1. Give good health a shot. Get your flu, shingles and pneumonia immunizations. Follow your doctor’s advice about regular cancer screening tests, stress tests and bone density measurements. Head off some of the problems of aging before they occur.
3. Don’t smoke. You’re never too old to quit. 4. Eat right. In addition to lots of fruits, vegetables and a few lean meats, older people should consume foods with vitamin B12, such as fortified cereals. Also, add flavor to foods with spices and herbs instead of salt and look for low-sodium packaged foods. Drink three cups of fat-free or low-fat milk throughout the day or the equivalent in yogurt, cheese or other dairy products. 5. Be physically active. Regular activity can help delay, prevent or manage many costly chronic diseases faced by adults 50 years old or older. Try for at least 2½ hours of moderate-intensity physical activity a week. Do it in increments of 10 minutes or more. Bike, dance, walk for cardiovascular health. Upon information and belief Defendant Philip Hubbell was married at all times relevant to the present cause of action. 7. Upon information and belief, there exist certain Unknown Claimants of Interest in the Premises Adverse to the Plaintiff. 8. The property which is the subject of this dispute is located in Bernalillo County, New Mexico. 9. This Court has jurisdiction over the subject matter of this dispute. 10. This Court has proper jurisdiction over the persons of this lawsuit. 11. Venue is proper in the Second Judicial District Court. GENERAL FACTS 12. Plaintiff re-alleges all allegations set forth in
Paragraphs 1 through 11 above as if fully restated herein. 13. In or about 1960, Decedent and her husband, Robert M. Martinez, purchased from Defendant Philip Hubbell and Philip Hubbell’s spouse, the following described property in Bernalillo County, New Mexico by General Warranty Deed (hereinafter the “Property”): The Southern one-half (S ½) of Lot numbered 17-B of the Dora A. Williams First Addition to the City of Albuquerque, New Mexico , as shown on the Plat of said Addition filed for record February 12, 1941, in the records of the Bernalillo County Clerk, Bernalillo County, New Mexico. 14. Upon information and belief, a warranty deed was completed conveying the Property from Defendant Hubbell to Robert Martinez and Mary Adele Martinez, husband and wife as joint tenants but such deed was not recorded with the Bernalillo County Clerk’s Office and has since been lost. 15. The last deed in the chain of title which is of record with the Bernalillo County Clerk’s office is dated June 23, 1958 and shows Mr. & Mrs. Philip Hubbell as owners. See Exhibit A attached hereto. 16. From the time the Property was purchased from Defendants Hubbell, Robert Martinez and Mary Adele Martinez as husband and wife exercised all rights of ownership and possession over the property to the exclusion of all others. Such actions included but were not limited to the constructed of a garage which is situate on the Property and an adjoining property identified as Lot 17A, also owned by Robert Martinez and Mary Adele Martinez. See Exhibit B attached hereto. 17. From the time of purchase to present, Robert Martinez and Mary Adele Martinez have been the assessed owners of the Property and have paid all property taxes associated with the Property. See Exhibit C attached hereto. 18. Upon information and belief, there exist certain Unknown Claimants of Interest that may claim an interest in the Property that is adverse to Plaintiff. Good Options For Funding Your Long-Term Care
M
ost Americans over the age of 65 will require long-term care at some point in their lives, with today’s average senior likely to incur $138,000 in future long-term care costs, according to the U.S. Department of Health & Human Services. This is different from medical care and includes personal help with daily living activities such as bathing and dressing. These services are typically not covered by Medicare or other traditional private health insurance. Unfortunately, the cost of long-term care insurance has risen significantly in the past decade and the number of carriers selling coverage has shrunk from roughly 100 to only a dozen or so now. That leaves Medicaid as the primary insurance coverage source for long-term care needs, but qualifying for Medicaid requires the virtual depletion of all personal assets. Faced with this dilemma, American seniors must get creative about how to pay for long-term care or risk a major hit to their retirement funds. The National Association of Insurance Commissioners (NAIC), the U.S. regulatory support organization created by the chief insurance regulators from all 50 states, formed a Long-Term Care Innovations Subgroup to study this issue. The group recently issued a report that endorsed some viable options for privately funding long-term care costs. Four specific options they laid out included the following: • Single Premium Permanent Life Insurance Policies • Annuity Long-Term Care Hybrid Policies • Impaired-Risk Payout Annuities • Life Settlements.
