TERMS & CONDITIONS

Participation in any auction on the Hodgins Halls Auction Group bidding website (the “Site”) is subject to the Auction Terms and Conditions. Hodgins Halls Auction Group (Hodgins Art Auctions Ltd. and/or Hall’s Auction Services Ltd.), the “Auctioneer,” reserves the right to periodically modify the Terms and Conditions and it is your responsibility to review any changes prior to each use of the Site. By using the Site, you agree in advance to accept any such changes.

1. To participate in any auction, you are required to register on our Site. All registration information you provide shall be current, complete, and accurate. Bidders must be 18 years of age or older. You will be suspended or permanently banned from the Site if you provide false information when registering, such as a false name, fraudulent contact information, or a stolen credit card.

2. The Auctioneer reserves the right to pause, suspend, delay, or restart any auction in the event of internet outage.

3. Auction purchases are subject to a 20% Buyer’s Premium on the bid price.

4. Although the Auctioneer takes great care and diligence in the cataloguing of lots offered for auction, all property is sold “as is”.

All parties bidding at the sale shall be held to have informed themselves as to the condition, identity, and authenticity of lots, and are not entitled to make any objections after the sale on any grounds whatsoever. All items are sold on an as-is-where-is basis and no guarantee is given as to their condition or suitability for any purpose.

The Auctioneer does not include condition notes in the description of the lots. Please use the photographs as a guide to condition. If you have any questions or concerns, the Auctioneer will provide condition reports upon request.

Bidders can inspect auction lots in person during the scheduled preview times. Take this opportunity to determine the condition, size and whether any item may have been repaired or restored. By placing a bid online, you agree that you have either inspected the respective lot or have waived your right to do so.

5. All items offered for auction are subject to a start price which the Auctioneer will not sell below.

6. The auctioneer reserves the right to refuse admission to the sale, to refuse to approve the registration of any online bidder, or to refuse to recognize any or all bids from any particular person or persons at any auction. If the auctioneer decides that any opening bid is below the value of the lot offered, he may reject the same and withdraw the lot from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance.

7. The highest bid accepted at the lot closing will be the winning bid. The close of a successfully bid lot signifies the acceptance of a contract with the Auctioneer, selling as agent for the consignor.

8. The security of your account username and password is your sole responsibility, and you are responsible for any bids placed under your bidding account.

Once you place a bid, and if you win, you are obligated to buy the lot. Placing a bid on our Site, winning the lot, then not paying for the purchase may result in prosecution, suspension, or permanent ban from registering for future auctions.

9. Online auctions begin and end at a predetermined date and time. If an item receives a bid during the final two minutes of the count-down clock there will be an automatic bidding extension: the bidding clock will be extended by two minutes - for that item alone. The time extensions continue until there is a two-minute period during which no bidding takes place on the lot.

10. Credit card transactions may be limited to $ 5,000.

11. If the purchaser fails to pay for any lot within seven (7) days from the date of the auction sale, the Auctioneer may, without limitation of the rights of the Auctioneer against the buyer, resell any of the articles affected and in such case the original buyer shall be responsible to the Auctioneer for; (a) any deficiency in price between the re-sale amount and the amount to have been paid by the original buyer; (b) any reasonable charge by the Auctioneer for the storage of such articles until payment and removal by the subsequent buyer; (c) the amount of commission to which the Auctioneer would have earned had payment been made in full by the original buyer.

12. All auction purchases are subject to Goods and Services Tax (GST) on the bid price and Buyer’s Premium unless specifically stated otherwise. Harmonized Sales Tax (HST) in rates applicable to the purchasing province will apply unless the purchaser takes legal possession of purchases within Alberta. If a purchaser from an HST eligible province arranges their own shipping, then the legal delivery is deemed to have occurred within Alberta and only GST shall apply.

13. Neither the Auctioneer, nor its employees, nor its agents, shall be liable for any loss or damage of any kind to the lots after the expiration of seven (7) days from the date of the sale, whether caused by negligence or otherwise, while any lot is in or under the respective custody or control of the Auctioneer.

