terrorism; (f) in case of lockdowns or similar situations, Authority regulations and any other reason of force majeure outside the control of Il Ponte. 10. Counterfeiting 10.1 If, after the sale, a lot turns out to be a counterfeit, Il Ponte will reimburse any Buyer who has requested termination of the sale contract - upon the return of the lot to Il Ponte - in an amount equal to the Hammer Price and the buyer's premium paid, in both cases in the currency in which these amounts were paid by the Buyer. The obligation of Il Ponte is subject to the condition that, no later than five (5) years from the date of adjudication, the Buyer: (i) gives Il Ponte written notice, within ninety (90) days from the date on which he received information causing him to believe that the lot is counterfeit, of the lot number, the date of the auction where the lot was purchased and the reasons why the Buyer believes that the lot is counterfeit; (ii) is able to return the lot to Il Ponte free from any demands or claims by third parties made after the date of sale, and the lot is in the same condition as at the date of sale; (iii) provides Il Ponte with the reports of at least two scholars or independent experts of internationally recognized competence, in which they explain the reasons why the lot is to be considered a counterfeit. 10.2 Il Ponte will not be bound by the opinions provided by the Buyer, and reserves the right to request additional expert advice at its own expense. 10.3 Il Ponte will not make a refund if: (i) the description in the catalogue was in accordance with the generally accepted opinion of scholars and experts on the date of the sale or indicated that the authenticity or attribution of the lot was controversial; or (ii) on the date of publication of the catalogue the counterfeit nature of the lot could be ascertained only by carrying out analyses generally considered inadequate for that purpose or otherwise not feasible, whose cost was unreasonable or which might reasonably have damaged or otherwise resulted in a decrease in the value of the lot. Under this Article, counterfeit means, in the reasonable opinion of Il Ponte, the imitation of a lot offered for sale, not described as such in the auction catalogue, created for the purpose of deception in regard to the authorship, authenticity, provenance, attribution, origin, source, date, age, period of the lot, which on the date of the sale had a value lower than it would have had if the lot had corresponded to the description in the auction catalogue. A lot that has been restored or modified in any way (including repainting or painting over) does not constitute a counterfeit. 11. Export from the territory of the Italian Republic. Declaration of cultural interest 11.1 The export of a lot from the territory of the Italian Republic may be subject to the issuance of a certificate of free circulation or of an export license, in accordance with the requirements of Article 68 et seq. of the Italian Legislative

Decree 22 January 2004 no. 42 (Urbani Code). In the event that lots are subjected to the process of declaration of cultural interest (the so-called “notification”) pursuant to article 13 and the following Italian Legislative Decree no. 42/2004, the Buyer shall be responsible for the compliance to all the provision of law and of any other applicable special regulation, including customs matter, tax matters, currency regulations and protected species regulations. The responsibility of verifying possible restrictions on movements and/or on export of the lot of interest or the adjudicated lot, that is any licence or certificate provided for by law in Italy and in the country of destination, shall be borne solely by the participants to the auction and the Buyers, as well as any formality and legal requirements provided for by law in the matters of movement and/or export of the adjudicated lot, and Il Ponte shall be expressly exempted from any obligation and/or responsibility. 11.2 The failure to grant or the delay in issuing the certificate of free circulation and/or the export license shall not give rise to the termination or annulment of the sale, nor shall it justify the non-payment or delay in payment of the Amount Due by the Buyer. 11.3 At the Buyer’s request and expenses, Il Ponte may accept to apply for the issuance of the certificate of free circulation and/or the export license, provided that the Buyer has already paid the Amount Due. Il Ponte charges to the Buyer a fee of € 150.00 (plus VAT - as per law if due - and any transportation cost) for each work for which an application is filed. In any case, Il Ponte shall not be held responsible for any obligation or guarantee regarding the good outcome of the pertaining application. 