Of these recommended long-term care financing options, a life settlement is the only one that does not involve seniors buying anything or spending any money out of their own pockets. A life settlement is a proven strategy for generating cash from an unwanted or unaffordable life insurance policy. In a life settlement transaction, a senior sells his or her life insurance policy to a third-party investor for an immediate cash payment. The investor then takes over the premiums on the policy and collects the death benefit when the insured passes away. Consumers who sell their policies receive a lump sum payment that is generally four or more times greater than if they lapsed or surrendered their policy, according to the NAIC, and these funds can then be used to pay for long-term care expenses without depleting other retirement assets. The NAIC report also notes that seniors “in immediate need of long-term care can sell their life insurance policies and receive the proceeds of the sale free from federal tax (Internal Revenue Code §101(g)). “Some elder care providers and professional advisors recommend that their clients consider using life settlement proceeds to fund an account with a bank and trust company to make monthly payments directly to a designated longterm care provider,” says the NAIC report. “Upon death, in addition to a modest reserve to defray final expenses, any remaining balance in the account is paid to a designated beneficiary.” For more information or to find a life settlement professional who can help you look into this option and see if it makes sense for you, call (800) 664-9024 or visit the LISA website at www.lisa.org. -NAPSI

Understanding IPF—A Rare Lung Disease
magine this: one day, you or someone you care about develops a persistent dry cough and shortness of breath. Doctors aren’t sure what to make of it. It could be a common respiratory condition like asthma, chronic obstructive pulmonary disease (COPD) or bronchitis—or it could be a rare, irreversible lung disease called idiopathic pulmonary fibrosis (IPF). Mark’s Story As an avid golfer and runner, Mark considered himself to be in relatively good health, which is why he was surprised when he developed a dry cough that wouldn’t go away and was hospitalized with a bad case of pneumonia. His doctor was concerned and ran additional tests; it was then that Mark learned he has IPF. Mark was diagnosed quickly, but many others with IPF do not have this experience. In one survey, more than half of people with pulmonary fibrosis reported at least a one-year delay between early symptoms and diagnosis. What Is IPF? IPF is a progressive disease that causes scarring of the lungs, making breathing difficult. Since most people with IPF are over the age of 50, they may dismiss their symptoms as changes in health that come with aging. But with a median survival time from diagnosis of just 3-5 years, IPF is very serious. Because it is a rare disease affecting approximately 100,000 Americans, those diagnosed with IPF often feel isolated and don’t know where to turn for help. “I was shocked when I was diagnosed. Hearing from my doctor that IPF is unpredictable and can progress very quickly was overwhelming,” Mark said. “It was an extremely hard time for me and my family.” What Can Be Done
Esbriet is a prescription medicine used to treat people with a lung disease called idiopathic pulmonary fibrosis (IPF). It is not known if Esbriet is safe and effective in children. Important Safety Information Before taking Esbriet, patients should tell their doctor about all of their medical conditions, including if they: • have liver problems • have kidney problems • are a smoker • are pregnant or plan to become pregnant. It is not known if Esbriet will harm the unborn baby. • are breastfeeding or plan to breastfeed. It is not known if Esbriet passes into breast milk. Patients and their doctor should decide if they will take Esbriet or breastfeed. Patients should tell their doctor about all the medicines they take, including prescription and over-the-counter medicines, vitamins, and herbal supplements. Patients should avoid: • Sunlight. Esbriet can make skin sensitive to the sun and the light from sunlamps and tanning beds. Patients could get a severe sunburn. Patients must use sunscreen (SPF 50) and wear a hat and clothes that cover the skin if they have to be in sunlight. Patients should talk to their doctor if they get a sunburn or rash. • Taking Esbriet with other medicines that can make your skin sensitive to the sun, the light from sunlamps and tanning beds.
Once Mark learned that the damage to the lungs caused by IPF cannot be reversed, he decided he wanted to act quickly and be proactive. Although there is no cure for IPF, there are ways to manage the condition.
• Smoking. Smoking may affect how well Esbriet works.
With the help of his doctor, Mark found ways to safely continue doing some of the hobbies he enjoys, such as golfing and going on walks. They also discussed FDA-approved medicines that treat IPF, and he now takes Esbriet® (pirfenidone).

Have A Dog Who Wets Her Bed? Your Vet Can Help s a pet owner, have you ever had a female dog who always finds the outdoor bathroom during the day, but wets her bed at night?
18 percent of the dogs in shelters were surrendered by frustrated owners because of house soiling.
Dogs who follow the house rules can be horrified when they realize that they’ve leaked -- even though it occurs during sleep.
Alternatively, there are other possible causes, so it’s essential to allow your veterinarian to make an accurate diagnosis before medication is started.
Plastic sheets aren’t the answer, and most likely your long-suffering pet wouldn’t be happy alone outside.
Urinary tract infections are common, especially for indoor girls. Bladder stones can also cause house soiling. And elderly dogs may urinate indoors because of senile brain changes, a problem called cognitive dysfunction syndrome. Pets with urinary symptoms need to see their doctors.
Urine soiling isn’t something pet owners enjoy discussing.
But poor bladder control following spaying is actually a physical disorder that’s seen mostly in middle-aged female dogs, and can occur any time after surgery.
If a thorough exam and urinalysis come up normal, a healthy female dog who leaks only when resting or sleeping most likely has urinary incontinence due to reduced estrogen. You can explain all of this to your dog, ending “the talk” by telling her that she has urethral sphincter hypotonus. With her leader so wellinformed, she is sure to feel better.
In addition, it’s more common in large breeds and those who struggle with obesity.
Veterinarians like to uncover these cases because almost all of them can be turned from frustration to success.
To that end, a rolled-up newspaper won’t solve this problem, and won’t improve behavioral house soiling either. Leaking urine during rest or sleep is not your dog’s fault.
Proin is often chosen because it is the only non-hormone treatment option, and also because it’s palatable and easy to dose.
Many assume it’s a behavioral problem, believing they’ve failed to properly train their pets.
There is value in spaying your female dog, but giving up their ovaries means the sphincter muscle in the bladder can be left just weak enough to relax and release urine. It may happen any time they drift off. The result is a tell-tale wet spot on their bed. About 20 percent of spayed dogs face this messy downside. For dog owners who want to try and help their pet, the answer may lie in a liver-flavored tablet.
