s U.S. companies continue to find new and innovative ways to conduct business, produce better products, offer the most efficient customer service, or unveil the latest gadget, one skill set employers look for is experience, or, more specifically, readiness. The U.S. military is a tremendous example of a “readiness incubator,” instilling within its members leadership, problem-solving and technical skills that translate well into private-sector employment. And the word is out among corporate America that hiring a military veteran is a good strategic move. An online survey conducted by Harris Poll on behalf of University of Phoenix® in fall 2015 of more than 500 hiring managers found that 80 percent of those hiring managers have employed a military veteran, and approximately 82 percent recognize the ways in which the skills of employees or applicants with military experience are superior to those who have never served. Approximately two-thirds of hiring managers cited teamwork (69 percent) and responsibility (65 percent) among the top military skills that would contribute to the leadership of their organizations. “Military veterans are well disciplined and possess an incredibly strong work ethic,” said Adam Such, University of Phoenix Military Relations vice president and retired Army lieutenant colonel. “Hiring managers have definitely taken notice of the skills that military members bring to the civilian workplace as a result of their service, which is critical now that many of our nation’s service members are returning home from overseas.” This is good news for the 24,000 to 360,000 men and women who are transitioning out of the U.S. military each year. ood news: More and more Americans are living longer and better. In fact, by 2030, seniors will represent one out of five Americans.
Bad news: The housing needs of retirees continue to grow rapidly, while their retirement income fails to keep pace with inflation. Further complicating the problem is this: Almost half of renters 62 and older spend more than half their income on housing. Better news: In America today, we are surrounded by people dedicated to making the lives of senior citizens better. One such person is Steve Protulis, president of Elderly Housing Development and Operations Corporation (EHDOC), a national organization for building and maintaining affordable housing and services for America’s 33 million seniors. Protulis understands the crisis and the grave consequences of inaction and has never been afraid to tell elected officials that to control and reduce the number of seniors entering nursing homes prematurely, they need ac-

YOUNG AMERICAN INSURANCE COMPANY Defendants. FIRST AMENDED COMPLAINT FOR PERSONAL INJURIES AND PROPERTY DAMAGES COMES NOW, Plaintiff David Garcia by and through his attorneys Martinez, Hart & Thompson, P.C. and for his complaint against Defendants states the following: 1. Plaintiff is a resident of the County of Bernalillo, State of New Mexico. 2. Defendants Michelle A. Nevarez and Josia Sarah Austin are residents of the County of Bernalillo, State of New Mexico. 3. Defendant Young American Insurance Company is a Texas Corporation doing business in the State of New Mexico by selling auto insurance policies to the citizens of the State of New Mexico. FACTS 4. On January 4, 2013 in the County of Bernalillo, State of New Mexico, Plaintiff David Garcia was driving his 2005 Dodge pickup truck westbound on Zuni Road in a legal manner. 5. At the same time, Defendant Michelle A. Nevarez was driving a vehicle which belonged to Defendant Josia Sarah Austin northbound on Virginia Street approaching the intersection with Zuni. 6. As Plaintiff David Garcia approached the intersection of Zuni Road and Virginia Street, he was proceeding on a thoroughfare, in a legal manner, and had the right-of-way. 7. At the same time, Defendant Michelle A. Nevarez was driving the 1997 Ford vehicle owned by Defendant Josia Sarah Austin northbound on Virginia Street toward the intersection approaching a stop sign and had a duty to stop the vehicle she was driving and yield the right of way to traffic traveling on Zuni Road, including Plaintiff David Garcia. 8. Defendant Michelle A. Nevarez failed to stop at the stop sign and failed to yield the right-of-way to Plaintiff David Garcia, drove directly into the intersection and caused a collision between the vehicle she was driving and the vehicle of Plaintiff David Garcia. 9. As a result of the collision, Plaintiff David Garcia’s truck was damaged beyond reasonable repair and he was injured. 10. At the time of the aforementioned collision, Defendant Young America Insurance Company had a policy of insurance covering the vehicle driven by Defendant Michelle A. Nevarez and owned by Defendant Josia Sarah Austin which provided auto insurance coverages pursuant to the Mandatory Financial Responsibility Act of the State of New Mexico. COUNT 1 11. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 10 as though the same were set out herein. 12. The actions and omissions of Defendant Michelle A. Nevarez in failing to stop at the stop sign and in failing to yield the right-of-way were negligent. 13. As a direct and