11.4 Each lot offered for sale at auction could already be the subject of a declaration of cultural interest by the Ministry of Culture and Heritage and Tourism in accordance with Article 13 of the Urbani Code. In that case - or if, in relation to the lot, the proceeding of declaration of its cultural interest pursuant to Article 14 of the Urbani Code has commenced - Il Ponte will communicate as much in the catalogue and/or through an announcement made by the auctioneer before the lot is offered for sale. In the event the lot has been the subject of a declaration of cultural interest prior to its sale, the Seller will report the sale to the competent Ministry pursuant to Article 59 of the Urbani Code. The sale is subject to the condition precedent that the relevant Ministry exercises the right of pre-emption within sixty days of receipt of such report, or within a period greater than one hundred and eighty days, pursuant to Article 61 paragraph II of the Urbani Code. During the period provided for the exercise of the right of pre-emption, the lot cannot be delivered to the Buyer, pursuant to Article 61 of the Urbani Code. In any event, it is understood that any declaration of cultural interest (or even just the commencement of the related procedure) that should occur subsequently to the adjudication of a lot shall not invalidate or nullify neither the adjudication nor the obligation of payment of the total amount due and, in general, the purchase of the lot. 11.5 Please note that the lot marked with“§”symbol has been imported under a temporary customs licence. The hammer price for the lot will be subject to VAT (as per law if due) for EU residents only. The cost of € 300 regarding the final importation will be at the buyer's expense. Il Ponte will not be responsible for the delays in paperwork procedures. 11.6 Please note that the lot marked with “#”symbol has been imported under a temporary artistic importation licence. 12. Resale right 12.1 If due, the payment of the so-called “resale right” (introduced by the Italian Legislative Decree 13 February 2006, no. 118, implementing Directive 2001/84/EC) will be paid by the Seller. 13. Protected species 13.1 Regardless of the issue of a certificate or an export license under Article 68 et seq. of the Urbani Code, all lots consisting of or containing parts of plants or animals (e.g.: whalebone, crocodile, ivory, coral, turtle), regardless of their age or value, may require a permit or certificate before export, and/or additional licenses and/or certificates for importation into non-EU countries. The granting of a license or a certificate for import does not guarantee the issuing of a license or certificate for export, and vice versa. Il Ponte recommends that potential buyers check their own specific national legislation regarding requirements for the imports of goods made of or containing protected species into their country. It is the Buyer's responsibility to obtain these import or export licenses/certificates, as well as any other required supporting document, before making any bid and Il Ponte shall be expressly exempted from any responsibility and/or obligation. 14. Legal Guarantee of Conformity 14.1 When required by law, lots sold through Il Ponte are covered by the legal guarantee of conformity provided for in Articles 128-135 of the Italian Consumer Code (Legal Guarantee), if applicable.

14.2 The Legal Guarantee is given to the consumer (who, pursuant to Article 3, paragraph I, letter a) of the Consumer Code, is an individual who acts for purposes unrelated to his business, commercial, craft or professional activities). 14.3 The Seller is liable to the consumer for any lack of conformity existing at the time of delivery of the product and that becomes apparent within two years of that delivery. The lack of conformity must be reported to the Seller within two months of the date on which it was discovered, otherwise the guarantee is voided. Unless proved otherwise, it is assumed that any lack of conformity which becomes apparent within six months of delivery of the product already existed on the delivery date, unless this assumption is incompatible with the nature of the product or with the nature of the lack of conformity. From the seventh month following the delivery of the lot, it becomes the consumer's burden to prove that the defect existed at the time of delivery. In order to avail himself of the Legal Guarantee, therefore, the consumer shall first give proof of the date of the sale and of the delivery of the lot. The consumer, in order to be able to provide this proof, should therefore keep all documentation suitable to demonstrate the sale (for example, the purchase invoice) and the date of delivery or collection of the lot. 14.4 With reference to the definition of “lack of conformity”, please refer to the provisions of Article 129, paragraph II, of the Consumer Code. Excluded from the scope of the Legal Guarantee are defects caused by accidental events or by responsibilities of the consumer, or by any use of the lot that is incompatible to its intended use. 14.5 In the event of a lack of conformity duly reported in the appropriate terms, the consumer is entitled: (i) first of all, to the repair or replacement of the lot, at his choice, free of charge, unless the solution requested is impossible or excessively expensive compared to the other; (ii) second, (in cases where repair or replacement is impossible or prohibitively expensive or the repair or replacement did not take place within a reasonable time or the repair or replacement made previously caused significant inconvenience to the consumer) to a reduction in the Hammer Price or the termination of the contract, at his choice. The remedy requested is overly burdensome if it imposes unreasonable costs on the Seller with respect to alternative remedies that may be exercised, taking intoaccount: (i) the value the object would have if there were no lack of conformity; (ii) the nature of the lack of conformity; (iii) the possibility that the alternative remedy could be implemented without significant inconvenience to the consumer. 