Nevarez was operating the 1997 Ford vehicle that she was driving, as the agent, servant or employee of Defendant Josia Sarah Austin or under such circumstances as give rise to the application of the family purpose doctrine and, therefore, Defendant Josia Sarah Austin is liable for the damages cause by the negligence, and/or negligence per se, of Defendant Michelle A. Nevarez.
COUNT 4 19. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 18 as though the same were set out herein. 20. Upon information and belief, Plaintiff David Garcia alleges that Defendant Josia Sarah Austin negligently entrusted her vehicle to Defendant Michelle A. Nevarez at a time when she knew, or should have known, that Defendant Michelle A. Nevarez was not a careful driver and would not operate the vehicle in a safe manner, thereby creating a hazard on the roadways of the County of Bernalillo, State of New Mexico for other drivers including Plaintiff David Garcia. 21. As a direct and proximate result of the negligent entrustment by Defendant Josia Sarah Austin of her vehicle to Defendant Michelle A. Nevarez, Plaintiff David Garcia’s truck was damaged beyond reasonable repair and he was injured. COUNT 5 22. Plaintiff incorporates each and every allegation contained in Paragraphs 1 through 21 as though the same were set out herein. 23. As the automobile liability insurance carrier for the vehicle driven by Defendant Michelle A. Nevarez and owned by Defendant Josia Sarah Austin, Defendant Young America Insurance Company is liable for all damages caused by the negligence of Defendants Michelle A. Nevarez and Josia Sarah Austin pursuant to the Mandatory Financial Responsibility Act of the State of New Mexico and its insurance policy contract. D A M A G E S 24. As a direct and proximate result of the negligence, and negligence per se, of Defendants Michelle A. Nevarez and Josia Sarah Austin, Plaintiff David Garcia suffered personal injuries which have resulted in medical expenses, pain and suffering, lost earnings, loss of household services and other damages. 25. 5. On April 7, 2014, the parents entered into a Parenting Plan. Pursuant to the Parenting Plan, the parties shared joint legal custody of ADAM. A timesharing schedule was outlined but was not clear about each parent’s specific periods of timesharing. 6. Father testified, and made offers of proof, as follows: a. ADAM has lived with him for the past four (4) years. b. Mother has missed hundreds of days of visits with ADAM. c. Mother has had no contact with ADAM since September 2015. d. In October 2015, Mother sent Father a series of disturbing text messages. The messages were read into the record at today’s hearing. In the text messages, Mother stated that she was addicted to pain medications. Mother referred to herself as a “junkie.” Further, Mother alluded to engaging in self-harming behavior (cutting) and to behavior associated with eating disorders (vomiting after eating.) Further, in her text messages, Mother told Father that Mother’s boyfriend was very abusive towards her and that Mother had suffered serious injuries as a result of the abuse. e. Father attempted to serve Mother with his Motion and with notice of today’s hearing. He mailed the pleadings to Mother’s last known address. He attempted to call Mother, but her telephone was disconnected. He attempted to call Mother’s mother and sister, but their telephones were also disconnected. f. Father is concerned that Mother may try to remove ADAM from Father’s care, which would be unsafe for ADAM. g. ADAM is currently in kindergarten at Adobe Acres, and is doing very well. h. Upon Father’s information and belief, there has been CYFD involvement involving Mother and her older children. THE SPECIAL COMMISSIONER THEREFORE RECOMMENDS: 7. Father shall have temporary sole legal and physical custody of ADAM. 8. Father SHALL NOT move out of the Greater Albuquerque Area with ADAM, without a Court Order, from this Court, allowing him to do so. 9. Father may travel outside of the Greater Albuquerque Area with ADAM. 10. Rather than squeezing into a hotel room, vacationers are spreading out and taking advantage of such benefits as extra space, convenience and privacy. Before booking a home base for what’s meant to be a relaxing getaway, however, travelers need to consider from whom they’re renting to ensure a trouble-free experience. Here are some important things to know before booking:
