Club Standards

General Standards

1. All persons using the Club Facilities must abide by the Club Documents.

2. The Club may amend the Glen Kernan Standard from time to time, in its sole discretion, without notice to Members or other persons entitled to use the Club Facilities. All capitalized terms used in the Glen Kernan Standard that are not defined herein shall have the meanings given to them in the Membership Plan. All amendments to the Glen Kernan Standard will become effective immediately upon the posting of a copy in a conspicuous place at the Club, posting online or on a platform available to Members, by announcement thereof in the Club’s newsletter and copies thereof being made available to Members, or upon mailing to Members, whichever is first to occur. In the event of conflict between the Glen Kernan Standard or any other rules and regulations promulgated by the Club and the Membership Plan and/or a Member’s Membership Application, such conflict will be resolved by the Club to make such provisions as consistent as possible and, in any event, any such inconsistency will be construed in favor of the Membership Plan, the Glen Kernan Standard and a Member’s Membership Application, in such order.

3. The Glen Kernan Standard reflects appropriate behavior of a private golf-oriented club. Courtesy, appropriate conduct and discipline complement our Club Facilities and enhance the social and golfing atmosphere. To preserve our traditions and maintain pride in the Club, all persons must observe the Glen Kernan Standard. Cooperation in observing the rules of decorous behavior, mode of dress and standards of conduct are required for Membership at the Club and for use of the Club Facilities by Members, Members’ immediate family Members and Guests, and visitors.

4. The Club Facilities will be open on the days and during the hours as may be established by the Club, in its sole discretion. The Club Facilities and other areas of the Club may be closed for scheduled maintenance and repairs, as needed.

5. Alcoholic beverages will not be served, sold or permitted to be consumed on the Club’s premises in any manner prohibited by law. Alcoholic beverages will not be sold or served to any person not permitted to purchase the same under the laws of the State of Florida. The Club reserves the right, in its sole discretion, to refuse service to any person for any reason or no reason whatsoever.

6. All food and beverages consumed on the Club’s premises must be furnished by the Club. No one is allowed to bring their own food and/or beverages to the Club Facilities or on the Club’s premises at any time unless approved, in writing, in advance by the General Manager of the Club (the “General Manager”). Personal coolers are not permitted at the Club Facilities or on golf carts. Food and beverage service is available at the Clubhouse and the Athletic Club (as applicable).

7. Outside catering is only permitted with the prior written approval of the General Manager.

8. Club employees are permitted to deliver food and beverages to locations away from the immediate area of the Clubhouse or other designated areas of the Club only with the prior written approval of the General Manager.

9. Commercial advertisements cannot be posted or circulated anywhere on the Club’s premises, and solicitations of any kind cannot be made on the Club’s premises or upon the Club's stationery without the prior written approval of the Club. Other than as permitted in writing by the Club, petitions of any kind cannot be originated, solicited, circulated, or posted on the Club’s premises.

10. No one is permitted to establish any commercial enterprise on the Club’s premises, unless established by the Club. Written permission must be obtained from the Club in order to conduct any commercial activity on the Club’s premises.

11. No one is permitted to use the roster or list of Members for solicitation, commercial or political purposes, or distribute such roster or list to anyone other than a Member. The roster or list of Members is considered confidential private property of the Club and cannot be used or given to anyone by a Member for any reason whatsoever, and may only be published and distributed to Members by the Club.

12. It is contrary to the Club's policy to have the Club Facilities used for functions or fundraising efforts for the benefit of a political cause, except as specifically permitted by the Club in writing. The Club Facilities cannot be used in connection with organized religious services or other activities, except as may be approved, in writing, by the Club.

13. No one is permitted to request services unrelated to the Club or special or personal services from Club employees who are not on duty, or that are outside the scope of such employee’s duties. No one is permitted to use the Club's furnishings or equipment, which are not ordinarily available for use.

14. The Club prohibits bringing a pet (a domestic animal kept for pleasure or companionship) to any of the Club Facilities without the prior written permission of the Club, with the exception of service animals pursuant to the Americans with Disabilities Act. Where dogs are permitted at the Club Facilities, they must be on a leash at all times. All persons are responsible for damage and injuries caused on the Club’s premises by an animal owned or controlled by such person or such person’s family Members and/or Guests.

15. Skateboards, roller skates, roller blades, mopeds, scooters, hover boards, and other similar items are not permitted at any of the Club Facilities.

