Nevarez and owned by Defendant Josia Sarah Austin which provided auto insurance coverages pursuant to the Mandatory Financial Responsibility Act of the State of New Mexico. COUNT 1 11. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 10 as though the same were set out herein. 12. The actions and omissions of Defendant Michelle A. Nevarez in failing to stop at the stop sign and in failing to yield the right-of-way were negligent. 13. As a direct and proximate result of the the negligence of Defendant Michelle A. Nevarez, Plaintiff’s truck was damaged beyond reasonable repair and he was injured. COUNT 2 14. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 13 as though the same were set out herein. 15. The actions and omissions of Defendant Michelle A. On April 7, 2014, the parents entered into a Parenting Plan. Pursuant to the Parenting Plan, the parties shared joint legal custody of ADAM. A timesharing schedule was outlined but was not clear about each parent’s specific periods of timesharing. 6. Father testified, and made offers of proof, as follows: a. ADAM has lived with him for the past four (4) years. b. Mother has missed hundreds of days of visits with ADAM. c. Mother has had no contact with ADAM since September 2015. d. In October 2015, Mother sent Father a series of disturbing text messages. The messages were read into the record at today’s hearing. In the text messages, Mother stated that she was addicted to pain medications. Mother referred to herself as a “junkie.” Further, Mother alluded to engaging in self-harming behavior (cutting) and to behavior associated with eating disorders (vomiting after eating.) Further, in her text messages, Mother told Father that Mother’s boyfriend was very abusive towards her and that Mother had suffered serious injuries as a result of the abuse. e. Father attempted to serve Mother with his Motion and with notice of today’s hearing. He mailed the pleadings to Mother’s last known address. He attempted to call Mother, but her telephone was disconnected. He

attempted to call Mother’s mother and sister, but their telephones were also disconnected. f. Father is concerned that Mother may try to remove ADAM from Father’s care, which would be unsafe for ADAM. g. ADAM is currently in kindergarten at Adobe Acres, and is doing very well. h. Upon Father’s information and belief, there has been CYFD involvement involving Mother and her older children. THE SPECIAL COMMISSIONER THEREFORE RECOMMENDS: 7. Father shall have temporary sole legal and physical custody of ADAM. 8. Father SHALL NOT move out of the Greater Albuquerque Area with ADAM, without a Court Order, from this Court, allowing him to do so. 9. Homeowners Beware: Are Termites Feasting on Your Home?

omeowners across the country are out enjoying sunshine and fresh air while prepping their homes for the warmer seasons. While home improvements on the honey-do list may seem endless, one important task that shouldn’t be ignored is checking for termite activity. Moisture-damaged homes, regardless of make, model or age, are susceptible to termite infestations. Termites are capable of chewing through wood, flooring and wallpaper undetected. These “silent destroyers” can’t be eradicated with do-it-yourself measures, and cause more than $5 billion in property damage annually, costs not typically covered by homeowners insurance. How to Identify Termites Termite-spotting likely occurs in spring as they build new colonies for mating and nourishment. As colonies mature, winged termites appear around lights of windows and doors. After mating, termites create nearby colonies, spreading the infestation and disappearing into structures. While homeowners may see termites, they can mistake them for flying ants. Termites have distinct body types characterized by straight waists, straight antennae and two sets of wings equal in size. Misidentifying termites could delay treatment and cause structural property damage. Homeowners should be on the lookout for mud tubes on the base of their house, soft wood that sounds hollow when tapped, darkening or blistering of wood structures, small feces piles resembling sawdust near a termite

nest and discarded wings near doors or on windowsills. Prevention Tips If your home is currently termite-free, you should still take preventative steps to avoid becoming a termite magnet in the future. Most importantly, eliminate or reduce moisture in and around the home, which termites need to thrive. Below are things you can do to help prevent infestations in your home: * Divert water away from the foundation by installing properly functioning downspouts, gutters and splash blocks. * Reduce humidity in crawl spaces with proper ventilation. * Trim vines, hedges and other vegetation so they don’t block vents. * Remove old form boards, grade stakes, tree trunks and roots nearby. * Maintain 18 inches between soil and any wood portions of your home. * Store firewood at least 20 feet away from the house and 5 inches off the ground. * Routinely inspect your home’s foundation for signs of termite damage. Protect Your Family From Cardiac Arrest

S

udden cardiac arrest (SCA), a malfunction of the electrical rhythm of the heart, can strike anyone, at any time—including at home.

The Problem Without CPR and an electrical jolt from an automated external defibrillator (AED) to restore normal rhythm to the heart, a victim of SCA is likely to die. Every year, hundreds of thousands suffer from SCA at home. In the U.S. alone, more than 326,000 people of all ages experience SCA annually—nearly 1,000 per day—and 70 percent of those SCA attacks occur at home. Nine out of ten of the victims die. In fact, the number of people who die from SCA every year is roughly equivalent to the number of people who die from Alzheimer’s, assault with firearms, diabetes, HIV, house fires, motor vehicle accidents, suicides and breast, cervical, prostate and colorectal cancers combined. Surviving SCA is largely dependent on how quickly a victim is defibrillated. For each minute that CPR and treatment with an AED are delayed, survival declines by 7 to 10 percent. After ten minutes without treatment, few victims survive. Protecting Your Family Fortunately, families can take action to help protect themselves. AEDs are available to the general public through certain online and “brick-andmortar” retailers. Purchasing an AED for home use may increase families’ “peace of mind” by providing a level of protection against SCA. All AEDs offer the basic protection of defibrillation in the event of SCA.