It is the responsibility of the buyer to make all arrangements for insuring, packing, and removing the property purchased and any assistance by the Auctioneer, or the employees of, agents or contractors in packing and removal shall be rendered as a courtesy and without any liability to them. The auctioneer shall not be liable for any damage to glass or frames and shall not be liable for any errors or omissions or damage caused by packers and shippers, notwithstanding the fact that the Auctioneer may have recommended such shippers or packers to the purchaser.

14. The buyer will comply with all laws, statutes, ordinances and regulations regarding bidding, purchase and transport of lots. The amount and/or type of alcoholic beverages purchased and taken into another province, state or country may be limited or entirely prohibited. The buyer is responsible for compliance with all applicable tax laws, duties and exportation and importation requirements. Each buyer represents and warrants that he or she will ensure that any purchased lots to be shipped will not be delivered to or received by any persons less than 18 years of age.

15. The purchaser(s) acknowledges that certain properties of Canadian cultural import may be subject to the provisions of Cultural Property Import and Export Act of Canada.

16. On no account is a consignor of any auction good allowed to bid on his or her own merchandise.

17. As a result of your participation in our online auction, or by inclusion on our mailing and e-mail notification list, we may have collected some or all the following personal information: name, address, postal/zip code, telephone number, e-mail address, and credit card information. This information will only be used by the Auctioneer to provide you with information regarding our products and services, namely upcoming auctions, and events. The Auctioneer does not sell or rent this information.

18. This agreement comprises the entirety of the contract between the Auctioneer and the buyer. The Auctioneer shall not be held liable in respect of any representations not made in writing herein. This agreement shall be governed in accordance with the laws of the Province of Alberta. In the event of a dispute hereunder, the Buyer agrees to submit to the exclusive jurisdiction of the provincial courts and the federal courts sitting in the Province of Alberta.

Jeff de Boer first became intrigued by armour as a 5-year old boy, accompanying his mother on a trip to Calgary's Glenbow Museum. His father was a sheet metal fabricator, so de Boer had easy access, from an early age, to the materials and tools with which to experiment. He made his first armoured mouse in 1986, while still a student at the Alberta College of Art & Design (now AU Arts). His chosen specialty of jewellery design, which required working with tiny tools to create fine detail, was instrumental in igniting the spark that grew into a lifetime passion.

Jeff de Boer has said of his armoured mouse series: "The mouse symbolizes an eternal underdog... By giving the mouse armour, I think it stands a fighting chance to take on the hostile world of cats (predators)". "The suit of armour is a transformation vehicle...something that only a hero would wear".

Each charming and whimsical armoured work - the artist has created over 500 during his 40 year career - takes inspiration from cultural and military history, whether Samurai, Hussar, or Medieval warrior. The museum-quality armour is carefully researched, detailed, and each piece meticulously hand-crafted.

De Boer's works can be found in numerous collections around the world. The artist was recently featured in a National Geographic article, "Meet the World's First (and Only) Cat and Mouse Armorer" (Kristen Romey; December 21, 2022).

Note: Maxwell Bates spent much of the 1930s living in London, visiting museums and galleries, and exhibiting his work. He then spent a year in Europe with the Middlesex regiment after enlisting, and 5 years as a German prisoner of war. Bates returned to Canada following WWII, and did not travel to Europe again until 1958/59 (this time with his wife Charlotte). On this leisurely trip he revisited many sites he had seen prior to the War and saw Italy for the first time. During this trip, Bates took notes and make sketches which he would develop into paintings upon his return home.

Larry Poons [b. 1937] is a respected American abstractionist whose artistic career has spanned over six decades. Poons began to painting in the late 1950s, and his work quickly rose to prominence in the 1960s in New York City, where he focused on Op-Art style abstraction. Represented early on by the Green Gallery in New York City, In 1965, he was included in MoMA’s exhibition, “The Responsive Eye”. He was subsequently the youngest artist to be included in their 1969 exhibition “New York Painting and Sculpture, 19401970”. In the later 1960s, with an interest in continuous development, he turned to looser abstraction. The 1970s saw Poons splashing, dripping and pouring paint directly onto his canvases. He began working directly on massive-scale canvas on the floor, immersing himself in the creation of the work, and subsequently cutting individual compositions from the roll. Today, Poons maintains an active practice and is internationally collected.