16. All persons must not abuse Club employees, verbally or otherwise. All Club employees are under the supervision of Hampton Golf and no one is permitted to reprimand or otherwise discipline any Club employee. In addition, no one is permitted to request a Club employee to leave the Club Facilities for any reason. Any Club employee not rendering courteous and prompt service should be reported to the General Manager or Hampton Golf immediately.

17. Self-parking is permitted in areas identified as such. Parking is not allowed on grassed areas, unless specified for a particular event as determined by the Club in its sole discretion. “No Parking,” “Disabled Driver” and all other parking signs must be observed.

18. Smoking is not permitted at the Club Facilities, except those certain areas approved and designated as outdoor smoking areas by the Club.

19. Firearms and all other weapons of any kind are strictly prohibited and are not permitted on the Club’s premises or into the Club Facilities at any time.

20. Use of the Club Facilities may be restricted or reserved from time to time by the Club.

21. Violation of any of part or portion of the Glen Kernan Standard or conduct in a manner prejudicial to the best interests of the Club will subject the person in violation to disciplinary action by the Club in accordance with the Club Documents.

22. Club employees have full authority to enforce the Glen Kernan Standard and any infractions will be reported to the Club.

General Club Standards (Continued)

23. Horseplay, profanity, disruptive conduct, and indiscreet behavior are strictly prohibited at the Club Facilities.

24. The Club may, in its sole discretion, establish rules and regulations for the use of cell phones at any of the Club Facilities, or provide restrictions to prevent the use of cell phones while persons are using any of the Club Facilities or on the Club’s premises.

25. Lockers and bag storage are available for Members only and may be reserved on a “first-come, firstserved basis.” The Club may, in its sole discretion, reassign or revoke locker and/or bag storage privileges of any person for any reason at any time.

26. Members are responsible for informing and updating their family Members and Guests (as applicable) of all Club policies, including the Club Documents, and are expected to ensure that their family Members and Guests (as applicable) adhere to such policies.

27. Each person is responsible for their own conduct and for the conduct of their family Members and Guests. Any Member, or any Member’s family Members and/or Guests, whose conduct, manner, deportment or appearance is deemed by the Club, in its sole discretion, as likely to endanger the welfare, safety, harmony, or good reputation of the Club or its Members, or is determined to be otherwise improper, may be reprimanded, fined, suspended, or expelled from the Club and may have all privileges associated with their Membership restricted, suspended or terminated by the Club. The Club is the sole judge of what constitutes improper conduct. Suspension or termination of Membership and use privileges are outlined in detail in the Membership Plan.

28. The Club may, in its sole discretion, demand any person to leave the Club’s premises at any time and for any reason or no reason whatsoever.

29. Each person is ultimately responsible for his/her own safety and must take all necessary measures to protect themselves while on the Club’s premises, including when operating a golf cart or encountering wildlife on the Club’s premises.

30. Alligators, deer, bobcats, boar, snakes (in particular, water moccasins), and other wildlife are a part of the natural environment surrounding a Golf Course, especially in the State of Florida, and thus, golfers may encounter wildlife while on Club property, particularly near water. Be alert to the presence of wildlife on and adjacent to the Golf Course, cart paths and natural areas. Never approach, provoke or interfere with any animal. Notify a Club employee immediately of the presence of any wildlife.

Children

1. Children under twelve (12) years of age are not allowed at the Club Facilities, unless accompanied and supervised by an adult.

2. Children under the lawful drinking age in the State of Florida are not permitted in any bar or lounge, unless accompanied and supervised by an adult. Children are permitted in dining facilities where alcoholic beverages are also being served, and must be supervised by an adult.

3. Under no circumstances will anyone under twenty-one (21) years of age be served alcoholic beverages.

4. Children under eighteen (18) years of age are permitted in the locker rooms only when accompanied by an adult (this rule does not apply to the restrooms).

5. All persons are responsible for the conduct and safety of their children when enjoying the Club Facilities.

6. Persons may be reprimanded, fined, suspended, or expelled from the Club and Members may have all privileges associated with their Membership restricted, suspended or terminated by the Club based on the conduct and behavior of their children. Children (Continued)

GLEN

1. It is expected that all persons will choose to dress in a fashion befitting the surroundings and atmosphere provided in the setting of the Club and exercise sound judgment in dress. The Club may publish dress requirements from time to time. The Club is entitled to make the final determination, in its sole discretion, as to the appropriateness of any person’s dress or attire.