proximate result of the the negligence of Defendant Michelle A. Nevarez, Plaintiff’s truck was damaged beyond reasonable repair and he was injured. COUNT 2 14. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 13 as though the same were set out herein. 15. The actions and omissions of Defendant Michelle A. Nevarez in failing to stop at the stop sign, in failing to yield the right-of-way to traffic traveling on Zuni Road, including Plaintiff David Garcia, and in failing to give her full time and entire attention to the operation of her vehicle, the roadway, and other traffic, were in violation of the traffic ordinances of the City of Albuquerque and the New Mexico Motor Vehicle Code and, therefore, constitute negligence per se. 16. As a direct result and proximate result of the negligence per se of Defendant Michelle A. Nevarez, Plaintiff David Garcia’s truck was damaged beyond reasonable repair and he was injured. COUNT 3 17. Plaintiff incorporates each and every allegation contained in Paragraphs 1-16 as though the same were set out herein. 18. At the time of the aforementioned collision, Defendant Michelle A. Nevarez was operating the 1997 Ford vehicle that she was driving, as the agent, servant or employee of Defendant Josia Sarah Austin or under such circumstances as give rise to the application of the family purpose doctrine and, therefore, Defendant Josia Sarah Austin is liable for the damages cause by the negligence, and/or negligence per se, of Defendant Michelle A. Nevarez. COUNT 4 19. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 18 as though the same were set out herein. 20. Upon information and belief, Plaintiff David Garcia alleges that Defendant Josia Sarah Austin negligently entrusted her vehicle to Defendant Michelle A. Nevarez at a time when she knew, or should have known, that Defendant Michelle A. Nevarez was not a careful driver and would not operate the vehicle in a safe manner, thereby creating a hazard on the roadways of the County of Bernalillo, State of New Mexico for other drivers including Plaintiff David Garcia. 21. As a direct and proximate result of the negligent entrustment by Defendant Josia Sarah Austin of her vehicle to Defendant Michelle A. Father was present in person and represented by Greg Gahan, Esq. Respondent (Mother) was not present and it appears from the Court record that the Notice of Hearing mailed to her address was returned to the Courthouse. The Hearing Officer having heard testimony, offers of proof, and arguments from Father, and being otherwise advised. FINDS: 1. The Court has jurisdiction over the parties and subject matter. 2. It appears, from a review of the Court record, that Mother did not receive notice of today’s hearing. The Notice of Hearing was returned to the Courthouse 3. Health City Sun LEGAL NOTICES the parents of one minor child, ADAM OTERO, born May 2010, age 5 years. 5. On April 7, 2014, the parents entered into a Parenting Plan. Pursuant to the Parenting Plan, the parties shared joint legal custody of ADAM. A timesharing schedule was outlined but was not clear about each parent’s specific periods of timesharing. 6. Father testified, and made offers of proof, as follows: a. ADAM has lived with him for the past four (4) years. b. Mother has missed hundreds of days of visits with ADAM. c. Mother has had no contact with ADAM since September 2015. d. In October 2015, Mother sent Father a series of disturbing text messages. The messages were read into the record at today’s hearing. In the text messages, Mother stated that she was addicted to pain medications. Mother referred to herself as a “junkie.” Further, Mother alluded to engaging in self-harming behavior (cutting) and to behavior associated with eating disorders (vomiting after eating.) Further, in her text messages, Mother told Father that Mother’s boyfriend was very abusive towards her and that Mother had suffered serious injuries as a result of the abuse. e. Father attempted to serve Mother with his Motion and with notice of today’s hearing. He mailed the pleadings to Mother’s last known address. He attempted to call Mother, but her telephone was disconnected. He attempted to call Mother’s mother and sister, but their telephones were also disconnected. f. Father is concerned that Mother may try to remove ADAM from Father’s care, which would be unsafe for ADAM. g. ADAM is currently in kindergarten at Adobe Acres, and is doing very well. h. Upon Father’s information and belief, there has been CYFD involvement involving Mother and her older children. THE SPECIAL COMMISSIONER THEREFORE RECOMMENDS: 7. Father shall have temporary sole legal and physical custody of ADAM. 8. Father SHALL NOT move out of the Greater Albuquerque Area with ADAM, without a Court Order, from this Court, allowing him to do so. 9. Father may travel outside of the Greater Albuquerque Area with ADAM. 10. Pending further Court Order, Mother shall have no visits or contact with ADAM. 11.Pending further Court Order, Mother shall stay 100 yards away from ADAM’s school. 12. Father shall publish notice of this Hearing Officer’s Report and Notice of Hearing pursuant to the requirements of Rule 4, and shall complete the publication process prior to the hearing scheduled below. 13. This matter is set for a Review Hearing on April 18, 2016 at 1:30PM in room 274 Commissioner Rourke. he IRS has good news, bad news and better news for many taxpayers.
The good news: You may be able to get an extension and file your taxes as late as October 17. The IRS knows sometimes you just can’t and that information needed to file a return, such as a Schedule K-1 or Form 1099, may not arrive in time. The bad news: You still have to pay your taxes by April 18. The better news: An extension lets you take advantage of any retroactive changes to the tax law that might be made, without having to file an amendment. Plus, some people believe filing an extension reduces your risk of being audited, since the longer a file is in the system, the longer the IRS has to look at it. Here’s further advice on making the most of an extension situation. Expert Advice “If filing your return by April 18 of this year just isn’t going to happen, there are actually several ways you can request an automatic extension of time to file an individual return,” explains Terry Durkin, an enrolled agent (EA) and president of the National Association of Enrolled Agents.
“You can e-file the ‘Application for Automatic Extension of Time to File U.S. Individual Income Tax Return,’ which can be found on the IRS website (Form 4868), or you can print that application out and mail it to the IRS. If you e-file Form 4868, do not also send a paper Form 4868. “If filing an extension on your tax return, remember that you still must pay any amount owed by April 18 and mail it to the IRS,” she adds. “All or part of your estimate of the income tax due can be paid with a credit or debit card or by using the Electronic Federal Tax Payment System.” You can find a list of service providers on Form 4868 through which you can pay your tax debt by phone or Internet. bout 10,000 baby boomers retire every day across America but research from the Insured Retirement Institute (IRI) has found they are losing confidence in their ability to attain financial security during their retirement years. A 2015 study by the IRI found that only 27 percent of boomers are highly confident their savings will last throughout retirement. This is the lowest level since 2011, when this annual study began.

Retirement planning experts say the lack of confidence could be the result of a combination of factors that have made saving for a secure retirement more difficult. These factors include longer life spans and thus potentially longer retirements, uncertainty with retirement programs such as Social Security and Medicare, and the rising cost of health care. The survey found that many boomers have not risen to the challenge and have inadequate savings for retirement.