Georgian Bay, with its windswept pines, rocky islands, and tumultuous skies, drew Arthur Lismer back to paint summer after summer. First visiting in 1913 with Dr. James MacCallum, he quickly fell in love with the region and returned with his family every summer thereafter. "Thousands of islands, little and big, some of them mere rocks just breaking the surface," he wrote, "some of the trees like miniatures in an oriental garden, their roots seeking tenacious hold in the cracks of the rocks."

The windswept jack pines of the rocky terrain, now synonymous with the Group of Seven, were among his favourite subjects, their bending rhythms against the westerly wind a natural fit for his loose, energetic style. This 1932 watercolour sketch is a fine example: the gnarled branches and roots of the pine seem to whip across the page, the tree holding fast against the wide expanse.

Exhibited: “Exhibition of Paintings by the Late Sir Frederick Banting”, Hart House, University of Toronto, February 13 to March 1, 1943 (label verso). This painting is listed under the title “Probably Maligne Lake, Canadian Rockies” on page 32 of the book that accompanied the exhibition: “Banting as an Artist” (A.Y. Jackson, with memoir by Frederick W.W. Hipwell); The Ryerson Press, Toronto; 1943). On the second anniversary of Banting’s death, a special exhibition of Bantings paintings, drawings and wood carvings was held at the art gallery of Hart House (University of Toronto), from February 13-March 1, 1943. Banting was a regular contributor to the annual Senior Members’ Show at Hart House and a long-time supporter. Great efforts were made to track down all known works by the artist for this memorial tribute.

Exhibited: “Sir Frederick Banting 1891-1941, A Collection of Forty Sketches Presented with the Cooperation Lady Banting”, Owens Art Gallery, Mount Allison University, Sackville NB, October 1967 (label verso). The painting is listed as “Maligne Lake – Canadian Rockies – 1936” (catalogue #4).

Frederick Banting was the youngest of six children born to William Thompson and Margaret Grant Banting, born on the family farm in Essa Township just outside of Alliston, Ontario. It is surprising given his future achievements that Banting was described as an unremarkable, shy, but conscientious student, though he had varied interests that included athletics and art. Today, he is globally recognized for his lifetime achievements: most notably his 1921 discovery of insulin with Charles Best. He received the 1923 Nobel prize in Medicine with John Macleod, and a knighthood in 1934 for his remarkable contributions to medicine. During his scientific career, Banting also became a respected artist, closely associated with A.Y. Jackson and the Group of Seven. As a young man, he enjoyed sketching nature and drew pen and ink cartoons.

He took up painting more seriously in 1920 while struggling to establish a medical practice in London, Ontario, and it became an important means of relaxation for him as his career progressed. In 1925, Banting joined the Arts and Letters Club of Toronto, and around the same time, first met A.Y. Jackson. Through Jackson and the club, Banting became aware of the work of the founding members of the Group of Seven and their philosophies about Canadian art. Jackson and Banting soon forged a strong friendship, and they were regular sketching partners for 16 years, travelling across Canada to paint the varied landscape together.

It was at the Arts and Letters Club that Banting was also introduced to images and tales of the western Rocky Mountains, prompting his first trip there in 1925. A few years later in 1928, Banting and Jackson headed West to sketch the Rockies for the first time together. Banting would show Jackson his sketches for feedback and invested significant time and effort into advancing his painting skills. Over time, he developed his own style, more controlled, contemplative of form, colour and representation.

In June 1936, Banting returned to Jasper en-route to the annual Canadian Medical Association convention in Victoria. He was the very first guest for the opening of the season at Jasper Park Lodge on June 15th: “I just bummed around there and loafed and painted,” he told reporters at the convention, “I had intended on going south after the convention, but I was so charmed with the place that I have decided to spend another few days in Jasper on my return.” True to his work, he did return and spent three additional weeks in Jasper to devote his time entirely to sketching. It was this trip to which most of Banting’s surviving Jasper sketches are attributed.