2. Members are responsible for advising their family Members and Guests of the Club’s dress requirements.

3. Spiked golf shoes are not permitted at the Club Facilities, including the Golf Course and Practice Facilities. It is mandatory that all persons wear soft spiked or spikeless golf shoes.

4. For the Golf Course and Practice Facilities:

Men: Shorts must be an appropriate length. Shirts must be golf specific, have sleeves and have a regular or mock turtleneck collar. Cut-offs, running shorts, tank tops and tee shirts are not allowed.

Women: Shorts or skirts must be an appropriate length. Ladies may wear sleeveless shirts, but cannot wear tank tops. Cut-offs, running shorts, tank tops, and tee shirts are not allowed.

Guest Privileges & Policies

1. Guest privileges may be extended under the Glen Kernan Standard, as amended, from time to time, in the Club’s sole discretion.

2. Although it is the intention of the Club to accommodate Guests without inconvenience to Members, the Club reserves the right to limit the number of Guests that may accompany a Member on any given day.

3. The Club may change the daily Guest fees, charges and policies for use of the Club Facilities by Guests at any time and for any reason, in its sole discretion.

4. Guest privileges may be denied, withdrawn or revoked at any time and for any reason considered sufficient by the Club.

5. All Guests of a Member must either be an Accompanied Guest (as defined below) or an Unaccompanied Guest (as defined below).

6. An “Accompanied Guest” is any Guest who is accompanied by the sponsoring or hosting Member (as applicable) when using the Club Facilities. All other Guests are considered “Unaccompanied Guests.” The Club will allow Unaccompanied Guests in the Club’s sole discretion on specific days and times.

7. Accompanied Guests are permitted to use the Club Facilities in accordance with the Membership privileges of the sponsoring Member.

8. Guests will be charged the applicable fees as established by the Club from time to time. Guests will have the opportunity to pay any Club charges and other fees incurred by the Guest at the Club; provided that the sponsoring Member will be responsible for all such charges incurred, but not paid by their Guests.

9. Each Member is responsible for the conduct of his/her Guests at the Club, whether the Guest is an Accompanied Guest or an Unaccompanied Guest.

10. An Accompanied Guest and Unaccompanied Guest may use the Golf Course (including the Practice Facilities) no more than a cumulative total of six (6) times per calendar year. A Member may have up to four (4) Guests (whether Accompanied Guest(s) or Unaccompanied Guest(s)) per each visit. The Club reserves the right to amend the number of times Accompanied Guests and/or Unaccompanied Guests are permitted to use the Club Facilities at any time and for any reason.

11. A House Guest (as defined herein) may use the Golf Course (including the Practice Facilities) no more than a cumulative total of six (6) times per calendar year. A “House Guest” is any Guest who is temporarily staying at the home of a resident Member for a limited period of time with the resident Member’s permission. If increased access to and use of the Golf Course and/or Practice Facilities of any House Guest is desired, the resident Member must register the respective House Guest with the Club and make arrangements in advance of said access and use in each instance. The Club reserves the right to amend the number of times House Guests are permitted to use the Club Facilities at any time and for any reason.

12. If the manner, deportment or appearance of any Guest is deemed to be unsatisfactory, as determined by the General Manager in his/her sole discretion, the sponsoring Member must, or the Club may (in the case of an Unaccompanied Guest), cause such Guest to leave the Club’s premises upon the General Manager’s request.

13. The Club may allow use of the Club Facilities by Guests of the Club on such terms, conditions, and rates and with such privileges as the Club determines in its sole discretion, from time to time.

14. Each Member is responsible for informing and updating their Guests as to the Glen Kernan Standard and other policies of the Club.

Clubhouse Standards

General Clubhouse Standards

1. The Club provides a variety of sports, cultural, educational, and recreational events in which all Members and Guests are encouraged to participate.

2. Reservations are required for most activities at the Club and are accepted on a “first-come, first- served” basis by pre-registering with the appropriate personnel of the Club.

3. A Member is entitled to charging privileges at the Club; provided that his/her Membership is in good standing and the Member has provided the Club with a valid commercial credit or debit card number or bank account information.

4. Cash payments are not permitted at the Club.

5. For the convenience of all persons, a gratuity percentage, as determined from time to time by the Club, may be added to all food and beverage sales. Any person with charging privileges may increase the gratuity percentage by signing the ticket invoice and changing the amount of the gratuity as they deem appropriate.

Dining Facilities - Reservations & Cancellations

1. The dining and reservation policies, and any corresponding fees (e.g., corkage fee), are determined by the Club, in its sole discretion, and are subject to change from time to time.

2. Cancellation of reservations without timely notice may result in being charged a cancellation fee.

3. Dinner reservations may be required as determined by the Club from time to time and must be made by contacting the Club by using the Club’s mobile application. Members should assist in maintaining required service levels by making reservations at least twenty-four (24) hours in advance.

4. To cancel a reservation for a special dining event at the Club (e.g., New Year’s Eve, Thanksgiving, Wine Dinners, Easter, etc.), the Club must be notified at least seven (7) days prior to the event. Cancellations after this deadline can only be accepted without a cancellation charge, if there is a waiting list from which the Club can fill the cancelled reservation. If there is no waiting list, the Club may, in its sole discretion, charge the Member a cancellation fee.

5. Reservations for dining will be held for only fifteen (15) minutes after the reserved time. All reservations will be seated promptly according to their confirmed reservation time to ensure proper service.

6. Dining room activities for small groups (i.e., of 13 persons or more) are only permitted with the permission of the Food and Beverage Director of the Club, in its sole discretion, who must approve plans or dates for Clubhouse activities in advance.

7. The Member sponsoring any gathering at the Club is responsible for the conduct of all Guests, family Members, agents, employees, invitees, and licensees on the Club’s premises and is responsible for the cost to repair any damage to the Club Facilities or surrounding area, as well as for any violations of the Club Documents and/or other policies that occur on the Club’s premises. Member gatherings must not interfere with the regular operation of the Club or the enjoyment of the Members using the Club Facilities at the time of the event, subject to the sole discretion of the Club.

8. The Club reserves the right, in its sole discretion, to change or modify the hours of operation of the dining facilities and reservation policies as well as other services provided at the Club as may be determined from time to time.

Golf Standards

General Standards

1. Persons using the Golf Course and the Practice Facilities must do their part to make a round of golf a pleasant experience for everyone at the Club and to ensure excellent playing conditions.

2. Although the Golf Shop Team may warn golfers about lightning in the area, of which they are aware, golfers must not rely on the Golf Shop Team to detect lightning and warn them. If lightning is in the area, golfers must stop play immediately and seek shelter.

3. The Club may close the Golf Course and the Practice Facilities to plan for adverse weather conditions, for maintenance purposes or when the Golf Course could be damaged by play. If play is suspended by the Club, all golfers must leave the Golf Course and Practice Facilities immediately.

4. Only golf Members have access to and may utilize the Golf Course (including the short game facility) and Practice Facilities.

5. Sports-Social Members may only access and utilize the Golf Course and Practice Facilities as the Guest of a golf Member or if participating in instruction with Club Team.

6. All persons using the Golf Course and Practice Facilities must adhere to the Rules of Golf and the Rules of Etiquette, both as adopted by the United States Golf Association (“USGA”), except when modified by local rules or the Club Documents.

7. Cooperation with the Golf Shop Team and Golf Course maintenance Team is appreciated and expected.

8. Hours of operation for the Golf Course and Practice Facilities are established by the Club, in its sole discretion, based upon the demand and the time of year. The hours will be posted in the Golf Shop.

9. All golfers must check in and register at the Golf Shop or with the Club Team before beginning play on the Golf Course.

10. Under no circumstances are golfers permitted to start play from residences.

11. Jogging, bicycling, fishing, recreational walking, hunting, ball hunting, sightseeing, or any other recreation-related activities are not permitted on the Golf Course or the Practice Facilities at any time, unless such activities are given specific permission, in writing, by the General Manager.

12. No beverage coolers are permitted on the Golf Course or the Practice Facilities, unless provided by the Club.

13. The Practice Facilities will be open during normal business hours as posted in the Golf Shop. The Practice Facilities may be closed for general maintenance from time to time, in the Club’s sole discretion.

14. Range balls are for use on the Practice Facilities only and are not to be removed from the Practice Facilities. Range balls must not be used on the Golf Course.

15. Balls must be hit from designated areas on the Practice Facilities. No hitting is permitted from the rough or sides of the Practice Facilities. No hitting is permitted from the driving range to non-designated areas.

16. Children under twelve (12) years of age will be permitted on the Golf Course and the Practice Facilities upon approval from the Head Golf Professional of the Club (the “Head Golf Pro”) and only when accompanied by an adult or an instructor. Golfers that are twelve (12) years of age or older are permitted to use the Golf Course and the Practice Facilities, subject to the approval of the Head Golf Pro or, in his/her absence, the Golf Shop Team.

