THANK YOU TO THE THOUSANDS OF MEMBERS WHO HIT THE HALLS OF NRG AND SHOWED HOUSTON THE POWER OF US. On April 1, HAA’s biggest event of the year, the 2026 HAA Education Conference & Expo, provided attendees with fantastic speakers, knowledgeable vendors and networking opportunities that proved the great power in this industry of ours. Thanks to our sponsors and committee for another successful show. We have full coverage of the event with photos and video starting on Page 28, and don’t forget to visit the photo gallery featuring all the action by clicking the red button.

HAA Cap Rate and Expense Studies available

HAA once again commissioned an independent Cap Rate/Expense Study in Q4 2025 that is now available to aid members as they consider protesting values. This marks the third year that HAA engaged consultants to produce reports aimed to identify current market conditions regarding cap rates, expenses, and subsequently valuations. HAA worked with consultant JLL and conducted surveys of members’ operating expenses, including payroll, insurance, etc., as well as market sales data, to produce an anonymized report for HAA members to utilize in protesting their assessed values in 2026. All property classes across the Houston Metro area were analyzed and commentary on each class is included in the report. The report also provided guidance on market capitalization rates and expense growth for multifamily properties across the Houston MSA.

In January, HAA (with a select group of owner/management members), met with the HCAD multifamily team to review and discuss the results of the study for consideration prior to the completion of their model calibrations. There was encouraging open dialogue, and the HAA team shared with HCAD that the report would be distributed membership-wide to be utilized during the appeals process. The nature of this discussion was to urge the appraisers to get closer to “accurate” values up front in order to possibly minimize the litigation process, which would be beneficial to both parties. Get in the “swing” of multifamily advocacy

HAA’s Political Action Committee and our members have been busy advocating for our industry. An HAA delegation headed to D.C. for the National Apartment Association’s Advocate (see Page 24 for details) and had the opportunity to meet with a number of legislators or key staff members discussing various topics impacting our industry. Specifically, we discussed ongoing discussion between the House and Senate regarding HR 6644 and more particularly, the insertion of Section 901, which would severely impact BTR development and investment. We also reignited the discussion surrounding ending the CARES Act’s requirement to provide a 30-day NTV on federally financed properties, as that provision was never intended to be permanent.

Next up for the HAA PAC, get tropical as the committee holds its annual fundraiser at TopGolf on May 14. This event sells out quickly and only sponsors and players are allowed – no spectators. On to the Runoff (Special Election)!

HAA’s endorsed candidate heads to the runoff election on May 16.

candidate for Houston City Council District C, Nick Hellyar, advanced to the runoff election! Turnout was INCREDIBLY low in the first round on April 4 and will likely be very low again in the May 16 runoff elections. It is critically important that HAA members who live in District C turn out and vote. You can see what City Council District you live in HERE

HAA PAC Chair, Stacy Hunt, said this on Nick Hellyar:

“The HAA PAC is proud to support Nick Hellyar for Houston City Council, District C. Nick is an advocate for sensible government and practical problem solving. The HAA PAC looks forward to partnering with him as the multifamily residential industry works to provide affordable and quality housing for Houston residents.”

May 26th Runoff Election

Not to be confused with the District C runoff election, but the runoff for the Republican and Democratic Primaries will be held on May 26.

A few races of consequence for HAA members include the Democratic runoff election for Justice of the Peace Precinct 7, Place 2 incumbent Sharon Burney will face Melanie Miles, and HAA members who live in the precinct are encouraged to support Judge Burney.

Also, the race for the Democratic nominee for Harris County Judge between Former Mayor Annise Parker and Former Houston City Councilmember Letitia Plummer is of great importance. HAA PAC voted at its April 21 meeting to endorse Annise Parker and encourages members in Harris County who plan to vote in the Democratic runoff election to support Former Mayor Parker.

Apartment Inspection Ordinance

HAA has continued working with Mayor Whitmire’s Administration on the muchdiscussed Apartment Inspection Ordinance. The ordinance has come a long way and evolved several times, incorporating most of HAA feedback. HAA will continue to monitor

the final version and is prepared to offer amendments if necessary.

Budget Season is Upon Us!

The City of Houston will soon enter “budget season,” which will set the City of Houston’s budget for next year. There has been much discussion about a potential budget shortfall and what the City will do to address it, which the Mayor and Council will dive into in the coming weeks. HAA will monitor these meetings and monitor any budget proposals that could have an impact on our members. Stay tuned for more details on the City of Houston Budget.

Not So Fast, My Friends!

An update on the 30-day Notice Requirement for Nonpayment of Rent.

ON FEBRUARY 26, 2026, HUD published a rule revoking their prior rule requiring a 30-day notice for nonpayment of rent evictions across many of its project based subsidized housing programs. Prior to that, HUD also repealed a regulation that applied more broadly to project based and non-project based programs. HUD’s revocation of the 30-day notice requirement for the selected properties was set to go into effect on March 30, 2026.