14.6 If, during the period of validity of the Legal Guarantee, the lot manifests a lack of conformity, the consumer may inform Il Ponte of this fact at the contacts provided in Article 16. Il Ponte will reply promptly to communications of any alleged lack of conformity and indicate to the consumer the specific procedure to be followed. 15. Jurisdiction and applicable law 16.1The contractual relationship between Il Ponte and the Buyer is governed by the Italian Law. These Terms and Conditions of Sale may be translated into other languages, should any conflict arise between the Italian original version and any foreign language translation, the conditions of sale included in the Italian version shall prevail and shall remain valid and binding. 16.2 In the case of consumer Buyers, for any dispute concerning the application, implementation and interpretation of these Terms and Conditions of Sale, the jurisdiction shall be the location where the consumer resides or is domiciled. 16.3 Under Article 141-sexies, paragraph 3 of the Consumer Code, when applicable, Il Ponte informs the consumer Buyer that, in the event he has filed a complaint directly with Il Ponte, after which however it has not been possible to resolve the dispute, Il Ponte will provide information about the Alternative Dispute Resolution entity or entities for the extra-judicial settlement of disputes relating to the obligations arising from any contract concluded under these Terms and Conditions of Sale (so-called ADR entities, as specified in Articles 141-bis et

seq. of the Consumer Code), specifying whether or not it intends to make use of such entities to resolve such dispute. 16.4 Il Ponte also informs the consumer Buyer that a European platform for online dispute resolution of consumer disputes has been established (the so-called ODR platform). The ODR platform is available at http://ec.europa.eu/consumers/odr/; through the ODR platform, the consumer Buyer may consult the list of ADR entities, find the link to the website of each of them and start an online dispute resolution procedure for the dispute in which he is involved. This is without prejudice of the consumer Buyer's right to appeal to a competent ordinary court for settlement of the dispute arising from these Terms and Conditions of Sale, regardless the outcome of the out-of-court dispute settlement procedure pursuant to Part V, Title II-bis of the Consumer Code. 16.5 The Buyer who is resident in an EU member state other than Italy may also have access, for any dispute concerning the application, implementation and interpretation of these Terms and Conditions of Sale, to the minor disputes procedure established by Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00. The text of the regulation is available on the website www.eur-lex.europa.eu. Additional Terms and Conditions of Sale for Online Bidding The following Additional Terms and Conditions of Sale for Online Bidding (Terms) apply to online auctions where Il Ponte – Casa d’Aste s.r.l., based in Milan, via Pontaccio 12 (20121), VAT no. 01481220133, fully paid-up share capital of Euros 34,320.00 (Il Ponte) allows online bids through the web site www.ponteonline.com (Web Site) and/or web sites of third parties (Platforms). Each lot is offered for sale by Il Ponte. All auction sale contracts concluded via online bidding through the Web Site and/or the Platform are are excluded from the rules of Chapter I, Title III of the Italian Legislative Decree no.206 of 6 September 2005 for the reason that the aforementioned contracts have been concluded at an auction sale. These Terms are in addition to (and do not replace) the above reproduced Terms and Conditions of Sale, whose definitions will be referred to in these Terms. By participating in an auction via the Web Site and/or the Platform, the bidder agrees to be bound by the Terms and Conditions of Sale applicable to the sale and these Terms. 1. One-Step Process and Irrevocability of an Online Bid. Exception to the Right of Withdrawal In order to register for an auction, a copy of a valid ID must be sent to info@ponteonline.com. Failure to do so, will make the registration impossible. Il Ponte reserves the right to refuse or to revoke registration for an auction at its sole discretion. The process for making a bid through the Web Site and/or the Platform is a one-step process; the bid is sent as soon as the bidder clicks the relevant button and it is final. By placing an online bid via the Web Site and/or the Platform, you accept and agree that bids are final and that you are not allowed in any way to amend or revoke it. Competing Bids If you have the leading bid this will be indicated on the Web Site and/or the Platform. Il Ponte’s responsibility Il Ponte will not be responsible for any errors or failures to execute bids placed via the Web Site and/or the Platform, including, without limitation, errors or failures caused by (i) a loss of connection to the internet or to the Web Site and/or