17. Handicaps will be permitted at the discretion of the Club and per then-applicable policies and procedures of the Club and the current USGA handicap system. All golfers with Golf Course privileges and their Guests that have a USGA-approved handicap may participate in Club-sponsored golf tournaments at the discretion of the Head Golf Pro. Golfers are responsible for turning in their scores. All handicaps submitted may be reviewed by the Golf Shop Team.

On-Course Standards

1. The Club has the authority, in its sole discretion, to decide when the Golf Course is fit for play. When the Golf Course has been closed, it can only be reopened by the General Manager.

2. In order to maintain the condition of the Golf Course, soft spike or spike-less golf shoes are the only type of golf shoes allowed. Golf shoes with metal spikes are not permitted anywhere on the Club’s premises.

3. Practice is not allowed on the Golf Course. All persons must use the Practice Facilities for all practice. All persons must avoid unnecessary damage to the Golf Course by limiting the use of mulligans and practice swings.

4. Speed of play is strictly enforced. All groups are required to keep pace with the groups in front of them. If a foursome or other group of golfers fails to keep their pace during play and falls behind the preceding group by more than one (1) hole, such group must allow the following group to play through. The same must be followed when stopping to search for a lost ball. No more than three (3) minutes should be used to search for lost balls.

5. All golfers who stop after playing nine (9) holes for any reason must occupy the next tee before the following golfers arrive at the tee or they will lose their position on the Golf Course, and must get permission from the Golf Shop Team to resume play.

6. “Ball hawking” is not allowed on the Golf Course at any time.

7. Members and their Guests may walk the Golf Course during the times and in accordance with certain rules and regulations promulgated by the Club, from time to time, in the Club’s sole discretion. Upon prior approval by the Club, use of a walking trolley is permitted during the hours walking is allowed. Walkers must maintain the pace of play set by the Club from time to time.

8. A round of golf should be completed in four (4) hours and fifteen (15) minutes, or less. Club employees may be on duty to help regulate play, speed of play and enforce the Glen Kernan Standard. Club employees have full authority as representatives of the Club to enforce all rules and pace of play on the Golf Course. If a golfer is repeatedly warned for slow play, the Club may take such action as it deems appropriate, including without limitation, restricting the person's use of the Golf Course during certain times of day.

9. Twosomes and singles may be requested by the Club to group with other golfers.

10. Groups of five (5) or more golfers must be approved in advance by the Head Golf Pro or the Golf Shop Team.

11. Golfers who provide a doctor’s certification of medical necessity to the Club will be provided a handicap flag designating that they have a disability. Handicap flag recipients may operate their golf carts closer to tees and greens than is normal. Due consideration to avoid damaging the Golf Course is expected. Handicap flag recipients must not operate a golf cart closer than ten (10) feet of the putting surface. If abnormal conditions dictate the Golf Course (e.g., course saturation and maintenance projects, such as overseeding), handicap flag recipients may be required to stay in the rough or on the golf cart paths as directed by the Club.

Golf Course Care & Etiquette

1. Each golfer must repair all ball marks.

2. Do not replace divots. Divots must be filled with soil mix/sand provided on each golf cart and then leveled to the surrounding surface on both fairways and rough.

3. Bunkers must be entered and exited from the low side (i.e., the nearest level point to the green) and raked neatly and thoroughly after use. Rakes must be laid near the low point of the bunker and the rake side must lay in the bunker with the handle side laying on the grass.

4. Keep golf carts off greens, green surrounds, tees, and tee slopes.

5. The time required to “hole out” on and around the green is a chief cause of slow play. Study and clear the line of your putt while others are doing the same. Be ready to putt when it is your turn.

1. Golf carts must not be used by any person on the Club’s premises without proper assignment and registration in the Golf Shop or with golf Team.

2. Each operator of a golf cart must be at least sixteen (16) years old and have a valid automobile driver’s license.

3. Only two (2) persons and two (2) sets of golf clubs are permitted per golf cart.

4. All persons must obey all golf cart traffic signs. Golf carts do not have the right-of-way on roadways and all persons must observe vehicles on the roads, exercising and prioritizing caution and vigilance towards vehicular traffic.