By now you are probably also aware that Texas passed a new law - Senate Bill 38. SB38 went into effect for cases filed on or after January 1, 2026 and allows an owner to give a 3day pre-suit notice (either a Notice to Vacate or a Notice to Pay Rent or Vacate) before filing an eviction, so long as the period between when the pre-suit notice was given and the service of the Writ of Possession equals or exceeds the federally required notice period.

Soooo…we’re good, right? We can stop giving 30-day notices, right? Right? Not so fast, my friends!

HUD’s most recent revocation, the one announced just a few weeks ago, is already suspended due to litigation! According to HUD, the rule itself is still in place for public comments, but the effective date of March 30, 2026 has been “delayed indefinitely.”

Also, please remember that the CARES Act did not expire! The laws, rules, and regulations over the years since COVID-19 which require a 30-day notice for nonpayment of rent, can be looked at as layers that seem to be in a constant state of change.

In this article, we will examine the current state of the 30-day notice requirement in Texas. We will look at some layers which have been removed, some which remain, and then discuss what is on the horizon.

THE HUD LAYER: Revoked, although not really

To provide some very general background, in

response to COVID-19, HUD added regulations in 2021, revised them in 2023, and then solidified them in 2024. These regulations required 30-days’ notice prior to filing an eviction for nonpayment of rent and mandated that certain information must be in the notice.

The CARES Act did not expire! The laws, rules, and regulations over the years since COVID-19 which require a 30-day notice for nonpayment of rent, can be looked at as layers that seem to be in a constant state of change.

HUD’ stated goal with the new rule – the one which is “delayed indefinitely” –is to undo “burdensome and costly” regulations. The new rule states that the “regulatory requirements for notice of termination for nonpayment of rent will return to pre-2021 requirements.”

Will this new rule ever go into effect? Only time will, so let’s buckle up and stay tuned (by the time you’re reading this, something else may have changed)!

If the new rule does eventually go into effect, what will it mean? Not to sound too ironic, but the new rule appears to be an attempt to restore the old rules

If you can remember life before the pandemic, you may recall that many HUD programs deferred to State law, which means that, for those programs, HUD will no longer require a 30-day notice. But please keep in mind that even prior to 2021, there were select HUD programs that required notices ranging from 14 to 30 days – such as the HOME program which has historically required a 30-day notice.

Knowing which program(s) your property participates in is the key to the puzzle. Once you know this, you can identify the current rules as well as what the new rules will be if the old rules are restored. GEEZ!

The CARES Act Layer: State-by-State

The relevant text of the CARES Act states, “The lessor of a covered dwelling unit may not require the tenant to vacate the covered dwelling unit before the date that is 30 days after the date on which the lessor provides the

tenant with a notice to vacate.”

Iowa: The Iowa Supreme Court has ruled unanimously that the 30-day requirement in the CARES Act expired in July of 2020 along with the Temporary Moratorium. This is the highest court in the country to directly address the CARES Act. It provides interesting context, but it is not controlling legal precedent outside of Iowa.

Virginia: The Virginia Supreme Court ruled (by affirming a lower court ruling) that an owner who is subject to the CARES Act may give the 5-day notice required by Virginia law and then proceed with immediately filing an eviction. The Virginia court said the owner would remain in compliance with the CARES Act so long as 30 days elapsed between the date the notice was given and the date that the Writ of Possession is executed.

Texas: As discussed above, the Texas Legislature has passed a law (SB38) which states directly that an owner may give the 3-day notice required by Chapter 24 of the Property Code and then proceed with filing an eviction without delay. Using the CARES Act as an example – Texas law states that the owner may give a 3-day pre-suit notice before filing an eviction as long as at least 30 days elapses between the delivery of the pre-suit notice and the service of the Writ of Possession..

The Department of Agriculture Layer: Rescinded

On February 25, 2026, the Department of Agriculture published a Final Rule entitled,

“Rescinding 30-Day Notification Requirements Related to Eviction Based on Nonpayment of Rent in Multi-Family Housing Direct Properties” – Effective February 25, 2026.

The Federal Housing Finance Agency Layer: Retired

On October 8, 2025, the FHFA announced that it would “retire” – aka no longer enforce –the 30-day notice requirement for nonpayment of rent through the terms and conditions of its Fannie Mae and Freddie Mac loan programs.

With all these layers being revoked, retired, or rescinded, what layers remain?

Let’s take a look:

The TDHCA Layer: Still in Effect

In Texas Administrative Code § 10.613, the Texas Department of Housing and Community Affairs requires a 30-day notice for certain housing programs. While SB38 allows evictions to proceed without being delayed by federal rules and laws, it does not apply to State of Texas rules and laws.

The TDHCA rule identifies eight (8) programs that must provide a 30-day pre-suit notice for nonpayment of rent cases: Housing

Tax Credit, Tax Credit Assistance Program, Tax Credit Exchange Program, National Housing Trust Fund, HOME*, HOME – American Rescue Plan*, Tax Credit Assistance Program Repayment Funds*, and Neighborhood Stabilization Program*.