the Platform software by either Il Ponte or the client; (ii) a breakdown or problem with the Web Site and/or the Platform software; or (iii) a breakdown or problem with a client’s internet connection, mobile network or computer. Treatment and legal basis Personal data, freely provided by the Customer to the company on the basis of the activity carried out by virtue of specific contractual regulations, will be treated in a lawful manner, according to correctness, and in accordance with the provisions of the Regulations, for the purpose of: - fulfilling the mandate to sell and / or participating in the scheduled auctions; - for the purposes established by the current anti-money laundering legislation (the Italian Legislative Decree 231/07 and subsequent amendments). The provision of the above data is mandatory for the holder to be able to carry out the task assigned to him. In case of refusal to provide the requested data, the holder will find it impossible to perform the contractually provided services, due to fact and fault of the Customer concerned. Personal data such as e-mail address, provided optionally by the Customer to the company on the basis of a specific consent issued by the same, will be processed in a lawful and correct manner, as well as in accordance with the Regulation for the purposes of forwarding information, updates and news regarding new auctions and / or future events. For this purpose the company will collect the consent with electronic and /or written modalities. The image will be recorded, by means of a video recording system and as per reported information, in the legitimate interest of the Owner, or in order to protect the safety of persons and the protection of the company's assets. 3. Processing tools and data storage methods The The data processed (which may be: common and identifying) are updated, complete, relevant and not excessive with respect to the aforementioned purposes of processing. The same data will be processed, in compliance with the security and confidentiality required through the following procedures: collection of data from the interested party, registration and storage of the same for predetermined, explicit and legitimate purposes. The same data will be processed using both paper and electronic and automated means. Personal data will be processed by the Data Controller as well as by employees and collaborators authorized to process the data. The data may be communicated, to the public bodies recipients of the communications /declarations object of the present contract, as well as to the appointed inspection persons, where required, during the verification and control phases related to the regularity of the fulfilments. The same data, object of this information, can be communicated to professionals

and /or collaborators of the holder for the accomplishment of the assigned task and for the same purposes. Moreover, the data in question will not be disseminated beyond the limits specified therein, unless otherwise indicated by the interested party, provided in writing. It is not the intention of the Data Controller to transfer the data object of this letter to a third country or to an international organization. It should be noted that the external backup is also performed by an Italian company, therefore also required to comply with the privacy legislation in question, through the use of server sites on Italian territory. There is no automated decision making process. Finally, the interested party is informed that the Data Controller has set up a great variety of security measures to protect data against the risk of loss, misuse or alteration. 4. Data retention period The data, subject of this information, will be kept: - for 10 years (ten years) from the conclusion of the contractual relationship, for treatment with a contractual legal basis; - 5 years from the withdrawl of consent for treatment with a consensual basis; - no more than 72 hours, relative to the treatment of images of the video surveillance. 5. Rights of the interested party The interested party has the right: - to ask the Data Controller to confirm or not the possession of personal data concerning himself, even if not yet registered, and their communication in an intelligible form, as well as access to personal data, its possible updating or integration, correction or the cancellation of the same, the transformation of the same in anonymous form or the blocking of those treated in violation of the law, the limitation of the processing that concerns himself or to oppose its treatment, in addition to the right to data portability. The interested party also has the right to obtain an indication of the origin of personal data, its purpose and the methods of treatment, as well as the logic applied in case of treatment carried out with the aid of electronic instruments; - he may also object in whole or in part to the processing of data concerning him for the purpose of sending advertising material, direct sales or market research or commercial communications; - he has the right to withdraw the consent at any time, without prejudice to the lawfulness of the processing performed on the basis of the consent given prior to the revocation, as well as the right to place a complaint with a supervisory authority.