5. Persons utilizing a Club golf cart cannot drive said golf cart on roads, unless no other path or route is available to drive to the appropriate hole during a round of golf. Other than the foregoing, a Club golf cart cannot be driven throughout the Community, to any residence within the Community, or for any other purpose.

6. All persons must use golf cart paths where provided, especially near tees and greens. Use the ninetydegree rule (e.g., cross fairways only at right angles at ninety (90) degrees). Golfers are required to remain on cart paths on all par 3 holes without exception and any other holes as determined by the Club from time to time. Notwithstanding the foregoing, handicap placard recipients may operate a golf cart closer to greens complexes on par 3 holes, but must demonstrate due care and consideration in doing so.

7. Only vehicles approved by the Club will be allowed on the Golf Course, including its cart paths.

8. Be careful to avoid soft areas on fairways, especially after rain. Use roughs whenever possible. Never drive a golf cart through a hazard.

9. Operation of a golf cart is at the risk of the operator and all persons accept and assume all responsibility for liability connected with operation of the golf cart. Cost of repair to a golf cart which is damaged by a Member or a Member’s family Members and Guests will be charged to the accompanying Member or to the sponsoring Member, respectively. Each Member is fully responsible for any and all damages, including damages to the golf cart, that are caused by the Member or said Member’s family Members and/or Guests, and said Member shall reimburse the Club for any and all damages the Club may sustain by such use.

10. Parking of golf carts is allowed in designated areas only.

11. In the Club’s sole discretion, Members may own a private golf cart for use on the Golf Course for a fee and pursuant to policies set by the Club. As a condition to private golf cart use on the Golf Course, Members must enter into a Private Golf Cart Lease Agreement with the Club; provided that the Club reserves the right to not approve or enter into said agreement with any Member in the Club’s sole discretion. The Private Golf Cart Lease Agreement will outline the policies governing private golf cart use at the Club Facilities.

12. Golf carts are not permitted on any tee area of the Practice Facilities. Golf cart parking is allowed in designated areas only.

13. All Members are required to pair up on Club golf carts to limit the number of carts required for any one group.

Athletic Club Standards

Use of the Athletic Club (including basketball courts, volleyball courts, soccer fields, pavilion, and all other related amenities) is permitted for Members and Accompanied Guests only, and is subject to applicable policies.

Wellness & Fitness Center

1. Hours of operation will be posted in the Wellness and Fitness Center and may be changed from time to time at the discretion of the Club.

2. Access to the Wellness and Fitness Center requires access using the Glen Kernan Club mobile app, which can be obtained by contacting the Club's Membership Office.

3. Prior to the use of the exercise equipment at the Wellness and Fitness Center, all persons will be required to sign a waiver of liability agreeing to hold certain parties harmless from any and all injuries and losses sustained from the use of the exercise equipment.

4. All persons using the Wellness and Fitness Center might be required to sign in upon entering the Wellness and Fitness Center from time to time.

5. Family Members and Guests of a Member using the Wellness and Fitness Center must be accompanied by the sponsoring Member or designee. Guest fees may be charged for use of the fitness facilities at the Wellness and Fitness Center and the Member’s account may be billed for such fees.

6. Casual workout attire is acceptable at the Wellness and Fitness Center. Tee shirts, tank tops, gym shorts, and warm-up pants are appropriate attire for men and leotards, tights, tee shirts, tank tops, gym shorts, and warm-up pants are appropriate attire for women. Appropriate footwear with non-scuffing soles is required in the fitness facilities (including the Aerobics Room) of the Wellness and Fitness Center.

7. Pregnant women must use caution in using the Wellness and Fitness Center after consultation with a licensed physician for guidelines.

8. Any person with health or physical problems must first consult with their physician before using any of the fitness facilities at the Wellness and Fitness Center.

9. All persons using the Wellness and Fitness Center assume full risk of loss and responsibility for any injury or damage to their health. It is the responsibility of all persons using the Wellness and Fitness Center to consult with their physician, and such person should be in good physical condition and have no physical, medical or psychological conditions, disabilities, impairments, or ailments, chronic or otherwise, which would preclude, impair or prevent them from safely using the exercise facilities, or engaging in active or passive exercise.

10. Smoking and alcoholic beverages are prohibited at the Wellness and Fitness Center. Gum, food and drinks (with the exception of sport bottles filled with water or sport drinks) are not allowed at the Wellness and Fitness Center.

11. It is the responsibility of each person to obtain instruction on how to use any equipment at the Wellness and Fitness Center prior to using such equipment, and the equipment is only to be used in accordance with such instructions and guidelines.