The vantage point of “Maligne Lake, Canadian Rockies” is likely from the area of the Bald Hills in Jasper National Park. Today, the challenging route through Bald Hills passes through a forest of lodgepole pine to treeline, where summits and ridgelines connect through alpine meadows, allowing one to wander and take in the everchanging views of Maligne Lake and the surrounding peaks. “I have never found myself in such surrounding anywhere else,” he stated upon return from this 1936 trip, “No matter where you look, you find something majestic, dignified, and aweinspiring. To me it is one of the most beautiful settings in the world.”

Reference: "A Prairie Boy's Summer" (William Kurelek; Tundra Books of Montreal; 1975). This book includes a full-page illustration of a very similar example (#14), from the collection of Art WindsorEssex (formerly Art Gallery of Windsor).

William Kurelek was born in 1927 on his family’s farm near Whitfield, Alberta. The eldest of seven children born to Dmytro and Mary Kurelek, young Kurelek grew up in a Ukrainian-Canadian farming family: Dmytro immigrated from Western Ukraine in 1924, while Mary was the daughter of first-generation Ukrainian immigrants who had arrived in Canada at the turn of the century. Kurelek spent his first seven years at Whitfield before the family moved to a farm near Stonewall, Manitoba in 1934. From the beginning of his career, both in his art and his writing, the artist closely examined his childhood on the prairies. His work frequently returned to memories of early childhood experiences, offering both nostalgic and honest accounts of the realities of life during the Great Depression.

The composition for (1976) first appeared in Kurelek’s second children’s book, “A Prairie Boy’s Summer” (1975). Kurelek would return to these images in later paintings, like we see here, spurred by the popularity of their subjects. He often referred to them as “potboilers”, a somewhat self-deprecating label from the humble artist, for these pastoral scenes of prairie life that would become among the artist’s best-known paintings. "A Prairie Boy’s Winter and Summer", and this overall aspect of his practice, were enormously popular and established Kurelek as a beloved “people’s painter”. Critics and collectors alike resonated with these evocative scenes of prairie life. (CONT.)

On “Making a Smudge”, #14 in “A Prairie Boy’s Summer”, Kurelek wrote the following:

"Apart from milking, dairying was much easier in summer than in winter. After his father put up an electric fence the cows took little looking after; all the boys had to do was pump a tankful of water for them.

But every summer evening, there was one more favor the cattle appreciated - especially in wetter years. Clouds of mosquitoes appeared - people said they came off the bog to the east - and William's parents would send him out at sunset to build a smudge fire to protect the animals from the pests.

Making a smudge wasn't the same as making a bonfire though it was sometimes called that. William's father showed him how to mix layers of dry straw with layers of wet straw or manure so that the pile would glow and smoke instead of blaze. Otherwise the fire would burn out long before daylight and the cattle would be unprotected. Of course, if there was no breeze the smoke didn't help much, for it went straight up. But that didn't happen very often.

William found there were really no gentlemen in the animal world. Even if the cows got to the smudge first, the farm horses always came along and took away the places in the smoke. The cows knew the horses were bullies, so they moved out of the way before they were bitten or pushed aside."

While there is a sentimental quality to the illustrative imagery and text, the apparent simplicity is deceptive. Kurelek’s childhood, which he is depicting here, was by no means gentle. An anxious and introverted child, Kurelek struggled deeply to connect with others, was physically fragile, and experienced mental health challenges from an early age. In his autobiography, “Someone With Me”, he describes his life as an outsider both in his family and at school. Moreover, farm work is grueling. As The New York Times noted of “A Prairie Boy’s Summer”, the book “walks the straight furrow between the sentimentality of nostalgia and the brutalizing of sweated labor.”

Like much of Kurelek’s work, “Making A Smudge” is a duality. As the evening sun sets, glowing softly over the trees, the young William pitchforks a burning pile of hay and manure: a tender and harsh image that captures both the quiet beauty of a prairie evening and the difficult, gritty realities of farm life.