Note, for programs denoted with *, a 30-day notice is required for ALL cases.

The Lease Layer: Always in Effect

You should ensure you pre-suit notice satisfies ALL applicable layers – which includes the lease. It is imperative that you know what your specific lease requires with respect to a pre-suit notice.

If your pre-suit notice satisfies Texas law but violates the lease, the court will likely dismiss your case or rule in favor of the tenant.

Court Interpretation Layer:

Court-by-Court

Just like you and I, judges are also digesting the way that eviction laws have changed over the past few years. Regarding the 30-day notice requirement, they are also seeing layers come and go. Tenants and legal aid attorneys are also reacting to the changes and are adjusting their arguments in court.

In most cases, judges will follow Texas law as it is written, but it may not always be that simple.

It is possible that you will be in court and the tenant or the tenant’s attorney are making arguments that are outdated. If the judge, the tenant, or the tenant’s attorney begin discussing HUD rules, you should be prepared to point out that there have been significant and recent changes to the HUD rules. This will help your judge and your case.

It is also possible that you will be in court and hear arguments that the judge should simply not enforce the new Texas law regarding the delivery of a 3-day pre-suit notice.

If you find yourself in court and the judge seems to think that your 3-day pre-suit should have been a 30-day pre-suit notice (either because their interpretation of the CARES Act requires this or because they are not enforcing the new Texas law), you should ask for a RESET.

A RESET is better than losing your case or having your case dismissed. A judge will typically grant a reset if you ask respectfully and professionally:

“Judge, may we have a reset to look into what they are saying?”

“Judge, may we have a reset so that we can hire an attorney?”

A RESET will allow you time to review recent changes in the law, consult with your attorney, and prepare your arguments for when you come back.

What’s Next?

Courtroom Application: Your experience in court will continue to depend heavily on your particular judge. The decisions being made in court may continue to evolve as all parties get more familiar with the new Texas law and the updated HUD rules. Try to be patient and flexible and armed with the most recent updates discussed in this article.

CARES Act: A federal bill entitled the “Respect State Housing Laws Act” has been introduced in the U.S. Senate and the U.S. House of Representatives. This bill would repeal the CARES Act requirement that a tenant be given 30 days before being required

to vacate. Lobbying for this bill is active but it has not yet been voted on.

Little by little the 30-day pre-suit notice layers are being peeled back. I hope you will find this update helpful. Stay tuned!

Details Matter

A resident who falsified an application receives a refund because of administrative delays.

This month, another Resident Relations case from the ABODE archives.

A RESIDENT FILED a complaint with HAA to receive a refund of her $200 administrative fee. The resident had applied for an apartment on August 28 and paid the fee. She had to have a guarantor and proof of the guarantor’s income, which took some time because her guarantor lived in Alaska. A few days later, the resident was told the application was denied because the original application was not submitted and there was conflicting information on the guarantor’s form. The resident stated she had proof from a representative of the property stating that a photocopy of the application sent by email would be accepted.

Management responded to HAA stating that the resident and her partner applied for an apartment on August 31 with a scheduled move-in date of September 9. When the residents reported that they needed to postpone their move-in until October 8, the leasing professional transferred their application to another apartment.

Along with a completed TAA application, income verification must be submitted as outlined in the qualification acknowledgment. Insufficient documents were provided

after several attempts and conversations with the residents. Since they did not qualify based on their income, an approved guarantor would be required. A guarantor’s application was photographed and submitted on September 5. An original application was requested by the property rather than a photocopy or other reproduction.

Since the guarantor lived out of state, a copy of the guarantor’s driver’s license would be required in an effort to authenticate the details of the application. The information listed on the guarantor’s application did not match the information on the governmentissued form of identification, and the resident admitted to completing the application herself because her father-in-law was in a remote location.

After several days, the leasing professional was able to communicate with the guarantor. She expressed her concern about the named applicants completing the guarantor’s application without properly consulting with him. He verbally agreed and outlined his personal information, which varied greatly from the information listed on the application. The guarantor stated that he would send in an original guarantor application, but the property never received such a document. Management believed the residents falsified the

guarantor’s information on the application in an attempt to receive approval. Enclosed were copies of the application and final account statement.

The committee decided in favor of the resident. The committee noted that the resident was originally denied for falsification of a document, but because the property did not notify the residents within the allotted sevenday time period per the TAA application, management was to refund the resident her $200 administrative fee.

The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

Members had the opportunity to meet with all 11 of Houston's Congressional Delegation where they advocated for changes to the 21st Century Road to Housing Act that would protect the Build-To-Rent (BTR) industry. Our members also advocated for the passage of the Respect State Housing Laws Act, which would strike down the federal notice language from the CARES ACT and return eviction policies back to the states. It was a productive week in the nation's capital advocating for the multifamily industry.