12. For the enjoyment of all persons using the Wellness and Fitness Center, during peak usage periods, please observe proper etiquette by observing thirty (30) minute time limits on any one (1) piece of equipment, including cardio equipment.

13. Please return all free weights to the proper storage rack and equipment to its proper place. Do not drop weights on the floor; place the weights on the floor gently.

14. Disinfectant wipes are provided in the fitness facilities of the Wellness and Fitness Center. Each person must use disinfectant wipes to clean equipment after use.

15. Towels are provided at the Wellness and Fitness Center and any used towels must be placed in proper receptacles.

16. All persons must not store clothing or personal possessions under benches or in the common areas, except for locker room facilities. Lockers are not provided for permanent storage. Do not leave valuables in lockers. The Club is not responsible for lost or stolen items.

17. Children under sixteen (16) years of age are not permitted to use the Wellness and Fitness Center, unless accompanied and supervised by an adult. Children under twelve (12) years of age are not permitted to access or utilize the Wellness and Fitness Center under any circumstances whatsoever.

18. Please keep the Wellness and Fitness Center clean by placing all refuse in containers provided for this purpose.

19. Electronic devices must not be so loud as to disturb other users.

20. Personal training sessions may be available by appointment. Cancellation must be made at least twenty-four (24) hours prior to the scheduled appointment. If a client is late for an appointment, the session will only last the remainder of the scheduled appointment.

21. Members may bring up to one (1) Guest to the Wellness and Fitness Center at any one (1) time, unless a greater number is approved by the General Manager or the Club’s Membership Experience Director, in advance.

22. Accompanied Guests must pay a special daily “Guest of a Member” rate to use the Wellness and Fitness Center, or pool facilities, as determined by the Club, in its sole discretion, from time to time.

Racquet Facilities

1. The Rules of Tennis of the United States Tennis Association will apply at all times, except when in conflict with the local rules or with any of the Club Documents.

2. Court reservations must be made by using the reservation software. Reservations will have priority over walk-ins. Consecutive or successive reservations (i.e., back-to-back bookings) are not permitted and will not be accepted.

3. Any users who fail to cancel their reservation at least four (4) hours prior to their scheduled court time may be charged a fee as determined by the Club, in its sole discretion.

4. At the end of their playing period, users must promptly relinquish their court to the next user(s). Once a user is off the court, they may sign up for the next available court time.

5. Court reservations may be made for up to two (2) hours, except for certain times designated by the Racquet Shop Team.

6. Only coaches who have been approved by the Club may provide lessons or other instruction. Outside coaches are not permitted.

7. Proper racquet attire, as determined by the Racquet Shop Team, is required at all times. Regulation tennis shoes are required.

8. Proper racquet etiquette must be observed at all times. Excessive noise, racquet throwing or profanity is not permitted.

9. Trash and other litter must be deposited in the proper receptacles.

10. All mobile devices (including, but not limited to, cell phones) must be on silent mode when on the court. Phone calls and video calls are permitted in designated area(s) only.

11. Use of the courts are subject to the control of the Racquet Shop Team at all times. The Racquet Shop Team will determine the suitability of the courts for play. Courts will be closed when necessary for maintenance operations, when dictated by safety considerations or when under adverse weather conditions. The Club may reserve the courts for special events from time to time.

Swimming Pool

1. Use of the swimming pool at any time is at the swimmer’s own risk. There are no lifeguards on duty. Any injuries or accidents must be reported to a Club employee immediately.

2. Members must register their family Members and Guests, and are responsible for the payment of any appropriate charges as the Club may determine from time to time, in its sole discretion.

3. Children under fourteen (14) years of age must be accompanied by an adult. Children who cannot swim must be accompanied by a parent or guardian at all times while in the swimming pool areas. To use the swimming pool, children must be at least three (3) years of age and toilet trained. Children wearing diapers are not permitted in the swimming pool.

4. Swimming is permitted only during designated hours. The swimming pool is officially closed when a “closed” sign is posted.

5. Showers are required before entering the swimming pool.adverse weather conditions. The Club may reserve the courts for special events from time to time.

6. Bottles, glass objects, drinking glasses, and sharp objects are not permitted in the swimming pool area. Trash must be placed in the containers located throughout the swimming pool area.

7. Food and drinks are allowed only in designated areas of the swimming pool area and then only in plastic or paper containers.

8. All swimmers must wear appropriate, family-oriented swimming attire. Cut-offs, thongs and Bermuda shorts are not considered appropriate family-oriented swimming attire. Shoes or other foot coverings and caftans or shirts must be worn outside the swimming pool area.

9. Electronic devices may be listened to at a sound level that is not unreasonably offensive to other persons.

10. Lifesaving and swimming pool cleaning equipment must only be used for the purposes intended.

11. Running, ball playing and hazardous activity are not permitted in the swimming pool areas. Pushing, dunking and dangerous games are prohibited.

12. Diving is not permitted.

13. Snorkeling equipment, other than a mask and snorkel, are not to be used in the swimming pool area, except as part of an organized course of instruction that is pre-approved, in writing, by the General Manager.

14. Club employees have the authority to remove anyone from the swimming pool area for failing to cooperate with the Glen Kernan Standard, or whose conduct is otherwise unbecoming of a Member.

15. Swimming pool parties may be arranged through the Club in advance of the occasion and in accordance with applicable Club policy.

16. All persons using swimming pool furniture are required to cover the furniture with a towel when using suntan oils and lotions. The use of these oils and lotions could stain or damage the furniture.

17. All persons using the swimming pool area must keep the swimming pool area clean.

18. Smoking is prohibited in the swimming pool area.

19. Flotation devices are permitted for non-swimming children up to five (5) years of age. Small toys such as balls, water guns, rings, etc. may be permitted, depending on the number of persons in the swimming pool area and the manner in which the toys are used. Tire inner tubes and other large flotation devices are not permitted in the swimming pool area.

20. Persons who leave the swimming pool area for over thirty (30) minutes must relinquish lounges and chairs by removing all towels and personal belongings. Saving chairs for persons absent from the swimming pool area is prohibited.

Guest Privileges & Policies

1. Guest privileges may be extended under the Glen Kernan Standard, as amended, from time to time, in the Club’s sole discretion.

2. All Guests of a Member must be an Accompanied Guest. An Accompanied Guest may use the Athletic Club no more than a cumulative total of six (6) times per calendar year, unless pre-approved by the Club. A Member may have up to four (4) Accompanied Guests per each visit. The Club reserves the right to amend the number of times Accompanied Guests are permitted to use the Athletic Club at any time and for any reason.

3. A House Guest may use the Athletic Club no more than a cumulative total of six (6) times per calendar year. If increased access to and use of the Athletic Club of any House Guest is desired, the resident Member must register the respective House Guest with the Club and make arrangements in advance of said access and use in each instance. The Club reserves the right to amend the number of times House Guests are permitted to use the Athletic Club at any time and for any reason.

4. All Guests (whether an Accompanied Guest, House Guest or otherwise) may only access and use the Athletic Club during operating hours. For avoidance of doubt, Guests shall not access or use the Athletic Club after operating hours and do not have 24/7 access.

5. Immediate family Members, outside of the defined term per the Club’s Membership Plan, who are lineal descendants of a Member may use the Athletic Club no more than a cumulative total of twelve (12) times per calendar year. For avoidance of doubt, the foregoing Guest privilege and policy does not include lineal ascendants (e.g., parents and grandparents).

6. Accompanied Guests are permitted to use the Athletic Club in accordance with the Membership privileges of the hosting Member.

7. Before utilizing any equipment at the Wellness and Fitness Center or accepting any service therein, Members must check in and register their family Members and Accompanied Guests at the Wellness and Fitness Center or with the Club Team.

8. The Club may change the daily Guest fees, charges and policies for use of the Athletic Club at any time and for any reason, in its sole discretion.

9. Guest privileges may be denied, withdrawn or revoked at any time and for any reason considered sufficient by the Club.

10. Guests will be charged the applicable fees as established by the Club from time to time. Hosting Members are responsible for all fees and charges incurred by Guests. Guests will have the opportunity to pay any Club charges and other fees incurred at the Club; provided that the hosting Member will be responsible for all charges not paid by their Guests.

11. Each Member is responsible for informing and updating their Guests as to the Glen Kernan Standard and other policies of the Club.

12. Each Member is responsible for the manner, deportment and appearance of his/her Guests at the Club. If the manner, deportment or appearance of any Guest is deemed unsatisfactory, the Club, in its sole discretion, reserves the right to remove Guests from Club’s premises.

13. The Club may allow use of the Athletic Club by Guests of the Club on such terms, conditions, and rates and with such privileges as the Club determines in its sole discretion, from time to time.
